Cabinet of Ministers Regulations No. 26 in 2016 (12 January. Nr. 2 17. §) airspace management of airspace structure and its change order Issued in accordance with the law "on the air" 39. the second paragraph of article 1 General questions 1. determines the flexible use of airspace management procedures, airspace structure and its change agenda in the Republic of Latvia. 2. the terms used in the rules correspond to the terms used in the legislation of the European Union: 2.1. Of the European Parliament and of the Council of 10 March 2004, Regulation (EC) no  549/2004 laying down the framework for the creation of the single European sky (the framework regulation) (hereinafter Regulation No 549/200), article 2; 2.2. the Commission of 23 December 2005, Regulation (EC) no  2150/2005 laying down common rules for the flexible use of airspace (hereinafter Regulation No 2150/2005), article 2; 2.3. the Commission's 2011 October 17 of the implementing Regulation (EU) no 1034/2011 on safety oversight in air traffic management and air navigation services and amending Regulation (EC) no 691/2010 (hereinafter Regulation No 1034/2011), article 2; 2.4. the Commission's 2011 October 17 of the implementing Regulation (EU) No 1035/2011 laying down common requirements for the provision of air navigation services and amending Regulation (EC) No 482/2008 and (EC) no 691/2010 (hereinafter Regulation No 1035/2011), article 2; 2.5. the Commission's July 7, 2011 Regulation (EU) no 677/2011, laying down detailed rules for the air traffic management (ATM) network function and amending Regulation (EC) no 691/2010, article 2; 2.6. the Commission of 25 March 2010 on the Regulation (EU) no 255/2010 laying down common air traffic flow management rules (hereinafter Regulation No 255/2010), article 2; 2.7. Commission of 26 September 2012 the implementing Regulation (EU) no 923/2012, laying down common rules for the operation of flight and air navigation services, rules and procedures and amending the implementing Regulation (EU) No 1035/2011 and Regulation (EC) No 1265/2007, (EC) no 1794/2006, (EC) no 730/2006, (EC) no 1033/2006 and (EC) no 255/2010 (hereinafter Regulation No 923/2012) 2. article. 3. The flexible use of airspace management objective is to provide the most efficient air space elements in different airspace users for the temporary fodder products derived use of airspace. 4. Airspace management is implemented in accordance with Regulation No.  549/2004, article 7, paragraph 2, set out in the regulation. 5. the airspace structure consists of the following elements: 5.1. air traffic control zone (CTR) – above ground created a controlled air space with a certain boundaries in the vertical and in the horizontal plane of the Earth's surface to a specific upper limit; 5.2. air traffic control area (CTA)-above the Earth's surface created by the controlled airspace boundaries in the vertical and in the horizontal plane; 5.3. the aerodrome air traffic control area (TMA)-set the size of the air space, set up air traffic services routes connecting locations for one or more of the aerodrome surroundings; 5.4. the aerodrome air traffic area (MARK)-set the size of the air space above the ground and adjacent areas for the aerodrome air traffic security; 5.5. the flight information region (FIR)-set the size of the air space in which flight information and alert services; 5.6. air route-controlled air space in the form of a corridor or part thereof; 5.7. the conditional route (CDR) – route in which air traffic services and planning and can be used under specific conditions; 5.8. the danger zone (D)-set the size of the air space within a fixed period of operation, which is dangerous for aircraft flights; 5.9. restricted flight zone (R)-set the size of the air space above the land or territorial waters, within which the flight of aircraft limit specific conditions; 5.10. the forbidden zone (P)-set the size of the air space above the land or territorial waters, in which the flight of aircraft is prohibited; 5.11 temporary reserved area (TRA)-set the size of the air space that is one of the aviation authorities in the management and in accordance with a common understanding be temporarily reserved for other aviation authorities for specific activities. Description and evidence on measures to reduce the risk of a collision with an aircraft involved, if the structural element is designed to perform unmanned and remotely controlled aircraft flights; 14.2.4. geographical locations and meteorological weather impact assessment on the proposed airspace structure element functionality (for example, the border or the immediate vicinity of controlled air space, the ability to make the transition from Visual flight rules to instrument flight rules); 14.2.5. Civil Aviation Agency decision on air space structural changes adopted in accordance with Regulation No.  1034/2011 10. the requirements set out in article. The decision can be challenged in administrative or judicial proceedings in accordance with the procedure prescribed by law.
19. the decision on refusal to change the structure of the air space shall be taken where: 19.1. these provisions have been submitted to 14.1., 14.2 and 14.5 14.4., referred to in documents; 19.2. If, following the assessment of local authorities received a refusal to align the respective airspace structure changes, it's warranted; 19.3. the proposing changes requested in the application to the airspace structure does not correspond to national regulations or European Union law the provision of air navigation and air traffic management; 19.4. This provision has not been submitted to the procedure referred to in paragraph 17.1 or 17.2. these provisions referred to in subparagraph safety assessment shows that the structure will not be fulfilled due to aircraft flight safety requirements and objectives. 20. In deciding on airspace structure changes, the Civil Aviation Agency: 20.1. Approves relevant airspace structure element, use the procedure, if any, of the airspace structure in the process of changing needs; 20.2. instructs the change agents, according to the laws and regulations on air navigation information preparation and dissemination in order to prepare and submit for publication of information on the structural changes of the integrated aeronautical information package (IAIP); 20.3. If the element is designed as a flexible element in the air space under this provision to paragraph 22 and 23, defines its priorities and criteria for the award.
3. The flexible use of airspace management 21. flexible use of airspace is implemented according to Regulation (EC) No 2150/2005 of 4, 5 and 6 and article and divided into the following levels: 21.1. strategic airspace management; 21.2. pre-tactical airspace management; 21.3. the tactical airspace management. 22. Flexible use of the airspace structure elements are: 22.1. temporarily demarcated area (TSA); 22.2. temporarily reserved zone (3); 22.3. the conditional route (CDR). 23. the danger zone (D) and limited flight zone (R) can be created as both flexible airspace structures, but also as an element of the flexible airspace structures. 24. other airspace structure elements, which are not mentioned in this provision in paragraph 22 and 23 are not flexible airspace structures. 3.1. strategic level the flexible use of airspace management 25. The flexible use of airspace management tasks to implement strategic level Civil Aviation Agency pursuant to Regulation (EC) No 2150/2005 article 4, paragraph 1. 26. questions concerning military users of airspace, Civil Aviation Agency implementing the strategic level, in consultation with the civil-military airspace planning and coordination of the Group of experts (hereinafter referred to as the Panel). 27. The Group of experts is composed of the Ministry of transport, Ministry of defence, the Civil Aviation Agency and the national armed forces delegated representatives. The Group of experts, chaired by the Ministry of transport of the authorised person, providing the expert group meeting and recording 14 days forward to the responsible authorities, expert group meeting. 28. The Group of experts for the execution of the job may invite other experts, as well as to request the necessary information from other national institutions, whose interests are affected by the use of airspace. 29. The Group of experts, decisions on all matters within its competence, shall adopt, by mutual agreement. The expert group shall take decisions by consensus. 30. the expert group meeting: 30.1.-planned not less frequently than every six months; 30.2. emergency: If this rule 27 30.2.1. above the authorised person of the members of the Group of experts received a written application in which justified the need for the hearing due to any of the provisions of Regulation No  2150/2005 article 4 referred to in paragraph tasks; 30.2.2. on Civil Aviation Agency initiatives; 30.2.3. on the initiative of the national armed forces on issues of military aviation. 31. The rules referred to in paragraph 27 of the authorized person shall, not later than 30 days before the meeting of the expert group on the electronic form shall notify the members of the Group of experts, noting the meeting venue, time and agenda. 32. The provisions referred to in paragraph 27 of the authorised representative no later than three working days in advance electronically inform the members of the expert group on emergency meeting venue, time and agenda. 33. The Group of experts: 33.1. under Regulation No 2150/2005 article 4, paragraph 1 b of the tasks prescribed in paragraph not less frequently than once a year, review the civil and military airspace users ' daily use of airspace and demand real airspace use statistics. The negotiation process, the Group of experts agreed on the need to make changes to the flexible use of airspace structure elements and their use in procedures; 33.2. Regulation No.  2150/2005 article 1, point "a" and "g" States involved in the task, if necessary: 33.2.1. the strategic, pre-tactical or tactical level to change the institution responsible for the allocation of competence laid down in these regulations; 33.2.2. in connection with the management of the air space in the strategic, pre-tactical or tactical level the specific tasks you need to develop a new external laws and regulations governing the airspace management strategic, pre-tactical or tactical level implementation, or to amend existing legislation; 33.2.3. reviewing the pre-tactical airspace management or tactical level operations procedures approved for military use, find that they need to make changes; 33.3. Regulation No.  2150/2005 article 1, point "c", "d", "e" and "f" States involved in the execution of the task, if: civil 33.3.1. airspace users and military users of airspace in the event of disagreement concerning the national armed force for the structural elements of the air space; 33.3.2. National armed forces announced a new airspace structure elements; 33.3.3. necessary changes National armed forces for the airspace structure element usage procedures; 33.3.4. Latvian air space, planned to organize aviation operations during operation may affect airspace structure elements; 20.8. Regulation No.  2150/2005 article 4 paragraph 1 of the "h", "i", "j" and "k" States involved in the execution of the task, if you need to make changes to the most flexible cross-border airspace structure elements or their use in procedures; 33.5. agree on communications products and technical solutions to the European single sky legislation make the early exchange of information between the pre-tactical airspace management and tactical level, ensuring the safety of aircraft. 34. The Group of experts the decisions taken shall be binding on the tactical and pre-tactical airspace management. 3.2. Pre-tactical level the flexible use of airspace management 35. Pre-tactical level is 22 and 23 of these rules referred to in paragraph flexible airspace structures elements of daily use planning and allocation of airspace users. 36. the pre-tactical airspace management level of regulation 2150/2005 article 5 requirements implemented by the Latvian air traffic. If the airspace structure element is refused or suspended this provision and paragraph 46.47 cases, it does not entitle the user to use the air space of the element outside the pre-tactical level allocated time.
4. Closing questions 49.
