No 88 43. §) rules on "operational programme infrastructure and services" Appendix "airport activity 3.3.1.4. infrastructure development" Issued under the European Union's structural and cohesion funds act 18 paragraph 10 of article i. General questions 1. determines: 1.1. procedures for implementing the action programme ' infrastructure and services ' Appendix 3.3. priority "European transport network and the development of sustainable transport promotion" UR3.3.1.pas "contributes a large scale transport infrastructure improvement and development" activity "airport 3.3.1.4. infrastructure development" (hereinafter activity);
1.2. the responsible authority;
1.3. project submission evaluation criteria;
1.4. requirements the project applicant. 2. The purpose of the activity is safe, effective, growing traffic, according to the air transport infrastructure. 3. the activity exercised limited project application selection. 4. the overall activity of the Cohesion Fund financing available is 51 654 269 lats. National funding by project. 5. National funding of not less than 15 percent of the eligible costs of the project, and funding from the Cohesion Fund shall not exceed 85 percent of the project's total eligible costs. Business support project can detect lower funding from the Cohesion Fund to the maximum percentage to be applied. 6. the maximum amount of financing of the Cohesion Fund in the national airport project has 41 114 034 lats from the project total eligible costs, the maximum amount of financing regional airports project-3 513 411 million lats. II. The responsible authority and the applicant of the project activities within 7 authority does the traffic Ministry. Project activities have assisted the national airport and a regional airport passenger terminal reconstruction, expansion and new construction, aircraft, offshore construction, construction and reconstruction of infrastructure, energy and communications construction and reconstruction of the runway, aircraft, passenger, baggage and cargo service infrastructure, as well as airfield technical equipment acquisition and modernisation of the runway reconstruction and modernisation of air navigation system. 10. the eligible costs of the project are: 10.1. land acquisition if its value does not exceed 10 per cent of the eligible costs of the project;

10.8. environmental compliance costs;

10.12. home improvement;
10.13. publicity measures, in so far as it provides for the European Union structural funds and the cohesion fund management regulatory acts;
10.14. expenditure for contingencies this provision 10.4., 10.11.10.12. referred to and expenses: not more than 10 per cent of the eligible costs of the project (including the possible incidence of compensation projects) projects whose total cost is at least 35 140 200 dollars, and a maximum of five percent of the project, whose total cost is less than 35 140 200 lats;
10.15. the value added tax, where the applicant cannot recover it according to the regulations of the tax policy. 11. in paragraph 10 of these rules, such costs are eligible: 11.1 from 24 October 2006, when the project is under the Finance Ministry's initial evaluation, the opinion not qualifying as a commercial support and project total eligible costs are at least 35 140 200 lats;
11.2. as from the date on which the responsible authority has taken a decision on the application for the approval of the project, if the project under the Ministry of finance, the opinion of the initial evaluation, not qualifying as a commercial support and project total eligible costs are less than 35 140 200 lats;
11.3. as from the date on which the responsible authority has taken a decision on the application for the approval of the project, if the project in accordance with the initial evaluation, the Ministry of Finance's opinion qualify as commercial support;
11.4. as from the date when the European Commission has adopted a decision on the compatibility of the project with the treaties establishing the European communities, if the project is in accordance with the initial evaluation, the Ministry of Finance's opinion qualify as commercial support, and about the need to notify the European Commission. 12. not eligible costs of the project are: 12.1. costs in excess of the approved project submission, the proposed amount of the eligible cost;
12.2. land acquisition when its value exceeds 10 per cent of the eligible costs of the project amount;
12.3. costs not justified by relevant source documents. 13. The project can include only the 10 and 11 of these regulations, paragraph. Project expenditure does not include administrative costs. 14. the implementation of the project of non-eligible costs shall be borne by the beneficiaries of their funds. IV. Project application selection to tender, project submission, and submission of the project application form 15. the responsible authority by sending a letter to invite the national airport and regional airports to submit these terms according to the project application. 16. The first application round project responsible body shall, no later than 30 March 2010. If the total cost of the project is at least 35 140 200 lats, project submissions prepared according to these provisions set out in annex 1 to the project submission form and the Commission of 8 December 2006, Regulation (EC) no 1828/2006 laying down provisions for the implementation of Council Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and European Parliament and Council Regulation (EC) No 1080/2006 on the European regional development fund, to annex XXI. 21. the total cost of the project is less than 35 140 200 lats, project submissions prepared according to this provision the project defined in annex 2 of the application form. 22. the project application submitted in person, by post or by electronic means. 23. the project submission in paper form shall be submitted in triplicate (one original and one copy) and adds the project application to the electronic version of data media (data media included documents formatted in MS Word, MS ExcelM format). 24. the project submissions electronically submitted in accordance with the legislation on electronic document design. 25.2. such specialist descriptions of life (curriculum vitae): 25.2.1. civil engineer with at least three years experience in airport infrastructures in the field of construction or the construction of transport infrastructure;
25.2.2. Project Manager with at least three years of experience in the management of transport infrastructure projects;
25.2.3. accountant financiers with at least three years experience in financial accounting;

25.3. the technical-economic justification of the project cost-benefit analysis and risk estimates and sensitivity analysis calculations, and calculations supporting documents;
25.4. the initial evaluation, the Ministry of Finance's opinion under the regulatory control of commercial support of legislation;
25.5. the business register issued the registration certificate of the applicant for the project. V. Project application procedures and the criteria of evaluation 26. activities within the project submitted submissions judged responsible authorities established a project application to the Evaluation Commission (hereinafter the Commission). Decision-making 32. the responsible authority for the project application is approved if it complies with all the rules referred to in annex 3 of the assessment criteria. 33. the project's responsible authority approves the application, if the application does not need to specify the corresponding to any of the provisions of annex 1 and referred to in paragraph 2, the evaluation criteria, which allow the application of the project approval with conditions. 34. the decision on the application of the project approval or approval with conditions, if the project is under the Finance Ministry's initial evaluation, the opinion qualifies as commercial support, which requires notification to the European Commission, the responsible authority shall specify the time limit for the entry into force of the decision determining that at this point the competent authorities referred to in this decision shall enter into force at the European Commission's decision on the compatibility of the project with the Treaty establishing the European Community. 35. the responsible authority shall reject the application for the project if it does not match any of the rules set out in annex 3 of the assessment criteria, which do not allow for the approval of the application, the project on condition. 36. the decision on the approval of the project application, approval or rejection provided the determining authority within five working days after the decision has been forwarded to the project applicant. 37. the decision on the application for the approval of the project provided the conditions contained in the project applicant 15 working days of notification of the decision. 38. Within five working days after the conditions for receipt of the supporting documents, the Commission shall evaluate compliance with the conditions contained in the decision and the responsible authority shall draw up the opinion. 39. Where the applicant has complied with the decision on the application for the approval of the project provided the conditions contained in the project application is considered and approved by the responsible authority within five working days after 38 of these rules. the expiry of the period referred to in paragraph 1 shall send to the applicant, project a positive opinion on the conditions contained in the decision. 40. If the decision contains conditions are not fulfilled, these provisions are not complied with within the time limit specified in paragraph 37 or 38 of these provisions the competent authorities referred to in the opinion is negative, the project application is considered to have been rejected and the responsible authority within five working days after 38 of these rules. the expiry of the period referred to in paragraph 1 shall send to the applicant a negative draft opinion. 41. the project the applicant within two weeks after the European Commission's decision on the compatibility of the project with the Treaty establishing the European Community submitted to the body responsible for making the decisions of the European Commission and in accordance with the law business lines support the control specified in the project application. If the European Commission, within the Council of 11 July 2006, Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, article 41 paragraph 1 provides for the submission of objections to the project, the responsible authority shall send to the applicant, the opposition to the project by setting a time-limit specified in the application for the project to the responsible authority. The applicant shall specify in the project the project submissions received objections and accordingly the competent authorities shall specify the deadline of the project submission. The responsible authority shall coordinate the project specified in the application and sent to the managing authority for reconciliation and for submission to the European Commission. VII. The project 43. Responsible authorities and funding requested in the contract concluded for the implementation of the project the responsible authority indicates the period of initiation of the procurement procedure, if the procurement procedure has been initiated in the past, as well as the preparation of request for payment and financing of the Fund of the European Union requested reimbursement. 44. The payment request can be made and expenses be repaid in dollars or the single European Union currency. 45. If the application of the project in accordance with the initial evaluation, the Ministry of Finance's opinion qualify as commercial support, the implementation of the project may be initiated by the competent authorities of the decision.
