Cabinet of Ministers Regulations No. 1491 2009 in Riga on 22 December (pr. 89 57. §) rules for agricultural service cooperatives the necessary documents for registration and screening of this public aid granted under the cooperative societies law of article 16 of the fourth subparagraph and the second subparagraph of article 36.1 of the rules provides: 1 1.1 documents, be submitted to the register of enterprises, to register for agricultural service cooperatives;
1.2. the agricultural service cooperatives annual screening procedures for the granting of aid;
1.3. the agricultural service cooperatives eligibility criteria and the evaluation procedure. 2. To register agricultural service cooperative societies (hereinafter referred to as the company), it shall submit the business register: registration 2.1. The application indicates that the society: 2.1.1. is an agricultural service cooperative society;
2.1.2. non-produced agricultural products but you can recycle society of production;
2.1.3. provide agricultural services, members of the public;
2.2. other cooperative societies laid down by law for the registration of cooperatives submitted documents. 3. The rules referred to in point 1.2 of the task performed by the society "Latvian Agricultural Cooperative Association (hereinafter Association), which is fed in these tasks by the Ministry of Agriculture. The decision on the company's compliance with this provision in paragraph 5 the criteria adopted by the Commission set up by the Association (hereinafter referred to as the Commission) consists of five people. The Commission has the right to a hearing to invite industry experts. 4. A company that wants to receive aid each year to 15 March the Association shall: 4.1. the application for conformity assessment (annex 1);
4.2. copy of the registration certificate;
4.3. list of members of the public. The list shall indicate the turnover of goods and services between the public and the members of the public (annex 2);
4.4. information on public goods and agricultural service turnover by persons that are not members of the public (annex 3);
4.5. information on surplus (annex 4);
4.6. the annual report for the previous period. 5. the Commission shall assess the compliance of the public after the previous year's figures, the economic activities according to the following criteria: 5.1. members of the society through the exercise only in its agricultural products produced on the holding or bought from other company agricultural products;
5.2. minimum goods and services turnover between agricultural society and members of the public are 5000 lats;
5.3. the minimum goods and agricultural service turnover between the public and the members of the public not less than 75 per cent of the public goods and agricultural service total turnover;
5.4. the surplus in proportion to the company's members provide products and services for the distribution of agricultural society members;
5.5. no less than 25 percent of the surplus funds will be invested in the development of society;
5.6. the maximum turnover of society with one of the members is 40 percent of the company's goods and agricultural service total turnover;
5.7. the public goods and agricultural service is not less than 10 members;
5.8. the company, in which the previous year's net sales exceed five million dollars, is cut off from the decision-making Executive. 6. the Association every year until 15 April: 6.1 shall inform the public of its compliance with this provision in paragraph 5 above;
6.2. in paper form and electronically submitted to the register of enterprises, the State revenue service and Ministry of agriculture list of evaluated compliance with the provisions of the companies referred to in paragraph 5 of the criteria. 7. the Association decision on compliance with this provision of the public referred to in paragraph 5, the criteria and the actual action may be challenged in the Ministry of agriculture. The Ministry of agriculture, may appeal to the Court. 8. the business register upon request, the Association shall forward to it a separate company of the annual accounts. The Association each year up to October 1 at least five percent of the public is the annual accounts submitted. 9. If the information society is different from the State revenue service submitted the annual report of the information and thus do not comply with any of the provisions referred to in paragraph 5 of the criteria, the Association has the right to cancel the award of conformity to the public during the year, as well as to deny it to qualify for eligibility the award next year. 10.
