Cabinet of Ministers Regulations No. 103 in 2010 February 2 (Mon. 6. § 18) driving acquisition and restore order and the issue of a driving licence, Exchange and restore order Issued pursuant to the Highway Traffic Act article 22, second paragraph, of the law "About the regulated professions and the recognition of professional qualifications" in article 18, paragraph 1, first subparagraph and the road transport law in the third paragraph of article 6.1 and the third paragraph of article 30.1 1. General questions 1. determines: 1.1. minimum requirements for driving a motor vehicle for obtaining of professional qualifications;
1.2. the procedures for acquiring and restoring motor vehicles, mopeds, trams and bicycle driving;
1.3. the arrangements for the issue, change and renew the driving licence. 2. the provisions do not apply to implements driving procedures and obtaining a driver's license, issuance, design change and renewal. 3. Driving licences (annex 1) are made from special materials, credit card format (54 x 85 mm size) document with embedded security features, which is issued to a person on the basis of acquired rights to drive the Highway Traffic Act in the particular category of vehicle. 4. Driving teaching authorisation (hereinafter permit) (annex 2) are made from special materials, credit card format (54 x 85 mm size) document with embedded security features, which is issued to a person as proof of the right to learn to drive A, B A1, B1, or C1. 5. The permit, renewal and 12 exchanges for permission, a person must have reached the age of the following: 12.1.14 years, to obtain a permit to learn to drive vehicles in category A1 and B1;
12.2.16-to obtain a permit to learn to drive A, B and C1. 13. When issuing the authorization the person, the right to learn to drive the following vehicle categories: 13.1. vehicles in category A1 and B1-persons aged 14;
13.2. A1, A, B1, B and C1 – individuals who have reached 16 years of age. 14. a Person is not authorised to learn to drive a certain category of vehicles if it is issued to the same category of driving licence (except when a person passed the theoretical examination according to this provision, paragraph 39). 15. in order to obtain a permit, the person CSDD presented legislation on health checks for drivers according to medical reference (hereinafter referred to as the medical reference). 16. To exchange the permit, the person shall submit the authorisation and exchangeable CSDD presented medical reference. 3. Driving acquisition 17. Driving the right person can get the CSDD Department in which the relevant category of vehicle driving tests necessary for obtaining and issuing the licence. 18. The various categories of driving rights acquisition procedures (age, length of service, type of training and driving of the sort obtaining exam) determined in annex 3 of these rules. 19. for driving vehicles, a person shall submit for examination following documents: 19.1. training card (with the exception of those rules specified in annex 3, unless the person is not the end of the relevant category of vehicle drivers training courses);
19.2. first aid training course for leaving certificate or the education or the students (pupils) of the certificate according to the laws of the driver training requirements;
19.3. medical inquiries. 20. further to the previous licence, driving licence (if you have previously obtained) passes the CSDD. Previous licence not put people who are double (Latvian and another country) citizenship, if the exchangeable licence is issued in the European Union or the European Free Trade Association Member States. 21. vehicle driving tests to obtain sorted in the following order: first sorts the theoretical exam, but after its successful completion, the driving exam (category M vehicles for obtaining driving driving exam not sort). 22. for several categories of driving right person sorts only the highest vehicle category according to the theoretical exam, but the driving exam first sorts with the lower category of the vehicle, then with each category of vehicle. If the driving test with a lower category of vehicle is fine, but with a higher category of vehicle is not settled or are not sorted, the person may, in accordance with the grant application for the above category and the category of the vehicle is issued a driver's license, which has been the driving exam. 23. If the driving exam is not settled or are not sorted, the theoretical exam results are valid for one year from the date of its sort. The expiry of the time limit, the theoretical exam results is reversed and the examination again. 24. to the person who received a driver's license with the right to drive vehicles without clutch pedal or hand lever free (A1 and category A vehicles), get the right to drive vehicles with a manual transmission, so take the appropriate category B driving test on a vehicle with a manual gearbox. 4. change of licence 25. To exchange a driving licence, a person shall submit the CSDD: 25.1. a replacement licence;
25.2. the presentation of medical inquiry. 26. in order to obtain approval for the acquisition of a driving licence exchanged for legality, in addition to this rule 25 CSDD. the documents referred to in paragraph 1 shall be entitled from the Ministry of Foreign Affairs or the issuing of driving licences the competent authorities require reference-approval if: 26.1. foreign issued driver's license point about categories or fixes the term of validity or pierakstījum, or if this is part of the certificate or otherwise mechanically damaged and it is not possible to determine the assigned categories, or the period of validity of the licence;
26.2. the licence submitted does not match the CSDD held national driving licence submitted samples, or driver's licence issuing form catalogues or if there is reasonable suspicion that the driver's licence is obtained illegally, and driver's license cannot be verified they are issuing the driving licence in the register. 27. change a driver's licence that is not predesigned Member State of the European Union or the European Free Trade Association Member States languages or Russian languages, CSDD has the right to require a driver's license, as well as other deliverable document notarized translation into Latvian language. 28. in Latvia, a driving licence issued by a Member State of the European Union or the European Free Trade Association member and a driving licence issued in a driving licence issued by a relevant intergovernmental agreement concluded, without the sort of change the exam. 29. A driving licence issued in a country not mentioned in paragraph 28 of these rules, change the category B according to the driving exam (the driving exam, which includes driving in road traffic), but the former USSR model driving licence does not change. If the driving licence only M, A1, marked A or B1 category, the person pass a corresponding category according to the driving exam, but if the driving licence or to the selected only three category, the person pass a theoretical exam. 30. If the person changing the driving licence issued in Latvia, while a change in another State issued driver's licence (other than the Member State of the European Union or the European Free Trade Association member and a driving licence issued in a driving licence issued by a relevant intergovernmental agreement concluded) that marked higher category than in Latvia issued the driving licence, the person at the driving examination shall be issued with a driving licence in both the above mentioned driving licences in the following categories. 31. If a person changes the driver's licence issued abroad that is not specified in the 1968 Vienna Convention on road traffic in certain categories of vehicles, then Latvia issued the driving licence shall specify the categories of vehicles that best matches the variable specified in the licence categories, provided that the person's driver's licence is issued, the vehicle categories higher than those specified for being exchanged in foreign countries issued the driving licence. 33. In the case of a person in accordance with the opinion of the health check is forbidden to drive a certain category of vehicle or person refuses in writing from one of the categories, the new driving licences shall be drawn up, without specifying the category. 34. If the person referred to in paragraph 33 of the rules of procedure are designed to be a driver's licence that is not specified in the individual vehicle categories, then to restore the category and get a driving licence, a person shall be submitted and presented this rule 25. documents listed. 5. driving licences and driving restoration 35. Driving licence renewal is recovery if person disqualified from driving. 39. 42.1.6. Economic and environmentally friendly driving, environmentally sound operation of the vehicle;
42.1.7. first aid;
42.1.8. safety when driving in tunnels;
26.2. the questions A1 and (A) categories of vehicle driving (additional questions): 42.2.1. protective clothing and helmets;
42.2.2. other road users action (in particular, their ability to see the motorcycle in a timely manner);
42.2.3. safe motorcycle driving in various road conditions;
42.2.4. condition of the motorcycle, the impact on road safety;
26.3. questions C1, C1, C, D1, d1e, D and DE CE, vehicle driving (additional questions): 42.3.1. driving and rest time of regulatory legal acts;
42.3.2. the carriage of goods or passengers of regulatory legal acts;
42.3.3. documents required by the transport of goods or passengers by inland and international traffic;
42.3.4. the driver's action, in the event of a road traffic accident (for example, passenger evacuation and first aid);
42.3.5. security measures by changing the wheels;
42.3.6. permissible vehicle weights and dimensions, speed limiter;
42.3.7. reading a road map, route planning (including electronic navigation systems);
42.3.8. safety factors relating to vehicle loading (only C1, C1, C and CE category);
42.3.9. the driver's responsibility in respect of the carriage of passengers, passenger convenience and safety, the transportation of children (only categories D1, d1e, D and DE);
26.3. the questions C, CE, D and DE vehicle driving (additional questions): 42.4.1. engine, cooling system, power system, electrical system, the ignition system and transmission design and operating principles;
42.4.2. protection by greasing and antifreeze;
42.4.3. tyre structure, Assembly, proper use and care;
42.4.4. the service braking system and the engine speed regulator types, operation, main parts, connection, use and day-to-day maintenance, ABS braking systems;
42.4.5. the coupling types, operation, main parts, connection, use and day-to-day maintenance (only for category CE and DE);
42.4.6. finding of the causes of damage to the vehicle;
42.4.7. vehicle maintenance and routine repair required;
42.4.8. the driver's responsibility for the goods receipt, transport and delivery in accordance with the agreed conditions (categories C, CE only). 43. The theoretical exam the applicant answered in sequence: 43.1. Vehicles of category M acquisition of the driver-to 20 basic questions;
43.2. vehicles in category A1 and driving acquisition – on 20 basic questions and drivers of vehicles in these categories for 10 additional questions;
43.3. vehicles of category B1 or B, as well as tram or bus driver acquisition-to 30 questions;
43.4. C1 or C category driving rights acquisition-for 30 key issues and drivers of vehicles in these categories for five additional questions;
43.5. vehicles of category D1 or D driving acquisitions – to 30 key issues and drivers of vehicles in these categories for the five additional questions. 44. The theoretical exam response time allowed for vehicles of category M driving acquisition in theoretical exam is 20 minutes, but the other categories of vehicles driving on the theoretical examination of acquisition to 30 minutes. 45. The theoretical exam is arranged, if when you sort test for vehicles of category M driving, the applicant is allowed a maximum of two incorrect answers, but when the rest of the exam category driving right,-not more than three incorrect answers. 46. If the theoretical exam is outstanding, the sort is permitted the examination no earlier than the day. 7. Driving exam acceptance and evaluation procedures 7.1 General requirements 47. Driving exam the applicant sort independently, drives the vehicle category. 48. The driving exam and A category A1 driving acquisition of sorts with the motorcycle, which in addition to the provisions laid down in paragraph 50 shall meet the following requirements: 30.5. Category A1 motorcycle driving acquisitions – the motorcycle without sidecar, with a cylinder capacity of at least 75 cm3;
30.6. the motorcycle driving, of which the engine power not exceeding 25 kW (34 HP) or 0.16 kW/kg (HP/0.22 kg), with a motorcycle without sidecar, with a cylinder capacity greater than 120 cm3 and a maximum speed of at least 100 km/h;
30.6. all category A driving acquisition – the motorcycle without sidecar, which was exceeding 35 kW engine power. 50. Certain categories of vehicles (vehicle combination) that sorts the driving exam, exam time is loaded in such a way that: 50.1. vehicle category C actual mass of at least 10 000 kg;
50.2. vehicle category BE the composition of the actual mass of the trailer of at least 800 kg;
50.3. C1e constituting the actual mass of the trailer of at least 800 kg;
50.4. vehicles of categories CE, the composition of the actual mass of at least 15 000 kg;
50.5. DE constituting the actual mass of the trailer of at least 800 kg. 51. The driving exam for the sort used vehicles with motor gearbox (except in the case of a person under medical reference allowed to drive vehicles without clutch pedal or hand lever free (A1 and category A vehicles)). 52. The driving exam with A1 and category A vehicles sorts during the period from 1 April to 1 October (when is the exam for favorable weather conditions, this period can CSDD extend). The driving exam evaluation 58. driving the mistakes of the applicant shall be assessed according to their significance and degree of hazard: 58.1. minor errors that do not usually affect road safety.
58.2. moderately severe errors that may endanger road safety, but because of the situation in which there is no direct threat to traffic safety;
58.3. dangerous errors that almost always pose a threat to traffic safety or the situation is a direct threat to road safety. If an applicant making a mistake, which is a direct threat to traffic safety, the Inspector, in order to ensure road safety, says driving and stopped in the exam. 59. The exam is outstanding, if a tenderer during the exam: 59.1. with two attempts, has not fulfilled any of the pieces;
59.2. are made a dangerous mistake;
59.3. is made more than two equal character in moderately severe errors or more than three different nature moderate;
59.4. is made over five insignificant errors. 60. If the applicant passed the driving test, driving exam sort, no earlier than the day, except when the person contesting the assessment exam. Exam rating in the case of a repeated challenge exam the person can log in after that provision referred to in paragraph 62 of notification of the decision. 7.3. The driving exam rating procedures appeals disputing and 61. In cases not referred to in these rules, decisions on the right of the driver, the driver's licence and for the renewal of a licence shall be adopted in accordance with the administrative process CSDD regulatory laws. 8. Bicycle driving getting 65. Bike driver certificate (annex 4) shall be issued to a person who has reached 12 years of age and passed the theoretical examination (computer based or writing), consisting of 10 questions on road traffic laws and governing traffic safety. 66. Response time bike driving acquisition in theoretical exam is 10 minutes. The theoretical exam is arranged, if the applicant is allowed a maximum of two incorrect answers. 67. The theoretical exam bicycle driving adoption and to obtain a driving licence issued by bicycle all CSDD. 68. If the theoretical exam is outstanding, the sort is permitted the examination no earlier than the day. 69. To exchange the bike driver's licence, a person shall submit to the exchangeable licence CSDD and one photo, but to restore the bike's driver's licence, a person shall submit one photo of CSDD. 70. for the bike's driver's licence on the basis of other vehicle driver's licence, a person shall produce the licence and shall submit one photograph. 9. acquisition of professional drivers and restore order and the renewal of a driving licence and the procedure for the exchange of professional managers of 71. law (C1, C1E, D1, D1, C, CE, D or DE driver's licences with this rule 3.8 of annex 1 for further information referred to in the code) the person is obtained by passing the CSDD theoretical and driving exam. 72. The theoretical exam the applicant sort independently, without the other person or exhibit. 73. The theoretical exam that lasts at least four hours, has two parts: first part-73.1. the tenderer certifying their knowledge, answering questions about the economic and rational driving vehicle and its proper use, proper placement of the cargo vehicle or passenger comfort, and the laws that govern the driving and rest time and regulate the cargo or passengers, as well as to questions about road traffic accidents incidence , dangerous situation prediction, driver performance in the event of a road traffic accident, crime and the prevention of illegal immigration, the principles of ergonomics, the driver's physical and mental abilities, the effects on road safety, a positive image of the merchant and cargo or passenger made economic conditions and market organisation;
73.2. second part: the applicant attest to your knowledge of this rule 73.1. issues referred through case analysis. 74. The driving exam the applicant organizes independently with the relevant category of vehicle. The driving exam has two parts, the duration of which is not less than, respectively, 30 and 90 minutes: 74.1. the first part – the applicant attest to your knowledge of the correct positioning of the load of the vehicle or passenger comfort, ergonomic principles and actions of the driver in the event of traffic accidents, as well as performance pieces;
74.2. second part: applicant drives a vehicle on a route that includes different complexity of roads in populated areas, as well as the paths to which allowed driving speed of at least 90 km/h. Driving 75. the applicant shall evaluate the errors according to the rules of procedure referred to in section 7.2. 76. The provisions referred to in Chapter 7 of the driving exam C1, C1, D1, D1, C, CE, D or DE acquisition drivers allowed to combine with the provisions referred to in paragraph 74 of the exam. 77. If the person is a professional Manager rights, in addition to acquiring C1, C1, D1, D1, C, CE, D or DE driving right then professional Manager rights are extended to more driving privileges. 78. To change or update these rules referred to in paragraph 71 of the driving licence, a driving licence with a record of acquired professional knowledge with a validity period of five years, the person shall submit the exchangeable licence CSDD and certificate of periodic training, as well as the presentation of medical inquiry. If the certificate is not filed, the person's driver's licence is issued with the licences previously issued information code (which indicates that the driver has met the head of the professional qualification requirements). 79. to person categories D1, d1e, D and DE driving rights has gained up to 9 September 2008 to get this provision 71. driver's licence referred to in paragraph 1, it shall submit the certificate of CSDD exchangeable certificates for periodic training, as well as the presentation of medical inquiry. 80. to person C and C1, C1, CE category driving rights has gained up to 9 September 2009 to get this provision 71. driver's licence referred to in paragraph 1, it shall submit the certificate of CSDD exchangeable certificates for periodic training, as well as the presentation of medical inquiry. 10. concluding issues 81. This provision of the annex 3 concerning the theoretical exam sorting category A Manager to obtain the rights apply to persons who have completed the category A driving training courses after the entry into force of these regulations. 82. in the cases referred to in these provisions, a person must produce medical CSDD reference or submit other information (for example, a training card, first aid training course for leaving certificate), it should not be presented or to be submitted, if the information is available and the driver of the vehicle in the national register. 83. This provision is 58 and 59 above driving exam the evaluation procedure shall enter into force on April 1, 2010. If the applicant admits error, the Inspector, in order to ensure road safety, says driving and stopped in the exam. 2) Council of 19 December 1994, Directive 94/72/EC amending Directive 91/439/EEC on driving licences;
3) Council of 23 July 1996, Directive 96/47/EC amending Directive 91/439/EEC on driving licences;
4) Council of 2 June 1997 Directive 97/26/EC amending Directive 91/439/EEC on driving licences;
5) Commission of 14 September 2000, Directive 2000/56/EC amending Council Directive 91/439/EEC on driving licences;
6) the European Parliament and of the Council of 15 July 2003 of Directive 2003/59/EC on the carriage of goods or passengers for road transport drivers in the initial qualification and the periodic training, Council Regulation (EEC) No 3820/85 and Council Directive 91/439/EEC, and Council Directive 76/914/EEC;
