Cabinet of Ministers Regulations No. 348 Riga 2010 April 13 (Mon. No. 19) the General Programme "solidarity and management of migration flows" within the European external borders Fund, the European return Fund and the European Refugee Fund project selection and the technical assistance for the implementation of the activity issued under the General Programme "solidarity and management of migration flows" within the established fund management law article 14, paragraph 3 (I). General questions 1. determines: 1.1. The General Programme "solidarity and management of migration flows" (hereinafter referred to as the programme) within the European external borders Fund (2007-2013) The European return Fund (2008-2013) and the European Refugee Fund (2008-2013) (hereinafter referred to as the Fund) project tendering procedure;
1.2. requirements for beneficiaries of the Fund;
1.3. the Fund's project application preparation and submission procedures and their evaluation criteria;
1.4. the Fund's project selection procedures;
1.5. the grant award procedure;
1.6. the Fund's technical assistance activities (hereinafter referred to as the technical assistance activity).
2. the Fund's application forms for the selection of projects and the financial resources available to each activity determine the annual programme Fund (hereinafter referred to as the programme).
3. the Fund's project submissions in the following ways: select a 3.1 organize an open design competition (hereinafter referred to as the open competition);
3.2. organizing a limited selection (limited selection).
II. Foundation project tendering 4. Open tender issued by the managing authority, placing an advert in the newspaper "Gazette" and your website on the internet.
5. A limited selection of the managing authority organised by sending a call for submission of the project of the foundation year program approved by the Fund in the project applicants.
6. Fund project application submission deadline is: 6.1., two months from the open invitation to tender;
6.2. the month of this provision in the invitation referred to in paragraph 5 is dispatched.
7. the managing authority for each programme development fund project application selection rules (hereinafter referred to as the selection rules). Selection rules approved by the managing authority.
8. specify the selection rules in the annual programme of activities, priorities and the financial resources available for the implementation of the project, the maximum time limit for submission of the draft selection form, submission deadline and place contact information that you can apply to the Fund for the project application selection process, and other information that the managing authority considers necessary.

III. Requirements for the beneficiaries of the Fund. the Fund's project 10 submission may participate in the selection of the Republic of Latvia, direct or in direct public administration, derived public person, other public or private-law legal person or a representative of an international organisation in the Republic of Latvia, operating in the area, supported by the Foundation (hereinafter referred to as project applicant).
11. the project applicant is responsible for the implementation and management of the project, as well as the results of the project and objectives. The project applicant must not be a mediator.
12. Project are available to the applicant stable and sufficient financial resources and other resources, to determine the extent of implementation of the project to ensure continuity and implementation of the project within the time limit laid down.
13. the Fund may not be eligible if the project applicant, a judgment which has the force of res judicata or prescription of punishment: 13.1. project officer of the applicant or any other person acting on his behalf, is sentenced to criminal penalties in connection with project activities of the applicant;
13.2. the project officer of the applicant or other person acting on his behalf, is found guilty of fraud, bribery or other activities detrimental to the European Union or the Republic of Latvia on financial interests.
14. the Fund shall not be eligible project applicant: 14.1. has tax arrears;
14.2. who has declared bankruptcy;
14.3. the reorganisation or winding-up proceedings.
15. the project will fund the project applicant submissions can also be submitted together with one or more of the partners is subject to the following conditions: 15.1 partner project of the Fund can be either a direct partner directly involved in project implementation and financial partner, participating in project financing;
15.2. the applicant and the project partners before the grant date of conclusion of the contract shall be the subject of a written agreement on cooperation in the implementation of the project.
16. the Fund's project, the applicant may submit an unlimited number of submissions for the project, taking into account that one fund project application must relate to one of the year's programme of eligible activity.
IV. Fund project application preparation and submission of 17 to qualify for the Fund's financing, project selection, the applicant shall be submitted within the time limit set in the managing authority the following documents: 17.1. project application form (annex 1);
17.2. the draft statement by the applicant (annex 2);
17.3. the cooperation partner's certificate (if applicable) (annex 3);
17.4. excess procurement (subcontracting) total basis (if applicable) (annex 4);
17.5. co-financing statement (if applicable) (annex 5).
18. the Fund's project, the application can prepare and submit the lead body personally, send by mail or electronically.
19. the preparation of the Fund's project applicant project application, the following shall be taken into account: 19.1. the Fund's project submission prepared into Latvian language;
19.2. the Fund's application of the project financial calculations in dollars;
19.3. the Fund's procurement projects (subcontracting) total may not exceed 40% of the direct eligible costs, except where the applicant submits the project exceeded the total amount of purchase (subcontracting) grounds, which confirms the Managing Authority Fund projects the application evaluation process;
19.4. the value added tax is applicable, if it is not, directly or indirectly, to the vendor of the recoverable or arise, established in another Member State and therefore unable to recover it.

20. If the applicant is a direct or of the Republic of Latvia in the immediate national regulatory authority or another public authority, the proportion of the eligible costs of the project are the following: 20.1. Fund – 75%;
20.2. State budget – 25% co-financing.
21. If the applicant is a child of the Republic of Latvia's public person or private-law legal person, international organization or representative office in the Republic of Latvia, which operates in the area supported by the Fund, the Fund in proportion to the eligible costs of the project are the following: 21.1. Fund – 75%;
21.2. the State budget financing – 15%;
21.3. the project co-financing by the applicant – 10%.
22. the implementation of a project launched by the Fund: 22.1. public tender Fund projects, starting with a grant date of conclusion of the contract;
22.2. the limited selection of Fund projects – 1 January of the year in which the approved annual programme concerned.
23. the European return fund or the European Refugee Fund project indirect eligible costs ratio relative to the project's eligible costs are direct: 23.1. to 20% if the purchase of the project (subcontracting) does not exceed 40% of the total direct eligible project costs;
23.2. up to 10% if the project procurement (subcontractors) amount is greater than 40% of the direct eligible costs.
24. the European external borders Fund project indirect eligible costs ratio relative to the project's eligible costs are direct: 24.1. to 5%, if the project (subcontracting) purchase cost, equipment cost, and real estate cost does not exceed 40% of the total direct eligible project costs;
24.2. to 2.5% of the project cost of purchase (subcontracting), equipment and real estate cost a total of more than 40% of the direct eligible costs.
25. all projects of the Fund in the preparation of the application stakeholders can get additional information about the Foundation's project application preparation. Questions about the preparation of the application projects of the Fund sent to the managing authority to the e-mail address specified in the select statement, no later than 10 working days before the Fund project application submission deadline.
26. the managing authority answers to questions received shall prepare and publish their website on the internet no later than two working days after the receipt of the question without specifying the question author.

38.2. the Fund's project application is drawn up into the Latvian language;
38.3. the Fund's application is the project caurauklot (does not apply to electronically filed applications for Fund project).
39. If the Fund project application meets all the criteria, the leading administrative authority for further evaluation of their moves according to the quality criteria and submitted to the Management Committee of the Fund for specific evaluation criteria.
40. where the application of the project of the Fund does not comply with these rules for any annex 6 part I 1.1., 1.2., 1.3, 1.4, 1.9, 1.10, 2.1, 3.1, 3.2 and 3.3 referred to administrative criteria, the Managing Authority Fund project application rejected.
41. If the Fund's project submission does not comply with the provisions of annex 6, part I, 1.5 1.6 1.7, 1.8, 1.11, 1.12, 1.13.., 2.2., 2.3., 2.4., 2.5., 2.6., 2.7., 2.8., 2.9 and 3.4 referred to administrative criteria, the managing authority shall make a request in writing to the applicant of the project specify the project's application of the Fund or to submit additional information to the managing authorities within the prescribed period.
42. If the applicant for the project of the Foundation of the managing authority is not made within the time limit specified in the project application or for more information, the Managing Authority Fund project application rejected.
43. If the applicant for the project of the fund managing authorities shall be submitted within the time limit set for submission of the project Fund specified or information, the Evaluation Commission evaluated again under the criteria and administrative:

26.8. If necessary updates are not performed or additional information has not been submitted in full, the Fund's project application is rejected;
26.8. If the necessary clarifications have been made or information has been submitted in full, the managing authority shall act according to the rules laid down in paragraph 39 of the order.
44. If the application is rejected for the project of the Foundation according to this provision, or 40 42 or 43.1. (a), the managing authority shall inform the applicant of the project.
45. the Fund's project application procedures under the specific assessment criteria determined by the Fund Management Committee Charter.
46. After assessing the Fund's project submission in compliance with the quality criteria and specific criteria, the managing authority shall draw up the Foundation's project submission list, listing them in order of priority by the number of points earned, beginning with the most points won.
47. the Fund's application of the project's total score is obtained by summing the quality criteria and the specific criteria for the number of points and the calculation of the total assessment in accordance with the provisions of annex 6 contains the formula.
48. If several submissions of projects the Fund has got the same number of points, priority shall be given to the submission that won the highest ranking 6. these provisions in part IV of annex II and the aforementioned criteria.
49. the Fund's project submissions, of which the total number of points does not exceed 40% of the maximum possible score, the managing authority is rejected, the project informed.

51. Depending on the year the program activity financial means made available, the managing authority will fund the project submissions, which have got the highest score and which requested the Fund can provide 100%. The remaining Fund project submissions included Fund project application to the reserve list.
52. the managing authority shall inform the applicant of the decision of the project fund project application to approve or to be included on a reserve list.
53. Depending on the amount of funds remaining in the activity: 53.1. the Management Committee shall decide the remaining funds be reallocated to the other activities of the Fund, financial resources for capacity building;
33.1. the managing authority shall decide the remaining financial means to redirect the funds included in the reserve list of project submissions for funding.
54. If the annual program of activity do not have the financial resources or the balance of the decision by the Management Committee to act in accordance with this rule 53.1. the procedures laid down in point, the reserve fund included in the list of project submissions rejected by the managing authority, notifying the applicant of the project.
55. where the managing authority adopts this rule 53.2. the decision referred to the reserve fund in the project list submissions a comparison taking into account the provisions of annex 6 part II 2.3, 4.2 and 4.3 the quality criteria referred to in (a) and part III, referred to in paragraph 1 in specific criteria rating.
56. the managing authority of the reserve fund included in the list of project submissions are ranked in order of priority by the number of points earned, beginning with the most points won.
57. the managing authority for approval to move the Reserve Fund on the list of project submissions, who won the largest number of points.
58. If the annual program activity have left enough financial resources to this provision the Fund referred to in paragraph 57 project applications could be funded 100% by the managing authority approves it.
59. If the annual activity programme of the remaining financial means are not enough to this provision the Fund referred to in paragraph 57 project applications could be funded 100% by the Managing Authority Fund project application is approved with the condition that reduced the requested Fund, indicating in writing the project applicant to submit the time limit set by the managing authority of the Fund specified in the project application.
60. If the applicant for the project managing authority is not made within the time limit specified in the project application to the Fund, the Fund's project submission is rejected.
61. Where the managing authority by the applicant within the time limit set, submit project application specified, the managing authority shall check whether the provisions referred to in paragraph 59 of the condition is fulfilled, and 61.1. If the condition is not met, the application is rejected for the project of the Foundation;
61.2. If the condition is met, the project of the Foundation approved the application.
62. If the reserve fund included in the list of project applications refused under this provision, 60 or 61.1. in point procedure, the managing authority for the approval of the next move on the reserve list of the Fund's project application, which won the largest number of points according to the rules in paragraph 58 and 59 of the procedures laid down.
63. The remaining Reserve Fund included in the list of project submissions rejected by the managing authority.
64. the managing authority shall inform the applicant of the project fund project approval or rejection of the application.
Vi. the limited selection of Fund projects submitted within the application and evaluation of Fund project 65. submissions valued under the Administration and quality criteria (annex 7).
66. the Managing Authority Fund project application under the administrative evaluation criteria and quality criteria creates a limited selection of project fund application Evaluation Commission.
67. the managing authority shall establish a restricted fund project application selection Commission rules of evaluation and project application, assessment and approval procedure.
68. the managing authority shall register the project and assign them to application identification number.
69. the Fund's project submission driven evaluation, if it meets the following conditions: 69.1. project fund application is filed within the time limits laid down in the Statute of the selection;
EB 69.2. project fund application is drawn up into the Latvian language;
69.3. Fund project application is caurauklot (does not apply to electronically filed applications for Fund project).
70. after the submission of the draft assessment of the Fund's eligibility criteria, the leading administrative authority for further evaluation of their moves according to the quality criteria.
71. the Fund's application of the project's total score is obtained by summing the quality criteria points earned.
72. If the Fund's project submission complies with all administrative criteria and don't need clarification in the application of the project of the Foundation, the leading authority on project submission guide for approval.

73. If the project application to the Fund does not meet even one criterion for administrative or need clarification of the application of project funds, the managing authority shall make a request in writing to the applicant of the project of the Foundation to clarify the application of the project of the Foundation or to submit additional information managing authority within the time limit.
74. After clarification of the application of the project of the Foundation in accordance with the request of the managing authority, the total number of points earned will not change.
75. Where the managing authority, the applicant is not made within the time limit specified in the Fund's project submission or additional information, Fund project application rejected.
76. Where the managing authority by the applicant within the time limit set, submit a project application to the specified or information, the Evaluation Commission evaluated the submitted clarifications or additional information: 76.1. If necessary and clarifications have been made or additional information has not been submitted in full, the Fund's project application is rejected;
76.2. If the necessary clarifications have been made or information has been submitted in full, the Fund's project submission moves.
77. the managing authority for the project assessment, the application shall inform the applicant of the project for the application of the project approval, approval with conditions that will reduce the requested Fund, or rejection.
78. The Fund's application to approve the project, the managing authority shall make a request in writing to the applicant of the project in its deadline to submit project fund application specified.
79. Where the applicant is the managing authority is not made within the time limit specified in the project application to the Fund, the Fund's project submission is rejected.
80. Where the managing authority by the applicant within the time limit set, submit project application specified, the managing authority shall ensure that the provisions referred to in paragraph 77, the condition is satisfied, and: 80.1. If the condition is not met, the application is rejected for the project of the Foundation;
80.2. where the condition is met, the project of the Foundation approved the application.
81. the managing authority shall inform the applicant of the project fund project approval or rejection of the application.
VII. Grant of 82. After conclusion of the contract Fund project application approval by the managing authority to the applicant, the project offers to conclude a grant agreement.
83. If the tender project applicant refuses or limits set by the managing authority will provide a grant of conclusion of the contract and if the relevant annual programme activity are available financial resources, driven by the managing authority for approval or approval with the conditions of application of the Fund for the project included in the reserve list for the next project with the highest number of points in that rule 56, 57, 58, 59, 60 and 61 above.
84. at the conclusion of the contract all grant, the managing authority shall inform the Fund project application to the remaining projects on the reserve list of applicants for the project submission rejection.
85. the Grant Agreement shall specify the following information: 85.1. the maximum eligible costs;
85.2. the Fund, the State budget and Fund co-financing project co-financing by the applicant;
85.3. Fund project funding recipient's duties and responsibilities;
85.4. amendment to the agreement and grant the termination order;
85.5. other information that the party considers relevant.
86. the managing authority shall send the quarterly information and audit of certification authority for grant agreements concluded or amended, including: 53.5. grant contract name, number and date;
86.2. Fund financing, co-financing and Government project co-financing by the applicant;
86.3. institution of the said request, grant the contract or amendment thereto.
87. the managing authority shall terminate a limited tender or selection without closing the grant agreement, in the following cases: 87.1. If all projects submitted submissions are rejected;
87.2. If for objective reasons (force majeure, shortage of financial resources), why not the managing authority may enter into a grant agreement with the winner of the open competition or limited selection of applicants.
VIII. Technical assistance activities for the implementation in the 88. Technical assistance activities implemented by the management of such funds, participating in the control and supervision of public administration authorities (hereinafter referred to as the responsible authorities): 88.1. managing authority;
88.2. audit authority;
88.3. certification authority.
89. The technical assistance activities for the maximum available funding for the Foundation, as well as its distribution between the responsible authorities approve the annual programme.
90. The technical assistance activities for the implementation of the related expenditure is covered by 100% of the financing of the Fund.
91. activities of technical assistance in the implementation by the responsible authority, acting in the framework of several funds attributed to the Fund concerned, taking into account available to the authority responsible for technical assistance funding ratio between funds.
92. The technical assistance activities eligible activities and eligible costs are set out in the decision of the European Commission on the implementation of the Fund.
93. in order to ensure that the audit authority and the certifying authority for technical assistance activities, as well as proper separation of these functions, the managing authority with the audit authority and certification authority concluded an agreement on the audit authority and the certifying authority for technical assistance activities.
94. to ensure the managing authorities for the implementation of technical assistance activities, the managing authority shall issue internal legislation.
