Cabinet of Ministers Regulations No. 403 in the year 2010 (April 27. No 21 34) the procedure for the grant of State aid for the purchase of working capital for the production of agricultural products Issued under the agricultural and rural development Act article 5, fourth paragraph 1. determines the order in which the State aid granted for the acquisition of marketable agricultural production.
2. State aid for the acquisition of working capital for the production of agricultural production of State joint stock company "Latvian mortgage and land bank" (hereinafter referred to as the mortgage bank), referred to the Ministry of agriculture has functional authority, granted in the form of a loan: 2.1 economic performers, producing the Treaty on the functioning of the European Union annex I agricultural products referred to in (economic analyst);
2.2. the agricultural service cooperatives, which comply with the regulations for agricultural service cooperatives conformity assessment (hereinafter referred to as the agricultural service cooperative society);
2.3. fruit and vegetable producer groups comply with the legislation on fruit and vegetables for the recognition of producer groups (hereinafter referred to as the fruit and vegetable producers group).
3. Mortgage loan the bank leveraging to grant State aid for the purchase of working capital for the production of agricultural products (hereinafter referred to as the loan), the Minister of Finance shall not apply the statutory interest rate risk of the loan.
4. the loan is granted in accordance with the Commission of 20 December 2007 Regulation No 1535/2007 of the EC Treaty and article 88 87. application of the de minimis aid in the agriculture product industry (Official Journal of the European Union, 2007. on 21 December, no L 337) (hereinafter referred to as Commission Regulation (EC) No 1535/2007) and in accordance with the Commission on 15 December 2006, Regulation (EC) No 1998/2006 on 87 and 88 of the Treaty. application of article de minimis aid (Official Journal of the European Union 2006 December 28, no L 379) (hereinafter referred to as Commission Regulation No 1998/2006).
5. Loans granted: 5.1 economic analyst, agricultural service cooperative society and the fruit and vegetable producer group, which has a tax debt, unless there is agreement with the State revenue service on tax debt repayment schedule and conditions are being fulfilled;
5.2. the economic operator of the action laid down in Commission Regulation No 1535/2007 article 1;
5.3. the agricultural service cooperative society and the fruit and vegetable producer group of activities laid down in Commission Regulation No 1535/2007 and article 1 of Commission Regulation No 1998/2006 article 1, paragraph 1.
6. the total amount of the loan is 10 000 000 lats.
7. the economic operator, the agricultural service cooperative society and the fruit and vegetable producer group granted a loan of 5 000-700 000 lats. Loan term not longer than one year.
8. Loan for economic operators granted as de minimis aid under Regulation No 1535/2007. the total amount of aid does not exceed the Commission Regulation No 1535/2007 article 3 paragraph 2 limits, calculating the subsidy equivalent in local currency.
9. Loans agricultural service cooperatives and fruit and vegetable producer groups depending on their activity as de minimis aid granted under Commission Regulation (EC) No 1998/2006 and Commission Regulation (EC) No 1535/2007. the total amount of aid does not exceed the Commission Regulation No 1998/2006 article 2 and paragraph 2 of Commission Regulation No 1535/2007 article 3 paragraph 2 limits, calculating the subsidy equivalent in local currency.
10. the subsidy equivalent in dollars of economic operators, agricultural service cooperatives and fruit and vegetable producer groups is calculated on the basis of the European Commission for a given period fixed base rate (base rate published on the DG competition of the European Commission's homepage on the internet), as well as the risk that the percentage rate is set according to the mortgage bank loan rating and receiving the proposed provision (annex 1).
11. the mortgage bank's decision to grant a loan assumes three weeks after it has received the application, which includes a description of the measures planned development and working capital loan repayment, product description, the expected cash flow, information about any support received pursuant to Commission Regulation No 1535/2007 or Commission Regulation 1998/2006, subject to the laws and regulations on de minimis aid and other limited amount of support.
12. the mortgage bank to the current quarter, the first to the last working day of the month Ministry of Agriculture report on economic operators, agricultural service cooperatives and fruit and vegetable producer groups which have received loans in the previous quarter (annex 2).
13. the rural support service and mortgage bank aid accounted for in accordance with the laws and regulations on de minimis aid and other limited amount of support.
14. The loan until 31 December 2011.
