No 10 43 §) national and European aid arrangements under "modernisation of the fishing fleet" Issued under the agricultural and rural development Act article 5, fourth paragraph i. General questions 1. determines the order in which the State and the European Union support for the project submission open competition in the form of a "fisheries development measures for the modernisation of the fishing fleet" (hereinafter measure) sub-measures: 1.1. "health and safety" (hereinafter referred to as the Sub-action 1.1); 1.2. "fishing impacts on the marine environment and the fishing limit adjustment for species protection" (hereinafter referred to as the Sub-action 1.2). 2. national and European Union aid granted in accordance with the European Parliament and of the Council on 11 December 2013 Regulation (EU) no 1380/2013 for the common fisheries policy and amending Council Regulation (EC) No 1954/2003 and (EC) no 1224/2009 and repealing Council Regulation (EC) No 2371/2002 and (EC) No 639/2004 and Council decision 2004/585/EC (hereinafter Regulation No 1380/2013) The European Parliament and of the Council of 15 may 2014, the Regulation (EU) no 508/2014 on a European maritime and Fisheries Fund and repealing Council Regulation (EC) No 2328/2003, (EC) no 861/2006, (EC) no 1198/2006 and (EC) no 791/2007 of the European Parliament and of the Council Regulation (EU) No 1255/2011 (hereinafter Regulation No 508/2014) and the Commission of 24 November 2014 the delegated Regulation (EU) No 2015/531 complementary to the European Parliament and Council Regulation (EU) no 508/2014, determining the costs which are eligible for the European Fisheries Fund for Maritime Affairs and fisheries support hygiene, health, safety and working conditions, marine biodiversity and ecosystem protection and restoration, mitigation of climate change and energy efficiency of fishing vessels (hereinafter Regulation No 2015/531). 3. national and European Union aid is granted for the following purposes: 3.1 1.1. Sub-fishermen's hygiene, health, safety and working conditions when making investments in fishing vessels, provided that these investments exceed directly applicable European Union law and national laws in accordance with the requirements of Regulation No 508/2014. paragraph 1 of article 32; 3.2. the Sub-measure 1.2: improvement of selectivity of fishing gear on fish size or species, discards or the eradication of unwanted catch processing, or fishing gear and catch for Europe mammals and birds protected under Regulation No 508/2014 article 38 paragraph 1, "a", "b" or "d". 4. project adoption application shall submit project applications, evaluate and select, adopt and communicate, support requests, as well as monitoring implemented and sanctions applied in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period insofar as these provisions do not stipulate otherwise. 5. measures in support of a certain period does not grant support to the tenderer (hereinafter the applicant), which has found violations under Regulation No 508/2014 article 10 and 17 December 2014 the delegated Regulation (EU) No 2015/288, the European Parliament and of the Council Regulation (EU) no 508/2014 on a European Fund for Maritime Affairs and fisheries added relating to the inadmissibility of the application period and the start and end of the day. 6. project submissions assessed according to these rules referred to in annex 1 to the project selection criteria. Applicant is registered in the European Union fishing vessel owners who meet the following conditions: it has concluded 8.1 commercial fishing rights lease with the fishing rights of the lessor; 8.2. it is valid special permit (license) commercial fishing; 8.3. the vessel within two calendar years prior to the application of the project at least 60 days took place in fishing activities in the Baltic Sea (including the Gulf of Riga) the coast or coastal waters or on the high seas fishing. 9. The applicant shall meet the following conditions for receiving public funding: 9.1. the project, reaching 1.1 or 1.2. sub goals; 9.2. the fishing vessel at least five previous years before the project is included in the application: 9.2.1. Ministry of Agriculture fishing vessels (hereinafter referred to as the list of fishing vessels); 9.2.2. the national joint stock company "Latvian maritime administration of Latvia register (hereinafter register) if the fishing vessel is being used for fishing on the high seas; 9.3. the project application has been proven the economic viability of the company in accordance with paragraph 10 of these rules. 10. The applicant shall include in the application the project simplified the business plan (2.14 (B) of the annex). The cash flow statement over the years to the application of the draft year, in subsequent years up to the end of the project, and a year after the implementation of the project. The economic viability of the company is cash flow positive project in the year of application, the subsequent years up to the end of the project, and a year after the implementation of the project. Cash flow cash balance at the end of each year is positive, and it shows the possibility to implement and achieve the project objectives. 11. The applicant in the application for the project includes investments for one of the fishing vessels as well as comply with Regulation No 508/2014. paragraph 3 of article 32 and article 38, paragraph 3 of the rules. 12. before the approval of the project application, during project implementation and for a period of five years following the last payment Field support representatives during the controls carried out by the fishing vessel is in port. III. Field support service projects a copy of the application along with proof of registration of the project shall be returned to the applicant; 13.2. the Declaration by the applicant in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period; 13.3. the procurement procedure documents – the subject of the procurement technical specification and all potential suppliers submitted tenders in accordance with the laws and regulations on the procurement procedure and the application of the principals of the funded projects and legislation on the national and European aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period; 13.4. If the fishing is carried out according to the Treaty of the European Union with third countries-the third country concerned shall be issued by the competent institution of the fishing authorisation (licence) to fish in this country's economic zone waters (a certified copy of the applicant); 13.5. in accordance with the national regulations for the marine safety of fishing vessels, the safety and health protection and medical care on board ships and the safety and health requirements for work on board fishing vessels prepared for national joint stock company "Latvian maritime administration maritime safety inspection (hereinafter referred to as the Maritime Safety Inspectorate) an opinion under its competence on: 13.5.1. modernisation of fishing vessels and, if necessary, the modernisation of fishing vessels of technical project. The modernisation of fishing vessels and, if appropriate, modernisation of fishing vessels of technical project shall be submitted together with the reconciliation project submission, or within six months after the entry into force of the rural support service of the decision on the approval of the project application. If the investments are for fishing vessels to fish in the cargo holds of fishing vessels, the applicant's technical upgrading project to certify that they do not increase the fishing vessel to fish cargo tank capacity (in cubic metres); 13.5.2. the fact that the rules referred to in point 16 items or activities exceed the European Union directly applicable legislation and national legislation requirements for sea fishing vessel safety, security and health protection and medical care on board ships and the safety and health requirements for work on board fishing vessels; 13.6. the National Research Institute for food safety, animal health and Environmental Research Institute "BIOR" "proof of the applicant's planned investment in compliance with the rules referred to in paragraph 19; 8.5. a declaration of conformity of the small companies (the little) or the average of the company according to the laws of the the order in which commercial companies declare their compliance with the small (tiny) and the average company status. 14. Beneficiary simultaneously with the final payment request and starting with the next year after the implementation of the project, each year up to June 1, a five-year period, the rural support service report on the beneficiary of economic indicators (annex 3) in the preceding calendar year. IV. Eligible and ineligible costs 15. Regulation No 508/2014 article 38 paragraph 1 referred to "a" equipment purchase and installation costs; 17.2. the cost of the investments on board or in the equipment, which comply with Regulation No 508/2014. paragraph 1 of article 38 of the "b" in subparagraph: 17.2.1. unwanted catch pretreatment (cleaning, gutting, tailing, heading, head and fins cut) for cooling, freezing and storage of the required fishing vessel, the rūmj, or the conversion of a freezer cabinet and restoration, as well as the purchase of building materials; 17.2.2. with the unwanted catch of the pre-treatment (washing, gutting, head and fins cut), chilling, freezing and storage-related machinery and equipment purchase and installation, including cold and ice production equipment, containers, container and the purchase of equipment to ensure the quality of the unwanted catches; 17.3. Regulation No 508/2014. paragraph 1 of article 38 "d" referred to the acquisition of equipment and installation costs. 18. the measure is applicable also in general costs, including architects, engineers and consultation fees, inspection, building services, legal services, feasibility study, as well as the use of patents and licences costs directly linked to the preparation or implementation of the project and does not exceed seven percent of these rules 16 and 17 above the total eligible cost. 19. in accordance with Regulation No 508/2014 article 38 (4) the aid is granted only if it can be shown that these rules 17.1 and 17.3 in this gear or other equipment is better selectivity in terms of size or less impact on ecosystems and species, non-target species than the standard fishing gear or other equipment that allowed under the European Union's directly applicable law or relevant national regulations, adopted in the context of regionalization, Regulation No 1380/2013.20. Rebuilding and reconstruction costs in an amount not exceeding the amount of costs defined in the contracts concluded with third parties, responsible for rebuilding and restoration work. 21. the Measures do not apply shall be the following: 21.1. for activities that increase the capacity of the fishing vessel or equipment which increases the ship's ability to find fish; 21.2. investments to increase the fishing vessel's main engine or auxiliary power, they changed or upgraded; 21.3. the contribution of fish cargo hold capacity (in cubic metres); 21.4. interest payments, money transfers, Currency Exchange Commission payments and exchange rate fluctuations suffered damage; 21.5. fines, penalties and the costs of the proceedings; 21.6. the subcontracting, which artificially and unduly increase the cost of the project and the fee is fixed as a percentage of the total cost of the project; 21.7. the costs associated with the supply of any services or work for which there is no appropriate procurement procedures carried out in accordance with the laws and regulations on the procurement procedure and the application of the principals of the funded projects and legislation on the national and European aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period; 21.8. the project related vessel, hardware, devices, assemblies and equipment maintenance, spare parts and operating costs; 13.6. the remuneration of personnel; 21.10. taxes and fees (excluding value added tax for those applicants who are not registered as a value added tax payer); 21.11. costs incurred prior to the application of the project, except for this provision, paragraph 18; 21.12. other costs that are not eligible under Regulation (EC) no 508/2014 and Regulation No 2015/531. g. Public funding of public funding of about 22:22.1. the owner of the fishing vessel that is not a coastal fishing boat owner, has 50 percent of the eligible costs, in accordance with Regulation No 508/2014 article 95 (1); 22.2. coastal fishing vessel owner is 80 percent of the eligible costs, in accordance with Regulation No 508/2014 article 95 and point 4. 23. These rules eligible costs aid be combined with other aid, up to 2014 to Regulation No 508/95. aid intensity laid down in article. Vi.
