Cabinet of Ministers Regulations No. 1057 Riga 2010 November 16 (Mon. 64 31) the procedures for granting state aid in the European Union and open the project in the form of tender application for the measure "promotion of tourism activities" Issued under the agricultural and rural development Act article 5, fourth paragraph i. General questions 1. determines the order in which the State and the support of the European Union (hereinafter referred to as aid) to open the project in the form of tender application for the measure "promotion of tourism activities" (hereinafter measure).
2. objective of the measure is to promote non-agricultural activities in rural areas, developing and improving the rural tourism and tourism-related services and infrastructure.
3. the project submission (annex 1) making publicity, project submissions valued and select, adopt and communicate, as well as support for the request in accordance with the laws of the State of the European Union and the granting of aid for rural and fishery development.
II. conditions for receiving the aid measure 4 points is the territory of Latvia, with the exception of: 4.1 of the city;
4.2. County territorial units-cities that have more than 5000 inhabitants. Population is determined, taking into account the Central Administration of statistics data for the population of Latvia's administrative territories in accordance with the latest State statistical observations;
4.3. the counties bordering the territory of the city of Riga.
5. Measures to support the following activities: 5.1 existing tourist accommodation (not more than 20 beds) the reconstruction or reconstruction and equipping of simplified, new tourist accommodation (not more than 20 beds) installing and outfitting companies that provide other types of tourist services;
5.2. existing tourist accommodation catering to block construction or reconstruction, or a simplified reconstruction and purchase of necessary equipment;
5.3. existing camping and youth tourism accommodation sharing kitchenettes, dining room, toilet and shower room construction, reconstruction, rehabilitation and equipping of the simplified (not including bath or sauna construction, reconstruction or simplified reconstruction);
5.4. the diversification of tourism services;
5.5. investments in environmental protection and energy efficiency for the accommodation.
6. supports the activities of the applicant may be eligible to receive a loan from the credit of the Fund in accordance with the laws and regulations on the procedures are administered and monitored by national and European Union support for agriculture, rural development and fisheries by creating a credit fund.
7. This rule 5.4. activities referred to in the implementation is supported by the following: 7.1 bathing;

7.8. sports and sports and recreational facilities construction in the existing or planned tourist services;
7.9. the provision of tourism services for inventory storage sheds or locked room or expansion, as well as improvement of the territory, subject to the maximum eligible costs in the calculation of the aid the main types of structures (structure type maximum eligible costs) (annex 2).
8. supports the applicant is: 8.1. farm;
8.2. a natural person pursuing an economic activity;
8.3. the merchant.
9. the applicant shall satisfy the following conditions: the support 9.1. in implementing the project, achieving the objectives of the measure;
9.2. as a tourism service provider includes a tourist brochure or Web site that you create with the promotion of tourism-related institutions;
9.3 develop and expand business operations, using, at least one of the following conditions: 9.3.1. job creation;
9.3.2. the existing jobs;
9.4. the project demonstrates economic viability in the application according to the rules in paragraph 12 and 13 these requirements.
9.5. to implement this rule 5.1. activity, referred to only those eligible applicants that supports the accommodation shall not be more than 20 beds.
10. The provisions referred to in paragraph 5, the implementation of the activities supporting the applicant will begin no later than six months after the entry into force of the rural support service of the decision on the approval of the project application.
III. Application procedures and the documents to be submitted 11. To log in for receiving the aid, support the applicant Field support services in person or electronic form of the document in accordance with the laws and regulations on the development of electronic documents, presentation, storage and circulation shall submit the following documents: 11.1. two copies of the project application (if the application is lodged by the project in paper form), including economic and financial analysis of this provision in paragraph 12 or 13 of the said action plan. 11.2. the applicant's statement in accordance with the laws of the State of the European Union and the granting of aid for the development of the rural and fisheries;
11.3. credit institutions, leasing companies or cooperative credit society for the provision of credit, where the project will take credit. Statement submitted with the project application or within six months after the entry into force of the rural support service of the decision on the approval of the project application. The certificate indicates a creditor and borrower's property and the loan amount. The certificate is presented for this rule 6, paragraph loan but inform the rural support service of the application for a loan from the credit of the Fund;
11.4. documents that prove the availability of funds, if the project supports the tenderer intends to invest private money funds (excluding loans);
11.5. annual report (full set) for the last year concluded (on presentation of a copy of the original) in accordance with the annual accounts Act or the annual income declaration "revenue from operating activities" for the last two years before the project was concluded in the submission (presentation of a copy of the original) in accordance with the laws and regulations of people's annual income statement. Support the applicant, established less than three years before the application date of the project, presented in the just concluded last year;
11.6. the construction or improvement of regional environmental management certification that the project activities are permitted and will not be harmed the environment, where this provision is referred to in paragraph 5 of the operational activities of the European Union are implemented matter protected area Natura 2000;
7.3. a booklet or printout referred to in point 9.2 of these rules;
11.8. the real estate in which, through a project for the construction, reconstruction, installation or deployment: 11.8.1. 11.8.2. 7.4. for the purchase of building materials – construction of the technical design of the accepted stages or a copy of it (the presentation of the original);
11.10. the construction or reconstruction, if the date is a technical project: construction of off. accept technical project or a copy of it (the presentation of the original);
11.10.2. construction permit (copy, the presentation of the original);
11.11. the construction or reconstruction, if the date is not in the project, the technical planning and architectural task (copy, the presentation of the original);
11.12. simplified reconstruction: 11.12.1. acknowledgement cards and intentions documentation (copy, the presentation of the original);
11.12.2. the purchase of building materials – drawn up by the applicant supports them;
11.13. the procurement procedure of the supporting documents;
11.14. form of de minimis aid received in accordance with the legislation on minimum support or other limited amount of support accounting and allocation procedures and accounting forms;
11.15. the reconstruction or renovation of technical-simplified inventory file (a copy of the presentation of the original).

12. supports the applicant's submission that the project's total eligible cost amount not exceeding 70 280 pounds, adds a simplified action plan that: 12.1 consists of information about services and costs, fixed assets and creditors for last year concluded, the subsequent years up to the end of the project, and a year after the implementation of the project, as well as the cash flow statement per month project in the year of application, the subsequent years up to the end of the project, and a year after the implementation of the project;
12.2. tenderer showing support to economic viability. Economic viability is positive cash flow of the project in the year of application, all project implementation years and years after the implementation of the project. The cash balance at the end of each month must be positive. Support the applicant in the year after the implementation of the project in comparison with the last year signed by at least three percent increase in revenue from operating activities or at least a three percent decrease in expenses. 13. supports the applicant's submission that the project's total eligible cost amount exceeds LVL 70 280, add standardized action plans that: 13.1 consists of information about services and costs, fixed assets, accounts payable, profit and loss statement, the balance sheet for the last year concluded, the subsequent years up to the end of the project, and a year after the project implementation (except production and cost), as well as from cash flow statement per month to the application project of the year in subsequent years, until the end of the project, and a year after the implementation of the project. The cash balance at the end of each month must be positive;
13.2. Reaffirms economic viability of applicants last year, concluded before the application of the project. Support the applicant meets at least two of the following indicators: 13.2.1. equity to total assets is, or more than 0.20;
13.2.2. working capital ratio of short-term vendor is 1.00 or more about it (from short-term creditors less short-term deferred income included in the composition of the State and the financial support of the European Union);
13.2.3. net profit and depreciation, multiplied by 50 percent, the amount is zero or greater;
13.3. prove the economic viability of the company a year after the implementation of the project according to this provision the indicators referred to in point 13.2.2. and at least one of these rules 13.2.1. is referred to in 13.2.3. indicators.
14. The construction and reconstruction of documents and purchase documents submitted with the application for the project or within six months after the approved rural support service of the decision on the application for the project.
15. the beneficiary with the last payment request Field Support Services report on the implementation of the project results (annex 3) and the report on the beneficiary of economic indicators by the European agricultural fund for rural development (EAFRD) under "tourism promotion activities" (code 313) (annex 4).
16. Starting with the next year after the implementation of the project, the beneficiary every year to 30 April in the five-year period of the Field support service report on the beneficiary of economic indicators by the European agricultural fund for rural development (EAFRD) under "tourism promotion activities" (code 313) (annex 4) for the preceding calendar year.

20. The beneficiary of that programming period has changed the legal status, of the natural person becoming the legal person, or a corporate reorganization, or a new company or created the farm (the recipient owns more than 50 percent of the capital in the new company): 20.1. aid can apply this provision in paragraph 11 above, and in paragraph 5 of these rules in these activities for the remaining amount of the eligible cost;
20.2. unable to log in to support this provision in paragraph 11 above, and in paragraph 5 of these rules in those activities where the programming period has received the maximum amount of the eligible costs.
21. before the grant of the aid field support service check that: 21.1. aid granted pursuant to these provisions, together with the fiscal year concerned and the two previous fiscal years assigned to de minimis aid, do not exceed the Commission Regulation No 1998/2006, article 2 (2) the maximum amount of de minimis aid;
21.2. the aid granted pursuant to these provisions, together with the fiscal year concerned and the two previous fiscal years assigned to the de minimis and other limited support, the amount does not exceed EUR 500 000 or equivalent in local currency.
22. If the applicant for the purposes of the project also receives this rule 6, paragraph loan, follow that rule in paragraph 21.
23. the Support shall be granted in the sectors of economic activity, referred to in Commission Regulation No 1998/2006 article 1, paragraph 1.
24. Starting a project, the evaluation of the application in accordance with the laws and regulations on the procedures for granting state aid in the European Union for the development of the rural and fisheries, rural support service to evaluate project compliance with basic application of qualitative criteria in determining whether the project submission complies with these rules in point 4, 9.2 above, paragraphs 12 and 13 of these requirements, and shall take a decision on the rejection of the application or project evaluation the continuation in accordance with the laws of the State of the European Union and the granting of aid for rural and fishery development.
25. project submissions are ranked according to the criteria for the selection of projects (annex 5). If the number of points be equal, priority is supported by the applicant, which operates in the territory of the municipalities with less development index.
V. eligible and non-eligible costs the following Measures 26. eligible costs: 26.1. the construction, reconstruction or simplified reconstruction costs, on the basis of contracts with third parties, responsible for carrying out the work, but not exceeding the maximum structure types of eligible costs (annex 2);
26.2. the acquisition cost of the building materials based on the construction plan of the technical design of the accepted stages or to support the preparation of the estimate, but not exceeding the maximum structure types of eligible costs;
26.3. the acquisition cost of the equipment, to ensure the implementation of the relevant activities;
26.4. General costs (including architects ', engineers ' and consultants ' fees, legal fees, feasibility study, obtaining of patents and licences), directly related to the project preparation or implementation. If the application contains only this rule 26.3. the costs referred to in general costs shall not exceed two percent of that rule 26.3. the costs referred to in point. In other cases, the General costs shall not exceed eight percent of these rules, and 26.3 26.1 26.2. in the above eligible costs.
27. in the structure type to apply the maximum costs include all of the object's construction-related costs, including external and internal plumbing, internal and external sewerage, internal and external power supply, ventilation and heating systems, as well as the rules referred to in paragraph 28.
28. The eligible costs are directly related to tourism services costs if their amount does not exceed 30 percent of the total eligible cost of construction: 28.1. a new administrative space construction, reconstruction of the existing space or a simplified reconstruction;
28.2. guarding and passes construction of premises;
28.3. burglar alarm (including CCTV systems);
28.4. the staff rooms of the building.
29. If the project construction or reconstruction costs for the respective type of construction exceeds the maximum eligible costs, the cost difference shall be borne by the beneficiary.
30. the construction plan is only Applicable to those positions that are directly linked to the achievement of the objective of the project.
31. The aid shall be paid only for goods purchased, which is the property of the beneficiary.
32. the support of the goods purchased, cost only if they have become the property of the beneficiary.
33. the following Activities are not eligible:

33.1. interest payments, money transfers, Currency Exchange Commission payments and currency fluctuation losses;
33.2. fines, penalties and costs;
33.3. subcontracting, if they do not ensure the achievement of the objectives of the project;
20.8. costs associated with the supply of any services or work for which there is no appropriate procurement procedure organised pursuant to the laws and regulations on the application of the procurement procedure;
33.5. the existing maintenance costs, maintenance, spare parts and operating costs;
20.9. remuneration of personnel;
20.9. fee for equipment with internal combustion engines;
33.8. costs in excess of the market price, and the unfinished work;
21.1. the other costs that are not eligible under Council of 20 September 2005 Regulation (EC) No 1698/2005 on support for rural development by the European agricultural fund for rural development (EAFRD) and the Commission of 15 December 2006, Regulation (EC) No 1974/2006 laying down detailed rules for the application of Council Regulation (EC) No 1698/2005 on support for rural development by the European agricultural fund for rural development (EAFRD).
