No 73 31) For the Government of the Republic of Latvia and the Ukraine Cabinet of Ministers agreement on transit traffic through ports and other transport infrastructure Issued under Cabinet installations Act article 31 2 of the first subparagraph of paragraph 1. Of the Government of the Republic and the Cabinet of Ministers of Ukraine Agreement on transit traffic through ports and other transport infrastructure (hereinafter the agreement), these rules are adopted and approved.
2. fulfilment of the obligations provided for in the agreement are coordinated by the Ministry of transportation.

The Prime Minister, regional development and local Government Minister v. dombrovsky traffic Minister u. Augul is adopted and approved by the Cabinet of Ministers of 14 December 2010 the terms of the no 1124 of the Government of the Republic of Latvia and the Ukraine's Cabinet of Ministers agreement on transit traffic through ports and other transport infrastructure, the Government of the Republic of Latvia and the Ukraine's Cabinet of Ministers (hereinafter referred to as the Contracting Parties), aiming to develop economic cooperation between the two countries on the basis of equality and mutual benefit, taking into account the Republic of Latvia as a Member State of the European Union status, giving great importance to the development of transit transport through ports and other transport infrastructure, and mutually beneficial cooperation on the basis of equality and mutual respect, have agreed as follows: article 1 the Contracting Parties shall cooperate in the field of equality and mutual benefit, by principle, on the basis of laws and international treaties that is a member of both Contracting Parties.
In this agreement, the terms used have the following meanings: the competent institution of the Republic of Latvia: Government of the Republic of Latvia, the Ministry of transport of Ukraine, the Cabinet of Ministers of the Ukraine Ministry of Transport and communications;
A port of the Republic of Latvia – with a certain boundaries of land territory of Latvia, including artificial mound, and part of the internal waters, including internal and external RAID and port access road, decorated vessels and passenger service, freight, transport and expedition operations and other economic activities;
Port of Ukraine-national transport companies for ship, passenger and freight service to the port specified in the territory and proper, as well as cargo and passenger transport by vessels belonging to the port. The port area can run all the property form companies and organisations operating in the Contracting Parties ' national legislation in accordance with the procedure laid down, with the aim to service the ships, passengers and freight;
Hereinafter referred to as – the port.
cargo-goods and any other items that are transported by various modes of transport;
vehicles-cars, railway rolling stock, sea, river vessels;
transit – freight through the territory of a Contracting Party, provided that at least through one of the territories of the Contracting Parties of the freight transported in transit;
third countries, any country which is not a member of this agreement.
2. in article 1 the Contracting Parties shall promote the implementation of the principle of free transit and refrain from any actions that could harm the international transport communications development.
2. the Contracting Parties agree to cooperate in the following areas: 1) participate to further transit traffic through the port, development;
2) to promote competitive transit transport conditions.
Article 3 the Contracting Parties agree: 1) to create the necessary conditions for the Republic of Latvia and the Ukraine's transport infrastructure and use the port for transit traffic;
2) to act immediately to eliminate the reasons that prevent efficient transit transport services, including container transport;
3) collaborate in the framework of international organizations, which is a member of the Republic of Latvia and the Ukraine, as well as with third countries, in order to achieve the objectives of this agreement.
Article 4 the competent authorities of the parties: 1) provides information about services related to transit transport;
2) transit delays or difficulties in the case shall cooperate with a view to its rapid elimination;
3) shall notify each other of changes to national laws governing transit transport conditions.
Article 5 transit traffic shall be carried out in accordance with national laws and international agreements, as well as taking into account the Republic of Latvia and the Ukraine's participation in international organisations.
Article 6 cargo, customs border controls and other control arrangements with the territory of Contracting Parties in the existing laws.
Article 7 the Contracting Parties shall take measures to maintain and develop effective business relations between the relevant institutions of the contracting parties responsible for transport and trade, as well as facilitate contacts between companies and organizations.
8. Article 1 the Contracting Parties shall take all necessary measures to prevent the movement of transit as a result of environmental pollution.
2. the Contracting Parties shall encourage the participation of the relevant authorities of the transit transport resulting from environmental pollution incident investigation and damages relating to these events.
1. Article 9 to review both parties over issues related to the application of this agreement, the total Commission is created.
2. total Commission meets after one Contracting Party at the request of the competent institution. The meeting place, date and agenda is determined by agreement between the competent authorities of the Contracting Party(ies).
3. to discuss specific issues and to develop appropriate recommendations to the Commission may invite total experts and set up working groups.
10. Article 1. Issues that are not stipulated in this agreement, will be addressed under other international agreements, which is a member of the Republic of Latvia and Ukraine, and of the Contracting Parties in accordance with the national regulations.
2. This agreement shall not affect the rights and obligations of the Contracting Parties arising from the international agreements to which the Contracting Parties are parties.
Article 11 amendments and additions are made to this agreement by mutual agreement of the Contracting Parties and are presented in the form of a Protocol, which enters into force in accordance with article 13 of this agreement and shall form an integral part thereof.
Article 12 of the agreement disputes concerning the interpretation and application of address advice between the competent authorities of the Contracting Party(ies) of the overall framework of the Commission. If there is no agreement, disputes will be dealt with through diplomatic channels.
13. Article 1 this Agreement shall enter into force on the day following receipt of the last notification by the Contracting Parties through diplomatic channels to send each other after all the domestic procedures have been completed, as provided for in national laws and regulations, to take effect.
2. This agreement is concluded for an indefinite period of time and is valid for six months from notification of the date of one of the Contracting Parties through diplomatic channels in writing to the other Contracting Party of its intention to terminate its operation.
Affirming the undersigned, being duly authorized by the Government, have signed this agreement.

The Government of the Republic of Latvia: Cabinet of Ministers of Ukraine: СОГЛАШЕНИЕ Правительством и Кабинетом Латвийской Республики Министров между Украины и с портов о транзитных перевозках использованием транспортной инфраструктуры Латвийской Республики другой Правительство и именуемые в дальнейшем Украины, Министров Кабинет Договаривающиеся стремясь развивать Стороны сотрудничество между двумя, экономическое государствами на основе во равенства и взаимной принимая внимание статус Латвийской выгоды, как государства – члена Европейского Республики Союза , придавая важное значение развитию транзитных перевозок с использованием портов и другой транспортной инфраструктуры и взаимовыгодного сотрудничества в области транспорта, базируясь на принципах равноправия и взаимоуважения, согласились о нижеследующем: Статья 1

Договаривающиеся Стороны осуществляют сотрудничество в области транспорта на равноправной и взаимовыгодной основе, руководствуясь национальным законодательством и положениями международных договоров, участниками которых являются оба государства Договаривающихся Сторон.
Для целей настоящего Соглашения используемые понятия имеют следующие значения: Компетентные органы - со стороны Правительства Латвийской Республики - Министерство сообщения Латвийской Республики, со стороны Кабинета Министров Украины - Министерство транспорта и связи Украины;
порт Латвийской Республики – часть сухопутной территории Латвийской Республики с установленными границами, включая искусственно созданные территории, и часть внутренних вод, внутренние и внешние рейды, сухопутные пути на подступах к порту, оборудованные для обслуживания судов и пассажиров, осуществления грузовых, транспортных и экспедиционных операций и прочей хозяйственной деятельности;
порт Украины – государственное транспортное предприятие, предназначенное для обслуживания судов, пассажиров и грузов на отведенных порту территории и акватории, а также перевозки грузов и пассажиров на судах, которые принадлежат порту. На территории порта могут функционировать предприятия и организации всех форм собственности, целью и видом деятельности которых является обслуживание судов, пассажиров и грузов в порядке, установленном национальным законодательством государств Договаривающихся Сторон;
Далее по тексту именуются - порты.
груз - любые товары и другие предметы, которые перевозятся различными видами транспорта;
транспортные средства - автомобили, железнодорожный подвижной состав, морские, речные суда;
транзитная перевозка - перевозка груза по территориям государств Договаривающихся Сторон при условии, что через территорию государства хотя бы одной из Договаривающихся Сторон груз проследует транзитом;
третьи страны - любая страна, которая не является участником настоящего Соглашения.
Статья 2 1. Договаривающиеся Стороны оказывают содействие осуществлению принципа свободы транзита и воздерживаются от любых действий, которые могли бы нанести ущерб развитию международных транспортных связей.
2. Договаривающиеся Стороны согласились осуществлять сотрудничество в таких направлениях: 1) содействовать дальнейшему развитию транзитных перевозок с использованием портов;
2) способствовать установлению конкурентоспособных условий транзитных перевозок.
Статья 3 Договаривающиеся Стороны согласились: 1) создать необходимые условия для использования портов и другой транспортной инфраструктуры Латвийской Республики и Украины при транзитных перевозках;
2) принимать оперативные меры по устранению причин, препятствующих эффективным транзитным перевозкам, в том числе в контейнерах;
3) сотрудничать в рамках международных транспортных организаций, членами которых являются Латвийская Республика и Украина и с третьими странами для достижения целей настоящего Соглашения.
Статья 4 Компетентные органы Сторон: 1) предоставляют информацию об услугах, связанных с транзитными перевозками;
2) в случае возникновения задержек или трудностей при осуществлении транзитных перевозок сотрудничают с целью их оперативного устранения;
3) уведомляют друг друга об изменениях национального законодательства, регулирующего условия транзитных перевозок.
Статья 5 Транзитные перевозки осуществляются в соответствии с национальным законодательством, международными сооглашениями, а также с учетом членства Латвийской Республики и Украины в международных организациях.
Статья 6 Порядок проведения пограничного, таможенного и других видов контроля грузов определяется действующими на территориях государств Договаривающихся Сторон нормами их национального законодательства.
Статья 7 Договаривающиеся Стороны направляют свои усилия на поддержание и развитие эффективных деловых отношений между соответствующими органами государств Договаривающихся Сторон, ведающими вопросами транспорта и торговли, а также на поощрение развития контактов между предприятиями и организациями.
Статья 8 1. Договаривающиеся Стороны принимают все необходимые меры для предотвращения загрязнения окружающей среды в результате транзитных перевозок.
2. Договаривающиеся Стороны оказывают содействие в участии специалистов соответствующих органов в расследовании происшедших при транзитной перевозке грузов случаев загрязнения окружающей среды и возмещению ущерба, связанного с указанными происшествиями.
Статья 9 1. Для рассмотрения представляющих взаимный интерес вопросов, связанных с применением настоящего Соглашения, создается Совместная комиссия.
2. Совместная комиссия собирается по просьбе Компетентного органа государства одной из Договаривающихся Сторон. Место, сроки проведения заседания и его повестка дня определяются по договоренности между Компетентными органами обеих Договаривающихся Сторон.
3. Для обсуждения отдельных вопросов и выработки соответствующих рекомендаций Совместная комиссия может привлекать экспертов и создавать рабочие группы.
Статья 10 1. Вопросы, не урегулированные настоящим Соглашением, решаются в соответствии с другими международными договорами, участниками которых являются Латвийская Республика и Украина, и в соответствии с национальным законодательством государства Договаривающихся Сторон.

2. Настоящее Соглашение не затрагивает права и обязанности Договаривающихся Сторон, вытекающие из положений международных договоров, участниками которых являются государства Договаривающихся Сторон.
Статья 11 Изменения и дополнения в настоящее Соглашение вносятся по взаимному согласию Договаривающихся Сторон и оформляются в виде Протоколов, которые вступают в силу в соответствии со статьей 13 настоящего Соглашения и является его неотъемлемой частью.
Статья 12 Споры, касающиеся толкования и применения настоящего Соглашения, решаются путем консультаций между Компетентными органами Договаривающихся Сторон в рамках Совместной комиссии. В случае невозможности достичь согласия, споры будут решаться по дипломатическим каналам.
Статья 13 1. Настоящее Соглашение вступает в силу со следующего дня после получения последнего из уведомлений, направляемых Договаривающимися Сторонами по дипломатическим каналам друг другу о завершении всех внутригосударственных процедур, предусмотренных национальным законодательством для его вступления в силу.
2. Настоящее Соглашение заключено на неопределенный срок и остается в силе до истечения шести месяцев со дня уведомления одной из Договаривающихся Сторон в письменной форме по дипломатическим каналам другой Договаривающейся Стороны о своем намерении прекратить его действие.
Удостоверяя что, нижеподписавшиеся, надлежащим образом уполномоченные своими соответствующими Правительствами, подписали это Соглашение.
СОВЕРШЕНО в _________________ «________ » _______________ 2010 года в двух экземплярах, каждый на латышском, украинском и русском языках, при этом все тексты имеют одинаковую силу. В случаях различного толкования настоящего Соглашения за основу принимается текст на русском языке.
