Cabinet of Ministers Regulations No. 1130 2010 in Riga on December 21 (Mon. No 74 41. §) rules on natural mineral water and spring water minimum safety and labelling requirements, and procedures for issuing permits to distribute natural mineral water and covers the costs of service Issued under the food surveillance law article 4 of part two and article 20 10.1 the second part and the consumer protection law of article 21, the first part i. General questions 1. determines: 1.1. minimum safety requirements for natural mineral water and spring water;
1.2. the order in which the natural mineral waters is authorized for distribution;
1.3. the requirements of natural mineral water and spring water mark;
1.4. State fees for the issue of the amount of a natural mineral water for distribution in the market and the State duty payment procedures.
2. the provisions do not apply to mineral water, who recognized the medicinal products or used in thermal treatment or watering place, located in the catchment areas.
3. the procedure laid down in these provisions: 3.1 for natural mineral water can be recognised microbiological safe water from groundwater deposits by one or more natural or bored exits. 3.1.2. natural mineral waters by the natural purity;

4. Food business provides geological natural mineral water, hydrogeological, physical, chemical, physico-chemical and microbiological assessment in accordance with the provisions of annex 1 of 1, 2, and 3.
5. natural mineral waters to characterize the specific effects on the human body functions, according to the food business regulations for clinical trials of the medicinal mineral water provides pharmacological, physiological and clinical evaluation in accordance with the provisions of paragraph 4 of annex 1.
6. The State of compliance monitoring and control provides the food and veterinary service (hereinafter service) and the national environmental service in accordance with the laws and regulations on the supervision of the food chain and the use of the subsoils.
II. Natural mineral water and spring water minimum safety requirements 7. Natural mineral water and spring water are allowed to start according to the laws and regulations on the use of the subsoils and discovery zone if it has permissions that determine the environmental regulatory laws.
8. natural mineral water and spring water collection and treatment facilities designed to prevent water pollution and ensure the conservation of properties of natural mineral water and spring water inherent to the mining site. To ensure these requirements are met: 8.1 a natural mineral water and spring water catchment areas are protected from the threat of pollution, subject to the regulations of the safety requirements;
8.2. natural mineral water and spring water extraction and processing equipment, pipes, reservoirs and 8.4. those provisions referred to tanks made of materials suitable for water, which comply with the legislation on materials in contact with food, and uses it to prevent any chemical, physico-chemical or microbiological alteration of the water. Natural mineral water and spring water systems comply with the regulations on requirements for et seq;
8.3. natural mineral water and spring water extraction process (also holds detergent and water bottling equipment) comply with the hygiene requirements. 8.4. natural mineral water and spring water are transported in tanks designed for distribution to the ultimate consumer.

9. If the natural mineral water and spring water extraction site notes that water is polluted and no longer complies with this rule 17, 18, 19, 20 and 21 referred to in rules of microbiological contamination, food company immediately cease all operations until the cause of pollution is eliminated and the water will again meet these rules 17, 18, 19, 20 and 21 referred to in rules.
10. Natural mineral water and spring water extraction site allowed to process only the following: 10.1 to separate unstable elements, such as iron and sulphur compounds, by filtration or settling (decanting), or enriching with oxygen (oksigenēj), unless the processing does not alter the essential components of mineral water;
10.2. the separation of iron, manganese, sulphur and arsenic compounds for the treatment with ozone-enriched air if one treatment does not change the essential components of mineral water;
10.3. remove unwanted chemical compounds other than those mentioned in these regulations and in paragraph 10.1 10.2., such as fluoride, if one treatment does not change the essential components of mineral water. Processing is carried out in accordance with the Commission's February 9, 2010 Regulation (EU) No 115/2010 fixing the activated aluminum oxide for use in the natural mineral water and spring water treatment of fluoride (hereinafter referred to as Commission Regulation No 115/2010);
10.4. the separation of carbon dioxide (carbon) or reduce the contents with physical methods.
11. This provision 10. the requirements referred to in paragraph 1 shall not apply to natural mineral water and spring water when used as ingredients in soft drinks and other products.

15. Natural mineral water and spring water extraction site is not allowed to add any other substance, with the exception of carbon dioxide (carbon dioxide), as specified in this provision, 3.3 3.2 and 3.4.
16. Natural mineral water and spring water are not allowed any kind of processing and a disinfectant bacteriostatic add additives or any other treatment to change the viable colony count of the bacteria.
17. 21.2. the Escherichia coli and other coliforms, faecal streptococci in 250 ml of sample analysis;
21.3. sulfītreducējoš (Clostridi) the anaerobic micro-organisms and their spores in 50 ml of the sample analysed;
21.4. Pseudomonas aeruginosa in any 250 ml sample analysed.
22. Natural mineral water natural components may not exceed the maximum allowable concentration (annex 3). No natural substances or anthropogenic origin contaminants (pesticides, hydrocarbons and volatile organic substances) concentration in the natural mineral water shall not exceed the legal minimum of drinking water safety and quality requirements established maximum permissible norms.

24. Natural mineral water and spring water filled tanks, equipped with the sealing devices that prevent tampering with it or pollute.
25. Natural mineral waters and spring waters, in addition to other labelling regulations on food these requirements shall include the following information:

25.1. the trade name according to this provision, 3.1, 3.3 and 3.4 3.2. subparagraph ("natural mineral water", "naturally carbonated natural mineral water", "natural mineral water fortified with gas from the underground water deposits", "carbonated natural mineral water");
25.2. the trade name "spring water" according to this provision 3.5;
25.3. in addition to the mineral water trade name can be added "completely degassed (decarbonated)" or "partially degassed (decarbonated)" If natural mineral water has been exposed to this rule 10.4. treatment referred to in (a);
25.4. in addition to the sales description can be added "carbonated", if the source water has been subject to this provision as referred to in point 15;
25.5. in addition to the sales description, you can add "easy pop" when natural mineral water and spring water corresponds to the European Parliament and of the Council of 20 December 2006, Regulation (EC) No 1924/2006 on nutrition and health claims made on foods;
6. natural mineral waters essential components and their quantities. The essential ingredient quantity permissible limits of natural fluctuation in the marking complies with: 25.6.1. underground water deposits laid down in the passport in accordance with the laws and regulations of the national mineral deposits and their exploitation, as well as the use of the subsoils permission requirements for water in Latvia;
25.6.2. the third national groundwater mining documents – third countries laid down for water;
25.7. the terrain (the source or a borehole and underground water deposits);

28. If the production site is not the name used for natural mineral waters and spring waters in the catchment of the trade name, the name of the site or any content on the label material shall indicate in characters which are at least 1.5 times higher and wider than the largest letter trade name.
29. Natural mineral waters and spring waters in the labelling or in any information or advertising material it shall be prohibited to use labels, trademarks, merchant name, brand names, illustrations or other references, as well as symbols, which indicate the characteristics of the product which does not possess. These requirements specific to natural mineral waters and spring waters of natural origin, natural mineral water of attestation of conformity in the receipt date, the results of analyses or any similar references to guarantees its authenticity.
30. the word "mineral", "source" or "mineral-name" ("mineral-") is used only for natural mineral waters and spring waters in the name of trade, which meets the requirements of this regulation.
31. Natural mineral waters and spring waters, regulations on labelling, technical documents, instructions for use, promotional material and other information should not contain indications that natural mineral water and spring water, treating or preventing disease cures the disease.

III. Natural mineral waters distribution authorisation procedures 34. Latvia and third countries for natural mineral water distributed, if you have received a service provided with natural mineral water distribution permit (hereinafter licence).
35. in order to receive the permit, the company submitted the food service: 21.8. the application for authorisation (annex 6);
21.9. in Latvia the resulting natural mineral water – certificate of compliance attesting that the natural mineral water shall meet the requirements of this regulation. The certificate of conformity issued by a certification body accredited by the society with limited liability "the standardization, accreditation and Metrology Centre" according to laws and regulations and in accordance with standard EN 45011: en 2004 "General requirements for bodies dealing with product certification systems" and for which the limited liability company "standardization, accreditation and Metrology Centre ' has published information on its homepage on the internet (hereinafter referred to as the certification authority);
35.3. in third countries for natural mineral water: 35.3.1. the competent national authority the certificate of conformity to natural mineral water of the European Parliament and of the Council of 15 July 2009. directive 2009/54/EC on the exploitation and marketing of natural mineral waters, as well as proof of regular national surveillance in order to guarantee the security of these rules 8, 9 and 10 above requirements;

35.3.2. According to the European standardisation organisations or the International Organization for Standardization standard accredited conformity assessment bodies issuing the certificate of conformity for the compliance of the manufacturer with natural mineral water of the European Parliament and of the Council of 29 April 2004, Regulation (EC) No 852/2004 on the hygiene of foodstuffs and the requirements set out in these provisions.
36. In third countries for natural mineral waters of the period of validity of an authorization shall not exceed five years, in the light of the information set out in the certification authority issued the certificate of conformity. That term: 36.1. is extended, the permit is issued, if a food company for at least 30 days before the expiry date of the authorisation shall submit the application to the Department during the period of validity of the licence renewal and certification bodies of the natural mineral water in the conformity assessment;
36.2. is extended if the food company that rule 36.1. within the time limit specified in paragraph do not apply to the extension of the term of validity of the licence. For permission to post this rule 36.1 in the end of this period, the food service company that rule 35. documents listed.

38. in the light of the principle of mutual recognition, Latvia permitted to distribute source water that according to legislation produced in another Member State of the European Union or the European economic area country, or Turkey.
39. the service 30 days shall notify the European Commission of the authorisation or refusal to issue a permit in Latvia and in third countries for the dissemination of natural mineral waters.
40. as a Member State of the European Union or the European Commission's request, the service sends the information, on the basis of which the authorisation was granted, as well as the results of the monitoring carried out.
41. natural mineral water, which is authorized to distribute any of the European Union or the European economic area, the competent authority of the country of (natural mineral water is included in the official journal of the European Union published the list of natural mineral waters recognised), allowed to import and distribute freely.
42. certification body: 42.1. the certificate of conformity issued during operation, periodically monitored to natural mineral water comply with the requirements of this regulation. Certification authority issued the certificate of conformity indicates the frequency of monitoring;
26.2. immediately notify the service about the issue, stop for mineral water or cancelled the certificate of compliance and the reasons for the decision.
43. the food company's monitoring and inspection of documents, the certification authority may decide to: 43.1. natural mineral water, the suspension of the certificate of compliance if found non-compliance with the requirements of this regulation. Food company to resolve the conflict, the certification authority shall set a deadline for corrective action. If the time limit laid down in the decision to end food company has not carried out the corrective action and the certification authority shall submit in writing information on the prevention of infringements detected, the certification body shall decide on the revocation of the certificate of compliance;
43.2. natural mineral water, the cancellation of the certificate of conformity if found non-compliance with the requirements of these regulations that pose a threat to the health of consumers, as well as if you do not meet these rules 43.1. the requirements referred to in point.
44. If the certification authority has been revoked by the certificate of conformity Service decides to cancel the distribution of natural mineral water.
45. If the officers are found in natural mineral waters likely risk to human health or natural mineral water non-compliance with the requirements of the food, the service has the right to make decisions about this product limitation or prohibition of trade in the territory of Latvia, even if non-compliant water is of one of the Member States of the European Union issued a distribution permit. The service shall immediately inform the European Commission and the Member States of the European Union on the grounds of the decision and actions with an appropriate product.

IV. State fees for the issue of authorisation and the procedure for payment of the fee For the permit 47. State fee payable amounting to: 29.3. for authorizations – 100 lats;
47.2. a repeated issue of authorisation, in accordance with the provisions of section 36.1.-30.
48. A State fee shall be paid before the submission of the document for authorization.
49. A State fee shall be paid in one of the following ways: 30.5. service by using a payment card;
30.6. the credit institution or other financial institution that has the right to carry out money transfers (hereinafter referred to as the credit institution).
50. If the Department finds that rule referred to in paragraph 35 of the documents submitted do not conform to these terms and no licence shall be issued, the State fee shall not be refunded.
51. the national fee including State budget revenues.
V. concluding questions 52. Be declared unenforceable in the Cabinet of 23 august 2005, Regulation No 634 "rules on natural mineral waters and spring water minimum safety and labelling requirements, and procedures for issuing permits to distribute natural mineral water and covers the costs of service" (Latvian journal, 2005, 136, no. 210).

53.8.4. Those provisions referred to in rule does not apply to water source, if its production and transportation tanks from the bottling factory in Latvia is authorised and launched before the entry into force of these provisions and source water distributed in the territory of Latvia.
54. food companies, producing and transporting these rules referred to in paragraph 53 of the source water, comply with the hygiene requirements laid down in European Parliament and Council of 29 April 2004, by Regulation (EC) No 852/2004 on food hygiene.
55. Natural mineral water and spring water, which do not comply with these rules and requirements as to labelling referred to in packaged and labelled until 31 December 2011, Latvia permitted to distribute to its expiration date.
56. before the entry into force of rules issued permit is valid, if the natural mineral water shall meet the requirements set out in these provisions.
57. This provision, 47, 48, 49, 50 and 51 shall enter into force on January 1, 2011.
58. By 2010 31 December shall be borne by the food business with the authorization service expenses associated 56.87 lats (without value added tax).

2.11. If necessary, the water element, i.e. oxygen (16-18) and hydrogen (deuterium, tritium, a hydrogen atom), the relative amount of isotopes in the water.
3. information on the microbiological analysis of underground water deposits: 3.1 evidence that water does not contain parasites and pathogenic micro-organisms;
