Cabinet of Ministers Regulations No. 1210 Riga 2010 December 28 (Mon. 75. § 22) the rules on European railway interoperability of the system Issued under the law "on conformity assessment" of article 7 and article 43 of the Railway Act, the third part i. General questions 1. determines: 1.1. European rail system requirements for interoperability;
1.2. the European rail system interoperability constituents and the subsystems the essential requirements and their compliance monitoring mechanisms;
1.3. the order in which to market surveillance.
2. the terms used in the rules: 2.1. verification of the subsystem – subsystem testing procedure to certify that it complies with these rules and regulations of the railway sector regulatory requirements and may be put into service in the European rail system;
2.2. the rail network – the lines, stations, terminals and various types of stationary equipment needed to ensure safe and continuous operation of the trans-European rail system;
2.3. the existing railway system, the existing rail infrastructure (track and stationary equipment), as well as to the category and origin of any rolling stock on that infrastructure;
2.4. the designer – the person who designs the interoperability constituents or subsystems of the technical solutions used for the interoperability constituents or subsystems or maintenance;
2.5. the manufacturer-merchant who manufactures the interoperability components. The manufacturer may also be the designer;
2.6. interface-a set of functions of the subsystem that provides direct interaction with other subsystems to perform all the necessary operational and technical requirements;
2.7. interoperability of the rail system's ability to provide secure and uninterrupted train traffic, which allows to achieve the required level of permeability on the infrastructure concerned;
2.8. interoperability constituents – any item details group node or node, which is included in or is intended for inclusion in the subsystem and from directly or indirectly dependent on the European railway system interoperability. Interoperability constituents may be material things or materials (e.g., software). Interoperability components can also be applied to other sectors, but when used for railway purposes, those specific requirements;
2.9. the essential requirements-the conditions for the implementation of the European rail system, subsystems and interoperability constituents including interfaces (annex);
2.10. basic parameters-regulatory technical or operational conditions that affect the interoperability and are indicated in the relevant technical interoperability specifications;
2.11. the supervisory authority, the authority shall decide on placing the subsystem into the European railway system, as well as conduct market surveillance, to use only these provisions under the interoperability constituents. In Latvia, the supervisory authority is national railway technical inspection.
3. the requirements set out in these rules refers to the rules referred to in chapter II of the European rail system design, construction, operation, upgrading (subsystem or part of a remarkable conversion, which improves the overall performance of the subsystem), restoration (a subsystem or part subsystem significant replacement jobs that do not change the overall performance of the subsystem), operation and maintenance (preventive replacement of the interoperability constituents with the details that have identical functions and operational parameters) that are placed in service in accordance with the procedure laid down in these rules, as well as to the operating and maintenance staff involved in vocational training and staff health and safety conditions.
4. These provisions shall not apply to: 4.1 metros, trams and other commuter rail systems;
4.2. infrastructure that is functionally separated from the rest of the railway system and intended only for the local, urban or suburban passenger transport services, as well as railway operators, which work only in these rail networks;
4.3. private railway infrastructure, which is used only by the owner of your freight, as well as to the rolling stock when it is used only for the following infrastructure;
4.4. infrastructure and rolling stock used for tourism, preserved as a historical object, or used only for domestic purposes.
5. the rolling stock, which is in accordance with the provisions of paragraph 4 shall not apply the requirements of this regulation, or in accordance with the provisions of paragraph 78 does not apply to the technical specifications of interoperability requirements, allowed to use the provisions of the appropriate railway infrastructure.
6. compliance of an interoperability constituent requirements determined by the notified body, which will meet the requirements of chapter V of the rules. The notified body carries out the evaluation in accordance with the provisions of Chapter VI.
7. compliance with the essential requirements of the subsystem determines the notified body, which will meet the requirements of chapter V of the rules. The notified body shall carry out the verification in accordance with the provisions of Chapter VIII.
II. The European rail system 8. European rail system consists of European conventional rail system and the trans-European high-speed rail system.
9. the trans-European conventional rail system consists of a European rail network infrastructure that is not included in the trans-European high-speed rail system, and rolling stock designed for the use of such infrastructure.
10. in the light of the provisions of paragraph 4 and 78 in these conditions, the European conventional rail system shall include public-use railway infrastructure in the following railway line: 10.1. State border – girl – Jelgava – Riga – lugazˇi – State border;
10.2. Riga-Krustpils;
Jelgava-Liepaja 10.3;
10.4 the Jelgava-Ventspils;
Jelgava-Krustpils 10.5;
10.6. Jēkabpils-Rēzekne;
10.7. Jēkabpils – Daugavpils;
10.8.-Rēzekne-kārsava Daugavpils – eglaine – State border;
10.9. Daugavpils – Indra;
10.10. Rezekne-Zilupe.
11. the European conventional railway system interoperability infrastructure includes traffic management, tracking and navigation systems: technical installations for data processing and telecommunications intended for long-distance passenger and freight transport in the rail network and ensure the safe and coherent functioning and efficient traffic management.
12. the European conventional railway system also includes rolling stock. Rolling stock includes one or more structural and functional subsystems or parts of such subsystems.
13. the trans-European high-speed rail system included in the European rail network of lines and fixed installations, which built or upgraded it to the rolling stock for such infrastructure, they can move through the railway law.
14. the trans-European high-speed rail system includes traffic management, tracking, and navigation systems, data processing and telecommunications technical equipment intended for the carriage of these lines and ensure safe rail network and coordinated activities and efficient traffic management.
III. The subsystem 15. European rail system broken down into the following subsystems: 15.1. structural subsystems: 15.1.1. infrastructure;
15.1.2. energy supply;
15.1.3. the control-command and signalling;
15.1.4. rolling stock;
15.2. the functional subsystems: 15.2.1. traffic operation and management;
15.2.2. maintenance;
15.2.3. applications for passenger and freight services.
16. the infrastructure subsystem includes the track, points, engineering structures (such as bridges, tunnels), station infrastructure (such as platforms, zones of access, including equipment that the needs of persons with reduced mobility), safety and protective equipment.
17. Power supply subsystem includes the electrification system, including the overhead line and power supply device, situated on rolling stock.
18. The control-command and signalling subsystem shall include all the equipment necessary to ensure safety, as well as train traffic management, which allowed the use of the rail network.
19. The rolling stock subsystem shall include any equipment, structure and train control system, as well as traction and energy conversion units, braking, coupling mechanisms and the rolling stock (such as carts, axes), suspension, doors, man and machine interfaces (driver, on-board staff and passengers, including equipment needed for persons with reduced mobility), passive and active means of protection and accessories of passenger and train health staff.
20. Traffic and management subsystem includes the working techniques and equipment that provides different structural subsystems of coordinated action in the normal and smooth mode, including train driving, traffic planning and management, as well as the professional qualifications required for cross-border services.
21. use the remote subsystem include:

21.1. telematic applications for passenger services, including systems providing passengers with information before and during the journey, ordering and payment systems, luggage management and management of connections between trains, taking into account harmonization with other modes of transport;
21.2. telematics applications for freight services, including information systems (real-time monitoring of freight and trains), marshalling and allocation systems, ordering, payment and invoicing systems, management of connections with other modes of transport and production of electronic accompanying documents.
22. The maintenance subsystem includes the work practices, equipment to be used, logistics centres for maintenance and backup, which enables you to perform the required repairs and preventive maintenance to ensure the European railway system interoperability and the required permeability.
IV. Technical specifications for interoperability 23. Technical specifications for interoperability are in accordance with the laws of the applicable Rail rail interoperability technical specifications issued by the European Union in the field of the common transport policy, based on the Treaty on the functioning of the European Union and article 91.171, and published in the official journal of the European Union. Technical specifications for interoperability each subsystem or part subsystem is covered, and their goal is to meet the essential requirements and ensure the European railway system interoperability.
24. The interoperability technical specifications define the subsystems and interoperability constituents of the operational and technical characteristics, requirements and interactions with other subsystems. Each of the subsystems one technical specifications for interoperability. In some cases, the subsystem will be subject to a number of technical specifications for interoperability, as well as one of the technical specification for interoperability relating to subsystems.
25. The merchant or institution (for example, infrastructure manager, carrier, maintenance, or repair of the offender) that use the interoperability constituents or subsystems (hereinafter referred to as the user), a subsystem of the compliance with the interoperability technical specifications, which were in force on the date on which the subsystem was upgraded, renewed or put into operation.
26. each of the technical specification for interoperability in the State: 26.1. its scope (the rail network or portion of a rolling stock subsystem or part subsystem);
26.2. the essential requirements for each subsystem concerned and its interfaces with other subsystems;
26.3. the operational and technical requirements to be met by the subsystem and its interfaces with other subsystems (in some cases these requirements depending on the use of the subsystem is different);
26.4. the interoperability constituents and interfaces covered by European specifications. European specification is a common technical specification, a European technical approval or the applicable standard;
26.5. the procedures to be used in each specific case of conformity of the interoperability constituents or for assessing suitability for use, or for verification of the subsystems;
16.5. the staff of the professional qualifications and health and safety conditions at work required for the specific operation and maintenance of the subsystem, as well as the technical specification of interoperability;
16.6. the technical specification for interoperability relating to the introduction of the transitional periods.
27. in order to maintain the existing railway system interoperability for which technical specifications for interoperability are at risk due to the requirement of compatibility with the existing system, each technical specification for interoperability relating to time or permanently provides the special case with regard to the infrastructures and rolling stock. Special cases for interoperability technical specifications provided certain conditions depending to the loading gauge, the track gauge and distance between the tracks, as well as individual conditions of rolling stock that runs from countries which are not Member States of the European Union (hereinafter third countries), or to them. For each specific case of the technical interoperability specification defines this rule 26.3, 26.4, 26.5 and 26.7., 16.5. the requirements referred to in point terms.
28. where the separate technical interoperability specification contains a direct reference to the applicable European or international standards or specifications, as well as the European Railway Agency shall publish technical documentation, standards, specifications, technical documentation or parts considered relevant technical specifications for interoperability and the standards, specifications or technical documentation from becomes mandatory technical specifications for interoperability the date of application. If the standard, specification or technical documentation, technical specifications for interoperability include reference to other relevant laws of the Member States of the European Union technical documents used to develop the standards or specifications.
29. If the technical specification for interoperability is that enforcement of the essential requirements set out in open access, the relevant Member State of the European Union legislation, standards and regulations, technical documentation in notificēt by the European Commission. The national railway technical inspectorate shall publish on its homepage on the internet (www.vdzti.gov.lv) for information about accessing the above binding laws, standards and regulations with the technical documentation.
V. 30. Notified Body interoperability constituents and the subsystems for structural compliance with the requirements of this Regulation shall assess the conformity assessment bodies accredited by limited liability companies "standardization, accreditation and Metrology Centre" Latvian National Accreditation Bureau and on which the published notice in the Latvian National Accreditation Bureau homepage on the internet (www.latak.lv) (hereinafter referred to as notified body), as well as other Member States of the European Union notified body.
31. Limited liability company "standardization, accreditation and Metrology Centre ', taking into account the technical specifications for interoperability in specific requirements, the accredited notified body according to the following standards: 31.1.  EN 2004 EN 45011: "General requirements for bodies dealing with product certification systems" If the technical specification for interoperability provides the interoperability constituents or subsystems certification;
31.2. Lvs EN ISO/IEC 17020:2005 "the main criteria for the various types of bodies performing inspection", if the technical specification for interoperability provides the interoperability constituents or subsystems of the inspection;
31.3. Lvs EN ISO/IEC 17021: conformity assessment 2007 ". Requirements for bodies providing audit and management system certification ", if the technical specification for interoperability provides the interoperability constituents or subsystems of the quality management system assessment;
19.5. Lvs EN ISO/IEC 17025:2005 "the competence of testing and calibration laboratories-General requirements" If the technical specification for interoperability provides the interoperability constituents or subsystems testing or calibration.
32. The notified body shall be entitled to assess the interoperability constituents and the subsystems, if it meets the following criteria: 32.1. the institution is independent from all parties and only provide third-party services;
32.2. the body, its Director and the staff responsible for the interoperability constituents and the subsystems for conformity assessment procedures, not the interoperability constituents or subsystems of the designer, manufacturer, supplier, Installer, maintenance or user or authorized representative. Exchange of technical information between the manufacturer and its authorized representative or the importer is authorized;
32.3. the body, its Director and the staff responsible for the interoperability constituents and the subsystems for conformity assessment, is functionally independent of the authorities under these regulations shall take a decision on the entry into service of the subsystems of the authorities issuing the railway licence or security certificates, as well as of the authorities responsible for the investigation of accidents;
32.4. the institution provides its services to all interested parties. The services must not be affected by financial or other discriminatory conditions;

32.5. the institution itself carries out all the conformity assessment related to examinations and tests, or pass to one of the conformity assessment tests the service competent subcontractor, taking full responsibility for the results of the inspections;
32.6. the institution has sufficient funds and adequate technical equipment to enable it to perform properly the technical and administrative tasks connected with conformity assessment;
32.7. the institution has sufficient numbers of staff to enable it to carry out all procedures related to inspection activities;
20.4. the staff responsible for the interoperability constituents and the subsystems for conformity assessment and attestation procedures are: appropriate professional 32.8.1. and technical training;
32.8.2. sufficient knowledge of inspection procedures and experience in carrying out checks;
32.8.3. skills report, report, report and certificate in design;
32.8.4. knowledge of the interoperability constituents to be assessed and the production technology and subsystems, as well as for damages, which may occur during their use;
32.9. institutions staff remuneration does not depend on the amount of the checks or tests and results;
32.10. insure your institution has liability for the results of the work, which it is empowered to make;
32.11. the institution of protected property rights, and shall not disclose information which it has received, the conformity assessment with the exception of information that is required by the supervisory authorities to supervise and control the railway system of the interoperability constituents and the subsystems, or authorities responsible for the investigation of accidents.
Vi. compliance of an interoperability constituent 33. assessment of the interoperability constituent meets the essential requirements if it complies with the relevant technical specifications for interoperability in specific conditions or the European specifications developed to comply with these conditions.
34. Interoperability constituent conformity assessment shall be carried out by the notified body and the manufacturer or his authorized representative on the conformity assessment of the time, place and agenda.
35. Conformity assessment by notified body uses modules of conformity assessment procedures in accordance with the technical specifications for interoperability.
36. Where an interoperability constituent meets the requirements contained in these provisions, the notified body shall issue the manufacturer or his authorised representative of a conformity assessment certificate.
37. If the manufacturer or his authorized representative does not ensure interoperability constituent or component part of the compliance with the requirements of these provisions, it provides instead a person who offers interoperability constituents on the market, or the person made their own needs or to set up a different origin of the interoperability constituents or components or parts.
38. the Declaration of conformity certifies that the notified body has been evaluated by one particular component of the interoperability of effective compliance with relevant technical specifications or the suitability for use of the European rail system or evaluated the interface in relation to test (mostly functional) technical specifications.
39. In drawing up the Declaration of conformity, the manufacturer or his authorised representative shall apply the relevant interoperability technical specifications conditions laid down.
40. in order to prepare the Declaration of conformity for the interoperability constituent suitability for use, the notified body shall monitor the subsystem that is installed in the interoperability constituent, to evaluate (if the relevant technical specification for interoperability is a requirement) to its suitability for the intended railway system.
41. A declaration of conformity and the accompanying document shall be signed by the manufacturer or the manufacturer's authorized representative, officer, or person that the manufacturer or the manufacturer's authorized representative empowered to sign the Declaration of conformity and the accompanying documents (specify date of signing).
42. in the Declaration of conformity: 42.1. a reference to those rules, and information about relevant European Union directives;
26.2. the manufacturer and its authorized representative (if any) name or business name and full address;
26.3. Description of interoperability constituent (make, type, for example);
26.3. Description of the procedure followed in order to declare conformity or suitability for use;
26.4. all relevant characteristics that meet the interoperability constituents, in particular its conditions of use;
26.5. notified body (bodies) of the name, which participated in the conformity assessment procedure, as well as the conformity assessment certificate number, date of issue, expiry date (if applicable) and conditions;
26.5. reference to European specifications, if applicable;
26.6. the signatories of the Declaration message.
43. Where interoperability constituents are in addition to the requirements of this regulation are subject to other requirements of law, Declaration of conformity of the interoperability constituents or indicate compliance with these requirements.
VII. the use of the interoperability constituents and market surveillance 44. Interoperability constituents is allowed to offer the European Union's internal market, dispose of or put in use (against or without payment) for use in the European rail system if it complies with the essential requirements and the manufacturer or his authorised representative has drawn up a declaration of conformity. Interoperability components allowed to be marketed for use outside the European railway system.
45. the interoperability constituents of the trans-European rail system is used for the intended purposes, according to the installed and maintained.
46. where the subsystem is put into service before the appropriate technical specifications for interoperability, the entry into force of parts you can use interoperability components without this provision the procedures referred to in chapter VI.
47. If the interoperability technical specifications are intended for a transitional period for certain rail products as interoperability constituents that are placed on the market before the appropriate technical specifications for interoperability entered into force, the following components are considered to satisfy the requirements of this regulation.
48. The interoperability components the market supervision over the national railway technical inspection.
49. National Railway technical inspection according to the competence, shall take the necessary measures for the market and would be in operation only interoperability constituents that, according to the manufactured, maintained and used without risk of rail traffic safety.
50. National Railway Technical Inspectorate may not prohibit, restrict or hinder the interoperability constituents on the market, intended for use in the European rail system if they meet the requirements of this regulation. The national railway technical inspectorate may not require checks which have already been undertaken in the context of Chapter VI of this conformity assessment.
51. If the market surveillance according to the European Parliament and of the Council of 9 July 2008. Regulation No 765/2008/EC, setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93 (hereinafter Regulation No 765/2008), the national railway technical inspectorate finds that the Declaration of conformity has been drawn up improperly, the manufacturer or his authorized representative shall be required to restore the interoperability constituent to a State of conformity and to terminate the relevant declaration of conformity do not conform pursuant to national railway technical inspection requirements. If non-compliance persists, the national railway technical inspection pursuant to Regulation No 765/2008 requirements shall take a decision restricting or prohibiting the placing the interoperability constituent on the market.
52. If the market surveillance under Regulation No 765/2008, national railway technical inspectorate finds that an interoperability constituent covered by the Declaration of conformity and placed on the market, when used as intended, to meet the essential requirements, it is not of Regulation No 765/2008 requirements shall take a decision restricting or prohibiting the use of the interoperability constituents.
53. National Railway technical inspection for this rule 51 and 52 of the decision referred to in paragraph shall inform the Ministry of traffic, but the traffic Ministry – the European Commission, to the European Commission within reach of an interoperability constituent shall be the withdrawal from the market of the European Union.
VIII. verification of the subsystem

54. structural subsystems authorised to be put into service in the European rail system if they are designed, constructed, or produced and installed in accordance with the relevant technical specification for interoperability relating to the essential requirements has been drawn up and the Declaration of verification. Declaration of verification may be made on the merchant or public institution that contracts and orders the railway system, subsystem or part of the design, construction, manufacture, modernization or reconstruction (hereinafter referred to as the client), or the manufacturer as well as the customer or the manufacturer's authorized representative. The Subscriber can also be of the rail infrastructure, carrier, holder or user of the subsystems, as well as the concession holder, who is responsible for the commissioning of the project.
55. The notified body, the manufacturer, the customer or their authorized representative request subsystem verifies the application of technical specifications for interoperability (if any). If the technical specification of interoperability are not essential requirements or is set for open access, the notified body subsystem verifies the application of this rule referred to in paragraph 28 of the applicable legislation, standards and regulations, as well as technical documentation subject to the legislative requirements for the construction of the railway infrastructure and rolling stock construction, upgrading, repair, restore, on conformity assessment and acceptance of service.
56. When verifying a subsystem, the notified body will use the modules of conformity assessment procedures in accordance with the technical specifications for interoperability.
57. The notified body shall carry out all verifications of the subsystem, overall design phase started and cover the entire manufacturing period through to the acceptance stage before the subsystem is put into service.
58. The notified body shall carry out all the verification of the subsystem in General, evaluate the following subsystems subsystem creation stages: 58.1. subsystem design;
58.2. manufacture or construction of the subsystem (also civil engineering works, the interoperability constituent Assembly and adapted);
58.3. final testing of the subsystem before the subsystem is put into service.
59. in order to ensure that any individual design, manufacture or construction, the compliance of the subsystem with the requirements of these provisions, design (including the type tests), manufacture or construction, the manufacturer, contractor or their authorized representative may require from the notified body the individual design, production or construction phase. The manufacturer, the customer or his authorised representative choose a notified body, which may not be so notified body that carried out the verification of the whole entire subsystem. The notified body shall carry out an assessment and issue the manufacturer or his authorized customer representative intermediate Declaration of conformity required intermediate statements of verification for the design, construction, or production compliance with the requirements of this regulation. The manufacturer, the client or his authorised representative shall draw up interim Declaration of conformity of the subsystem's design, manufacturing, or construction phase. Intermediate Declaration of conformity accompanied by the appropriate documentation from the provisions referred to in paragraph 72 of the technical documentation.
60. For the subsystem at the design stage, the notified body shall assess the subsystem project technical documentation of compliance with the requirements of this regulation.
61. The subsystem manufacturing or construction, the notified body shall carry out the monitoring, to ensure that the subsystem created to comply with the obligation in accordance with the technical documentation.
62. The subsystem manufacturing or construction phase notified body employees have permanent access to building sites, production workshops, storage areas and, where appropriate, prefabrication or testing facilities and any of the territory they must be attending the performance of their duties. The manufacturer, the customer or their authorized representative notified body provides the necessary documents (e.g., the establishment plan of the subsystem and technical documentation).
63. The subsystem manufacturing or construction, the notified body shall carry out surveillance inspection (audit), in order to verify the conformity of the subsystem with the requirements of these regulations. The supervisory inspection (audit) report presents the persons performing the work. If necessary, the notified body shall request the presence of its representatives in certain stages of the work or production.
64. The subsystem manufacturing or construction phase notified body representatives may visit the worksite or to the production workshops. During such visits, they take full or partial supervision inspection (audit). The visit report or with the supervisory inspection (audit) report presents the persons performing the work.
65. The notified body shall carry out all the verification of the subsystem in General, take into account the intermediate statements of verification, if any, and before the issue of the certificate of verification checks: 65.1. subsystem is built in accordance with the relevant design and production intermediate statements of verification, issued to the manufacturer, the client or his authorized representative, if it has asked the notified body to assess the separate phases;
65.2. built in the subsystem meets all aspects of the design of the intermediate statements of verification, issued to the producer, the client or his authorized representative, if it has asked the notified body only for the design be evaluated separately;
65.3. the compliance with the technical specification of interoperability requirements and assesses the design and production stages of construction or that are not included in the design and construction of production or intermediate verification certificates.
66. The notified body before the subsystem is put into the trans-European rail system, conducted a final verification of the subsystem – subsystem interfaces verify with the railway system, which is included in the subsystem. The test is carried out on the basis of the information available in the technical specifications for interoperability, as well as the infrastructure and rolling stock registers.
67. where the subsystem meets the requirements contained in these provisions, the notified body shall issue to the manufacturer, the customer or their authorized representative Declaration of verification of the required certificate of verification.
68. The notified body responsible for that provision referred to in paragraph 72 of the compilation of the technical file. The technical documentation includes papers on the subsystem parameters (if necessary, the documents certifying conformity of the interoperability constituents of the requirements laid down in these rules), the use of the subsystem, under the conditions and within the limits as well as servicing, constant or routine monitoring, adjustment and maintenance instructions. The technical documentation shall be referred to the manufacturer, the client or his authorized representative, together with the certificate of verification. Certificate of verification without the technical file is not valid.
69. the manufacturer, or his authorized customer representative shall draw up a declaration of verification on the basis of which a decision will be made on the acceptance into service of the subsystem. In drawing up the Declaration of verification, the manufacturer, the customer or his authorised representative shall apply the relevant interoperability technical specifications conditions laid down.
70. the Declaration of verification and the accompanying documents shall be signed by the manufacturer, the customer or their authorized representative, officer, or person whose manufacturer, contractor or their authorized representative empowered to sign the Declaration of verification and the accompanying documents (specify date of signing).
71. the Declaration of verification of claims: 71.1. reference to these rules and of the relevant European Union directives;
71.2. the manufacturer, or the Subscriber, as well as their authorized representative (if any) name or business name and full address;
71.3. brief description of the subsystem;
71.4. notified body which carried out the verification of the subsystem;
71.5. the technical documentation shall include a list of the documents;
71.6. all the relevant provisional or definitive conditions which must be met by the subsystem, as well as, where appropriate, any operating restrictions or conditions;
71.7. period of validity of the Declaration, if it is limited;
44.6. message of the Declaration's signatories.
72. the Declaration of verification accompanied by the technical documentation following: 72.1. for infrastructure-building plans, plans excavation excavations and reinforcement of the reception and transmission of acts, concrete testing and inspection, as well as other information that describes the infrastructure;

72.2. for other subsystems-overview drawings and detailed drawings in line with execution, electrical and hydraulic diagrams, control-circuit diagrams, description of data-processing and automatic systems, operating and servicing, constant or routine monitoring, adjustment and maintenance instructions, as well as other information that describes the subsystem;
72.3. subsystem included a list of the interoperability constituents;
72.4. subsystem interoperability constituents included a copy of the Declaration of conformity and, if necessary, the corresponding calculation notes and a copy of the Protocol for the trials and tests carried out by the notified bodies on the basis of the common technical specifications;
72.5. intermediate statements of verification (if any) and the construction of intermediate subsystem conformity declaration together with the certificate of verification, as well as data on notified bodies the results of the verifications with respect to intermediate statements of verification of conformity;
72.6 at. notified body certificate of verification issued (along with the corresponding calculation notes), approved by signature and stating that the project complies with the requirements of this Regulation (mentioning any reservations arising from work at the time and still not withdrawn). Visits are attached to the certificate of inspection and monitoring (audit) reports drawn up by the notified body in accordance with the provisions of paragraph 63 and 64.
73. Documentation and correspondence form in relation to the verification procedures of the Member State of the European Union, as the producer or a Subscriber, or in a language accepted by the manufacturer or by the Subscriber.
74. If the technical specifications for interoperability allows, the notified body may issue verification certificates or certificates of conformity of the subsystem with the series or the parts of the subsystem.
75. The notified body must periodically publish your website on the internet for information about: 75.1. verification of the applications received;
75.2. intermediate statements of verification issued;
75.3. refusal to issue a intermediate statements of verification;
75.4. verification certificates issued;
75.5. refusal to issue a certificate of verification;
refusal to issue a 75.6. certificate of compliance.
76. the user declaration of verification and the technical documentation throughout the service life of the subsystem. On request presented to the supervisory authority.
IX. Decision concerning a technical specification for interoperability relating to the application of the specific project 77. at least one month before the planned construction of the subsystem, the renewal or upgrading, the initiation of the manufacturer, the customer or authorized person shall present him the national railway technical inspection planned the construction of the subsystem, the renewal or upgrading of technical tasks of the project documentation.
78. National Railway technical inspection of the construction of the subsystem the appearance, renewal or modernisation project technical documentation tasks and, taking into account the relevant technical specification for interoperability requirements laid down in the implementing conditions, shall decide on the conditions for the adoption of the subsystem into service, indicating the specific subsystems for the construction, reconstruction or modernisation, the applicable technical specifications for interoperability or parts thereof. Where the renewal or upgrading works will not affect the overall security of the subsystem level, national railway technical inspection shall take a decision not to consider the re-employment of the subsystem into service.
79. This provision of the decision referred to in paragraph 78 of the manufacturer and the customer when conducting a specific subsystem of the construction, renewal or modernisation.
80. The adoption of the rules referred to in paragraph 78 of the decision, the national railway technical inspection shall take a decision not to apply the provisions of Chapter VIII and X: 80.1. the subsystems that construction or modernisation of the proposed before the technical specification of interoperability, as well as the entry into force of any subsystem that the technical specifications for interoperability at the date of entry into force of the end stage of development or the subject of a contract that is already filled;
80.2. projects, an existing subsystem of renewal or upgrading, if infrastructure parameters (dimensions, track width, the distance between the tracks, or electrical voltage) to the corresponding interoperability technical specifications are not compatible with the existing parameters of the subsystem;
49.9. projects, an existing subsystem, the renewal, extension or upgrading, if appropriate the technical specification of interoperability application threatens the economic viability of the project or the compatibility of the existing rail system;
80.4. If, after an accident or a natural disaster, for economic or technical reasons, the rail network renewal conditions do not allow for partial or total application of the relevant technical specifications for interoperability;
80.5.1520 mm track width for the rail network rolling stock which is used or is intended to be used for transport to and from third countries.
81. After receipt of the documentation of the technical task of national railway technical inspection for each instance that matches this rule 80. criteria referred to in paragraph 1, collects and sends traffic to the Ministry the following: 81.1. work, object and a description of the services provided for exceptions. The description shall specify the key dates, the geographical location as well as functional and technical areas;
81.2. a precise reference to the technical specification for interoperability (or parts) for which a derogation;
81.3. detailed reference and details of the alternative provisions and technical specifications intended to be applied;
81.4. evidence that the project is in the development stage, if the project meets these rules 80.1. the criteria referred to in (a);
exceptional grounds, 81.5. specifying the technical, economic, commercial, operational and administrative reasons;
81.6. other documents (if any) which justify the derogation;
81.7. Description of the measures planned to implement the project to promote the interoperability of its final stage. If exceptions are minimal, this description is necessary.
82. The Ministry of transport that the send the information referred to in paragraph 81 of the European Commission.
83. If the project complies with this provision or section 80.4.80.1. the criteria referred to in the national railway technical inspection shall take a decision not to apply this provision the project VIII and chapter X of the European Commission before the response is received. Following the European Commission's response (if one is received) in the national railway technical inspection shall send the customer to the manufacturer or his authorised person decision on additional conditions to the project, the European Commission prepared recommendations concerning the technical specification for interoperability. The manufacturer, or his authorized customer person operating pursuant to this provision, the information specified in point 81, taking into account the national railway technical inspection decision on additional conditions to the project (if it is received).
84. If the project meets this rule 80.5 80.2, 49.9. or. criteria referred to in the national railway technical inspection of the final decision on the rules of Chapter VIII and X of the non-application of the project shall be made only after the European Commission's affirmative response from you. If within six months after this rule 82, paragraph request was submitted to the European Commission, no reply has been received, the request shall be deemed approved.
85. National Railway technical inspection this provision 78. the decision referred to in paragraph 1 shall adopt the administrative procedure law. 85.4. If necessary, information about the postponement of the final decision to the coordination with the European Commission this provision in paragraph 84.
X. subsystem commissioning a European railway system and the monitoring of structural subsystems 86. European rail system allowed to operate only after its commissioning in accordance with the procedure laid down in this chapter.
87. The rolling stock shall adopt laws and regulations in the operation of the rolling stock construction, upgrading, repair, restore, on conformity assessment and acceptance of service.

88. To pass into a structural subsystem, excluding rolling stock manufacturer, the customer or a person authorised by the national railway technical inspection shall be: 88.1. Declaration of verification of the subsystem and technical documentation, which is also a proof of the compatibility of subsystems with 1520 mm track width;
88.2. if subsystem or part thereof shall also apply to laws and regulations of the railway, the-… documentation showing compliance with the requirements of these regulations;
88.3. information on the procedures that will ensure the use of the subsystem, servicing and maintenance in order according to the essential requirements.
89. National Railway technical inspection before the subsystem is put into service, check: 89.1. documentation provided;
89.2. the safe into the subsystem user security management system according to the European Commission 24 April 2009. Regulation No. 352/2009/EC on the introduction of common security methods for the detection and assessment of the risk in accordance with European Parliament and Council Directive 2004/49/EC article 6 paragraph 3 "a";
89.3. subsystem technical compatibility with the system in which it is included;
89.4. compliance with the technical specification of interoperability rules for the operation and maintenance of the subsystems.
90. National Railway Technical Inspectorate may not prohibit, restrict or impede the creation of structural subsystems, commissioning and use, if they comply with the essential requirements and the rules referred to in paragraph 89 of the test results confirms the structural conformity of the subsystem with the requirements of this regulation.
91. National Railway Technical Inspectorate may not require checks which have already been made: 91.1. in connection with the verification of the Declaration of acquisition of these rules prescribed in Chapter VIII;
91.2. other Member States of the European Union, if verified compliance with the identical requirements under identical operating conditions.
92. National Railway technical inspection is entitled at any time to get information from notified body for: 57.2. verification of the applications received;
92.2. intermediate statements of verification issued;
92.3. refusal to issue a intermediate statements of verification;
the certificate of conformity issued 92.4.;
92.5. certificate of conformity issued denials.
93. where the subsystem meets the requirements of these regulations, the national railway technical inspectorate shall decide on placing the subsystem into the European railway system.
94. for placing the subsystem into the European railway system in the national railway technical inspectorate shall publish on its homepage on the internet (URwww.vdzti.gov.lv).
95. the subsystems put into operation under the supervision of the national rail competence of technical inspection, monitoring subsystem user security management system for the safety certificate or a safety authorisation. The national railway technical inspection used in legislation, as well as the relevant structural and functional interoperability technical specifications set out in the assessment and verification procedures.
96. If the railway technical operation control and supervision according to law, the rail subsystem during the national railway technical inspectorate finds that a structural subsystem covered by the Declaration of verification accompanied by the technical file does not fully meet the requirements of this regulation which does not meet the essential requirements, it shall prohibit the entry into service of the subsystem and requires further testing.
97.96. These provisions in the case referred to in paragraph national railway technical inspectorate shall immediately inform the Ministry of transport of any additional checks requested and set out, giving their reasons. The national railway technical inspection indicates whether or not the requirements of the rules or any of the essential requirements creates the technical specifications for interoperability failure or technical specification of interoperability does not meet the essential requirements.
98. The Ministry of transport shall report to the European Commission of the non-compliance found and the measures taken to address it, the Member States of the European Union in which the person who prepared the Declaration of verification, and to request the Member State to take the appropriate measures.

1.3. health: 1.3.1. rolling stock and railway infrastructure materials may not be used, which can pose a health threat to people who come in contact with them;
1.3.2. the rolling stock and railway infrastructure materials must be selected, deployed and used in such a way as to restrict the emission of harmful and dangerous fumes or gases, particularly in the event of fire;
1.4. environmental protection: 1.4.1. designing the system, assess and take account of the European rail system and the operational impact on the environment; 1.4.2. the rolling stock and infrastructure use materials that prevent the environmentally destructive and dangerous fumes and gases, for example, if a fire;
1.4.3. the design and manufacture of rolling stock and the energy supply system, ensure electromagnetic compatibility with the installations, equipment and public or private communication systems in order to avoid mutual interference;
1.4.4. operation of the trans-European rail system, comply with the noise control requirements;
1.4.5. operation of the trans-European rail system in a normal state of maintenance should not give rise to an inadmissible level of ground vibrations for the activities and areas close to the infrastructure;
1.5. technical compatibility: 1.5.1 provides the infrastructure and fixed installations of the mutual compatibility of technical parameters, as well as compatibility with the use of the European rail system rolling stock;
1.5.2. If the individual stages of the railway network technical compliance with specifications is difficult, may be used to provide temporary solutions, which ensure compatibility in the future.
2. Special requirements for each subsystem: infrastructure: 2.1 2.1.1. safety: 2.1.1.1. take measures to prevent access to the equipment and to prevent arbitrary access to them;
2.1.1.2. take measures that reduce the risk to people, such as the trains running through the station;
2.1.1.3. public infrastructure objects and constructed so as to reduce any danger to the safety of persons (such as stability, fire, access, evacuation);
2.1.1.4. take account of the particular safety conditions in very long tunnels for movement;
2.2. energy supply: 2.2.1. Security. Operation of the energy-supply systems must not impair the rolling stock or of persons (passengers, staff, residents and third parties);
2.2.2. protection of the environment. Electrical or thermal energy-supply systems must not cause damage to the environment in excess of the level;
2.2.3. technical compatibility: 2.2.3.1. use electrical and thermal energy system provides the traction rolling stock specific power indicator;
2.2.3.2. the electric power supply system ensures compatibility with the traction rolling stock set power stripping;
2.3. control equipment and alarm: 2.3.1 safety:

2.4.1.2. the maintenance and the frequency of operation, maintenance and control centre staff training and qualification, as well as the quality management system implemented by the operators concerned in the control and maintenance centres, ensure a high level of safety;
2.4.2. reliability and uptime. The maintenance operations and intervals, the maintenance and control centre staff training and qualification, as well as the quality management system implemented by the operators concerned in the control and maintenance centres to ensure a high level of system security and integrity;
2.4.3. technical compatibility. Operating rules of the railway network, the level of harmonisation and traction drivers (driver), train staff and train management control centre staff qualifications provide a European railway system operational effectiveness, bearing in mind the different requirements of cross-border and domestic services;
2.5. rolling stock: 2.5.1. Security: 2.5.1.1. the rolling stock and the construction of a connection designed so as to protect the passenger and driving traction (the engineer) partitions of the rolling stock in the event of a collision or if rolling off the Rails;
2.5.1.2. electrical equipment must not interfere with the control and command and signalling equipment safety and performance;

2.6.2. reliability and uptime. Databases, software and data communication protocols of use, management, updating and maintenance techniques guarantee the efficiency of these systems and the quality of services;
2.6.3. the health protection. Remote control system and user interface meets at least the minimum of ergonomics and health protection requirements;
2.6.4. safety and security. Storage or transmission of safety-related information, comply with the appropriate requirements for information security and safety;
2.7. maintenance: 2.7.1. health and safety. Ensure that the maintenance of technical equipment and the Centre of relevant working methods guarantee the safe operation of the subsystem and not to endanger the health and safety of people;
2.7.2. the protection of the environment. The technical installations and the procedures used in the maintenance centres must not cause any damage to the environment in excess of the level;
2.7.3. technical compatibility. The rolling stock maintenance facility capable of providing the security, hygiene and comfort measures for any rolling stock, for which it is intended.
