Cabinet of Ministers Regulations No. 1211 Riga 2010 December 28 (Mon. No 75 23. §) rules for rolling stock construction, upgrading, repair, restore, on conformity assessment and acceptance of service Issued under the Railway Act, the second paragraph of article 36.1 and law "on conformity assessment" 7. the first paragraph of article 1 General questions 1. establishes the essential requirements of the rolling stock and the compliance monitoring mechanisms, rolling stock construction, modernization, repair and restore the conformity assessment procedures and arrangements in which the rolling stock is taken into service.
2. Rolling stock accepted into service before its entry into service in Latvia.
3. Rolling stock authorised to offer to dispose of the Latvian market – or put in use (against or without payment) for use in the railway system if it complies with the requirements of this regulation.
4. the rules do not apply to: 4.1. another Member State of the European Union registered a 1520 mm track width railway network intended for vehicles used in international transport from countries which are not Member States of the European Union (hereinafter third countries), and to them, if it does not offer the Latvian market;
4.2. in third countries established in 1520 mm track width for the rail network rolling stock, if it does not offer the Latvian market and if the owner of the rolling stock and the user is the third country to a natural or legal person, as well as rolling stock used in international transport from and to third countries.
5. before rolling stock construction or modernisation (conversion works that adopt these rules specified in annex 1 to the rolling stock subsystem changes that change the Basic or it) started rolling stock manufacturer, the reviewer of the modernisation or construction of rolling stock and modernisation of the customer, or their authorized person submitted the national railway technical inspection of the project technical documentation tasks and receives from its decision on the technical specifications for interoperability relating to the conditions of application of the legislation on the European railway system interoperability in accordance with the procedure laid down as well as the conditions of the rolling stock type, series, or model (hereinafter referred to as the type of rolling stock) acceptance into service according to the requirements of this regulation. On the modernization of the rolling stock shall be deemed an action that changes the provisions included in annex 2 of the Act on railway rolling stock acceptance into service of the type listed in part 6 of the rolling stock of basic parameters of type raksturojošo.
6. Rolling stock, who built or upgraded to one of the conformity assessment body for rolling stock type issued certificate of conformity, is considered appropriate for one type of rolling stock.
7. Rolling stock construction or modernization is carried out in accordance with the provisions of Chapter 2 requirements.
8. If the relevant interoperability technical specifications include requirements for rolling stock and no specific exceptions in the building and upgrading of rolling stock which meets all the technical specifications for interoperability (hereinafter TSIs suitable rolling stock), the law on the system of the European railway interoperability down conformity assessment procedures.
9. The rolling stock, which does not comply with all the relevant technical specification for interoperability (including rolling stock, subject to the exceptions and technical specifications for interoperability or parts thereof do not apply) (hereinafter referred to as the TSI rolling stock irrelevant), conformity assessment shall be carried out in accordance with the laws and regulations of the European rail system interoperability accredited notified body (notified body), which is included in the scope of accreditation of conformity assessment of compliance with the essential requirements of the established interoperability technical specifications regarding open access and in special cases, the applicable national requirements and to be applied in accordance with the laws and regulations of the European rail system interoperability.
10. The notified body shall assess all technical interoperability specifications and this provision is included in annex 1 to the rolling stock subsystem in compliance with the requirements set out in the technical interoperability specifications and regulations on the European railway system interoperability in those binding laws, standards and regulations in the technical documentation.
11. If these provisions are not certain other requirements, the notified body shall carry out the conformity assessment of the rolling stock according to the technical specifications for interoperability in the conformity assessment procedures laid down in the modules. If the desired type does not have rolling stock of existing technical specifications for interoperability, conformity assessment carried out for the type of rolling stock together with the rolling stock unit verification.
12. A newly or first market (hereinafter referred to as new) or upgraded rolling stock type in the national railway technical inspection shall adopt these rules accordingly in the operation Chapter 3 requirements. 16. 2. The rolling stock construction, modernisation and conformity assessment 18. Rolling stock construction or modernization is carried out in accordance with the tasks provided for in the project technical solutions, subject to the technical specifications for interoperability and rail regulations, as well as taking into account the provisions of paragraph 5 of the said national railway technical inspection decision on the technical specifications for interoperability relating to the conditions of its application.
19. before the construction of rolling stock and modernisation of the launch of the manufacturer, the reviewer of the modernisation or construction of rolling stock and modernisation of the customer, or their authorised person selects the notified body to carry out the construction of rolling stock and modernisation of conformity assessment.
20. The notified body chosen by the construction of rolling stock and modernisation of the conformity assessment, job initiate the design phase and continue to do so all the buildings and the modernisation of rolling stock up to commissioning.
21. The notified body chosen by the construction of rolling stock and modernisation of the conformity assessment, carried out in the following stages: 21.1. rolling stock construction or modernisation of design;
21.2. the rolling stock construction or modernization;
21.3. the rolling stock of the final examination before commissioning.
22. the notified body shall evaluate the construction of rolling stock and modernisation of the technical documentation of the project and the compliance with the technical specification for interoperability and binding legislation, standards and regulatory requirements of the technical documentation, as well as the newly built or upgraded rolling stock conformity of the sample project and technical documentation. If rolling stock meets these requirements, the notified body shall issue a type of rolling stock conformity certificate. In the event of non-compliance the notified body shall refuse the issuance of the certificate of compliance, giving reasons for its decision, as well as inform the public about the railway technical inspection of such decision.

23. the number of identical units of rolling stock construction or upgrade to one of these rules referred to in point 22 of the type of rolling stock conformity certificate, the notified body shall assess each compliance unit rolling stock the rolling stock type of the certificate of compliance. In this case, the rolling stock manufacturer, the reviewer of the modernisation or construction of rolling stock and modernisation of the country's principal railway technical inspection without requiring that the decision referred to in paragraph 5.

3. the type of rolling stock acceptance into operation 3.1 General requirements 25. before new or upgraded rolling stock accepted for commissioning into service of rolling stock type.
26. the type of rolling stock can be put into service if: 26.1. types of rolling stock are prepared technical documentation (annex 4) which describes the structure of the rolling stock, technical characteristics, as well as maintenance and repair programs. The technical documentation shall include all interoperability technical specifications or these rules specified in annex 1 to the rolling stock subsystem description.
26.2. rolling stock complies with the laws and regulations governing the railway technical operation;
26.3. rolling stock meets specific rolling stock for the solution of the project;
26.4. rolling stock meets its place of use railway infrastructure, power supply, signalling and traffic management system, the track width and the maximum permissible axle load;
26.5. rolling stock have been made for the trial, including the test drive on the rail infrastructure.
27. The rolling stock owner, user, producer, performer of the modernisation, the client or his authorized person (hereinafter applicant) requested from the public railway infrastructure manager's opinion on the conformity of the rolling stock it infrastructure. If the rolling stock are not intended for public use railway infrastructure, the applicant an opinion on the conformity of the rolling stock of the railway infrastructure requires the private use of the rail infrastructure, where infrastructure and rolling stock to be used.
28. where the applicant and the railway infrastructure manager are the same person, this provision of paragraph 27 of that opinion is not required.
29. the infrastructure manager shall, in agreement with the applicant, within three months after receipt of the request by the applicant for carrying out the checks and provides an opinion.
30. the infrastructure manager, in its opinion on the conformity of the rolling stock for rail infrastructure the infrastructure indicates the stations where the rolling stock can be used.
31. According to the TSI rolling stock type be adopted into service in accordance with this rule 3.1. and 3.2 or 3.3 subdivision requirements.
32. the TSIs shall not be an appropriate rolling stock type be adopted into service in accordance with this rule 3.1 and 3.4 or 3.5. subdivision requirements.
33. the type of rolling stock To be accepted into the applicant: 33.1. be submitted to the national railway technical inspection application, adding that rule 4. technical documentation referred to in the annex and this provision referred to in paragraph 27 of the rail infrastructure for its opinion on the conformity of the rolling stock, infrastructure, as well as other documents specified in this section;
33.2. the above agreement on time and space, exhibiting the national railway technical inspection of rolling stock for the type of rolling stock unit, which has performed the tests.
34. National Railway technical inspection on SITE according to the type of rolling stock acceptance into service of the administrative procedure shall be adopted in accordance with the procedure prescribed by law. The decision may be renewed: 34.1. for two months from 48. these provisions or paragraph 54 of the date of receipt of the dossier;
21.3. about one month from the national railway technical inspection of the information requested, the risk analysis or test results received, if national railway technical inspection has requested additional information, the risk analyses or the tests.
35. National Railway Technical Inspectorate decision of non TSI rolling stock type acceptance into service of the administrative procedure shall be adopted in accordance with the procedure prescribed by law. The decision may be renewed: 21.8. about four months from this rule 57, 58, 62 or 63. referred to the date of receipt of the dossier;
35.2. about two months of national railway technical inspection of the information requested, the risk analysis or test results received, if national railway technical inspection has requested additional information, the risk analyses or the tests.
36. If national railway technical inspection shall take a decision on the refusal to accept the type of rolling stock in service, the reasons for its decision and notify the applicant.
37. the decision on the type of rolling stock acceptance into the national railway technical inspectorate may suspend the review: 37.1. rolling stock user security certificate in accordance with the legislation on the security certificate issue of parts A and B, cancellation and suspension procedures and criteria;
37.2. the rolling stock user security certificate in accordance with the laws and regulations on security of issue of the licence, cancellation and suspension procedures and criteria.
38. National Railway technical inspection, the decision on the adoption of the type of rolling stock into service or refusal to accept the service, an applicant may contest the National Rail Administration in administrative procedure law.
39. In considering the application for the national railway technical inspection, redress before the National Railway Administration may izprasī the opinion of the European Railway Agency. The European Railway Agency received the opinion of the national railway administration shall notify the applicant and the railway technical inspection. Application for the national railway technical inspection of redress before the National Railway Administration examined and appropriate decisions shall be adopted by the administrative process law. The timescale for a decision, if necessary, may be extended by two months from the date of receipt of the application. The National Rail Administration's decision, the applicant may appeal to the Court of Justice of the administrative procedure law.
40. If national railway technical inspection this rule 34 and 35 the time limit referred to in paragraph has not acted, the type of rolling stock is considered accepted and the operation after three months from the adoption of the decision provided for the end of the period specified in the application is allowed, the infrastructure for which the time limit laid down in the decision is taken. 41. If the technical specifications for interoperability or statutes, on the basis of which the rolling stock type was taken into operation, is changed, the national railway technical inspectorate assesses the impact of the changes on the operation of the rolling stock type.
42. If the technical specification of interoperability or legislative changes affect this provision set out in annex 1. the rolling stock type the basic parameters and the type of rolling stock no longer meets the technical specification for interoperability and legislative requirements, the national railway technical inspectorate Act on administrative procedures shall be adopted in accordance with the procedure laid down in general administrative act, indicating the time limit within which to adopt into this type of rolling stock the rolling stock units. The national railway technical inspection in this administrative act indicates that provision referred to in paragraph 41 of the evaluation results, as well as publish that information on its homepage on the internet (URwww.vdzti.gov.lv).
43.42. these provisions after the expiry of the period referred to in paragraph repeatedly passed into the type of rolling stock, the applicant reiterated the national railway technical inspection application, adding assurances that the provisions referred to in paragraph 41 of the changes have been considered. In this case, the national railway technical inspectorate checks only the parameters that affect the change in the technical specifications for interoperability or laws.
44. This provision, paragraph 42 national railway technical inspection issued general administrative act shall not affect decisions on the acceptance of the rolling stock units into service, which was adopted on the basis of the above the rolling stock operation type.

45. National Railway technical inspection, the decision on the adoption of the type of rolling stock into service shall not affect the fulfilment of requirements for the use of rolling stock, which laid down the law about the security certificate issue of parts A and B, cancellation and suspension procedures and criteria, as well as legislation on security of issue of the licence, cancellation and suspension procedures and criteria.
46. Information on the rolling stock in operation types national railway technical inspectorate shall publish on its homepage on the internet (URwww.vdzti.gov.lv).
3.2. under the TSI rolling stock acceptance into operation that has never been accepted into other Member States of the European Union 47. the subdivision requirements apply according to the TSI rolling stock that have not previously been taken into service in another Member State of the European Union, and complies with all relevant interoperability technical specifications that are in force on the date on which the rolling stock type is assumed.
48. The applicant, submitted to national railway technical inspection of these rules 33.1. application referred to, shall attach the following information: 29.9. technical documentation according to the legislation on European railway interoperability of systems;
48.2. subsystem rolling stock and its declarations of conformity according to the European legislation on rail interoperability of systems;
48.3. the notified body in the conformity assessment certificate issued and receipts;
30.1. the declarations of conformity and certificates on technical and operational characteristics that indicate conformity of the rolling stock, infrastructure and fixed installations, including climate conditions, energy supply system, management control and signalling system, track gauge and infrastructure gauges, maximum permitted axle load and other constraints of railway infrastructure;
30.1. If 1520 mm track width for railway rolling stock also wants to use the carriage to and from third countries, the attestations of the relevant third country requirements.
49. National Railway Technical Inspectorate shall decide on the acceptance of the rolling stock of the type into service in the following order: 30.5. If all the rolling stock subsystem are adopted for structural operations according to the laws and regulations of the European rail system interoperability, the decision on the acceptance of the rolling stock type into accepting, without any further checks;
30.6. where the rolling stock is composed of all the legislation on the European railway system interoperability verification as provided for in the Declaration, the decision of the national railway technical inspection shall verify: 49.2.1. subsystem rolling stock the mutual compatibility;
49.2.2. rolling stock safe inclusion in the user's security management system according to the European Commission 24 April 2009. Regulation No. 352/2009/EC on the introduction of common security methods for the detection and assessment of the risk in accordance with European Parliament and Council Directive 2004/49/EC article 6 paragraph 3 of the section "a" (hereinafter referred to as Regulation No. 352/2009);
49.2.3. the technical conformity of the rolling stock on the railway infrastructure;
49.2.4. If the interoperability technical specifications for certain essential requirements of open access,-notified body issued assurances of compliance in such cases, the applicable documentation;
49.2.5. notified body provided assurances on compliance with the relevant technical specifications for interoperability in specific cases, provided the applicable legislative requirements.
50. in order to verify this rule 30.6. criteria referred to in the national railway technical inspectorate may ask for additional information on risk analysis in accordance with Regulation No. 352/2009 or for carrying out the appropriate railway infrastructure. The national railway technical inspectorate after consultation with the applicant, determine the required additional information, risk analyses and tests amount and content.
3.3 according to the TSI rolling stock acceptance, commissioning, adopted into other Member States of the European Union 51. these requirements apply to the subdivision according to the TSI rolling stock accepted into service in another Member State of the European Union, and complies with all relevant interoperability technical specifications that are in force on the date on which the rolling stock type is assumed.
52. If the TSI compliant rolling stock was taken into service in another Member State of the European Union, the adoption of the type of rolling stock in service in Latvia to apply that rule 54, 55 and 56 of the procedure laid down in paragraph 1, except those provisions referred to in paragraph 53.
53. If the TSI rolling stock in accordance with adopted into another Member State of the European Union will move only through interoperability technical specifications fully compliant infrastructure, rolling stock do not require additional rolling stock type acceptance into service in Latvia. In this case, the owner of the rolling stock or user before commissioning of the rolling stock shall be submitted to the national railway technical inspection information on rolling stock to identify rolling stock and indicating the country in which the type of rolling stock was taken into service.
54. The applicant, submitted to national railway technical inspection of these rules 33.1. application referred to, shall attach the following information: 54.1. documents certifying that the TSI rolling stock according to the type of use is authorised in another Member State of the European Union;
54.2. declarations of conformity and the technical documentation according to the regulations on the European railway system interoperability. When rolling stock is equipped with reģistrētājierīc, the data contain information on the data collection procedure, which allows it to read and evaluate if that data collection is not harmonised with the relevant interoperability technical specifications;
54.3. Notes on the life history of the rolling stock, maintenance and technical modifications undertaken after the acceptance into service in another Member State of the European Union;
54.4. the declarations of conformity and certificates on technical and operational characteristics that indicate conformity of the rolling stock, infrastructure and fixed installations, including climate conditions, energy supply system, management control and signalling system, track gauge and infrastructure gauges, maximum permitted axle load and other constraints of railway infrastructure;
If the 1520 mm 54.5. track width for railway rolling stock also wants to use the carriage to and from third countries, the attestations of the relevant third country requirements.
55. National Railway technical inspection shall verify: 55.1. the rolling stock and the infrastructure concerned mutual technical interoperability. If interoperability technical specifications for certain essential requirements of open access, also notified body issued assurances of compliance in such cases, the applicable documentation;
55.2. notified body provided assurances on compliance with the relevant technical specifications for interoperability in specific cases, provided the applicable legislative requirements.
56. in order to verify this rule 55. criteria referred to in paragraph 1, the national railway technical inspectorate may ask for additional information on risk analysis in accordance with Regulation No. 352/2009 or for carrying out the appropriate railway infrastructure. The national railway technical inspectorate after consultation with the applicant, determine the required additional information, risk analyses and tests amount and content.
3.4. the TSIs shall not be an appropriate acceptance of rolling stock in service, who have not previously been taken into service in other Member States of the European Union to adopt into 57. The TSIs shall not be an appropriate type of rolling stock, with the exception of the provisions referred to in paragraph 58 cars, the applicant shall submit the national railway technical inspection of these rules 33.1. application referred to, shall attach the following information: 57.1. declarations of conformity and the technical documentation according to the legislation on the European railway system interoperability If for any rolling stock technical characteristics is suitable for technical specifications for interoperability;
57.2. declarations of conformity and the notified body provided evidence on technical and operational characteristics for compliance with applicable regulatory requirements;

57.3. declarations of conformity and certificates on technical and operational characteristics that indicate conformity of the rolling stock, infrastructure and fixed installations, including climate conditions, energy supply system, management control and signalling system, track gauge and infrastructure gauges, maximum permitted axle load and other constraints of railway infrastructure;
57.4.1520 mm track if the width of the rail infrastructure rolling stock also wants to use the carriage to and from third countries, the attestations of the relevant third country requirements.
58. in order to be accepted into 1520 mm track width of the rail network for vehicle type, for use in the territory of Latvia in international transport to third countries and from the applicant, submitted to national railway technical inspection of these rules 33.1. application referred to, add the following: 58.1. documents certifying that the operation is a type of wagons permitted the third countries in question;
58.2. Declaration of conformity and certificate of conformity of the rolling stock concerned technical railway infrastructure.
59. National Railway technical inspection shall take a decision on the SITE does not match the type of rolling stock acceptance into service in the following order: 59.1. If for any rolling stock technical characteristics which are suitable for technical specifications for interoperability, has drawn up legislation on the European railway system interoperability verification as provided for in the Declaration, in respect of the following parameters apply to the rules specified in paragraph 30.6. procedure;
59.2. the rest of the technical parameters and the rolling stock in General, check: 59.2.1. rolling stock technical compliance with applicable regulatory requirements;
59.2.2. the rolling stock and the infrastructure concerned mutual technical compatibility;
59.2.3. rolling stock safe inclusion in the user's security management system, in accordance with Regulation No. 352/2009;
59.2.4. rolling stock operation, repair and maintenance procedures.
60. in order to verify this rule 59. criteria referred to in paragraph 1, the national railway technical inspectorate may ask for additional information on risk analysis in accordance with Regulation No. 352/2009 or for carrying out the appropriate railway infrastructure. The national railway technical inspectorate after consultation with the applicant, determine the required additional information, risk analyses and tests amount and content.
3.5. the TSIs shall not be an appropriate acceptance of rolling stock in service, taken into service in other Member States of the European Union 61. other Member States of the European Union on the SITE does not match the type of rolling stock acceptance into the national railway technical inspectorate takes into account when making a decision pursuant to the requirements of this subchapter.
62. in order to be accepted into the TSI rolling stock incompatible type, except that the provisions of paragraph 63 of the wagons, the applicant shall submit the national railway technical inspection of these rules 33.1. application referred to, shall attach the following information: 62.1. documents certifying that the operation of the type of rolling stock authorised in another Member State of the European Union, and the documentation on the procedure followed in order to show that the rolling stock type meets the relevant applicable national security requirements as well as information on the appropriate indentation;
62.2. technical characteristics, maintenance programme and operational characteristics. When rolling stock is equipped with reģistrētājierīc, data, details of the data collection procedure, which allows it to read and evaluate;
38.7. Notes on the life history of the rolling stock, maintenance and technical modifications undertaken after the acceptance into service in another Member State of the European Union;
38.8. declarations of conformity and certificates on technical and operational characteristics that indicate conformity of the rolling stock, infrastructure and fixed installations, including climate conditions, energy supply system, management control and signalling system, track gauge and infrastructure gauges, maximum permitted axle load and other constraints of railway infrastructure;
If the 1520 mm 62.5. track width for railway rolling stock also wants to use the carriage to and from third countries, the attestations of the relevant third country requirements.
63. in order to be accepted into 1520 mm track width of the car intended for the network type for use in the territory of Latvia in international transport to third countries and from the applicant, submitted to national railway technical inspection of these rules 33.1. application referred to, shall attach the following information: 39.2. documents certifying that the operation is a type of wagons authorised in another Member State of the European Union;
39.3. documents certifying that the operation is a type of wagons permitted the third countries in question;
63.3. declarations of conformity and certificates on technical and operational characteristics that indicate conformity of the rolling stock, infrastructure and fixed installations, including climate conditions, energy supply system, management control and signalling system, track gauge and infrastructure gauges, maximum permitted axle load and other constraints of the railway infrastructure.
64. National Railway Technical Inspectorate does not check this rule 62.1, 62.2, 39.2 and 39.3 in... conformity referred to, unless there is a proven significant security threat.
65. in order to verify this rule, 38.7 38.8, and 63.3 62.5. criteria referred to in the national railway technical inspectorate may ask for additional information on risk analysis in accordance with Regulation No. 352/2009 or for carrying out the appropriate railway infrastructure. The national railway technical inspectorate after consultation with the applicant, determine the required additional information, risk analyses and tests amount and content.
4. New or upgraded rolling stock acceptance into service units 66. Rolling stock units may be put into service if: 66.1. rolling stock type is accepted into Chapter 3 of these rules in the order;
66.2. the rolling stock unit has issued the necessary Declaration of conformity and certificate of conformity assessment;
66.3. rolling stock unit in accordance with the procedure laid down in this chapter have made trial trips;
66.4. rolling stock unit is technically off-the-shelf;
41.3. rolling stock unit is defined in the law on security of issue of the licence, cancellation and suspension criteria and procedure mentioned on the rolling stock maintenance responsible body.
67. The traction rolling stock and passenger cars to undertake such a trial run: 67.1. If the traction rolling stock intended for sharing infrastructure, rolling stock, on a trial voyage for not less than 40 km idling and not less than 40 km with the workload;
67.2. If the traction rolling stock are not intended for sharing infrastructure, rolling stock, on a trial run carried out private-use infrastructure where it is to be used;
67.3. multiple units intended for the carriage of passengers in traction rolling stock and passenger cars during the test drive reaches maximum speed, and not less than 40 km.

69. On a trial run of the Act shall be drawn up according to the provisions in annex 5 to the specimen, and sign it.

73.1.4. rolling stock signed a statement on the user;
73.2. prior agreement regarding time and space, exhibiting rolling stock unit national railway technical inspection.
74. If the rolling stock unit corresponding to the service adopted a type of rolling stock, as well as rolling stock unit is technically off-the-shelf, national railway technical inspection shall adopt operating rolling stock units, on the basis of the applicant's statement of conformity of the rolling stock for this type.
75. National Railway Technical Inspectorate may decide about acceptance into service in respect of each unit rolling stock separately, or for a number of one type of identical pieces of rolling stock together.
76. If national railway technical inspection shall take a decision on the refusal to accept the units of the rolling stock in operation, its reasons for its decision and notify the applicant.
77. the decision on the acceptance of the rolling stock units into the national railway technical inspectorate may suspend the review: 77.1. rolling stock user security certificate in accordance with the legislation on the security certificate issue of parts A and B, cancellation and suspension procedures and criteria;
77.2. rolling stock user security certificate in accordance with the laws and regulations on security of issue of the licence, cancellation and suspension procedures and criteria.
78. National Railway technical inspection decision on acceptance of the rolling stock units into service shall not affect the fulfilment of requirements for the use of rolling stock, which laid down the law about the security certificate issue of parts A and B, cancellation and suspension procedures and criteria, as well as legislation on security of issue of the licence, cancellation and suspension procedures and criteria.
79. the service adopted the type of rolling stock the rolling stock unit, which does not offer the Latvian market and which, in accordance with the regulations on the procedure of registration of rolling stock are not to be registered in a national register of rolling stock, the operation does not accept.
