No 32 33) climate change financial instruments project financed by the open competition "reduce greenhouse gas emissions in areas of local public lighting infrastructures" Charter Issued in accordance with the law "on the participation of the Republic of Latvia, the Kyoto Protocol's flexible mechanisms" in article 10 the third paragraph of point 1 and 2 i. General questions 1. determine the climate of the financial instrument (financial instrument) funded project open competition "reduce greenhouse gas emissions in areas of local public lighting infrastructures" (hereinafter referred to as the competition) regulations including the assessment criteria, application, examination, approval and funding arrangements, as well as project implementation, reporting and verification procedures.
2. the terms used in the rules: 2.1.-electrical equipment flashlight, consisting of light sources, reflectors (usually of polished aluminium) or light-focusing or dissipating power lens (also called a ballast, electronic ballast) and the shell of the light source position and protection;
2.2. light source: light emitting object: low pressure sodium lamps, high pressure sodium bulb, halogēnspuldz, incandescent, light-emitting diode (LED) or metālhalīd light bulb;
2.3. ballast – electromagnetic or electronic ballast is an electrical equipment for the correct and secure source of light for connection to the electric network, to ensure the functioning of the network parameters;
2.4. the nominal capacity-luminaire luminaire total nominal capacity, which includes both luminaire light source and light ballast power consumed;
2.5. the power of the light source – this provision referred to in paragraph 2.2 of the light-emitting object, the power absorbed;
2.6. the lighting level adjustment device, electrical equipment, one or more luminaires or lighting line for automatic control according to the desired control algorithm or control signal from the centralised control system to adjust the light level or quantity to be illuminated surface (such as the luminaire power supply voltage value adjustment and stabilisation);
2.7. the centralized management system, data transmission network operation with one data transmission network station run by other stations with check or survey procedures;
2.8. protection automation-short circuit and overload protection devices (automātslēdž) protection of the active load with a small 2 x up to triple the run currents (A curve), mazinduktīv load with triple run currents up to 4 x (curve B) or if the lighting is up to 4.5 10-line run currents (C runs curve);
2.9. drive (support cable)-electric cable lighting support (column) that connect the light bar with protection automated, with a maximum length of 15 metres;
2.10. the backlight power supply network (uplink) – lighting line low voltage (AC voltage supply does not exceed 1000 V) electrical network that provides voltage supply from the transformer substations up to light line light bar;
2.11. the lighting infrastructure – the system that creates this rule 2.1., 2.2., 2.3., 2.6., 2.7., 2.8., 2.9 and 2.10 elements referred to;
2.12. local public area-roads, streets, bicycle, square, parks, squares and other public use for areas that are municipal property.
3. The aim of the competition is the reduction of carbon dioxide emissions in the territory of local public lighting infrastructures using such technologies and environmentally friendly approaches to reduce the current power consumption.
4. The tender within the available financial instruments, funds (hereinafter funds) are 2 811 216 dollars.
5. The tender within the projects approved for activities implemented under the agreement for the implementation of a project date of signature (hereinafter the project), but not later than July 1, 2012.
6. Carbon dioxide emissions reductions of the project shall be calculated in accordance with the provisions of annex 1.
7. Purchase necessary for project preparation and implementation, the project applicant (hereinafter referred to as project applicant) or the project applicant, who entered into a project contract (hereinafter called beneficiaries): 7.1 in accordance with the laws and regulations governing public procurement, where the applicant is a municipality of the Republic of Latvia, the institution or agency;
7.2. in accordance with the procurement procedure and its application procedures, if the applicant is a registered merchant in the Republic of Latvia (hereinafter referred to as the operator).
8. the projects implemented in the territory of the Republic of Latvia.
II. requirements for the applicant of the project 9. applicant Project eligible for funding within the framework of the contest if it is 9.1: Republic of Latvia, the body or the agency or merchant;
9.2. its balance sheet is the lighting infrastructure: 9.2.1. which will be implemented in the contest, eligible activities;
9.2.2. to ensure local implementation of autonomous functions according to the law on municipalities;
9.2.3. the municipal public territory.
10. the project applicant is entitled to submit a maximum of two project submissions. For the same lighting infrastructure can submit only one project submission.
11. the funding for the implementation of the project does not qualify if: 11.1. the applicant, who is the project operator, a judgment which has the force of res judicata found guilty of environmental protection, competition or labour law violations;
11.2. the project the applicant which is a legal person, a natural person, the interest is made a criminal offence in the Republic of Latvia or the European Union's financial interests, and the project for the applicant under the criminal code is applied to the forced influence;
11.3. the project for the applicant, who is a businessman, is a tax debt, which totals more than 100 lats, including State social security payment;
11.4. the project applicant, who is a merchant, a judicial decision has been declared insolvent, including reorganisation, in the legal protection process, its economic activity or has been terminated in accordance with the commercial register of the information available, it is in the process of liquidation;
11.5. the project is aimed against the applicant's claim for the recovery of other national aid schemes or individual aid projects in accordance with the European Commission or the national support program managers decision declaring the aid illegal and incompatible with the common market;
11.6. the project for the applicant's financial instruments funded eligible costs has received or expects to receive co-financing from other funding programmes or individual aid project from other financial instruments, including the European Union or foreign financial assistance, as well as of the "operational programme infrastructure and services" in addition to the activities of the "national 3.6.1.1 and regional development center, promotion of balanced national development" activities "3.6.1.2. Riga City sustainable development" or activity "support 3.6.2.1. County Municipal complex development".
III. determination of funding within the framework of the contest 12 per project: 12.1 the minimum funding of a financial instrument is 10 000 LVL;
12.2. maximum financial instrument funding is 350 000 lats.
13. maximum permissible within the framework of the financial instrument, the aid intensity shall not exceed 70% of the project total eligible costs.
14. Any incidence of the project in relation to the approved project, eligible costs borne by the beneficiary of the funds.
IV. The tender within the eligible project activities and costs, as well as the eligible and ineligible costs eligible under 15 Competition, the following project activities: 15.1. current luminaries, or their components, replacement or reconstruction of the transition to energy efficient lights to reduce energy consumption;
15.2. installation of new energy-efficient luminaires;
15.3. the luminaire lighting level control devices and protection systems (with B or C curve) installation (implement this activity together with this rule 15.1 or 15.2. the activity referred to in point);
15.4. setting the transmission period of protection Automation to the light, if the length of the period is not more than 15 metres (implement this activity together with this rule 15.1 or 15.2. the activity referred to in point).
16. Change or the luminaires must be reconstructed provides minimum lighting requirements according to location lighting class defined in annex 1 of these rules in point 6 and comply with the requirements of the standards for street and road lighting.
17. the eligible cost of the project is the following according to the rules referred to in point 15 activities: 17.1. luminaire or their components, lighting level adjustment devices, automation and transmission of protection cost of acquisition;

17.2. the luminaire or their components dismantling costs, if the luminaire is mounted in place of the new energy-efficient flashlight or luminaire or their components and replacement of reconstruction;
17.3. the luminaire or their components, lighting level adjustment devices, automation and transmission of protection mounting costs.
18. The tender within the eligible costs of the project the applicant the additional cost required to achieve higher energy efficiency. The eligible costs for the project, if the calculation of the provision referred to in paragraph 17, the cost amount is subtracted the so-called fossil base-project on-site or replaceable (compensated) multiplied by the number of lights with 20 lats.
19. within the framework of this Competition rules referred to in paragraph 18 eligible has the following limitations: 19.1. dismantling work may not exceed 7% of total eligible costs;
19.2. the Assembly working together must not exceed 10% of total eligible costs;
19.3. the lighting level adjustment devices, automation and transmission of protection purchases should not exceed 25% of the total eligible costs.
20. the costs considered eligible if they meet the following provisions: 20.1.18. costs referred to in paragraph 1, and 19 of these rules referred to in paragraph cost limitations;
20.2. the need for the implementation of the project, as well as being included in the project application and the project agreement;
20.3. is encountered after the conclusion of the contract, but not later than the expiry of the implementation of the project;
20.4. the project is specified in the applicant's bookkeeping, identifiable, separate from the rest of the cost, is verifiable, and is included in the assets of the beneficiaries as the depreciable fixed assets. These eligible costs is certified with the appropriate justification of the original documents or their derivatives, made according to the regulations laid down in the document production and design requirements.
21. Ineligible project costs are the following: 21.1. costs associated with the existing lighting power supply network and centralized management system renovation, reconstruction or create from scratch;
21.2. the costs associated with existing lighting unit (support, switchboard, mounting brackets, cables and wires and cables air line) replacement or reconstruction;
21.3. the costs associated with project management, ground improvement works, sidewalks or pavement replacement or new coverage and other relevant mechanisms, not provided for in paragraph 15 of these rules;
21.4. payment of value added tax, if they are recoverable from the State budget;
21.5. the customs duties and taxes;
21.6. the payment for the loan review, presentation and booking, interest payments, interest, fees on money transfers, commissions, losses due to currency exchange, financial transactions and other direct financial expenditure;
21.7. working capital acquisition costs;
21.8. leasing costs;
13.6. the costs relating to the project submission form and other additional paperwork;
21.10. any type of mobile equipment and the acquisition cost of the vehicle;
21.11. costs that are greater than those referred to in paragraph 19 of the rules limit;
21.12. costs that exceed the approved project for the attributable cost;
21.13. the other costs that are not identified as eligible.
22. within the framework of the competition not eligible costs are those provisions referred to in paragraph 21, as well as the rules laid down in paragraph 18 of the fossil.
V. 23. Invitation to tender tender issued 40 working days after the entry into force of these rules for all these rules referred to in paragraph 4.
24. If you have not used all available funding, then the next round of the competition shall not later than six months after the previous invitation to tender.
25. The protection of the environment and regional development Ministry (hereinafter referred to as the responsible authority) shall be advertised by placing an advert in the newspaper "Gazette", as well as the authorities and the society with limited liability "environmental investment fund" (hereinafter referred to as the environmental investment fund) website. Invitation to tender date of authority on its website puts the guidelines the project applicants.
26. the responsible authority shall specify in the invitation to tender, the tender name, project submission deadline (date and time), the location (address of responsible authority) and electronic mail.
Vi. submission of the project and submission of the project application, 27, completed the project application form (annex 2) and the provisions referred to in paragraph 28, in addition to supporting documents, shall be submitted in one of the following ways: 27.1. paper form, by sending a project submission by post or by submitting personally and adding a second copy of the application to the project or its certified copy and compact disc (CD) with identical completed project submission form with 28.5. This provision States the technical characteristics of the project;
27.2. the electronic document by sending the project submissions by electronic mail, signed with a secure electronic signature and confirm with the time stamp under the electronic Act.
28. the project for the application that you want to add the following additional documents to be submitted: 28.1 applicant project decision on project implementation, which is signed by the representative or local merchants, the head of the institution or agency and which outlines the project total eligible costs and project co-financing by the applicant, or a statement that decision;
28.2. the draft statement by the applicant that the project sign lighting infrastructure projects located in the balance sheet of the applicant, specifying the number of luminaires, type and distribution of power;
28.3. proof of project co-financing required for provisioning: provide co-financing 28.3.1. If the applicant is the project operator, it shall submit his proof of the necessary co-financing for the project;
28.3.2. co-financing provided by the Latvian authorities, the authority or the Agency, the applicant shall provide the authorities of the Republic of Latvia for the co-financing decision;
28.3.3. If a credit institution, ensure the co-financing of the project, the applicant shall submit his proof of the necessary co-financing for the project, giving credit where credit is requested;
28.3.4. If co-financing provides individuals, other than a credit institution, the applicant shall submit documents proving that the co-financing of the project have the necessary funds for co-financing;
28.4. purchase procedure requires technical specifications;
28.5. technical characteristics of the project: 28.5.1. each street or public areas the profile schema (at least a scale of 1:1000), which provides for the implementation of the project, indicating the distances between the existing pillars, cable placement and length of luminaire anchorages walls of buildings, their height and the distance between them;
28.5.2. projected lighting calculation for each project profile schema according to the rules referred to in paragraph 16;
28.5.3. carbon dioxide emission reduction calculations;
28.5.4. electricity consumption before and after implementation of the project, indicating the existing and projected capacity and type of luminaire;
28.5.5. project location the street lighting class. If it is fixed, then specify all the parameters for the selected category of lighting, traffic, road, or street, branching characteristics: junction, encumbrances and obstructions, sidewalks, bicycle;
28.6. If the project application, the applicant shall submit to the authorized person, a power of Attorney for the right to represent applicants in the competition of the project and to take all steps required by the applicant for the project execution of duties in accordance with these rules.
29. the project applicant project application, subject to the following conditions: the project application 29.1. signature project legal representative of the applicant or the authorized person;
29.2. the project submission prepared and presented under the management of the regulatory requirements set out in the laws drafting and design requirements;
29.3. the project submission form prepared into Latvian language except the project application form (annex 2) in point 2.2.2;
29.4. the project application is completed without deletions, not specified for deletions, aizkrāsojum, corrections and additions;
29.5. the project to add additional application to submit the original documents or their derivatives, drawn up in accordance with the provisions laid down in the laws drafting and design requirements;
18.4. the project submission in all calculations used in currency is the lats;
18.5. the application shall be accompanied, where the paper form: 29.7.1. project application form and this rule 28.5. the deadline laid down in the technical characteristics of the project is identical to the project submission in electronic form attached to the application form for the project and that rule 28.5. referred to the technical characteristics of the project;

29.7.2. project application adds a compact disc (CD) to the project submission form and this rule 28.5. project referred to the technical characteristics of DOC, DOCX, xls, XLSX, PDF, JPG or file format;
29.7.3. project application form is cauršūt (caurauklot) together with the documents to be submitted, saving a single page numbering;
29.8. If the project application submitted in electronic form of a document: it draws up corresponding 29.8.1. legislation on the development of electronic document, presentation, storage and circulation;
29.8.2. DOC, DOCX, in their development, xls, XLSX, PDF or JPG file format;
29.8.3. project application form is signed with a secure electronic signature, in addition to the original documents be signed separately with a secure electronic signature and is certified by the stamp of the time before the project application acceptance deadline. If additional documents are copies of the documents certifying the applicant's project safe digital signature and time stamp before the project submission deadline for adoption under the laws on electronic documents and document legal force.
30. If a project applicant project application submitted by: 30.1. the paper form, by sending it by mail or filing a body personally responsible, the application inserts it in a closed container: 30.1.1. destination: 30.1.1.1. by submitting personally – the protection of the environment and regional development Ministry;
30.1.1.2. sending by post-the protection of the environment and regional development Ministry, Flying 25 Street, Riga, LV-1494, Latvia;
30.1.2. contest name-"reduction of greenhouse gas emissions for the territory of the municipal infrastructure of public lighting;
30.1.3. project name and address of the applicant;
30.1.4. "not to be opened before the start of the evaluation";
30.2. the electronic document by sending the electronic form to the responsible authorities the e-mail address specified in the invitation to tender shall contain an indication of the "not to be opened before the start of the assessment".
31. the project submission deadline is 40 working days from the date of the invitation to tender.
32. the responsible authority shall consider the project submissions, which is submitted to the responsible body (in person or electronically) or put a post office (postal stamp) to the specified in the invitation to tender expires. If the responsible authority submits that the application is received to the invitation to tender within the specified deadline, it justifies this claim.
33. the competent authority at the time of the application, the project shall be established in accordance with the following conditions: If the project application 33.1. sent by post, at the time it considered the postmark shows the date of dispatch;
33.2. If application of the project shall be submitted personally, about the time it considered the stamp of the authority responsible for the project specified in the date of receipt of the application;
33.3. If the project document submitted to the electronic application form for filing shall be deemed to be the time when the project application is sent via electronic mail.
34. If the application is received after the submission of the project application deadline, the responsible authority shall inform the applicant of the project location and the time of submission of the project not open you can get back.
35. the competent authority shall register the project submissions, give them identification numbers and 14 working days after the submission of the project application deadline, notify in writing the applicant project application project identification number. If the project applicant project application submitted personally, project submission identification number is assigned and communicated to the project applicant.
VII. submission of project evaluation and decision on financing the project application 36. consideration and evaluation responsible authority creates a project application for the evaluation of the Commission (hereinafter referred to as the Evaluation Commission).
37. the establishment and operation of the Commission shall lay down the procedure for the assessment of the Commission's regulations. The Evaluation Commission and the regulation approved by order of the responsible authority.
38. evaluation the Commission shall consist of three representatives of the responsible authority and one representative of the Ministry of Economic Affairs. The Evaluation Commission is headed by a representative of the responsible authority.
39. the application of the administrative evaluation of projects is carried out in accordance with the refine, refine, administrative and evaluation criteria set out in annex 3 of these rules. Compliance with the administrative evaluation criteria assessed with "Yes" or "no", or "NA" ("Yes", "no" meet-does not meet, "NA" for not applicable) in the following order: 24.3.  the first is the submission of the project's compliance with this provision of the annex referred to in paragraph 1. 40. in the case of non-compliance with one or more of the rules referred to in annex 3 refine administrative evaluation criteria, including the arithmetic error, the responsible authority shall inform the applicant of the project identified inconsistencies and invites the submission of the draft to clarify as follows: 24.9. clarification of the application of the project deadline is 10 working days from the date of the responsible authorities received information about the project submission does not match the administrative evaluation criteria;
40.2. clarification of the application of the project during the project, the applicant does not increase the financial instrument, the amount of the eligible costs.
41. in the case of non-compliance with one or more of the rules referred to in annex 3 do not refine administrative evaluation criteria, the responsible authority shall take a decision on the rejection of the application for the project.
42. Where the applicant authority shall be submitted within the time limit set for submission of the project specified, it scored again according to administrative evaluation criteria for determining whether a project application meets the requirements and is directional to the quality assessment of the evaluation criteria.
43. Where the applicant authority is not made within the time limit specified in the project application or after the submission of the draft assessment does not meet one or more of the administrative evaluation criteria, the responsible authority shall take a decision on the rejection of the application for the project.
44. If the total of the financial instrument the requested funding will not exceed that laid down in paragraph 4 of the rules, the evaluation of the application of the project according to quality criteria is made and funding for all projects that meet the administrative evaluation criteria. If the total of the financial instrument the requested funding exceeds the provisions referred to in paragraph 4 and the project submission complies with all administrative evaluation criteria, it is the quality evaluation of directional according to these rules, 46.45 and 47 points in these conditions.
45. the project submissions valued according to the quality of the quality evaluation criteria defined in annex 4 of these rules. Maximum per project are awarded 81 points.
46. After the submission of projects for the evaluation of the quality evaluation criteria the Evaluation Commission ranked the project submissions in descending order according to the number of points obtained.
47. If multiple project submissions received the same number of points, the responsible authority in deciding the project's approval of the application, the priority given to the application of the project with the highest overall reduction of carbon dioxide emissions a year.
48. evaluation by the Commission, if necessary, by independent experts, examine the project specified in the application for compliance with the reach project planned activities and the technical documentation submitted. Within the assessment of the inspection by the Commission or its external experts, if necessary, surveyed the site of the project, including checking the other project information provided in the application, and the applicant of the project provides access to the project site and documentation.
49. If during the test is determined that the project applicant project application or its annexes has provided false information that does not comply with the submission of the draft declaration (annex 2 to these regulations, section 6) and the rules referred to in annex 3 criteria, the responsible authority shall reject the application for the project according to annex 3 of these regulations 1.8.
50. the responsible authority shall take a decision on the application for the approval of the project, based on the assessment of the Commission, if the following conditions are met: 50.1. application of the project meet all the administrative evaluation criteria;
50.2. application of the project proposed for the implementation of project activities after the project submission ranking this provision in paragraph 46, in that order, also taking into account the provisions of paragraph 47, the conditions are sufficient funding according to point 4 of these rules.
VIII. conclusion of the contract of the project and the conditions of implementation

51. the responsible authority shall within 14 working days after the decision has been taken on approving or rejecting the application, the relevant draft decisions forwarded to the applicant. If the application is approved, the applicant shall invite the project to conclude a project agreement.
52. the project applicant is 20 working days after receipt of the decision of the authority responsible for the approval of the project application, concluding the project agreement.
53. If the applicant does not conclude the contract of the project within 20 working days from the day of receipt of the decision of the authority responsible for the application of the project approval, project, the applicant loses the right to enter into contracts for the project.
54. If the rules referred to in paragraph 53 of the reasons a project contract with the project applicant is not concluded, the responsible authority and the environmental investment fund switch project contract with the project applicant project application which has the next highest number of points according to the quality evaluation criteria if: 54.1. the balance of the funding of the financial instrument is sufficient to finance this project under point 4 of these rules;
54.2. the project submission was assessed according to the quality evaluation criteria.
55. the project applicant, after receiving the decision of the authority responsible for the approval of the project application: 55.1. to conclude a project agreement and then take all the project-related payments, 10 working days: 55.1.1. open current account registered in the Republic of Latvia or the Treasury credit institution according to the legislation on the budget and financial management – where the applicant is a businessman;
55.1.2. open a checking account in the Treasury under the legislation on the budget and financial management – where the applicant is a municipality of the Republic of Latvia, the institution or agency;
55.2. within 10 working days forward the environmental investment fund informative letter (by post or electronic) for bank account details to be able to conclude a project agreement and then take all the payment related to the implementation of the project;
55.3. within one month of the date of conclusion of the contract of the project submitted by the environmental investment fund decision on debt or other financial instruments (if such is provided to attract) the award of the project, indicating the project funding to be granted if that document is added to the project submission.
56. in order to ensure the publicity of the project, the funding recipient: 56.1. at the project deploying the instrument plate under the informational project requirements laid down in the Treaty;
56.2. project implementation period not less frequently than quarterly to deploy information on project implementation, financial leverage and the reduction of carbon dioxide emissions in one of the following types of information: 56.2.1. promotion of local newspaper;
56.2.2. your Web site (if any);
56.3. performing other publicity measures at its discretion.
57. during the implementation of the project for each of the three months period (hereinafter referred to as project quarter) to the project in the following month of the quarter, the twentieth date, the beneficiary shall submit an environmental investment fund report on project implementation progress (hereinafter the interim report), prepared in accordance with the model annexed to the project.
58. If the beneficiary determines that the project activity cannot be performed within the time limit laid down in the Treaty, this project not later than one month before the contract deadline may require the extension of the project implementation. In this case, the beneficiary shall submit an environmental investment fund the application, specifying the circumstances which hinder the implementation of the project (for example, equipment delivery period that was not previously possible to predict). After consideration of the application of the responsible authority and the environmental investment fund shall be the subject of a written agreement with the beneficiary of the financing agreement on the amendment of the project, extending the deadline for implementation of the project for a period of not more than four months. Extension of the contract amendments may be made once.
59. The beneficiary after the completion of activities under the contract, but not later than 20 working days after the end of the project shall submit an environmental investment fund report on the entire project implementation period (hereinafter referred to as the final report), prepared in accordance with the model annexed to the project.
IX. Financing available to the recipient of the payment and the payment arrangements 60. financing is available to the recipient of the following types of payment: payment in advance: 60.1.60.1.1. to 15% of the projects approved for funding in the amount of the financial instrument, if the funding recipient is a businessman;
60.1.2. up to 50% of the projects approved for funding in the amount of the financial instrument, if the funding recipient is local, the institution or agency;
60.2. one or more interim payments, which total the amount of the advance payment shall not exceed 90% of the projects approved for funding in the amount of the financial instrument;
60.3. the final payment, which totals with the funding recipient paid advances and intermediate payments shall not exceed the approved project total financing amount of the financial instrument.
61. The beneficiary under this rule 60.1. (a) can receive advance payment, if it has been submitted by: 61.1. Environmental Investment Fund payment request drawn up according to the project the model annexed to the Treaty;
61.2. has submitted an environmental investment fund credit advance payment letter of guarantee for the full amount of the advance issued in favor of the responsible authority, and credit guarantee period is shorter than the period of project implementation, as well as a condition for funding include the return of a first request for extension of the guarantee.

63. The beneficiary may receive a final payment if: it has provided 39.2. Environmental Investment Fund closing the payment request and added the works and their payment, specified in the project agreement;

63.3. final payment claim includes costs apply and comply with the requirements contained in these provisions;

X. liability of the beneficiaries of the project results 65. The beneficiary is responsible for the submission of the project and project results laid down in the Treaty, including the reduction of carbon dioxide emissions.

67.3. the beneficiaries will be listed in the balance sheet;
41.9. local government is involved in the implementation of autonomous functions according to the law on municipalities;

68. the project the applicant for at least 10 years after the expiry of the contract shall undertake to keep all the documentation related to the implementation of the project and, if necessary, to produce the instrument controls and audits of representatives before approving a project, the project during and after the final payment is received.
69. the responsible authority and the environmental investment fund is the right project interim review or statutory valuation, as well as five years after the implementation deadline to examine the interim review, the final report of the project agreement and the monitoring of the information provided in the report, surveying the project site, and the beneficiary will provide access to it.

70. If, within five years after the completion of the project it is established that the beneficiary does not provide this rule 67, paragraph requirements, environmental investment fund shall inform the beneficiary and responsible authority for all funding recipient paid and recoverable financial instrument funding. The responsible authority shall take a decision on the financial instrument for the project funds for ineligible and the recovery of the financial instrument.
