Cabinet of Ministers Regulations No. 704 in 2012 (9 October. No 56 37. §) rules on "operational programme human resources and employment enhancement activity" human resources 1.1.1.2. attraction to science "second application round of projects issued under the European Union's structural and cohesion funds act 18 paragraph 10 of article i. General questions 1. determines: 1.1. procedures implemented by the operational programme" human resources and employment ' priorities "of Appendix 1.1. Higher education and science" based "Science and UR1.1.1.pas research potential development" activity "human resources 1.1.1.2. attraction of science" (hereinafter referred to as the activity), the second application round project (hereinafter referred to as the second round); 1.2. the requirements for the project of the European Social Fund (hereinafter the project) to the applicant; 1.3. the application of the project evaluation criteria; 1.4. the responsible institution and liaison body, the distribution of competence between these institutions and cooperation arrangements, as well as the responsible authorities and cooperation agencies functional form of subordination. 2. The terms used in the following terms: 2.1 foreign scientist-science employed staff with doctoral degrees who are working outside the legal relations of the Republic of Latvia, the existing scientific institutions; 2.2. doctoral applicants – in the sense of these provisions, a person who on the date of submission of the application, the project has received or expects to receive public the qualification Commission opinion on thesis and during project implementation plans to defend the thesis, including the person who studies doctoral program, a person who has acquired the accredited doctoral study programme, or a person's academic activity is equated with accredited doctoral program requirements under the regulations to the Act concerning the doctoral degree (thesis) procedures and criteria (if the person is not studied in the programme concerned); 2.3. internal transactions-research generated knowledge management, where knowledge and technology transfer: 2.3.1. Research Department or research organisations – a subsidiary of the company, in which the participation of the parent company's share exceeds 50 percent, or in which the parent company has the majority; 2.3.2. the research organisation jointly with other research organisations; 2.3.3. a research organisation with third parties, the conclusion of contracts for certain services in the open competition; 2.4. new technology, the changes in technology, methods, equipment, and software that improves production or services processes, including data processing and interpretation methods, data planning and arranging techniques, methods, political decision-makers in Government or institutional level, methods to select and classify staff, learners or other people groups, methods for checking children with reading problems or other special needs, methods to study customer , the Subscriber or other target groups, to create new services; 2.5. new scientific research group-group that is created for the implementation of the research activities within the framework of the second round (hereinafter referred to as the scientific group); 2.6. new product – full of new goods or services or goods and services that have improved functional properties or change the intended use (including changed or improved technical characteristics, components, materials, add software, user friendly features). The product is not classified as new, if it includes renewal, innovation of regular seasonal changes, product adaptation of one customer's needs and other changes that do not contain functional properties changes or improvements. The responsible authority shall ensure that the Ministry of education and science. Approves the amendments to the project; 8.11. accumulates data about the application of the project and of the project in accordance with the laws of the European Union's structural funds and the cohesion fund management information system design and use; 8.12. provides information to the public and provide publicity on matters related to the implementation of the second round of the activity; 8.13. If the non-compliance found, the corresponding expenditure provides recovery in accordance with the laws and regulations establishing procedures for reporting on the implementation of the structural funds of the European Union in the perceived discrepancies, accept the Board's decision on the use of funding granted and recover the irrelevant. 9. The Liaison Office has functional authority. 10. the activities implemented in the framework of the second round of projects co-financed by the European Social Fund. The total activity in the second round of funding available is 5 342 845 lats, the European Social Fund co-financing 5 207 423 lats, national public funding 109 067 lats and private funds 26 355 lats. 11. the second round of the activity to the available amount of liabilities that exceed this provision in paragraph 10 the total eligible funding is 4 463 146 lats, including European Social Fund funding 3 860 175 lats. The beneficiary shall ensure their co-financing in proportion to the intended virssaistīb for the implementation of the project funding in accordance with the provisions of paragraph 12.
12. the maximum permitted by the European Social Fund co-financing amount is 92.47 percent of the total eligible project cost totals. Project has supported the following: 14.1. create a scientific group, providing additional human resources Association science; 14.2. the creation of new jobs in scientific groups involved in scientific employees; 14.3. the scientific research activity under the national priority scientific directions of fundamental and applied research funding in the 2010-2013:14.3.1. energy & environment (renewable energy resources and technology, climate change technologies and decreasing biodiversity); 14.3.2. innovative materials and technologies (informatics, information and technologies, signālapstrād, multifunctional nanostructured materials and nanotechnology); 14.3.3. the national identity (language, Latvian history, culture and cilvēkdrošīb); 14.3.4. public health (prevention, treatment, diagnostic tools and methods, biomedical technologies); 14.3.5. local resources (subsoils, wood, food and transport) – new sustainable products and technologies. 15. activities in the framework of the second round provides support only for the projects in the framework of actions for the country's scientific institutions are not economic core. III. Requirements to the applicant of the project 16. applicant Project may be a scientific authority of the State, which is registered in the register of scientific institutions – National Research Institute (derived public person, government agency), a public College, or University of the State Scientific Institute (public agency) – and the research status of the Organisation (hereinafter referred to as the scientific authority of the State). 17. the project applicant project can be implemented individually or in partnership with other national scientific bodies. 18. Cooperation within the project partnership can create one national research centre, the Centre of several national framework or with the State scientific institution, which is not a national research center of the maker. 19. where the project involves the building of partnership (at least two partners participate in the project's development, contribute to the implementation and share project risks and results), the application shall be accompanied, the managing partner, who is responsible for the project implementation, is considered a project and if the project is approved, the beneficiary of the financing. 20. If the cooperation project, the partners switch on the draft cooperation agreement and the joint exploitation of results (hereinafter referred to as the agreement), which specifies the project implementation and outcomes, including: 20.1 obligation and responsibility. the risk allocation; 20.2. the financing arrangements; 20.3. the right to the results of the project, including the rights to intellectual property (if applicable); 20.4. the results of the project, including intellectual property, new products or technologies, and prototypes of future commercialization conditions (if applicable). 21. the minimum eligible costs of the project amounts to 105 420 dollars, the maximum eligible cost total is 350 000 lats. IV. submission of the project selection and project submission notification submission 22. the responsible authority shall open the project application selection, publishing the newspaper "Latvian journal" and the Ministry of education and Science website (www.izm.gov.lv) where notice of project application submission. 23. The notice of project application submission: 23.1. activities for the second round of the available common European Social Fund co-financing; 23.2. the project submission deadline, which is not shorter than 20 working days from the day of promulgation; 23.3. the application of the project site and order; 23.4. the website which published the application to be used for the preparation of the project documents. 24. the statement on the second round of project submissions must be no earlier than one month and not later than two months after the entry into force of these regulations. 25. the project applicant project application submitted, subject to the following conditions: 25.1. each of these provisions 3.1., 3.2., 3.3., 3.5., and 3.6. the persons referred to may be employed for no more than one project; 25.2. the scientific group can invoke this provision of the 3.1, 3.2 and 3.3 referred to persons who have not received the support of the activities of the first selection round (except persons PhD degree has got more than 10 years ago, or the person who set the laws of order replaced the absent persons employed in the draft no longer than three months); 25.3. the project submission count: 25.3.1. procedure where the applicant institution employing scientific staff of full time equivalent terms not exceeding 50, the applicant may submit one project submission; 25.3.2. If the applicant authority of the scientific staff of full time equivalent terms exceeds 50, the allowed number of submissions of projects Psk is calculated using the following formula, provided the Psk ≤ 7: Psk = ZD/50 + 1 Psk-number of projects which the applicant may submit a second round of activity (number of projects shall be expressed in whole numbers, the decimal digits of a discarded); ZD-project applicant institution employing scientific staff of full time equivalent terms; the common project of scientific institutions of the applicant, the number of employees full time equivalent terms (ZD) is determined according to the number of scientific personnel, which was taken into account in calculating the base funding for 2012 in accordance with the law on the financing arrangements for the base of the State scientific institutions; 25.4. the project application to the institution of the applicant, the signature of the project manager or his authorised person, project submission by adding the appropriate authorisation. 26. the project application form a completed project application form (annex 2) and the following annexes: 26.1. According to this provision the provisions of paragraph 20 of the cooperation agreement and (if applicable) for the certified copy; 26.2. the scientific group of the scientific staff: 26.2.1. proof of participation in the project (annex 3); 26.2.2. Description of dzīvesgait (CV) with attachments, including formal education (certified copies), publications and other documents (annex 4) which justify the scientific employee compliance with this provision of the annex 5 1, 2, 3, and 5. quality criteria laid down in paragraph 1; 26.3. annual report on the implementation of the budget (certified copy), prepared in accordance with the regulations on the procedure for the preparation of the annual report, for the last three reporting years concluded (responsible authority received national statistical surveys is used only for the purpose of the summary and grouping of data, economic processes and scientific analysis). A certified copy of the report shall be submitted separately, not bound to the project submission; 26.4. The State revenue service inquiries (issued not earlier than 20 working days prior to the application of the project) on tax payment and the average of the applicant and its project partners (if applicable) institution number of employees working in the last two years (over the years) or consent letter in which the project applicant or its partner (if applicable) authorise the competent authority at the request of the State revenue service certificate (annex 6); 26.5. financial analysis (if the project complies with this provision in paragraph 62 above conditions), which includes cash flow and financing the deficit and the assumptions used in the calculations (including financial projections), fact and opinion, a detailed description (including the intellectual property future value description of the method of determination) and justification (copies of supporting documents: diagrams, tables, charts, market research, competitive analysis, and other copies of the document); 16.5. other draft documents that the applicant deems necessary to substantiate compliance with the project application, this provision is referred to in annex 5, project submission evaluation criteria.
27. If the rules referred to in paragraph 26 of the document are not Latvian language (with the exception of those provisions referred to in subparagraph dzīvesgait 26.2.2. Description (CV)), shall be accompanied by a certified translation in accordance with the laws and regulations on the procedures which are translations of documents in the language of the country.
28. the project applicant project application can be submitted to the responsible authority: 28.1. single copy in paper form by adding identical fill the project application form and all application project (the project's financing plan and project budget summary, including indicative project cost plan (Microsoft Excel file format)) electronic version of the electronic media. If additional documents are copies of the documents, they must be designed according to the law on the development and presentation of the document specified. All the documents placed in a package (envelope) and sealed; 28.2. the electronic document in the form of laws and regulations for the design of electronic documents in the order, including the project application must be developed in DOC (Microsoft Office Word document) file format, xls (Microsoft Excel file format) or PDF (portable document format) file format. Project submission form, and in addition to the original document to be submitted must be signed by the individual applicant's institution of the project manager or his authorised person's secure electronic signature and confirm with the time stamp before submission of the draft selection. If additional documents are copies of the documents must be certified by each individual to the project the applicant secure electronic signature and a time stamp prior to the submission of the draft selection. 29. This provision 22, paragraph specified in the notifications to the application of the project end date is the last day when the project applicant project application may be made in person, in the form of electronic document or sent by mail. 30. the responsible authority shall register the project application submitted to it on the date of receipt. Proof of receipt of the application, project, the responsible authority shall issue to the applicant personally the project immediately after the application of the project or within 10 working days after the application deadline date by post or electronically in the form of an electronic document signed with a secure electronic signature according to the regulations on electronic document design.
V. Project submission evaluation 31. activities under the second round of project submissions submitted to the Commission. Panelists included representatives from the Ministry of education and science and the Latvian Academy of Sciences.
32. Commission meetings as observers without the right to vote can participate in the managing authority, in cooperation with the authorities, the Latvian Science Council, the National Institute Association and the Latvian Association of young scientists. 33. the Commission may invite the process of evaluating one or more experts (without voting rights). 34. In order to assess the conformity of the application of the draft provisions of annex 5, paragraph 15 of the specific criterion, the Commission consulted scientific experts, which the Latvian Science Council has granted the rights experts and which are included in the Latvian Science Council expert database. Scientific experts valued the project idea and the scientific relevance of the validity and reasonableness of research methodology. 35. the launching of the Commission, Commission members, experts and observers signed a declaration that: 21.8. during the meetings of the Commission and the information content of the document will not disclose to third parties; 35.2. they do not exist in such conditions that they can violate the laws of the European Union's structural and cohesion funds limits the European Union fund management to the person involved, and not the circumstances that it could be argued that they are interested in a specific project in the project submitted by the applicant for the approval or rejection of the application. 36. The Commission shall determine the responsible authorities developed and approved the rules of procedure. 37. the project applicant and project submission compliance is assessed in accordance with the rules referred to in annex 5, project submission evaluation criteria in this order: 37.1. administrative criteria; 37.2. the eligibility criteria; 37.3. quality criteria and funding criteria. 38. project submissions valued under the project application to the assessment criteria (annex 5), subject to these rules and other regulations that govern the European Union's structural and cohesion funds. 39. the project submission compliance administrative criteria, eligibility criteria and funding criteria are valued with a score of "Yes" or "no" ("Yes", "no" – meets does not meet). Application of project compliance with quality criteria assessed by giving a certain number of points. Vi. adoption of the decision on the application of the project approval, the approval or rejection of a conditional and its communication 40. The responsible authority shall take a decision on the application of the project if the project application meets the following criteria: 24.9. the project submission all these rules referred to in annex 5, project submission administrative, compliance and funding criteria have been assessed with "Yes"; 40.2. the project application, each of these provisions of annex 5, 5, 7 or 9. quality criteria referred to in point of assessment has received at least one point; 40.3. the project the application of these rules in annex 5, paragraph 6, of the quality criteria of assessment is received at least two points; 25.1. the application of these provisions of the draft annex 5 referred to in paragraph 1 of the quality criteria of assessment are received at least 4.2 points; 25.2. the application of these provisions of the draft annex 5 of these quality criteria are received at least standings 14.7 points. 41. the competent authority shall take a decision on the rejection of the application of the project and its evaluation the continuation, if not one of the following conditions is met: 41.1. the applicant does not meet the project one of these provisions of annex 5, 27, 31, or 32. criteria referred to in points; 41.2. the project submission does not comply with any of the provisions of annex 5, 10, 11, 23, 33 or 43. criteria referred to in paragraph 1; 41.3. these provisions of annex 5, paragraph 15 referred to scientific expert opinion about the scientific quality of the research project are negative; assessment of compliance with 25.7. these provisions of annex 5, 5, 7 or 9 quality criteria listed in the project application has been received by less than one point; assessment of compliance with 25.8. these provisions of annex 5, paragraph 6 the quality criterion received less than two points; assessment of compliance with 25.8. This provision of the annex 5 1. above quality criteria received less than 4.2 points. 42. the responsible authority shall take a decision on the rejection of the application for the project, if these provisions of annex 5, paragraph 46, the funding criteria are evaluated with "no". 43. If the project application selection round several projects submissions receive the same number of points and the project submissions round of funding is not sufficient, the priority is the project eligible who this rule 5 of annex 1, 2, 3 and 9. quality criteria referred to in point standings of received higher scores. 44. Where the application does not have sufficient information to assess the project submissions conform to one or more of the criteria, and, if such information is not legible, believes that the project submission does not meet the criterion or criteria concerned given lower ratings. 45. The competent authority may take a decision on the approval of the application, the project on condition that must be satisfied in order to project the applicant would conclude the agreement on the implementation of the project. That decision may include the following conditions: 45.1. clarification of the application of the project according to the rules of annex 5, 12, 13, 14, 16, 17, 18, 19, 20, 21, 22, 24, 25, 26, 28, 29, 30, 34, 35, 36, 37, 38, 39, 40, 41, 42, 44 or 45. the evaluation criteria;  45.2. the provisions referred to in paragraph 26 of the annex to the submission; 45.3. the clarification of costs on condition that the rules referred to in paragraph 21 of the cost limits are not exceeded; 28.2. other specific legal authority to justify action, which is focused on the conclusion of the agreement. 46. If the responsible authority when deciding on the approval of the project application, conditional execution, finds that the second round of the activity is financing balance, it redirects the next submission for approval of the project, the evaluation obtained the highest scores.
47. the responsible authority shall within five working days after the date of adoption of the decision: sent to the applicant of the project-29.3. the decision on the application of the project approval, approval with conditions or disapproval; 47.2. the cooperation body, the decision on the application for the approval of the project and submission of the project approved original filed in paper form, or project submission, presented in the form of electronic documents signed with secure electronic signatures, and confirm with the time stamp according to the regulations on electronic document design. If the application filed in paper form, within five working days after the conclusion of the cooperation agreement the authority of the responsible authorities for the project received the original of the application shall be returned to the competent authority. 48. If a decision is taken on the application for the approval of the project, the project applicant, within the time limit laid down in the decision of not less than 10 working days, and at the same time does not exceed 30 working days from the date of entry into force of the decision, shall be submitted to the responsible body for evaluation information on the fulfilment of the conditions. Decision within the time limit set in the information about the conditions of the project, the applicant may submit a maximum of two times. 49. Specifying the project submission under this provision in paragraph 48 of that decision, the project applicant must not increase the total eligible cost of the project and public aid intensity. 50. the responsible authority shall be 20 working days after this rule 48 referred to the time limit laid down in the decision to assess the information submitted by the applicant for the project and draw up an opinion on the decisions contained in the conditions (opinion).
51. The project shall ensure that the decisions referred to in paragraph 48 of the conditions within the period laid down in the decision and the opinion of the responsible authority is positive, responsible authority within five working days from the date of signing the opinion sent: 51.1. the project applicant, opinion; 51.2. cooperation authority – a decision on project approval, and submission of the approved project, which filed the original paper, or project submission, presented in the form of electronic documents signed with secure electronic signatures, and confirm with the time stamp according to the regulations on electronic document design. 52. If the applicant does not provide this provision in the decision referred to in paragraph 48 of the conditions within the time limit laid down in that decision, finding that the decision contained in the conditions are not met, the responsible authority shall send the draft to the applicant not later than five working days from the date of its signature. VII. General 53. financing conditions required for the implementation of the project the national co-financing percent from 7.53 project total eligible costs provides of the following national funds: 53.1. the State budget means percent of 7.23 project total eligible costs; 53.2. from the scientific institutions-hand means 0.30% of the project total eligible costs for which no public support (including savings). 54.
