Cabinet of Ministers Regulations No. 940 Riga 2012 December 18 (Mon. No 71 95. §) rules on the establishment and management of the mikroliegum order, protection, as well as the mikroliegum and the determination of the buffer zone are Issued according to species and Habitat Protection Act article 4, paragraph 4 and 20 i. General questions 1. determines the mikroliegum creation and management procedures, protection, as well as the mikroliegum and the determination of the buffer zone. 2. If mikroliegum is created in one of the specially protected natural areas, in addition to those provisions of the applicable rules governing the specially protected natural areas protection and management. II. determination of the Mikroliegum 3. Specially Protected mammal, amphibian, reptiles, invertebrates, vascular plants, mosses, algae, Lichen and fungi species whose protection can create mikroliegum, determine the provisions of annex 1. 4. Specially Protected bird species whose protection can create them for the mikroliegum and mikroliegum areas, identified in annex 2 of these rules. 5. Specially Protected fish species that can create mikroliegum for the protection of the spawning sites, determine the provisions of annex 3.  6. the protection of habitats which can form mikroliegum, certain legislation on specially protected habitat types. 7. Mikroliegum of the specially protected area of animal, plant, fungi, Lichen, algae species (with the exception of birds, fish and other watercourses and bodies of living species) and the conservation of the habitats of this species in appropriate habitats and Habitat location area 0.1 – 30 hectares. 8. Mikroliegum for specially protected fish spawning sites and watercourses and bodies specially protected living animal species, as well as for the protection of habitats of fresh waters down the individual stages of the river no more than five kilometres in length and no more than 20 ha in area and Lake or lakes up to 20 ha. 9. Environmental Protection Administration, State Forestry Department and the Ministry of agriculture (hereinafter referred to as the institution responsible for each –) is responsible for the creation of a mikroliegum within the limits of its competence and in accordance with the relevant species and habitat protection areas of the certified expert (hereinafter expert) opinion: 9.1. Nature Protection Administration determined mikroliegum, including mikroliegum of laws in the nature reserves and national parks, except for this provision 9.2 and 9.3 cases referred to; 9.2. the national forest service determines the mikroliegum of the forest lands outside the statutory natural reserves and national parks; 9.3. the Ministry of agriculture established in mikroliegum specially protected fish spawning sites. 10. Mikroliegum, which is defined for certain specially protected bird species can be determined as a buffer zone. Buffer zone in the area concerned shall determine the following species of mikroliegum: 500 hectare 10.1 to the area (including the mikroliegum area) around the medņ the rut. 11. If the proposal for the establishment of a mikroliegum is not attached to the expert's opinion, the responsible institution within 15 working days after receipt of the proposal of the creation of mikroliegum, please provide the appropriate habitats, species or group of species of a group of expert opinion on the planned area of mikroliegum existing species and habitats through mutual agreement. Mikroliegum-specially protected mammal, bird, fish, amphibian, reptiles, invertebrates, vascular plants, mosses, algae, Lichen and fungi species in habitats not form if the expert opinion stating that: 24.1. Habitat of these species is not maintained in the long term, also providing it mikroliegum status and appropriate management; 24.2. particularly protected species presence in this place is casual in nature, as evidenced by the fact that only some of these species found in these specific individuals and unsuitable Habitat or species is referred to dārzbēgl. 25. Mikroliegum-specially protected habitats for protection do not form if: 25.1. special protection of the Habitat is degraded and the existing circumstances, the existence of specially protected habitat is not sustainable; 25.2. specially protected habitat specific species presence in the territory is incidental, as evidenced by the fact that separate this species found only on individuals without permanent substrate, which is located in the Habitat as a whole is not a suitable habitat for the species ecological structure of signs or elements and is not found in other species of Habitat-specific. 26. After the decision on the establishment of mikroliegum receiving the land owner or legal possessor informs the tenants or users of land, if any, of the created mikroliegum and provides information about the individual mikroliegum management and protection requirements. 30. the national forest service for mikroliegum created forest lands outside the statutory natural reserves and national parks and the Ministry of agriculture on mikroliegum created specially protected fish spawning sites within 15 working days, inform the environmental protection administration, to electronically fill in a specially protected species and habitats in the mikroliegum application and inventory questionnaire (annex 4), the decision on the establishment of the mikroliegum, as well as other available information, and describes the mikroliegum mikroliegum's kartoshēm (gml. dwg, dxf, dgn,. or. a. shp file form). 31. On the resulting mikroliegum of wooded land laws in the nature reserves and national parks of nature protection authority shall inform the national forest service, electronically send the filled in especially protected species and habitats in the mikroliegum application and inventory questionnaire (annex 4), the decision on the establishment of the mikroliegum, as well as other available information, and describes the mikroliegum mikroliegum a kartoshēm (. dxf dwg, gml,...,. shp file dgn or form). 32. IV. protection 37. Mikroliegumo, created a specially protected forest breeding bird species, allowed the ditch renovation, if you receive an expert opinion that there is no negative performance impact on the breeding bird species. 39. in the buffer zone around the forbidden mikroliegum medņ rut: 24.3. to carry out the construction and reconstruction of the ditch; 24.4. the forestry operations from 1 March to 31 July, excluding fires and forest restoration, carried out using only a hand job;
39.3. restoring the forests, planted or sow spruce; 24.5. pine stands to make a clear cut that is larger than 1 ha; 24.5. the tree felling in the main lock at random, to reduce the stumpage ground-floor stocking level below 0.4, not including dry standing trees. 40. the Mikroliegum buffer zone is prohibited for all types of harvesting, timber and pievešan soil formation in periods of preparation: 24.9. around the Black Stork, black kite, red bran, fish Eagle, čūskērgļ, medium, little Eagle Eagle, Falcon, ūpj, hen Hawk, green Crow and woodpigeon mikroliegum-from 1 March to 31 July; 40.2. around the Sea Eagle and Eagle Rock mikroliegum, from 1 February to 30 October. 41. From 1 august through 31 January through mikroliegum, which created a specially protected forest breeding bird species, allowed the pieves wood from felling in other stands only in the cases where it is not possible to other export routes. 42. Mikroliegumo established bodies and watercourses breeding specially protected bird species protection, nature protection administration following the written permission from august 1 to 31 March allowed such actions, if they do not endanger or specially protected species in its Habitat: 44.1. actions that cause ground water, and surface water level changes (including drainage); 44.2. mineral extraction; 27.5. movement with motor vehicles mikroliegum land and water areas, if it does not need mikroliegum management and control. 45. Mikroliegumo created for mammals, amphibians, reptiles, invertebrates, vascular plants, mosses, algae, Lichen and fungi species and habitat protection, prohibited any activity that is incompatible with the creation of the mikroliegum objectives and targets, destroy or interfere with the especially protected species, or destroy its Habitat, damage or destroy the Habitat of special conservation interest, negatively affects ecosystem structure, including: 45.1. actions that cause groundwater groundwater and surface water level changes (including reclamation), except if the water level changes required for maintaining a species or habitats; 45.2. the construction, roads, power and other linear communications erection without nature protection management written permission; 45.3. the activities causing soil erosion; 28.2. mineral extraction; 28.3. forestry activity, except forest fire and fire safety measures, as well as specially protected species habitat or Habitat management or restoration measures, including expert recognized by other forest management activities by nature protection management written permission; 45.6. movement with motor vehicles mikroliegum land (except the movement by road) and water territory if it does not need mikroliegum management and control; 28.4. tourism or recreational facilities, installation of the recreation and sports activities and progress, except for this provision, paragraph 22 areas; 28.5. bathing water bodies and watercourses of the establishment, with the exception of experts specified location; 28.5. fertilizer, pesticides and hazardous chemicals; 45.10. operations resulting in a change in the land use category, except when they need them especially protected species habitat or Habitat for maintenance or restoration of natural protection administration following written authorization; 45.11. specialist fish farming and artificial propagation of fish; 45.12. bottom placement, the surface of Earth nostumšan; 45.13. follow-on formulae of wild species; 45.14. any waste water discharges (injecting directly or mikroliegum ietekoš in watercourses in the territory), except where, in accordance with the national environmental service regional environmental management issued a permit to the pollutant conditions specified levels after treatment the quantity of contaminants remaining in the long term cannot substantially worsen especially protected species habitat or specially protected habitat quality; 45.15. other activities expert for disadvantaged and pointed out in its opinion. 46. Mikroliegumo created specially protected fish spawning sites, as well as that of other watercourses and bodies of living especially protected species, prohibited any activity that is incompatible with the creation of the mikroliegum objectives and targets, destroying or damaging of the species or Habitat, adversely affect the structure of aquatic ecosystems, including: 46.1. mechanical obstacles to the formation and activities of ūdensrežīm of bodies and change into watercourses; 46.2. mineral extraction; 46.3. the construction works (including boat offshore construction, roads, power and other linear communications erection) without nature protection management written permission; 46.4. water sampling of bodies and watercourses; 28.9. industrial fishing and underwater hunting; 46.6. any waste water discharges (directly or ietekoš in transferring into watercourses), except where, in accordance with the national environmental service regional environmental management issued a permit to the pollutant conditions specified levels after treatment the quantity of contaminants remaining in the long term cannot substantially worsen especially protected species habitat or specially protected habitat quality; 29.0. motorized movement of vehicles mikroliegum land (except the movement by road) and water territory if it does not need mikroliegum management and control; 29.1. aquatic burning, if it is not required for the management of mikroliegum; 46.9. water poultry rearing economically; 46.10. other activities expert for disadvantaged and pointed out in its opinion. 47. From December 1 to 29 February mikroliegumo, created specially protected fish spawning ground, allow this provision and 29.0 28.9. States, if they do not endanger spawning after environmental protection authorities a written authorisation. V. procedures for the management of Mikroliegum 48. Mikroliegum are managed to ensure the favourable conservation status of the species or habitats, which created mikroliegum. 49. Mikroliegum can manage the land owner or, if not, the lessee or legal possessor, or the hired person, municipality or conservation authority in accordance with the opinion of an expert. Expert opinion is required for removal and mowing grass. 50. to ensure mikroliegum management regulations in accordance with the procedure laid down, you can perform the following actions, which in the opinion of the experts pointed out, if they do not conflict with specially protected species and habitats protection: 50.1. Reed mowing and disposal or controlled burning; 50.2. specially protected species or Habitat maintenance, or restoration – tree, including the deposed and broken trees, bushes and felling and removing sīkkrūm; 50.3. the socket, if the nest tree is corrupt or unstable; 50.4. artificial nest building for the nest to nest, if not strengthening its stability; 50.5. actions to maintain the bird's nest pielidošan corridors; 50.6. fish spawning sites; 50.7. species count (monitoring) and propagation; moorland, 50.8. meadow, grassland and forest controlled burning; 50.9. measures for the conservation and restoration of the regime; 50.10. other actions necessary for the expert. 51. the scientific research carried out by mikroliegumo nature protection management written authorisation. Scientific research activity must not impair the mikroliegum condition. Research Investigator submitted to nature protection authority a written application for a planned scientific research mikroliegumo, specifying the expected, their quantity, time and place of the performance. Research investigator shall inform the owner of the land or, in the absence thereof, the lessee or legal possessor of any scientific research activity in mikroliegum.
52. Those rules that nature protection management written permission is not required if the take the environmental protection administration, to implement the laws and regulations in specific it functions and tasks. 53. developing local authorities planning or detailed through land-use planning, forest inventory and all types of design and planning, follow the placement of mikroliegum and their protection and management requirements. 54. Mikroliegum protection of State control under the competence of the national forest service and the environmental protection administration. 56. Environmental Protection Administration at the State and local government bodies, the land owner, or, if not, the legal possessor, or at the request of the lessee shall provide such information free of charge on the created mikroliegum (if this information is not available for the management of nature conservation homepage on the internet): 56.1. creating the mikroliegum purpose, rationale, specific species and Habitat the exact location; 56.2. mikroliegum and its buffer zones; 56.3. mikroliegum protection and management requirements; 56.4. other information, to the extent that can not harm the species or habitat protection that mikroliegum created. 57. the nature protection authority by Association and Foundation, scientific institutions or experts request the following information about the created mikroliegum (if necessary nature protection plan development, scientific research or monitoring of species and habitats and nature protection is not available on the website of the administration of the internet): 57.1. creating the mikroliegum purpose, rationale, specific species and Habitat the exact location; 57.2. mikroliegum and its buffer zones; 57.3. mikroliegum protection and management requirements; 57.4. other information, to the extent that can not harm the species or habitat protection that mikroliegum created. 58. Information on the mikroliegum of existing specially protected habitats and species Habitat location can only be distributed with nature protection management written permission. A person wishing to disseminate information on the mikroliegum particular habitats and protected species Habitat location shall be submitted to the environmental protection administration application for a planned distribution of information, indicating the amount of information to be disseminated, the insertion site and its public availability. Environmental protection administration is right not to issue a permit if it finds possible especially protected species or habitats. 59. the national forest service forest lands created the mikroliegum, including buffer zones, forest recorded in the national register.
