Cabinet of Ministers Regulations No. 73 in 2013 (January 29. 6. § 19) provisions for agricultural service cooperatives and cooperatives of forestry services screening Issued in accordance with the laws of the cooperative society 36.1 the second paragraph of article i. General questions 1. establish agricultural service cooperatives and cooperatives of forestry services, eligibility criteria and evaluation procedures. 2. the agricultural service cooperatives and cooperatives of forestry services shall assess conformity of society "Latvian Agricultural Cooperative Association (hereinafter Association) that this task is subordinated to the Ministry of agriculture. 3. A decision on the service cooperative society of agriculture and forestry services cooperative society in compliance with this provision, (II) and (iii) the criteria in chapter Association creates Commission composed of five people, including one representative from the Ministry of agriculture, the rural support service and the State revenue service and two representatives from the Association. If company distributes products purchased from a member, which is another company, purchased products are produced on the holding of this society; 6.2. the agricultural turnover of goods and services between the public and its members shall not be less than 75 percent of the company's agricultural goods and services total turnover; 6.3. the fruit and vegetable sector in public agricultural turnover of goods and services in the sector concerned is not less than 80 per cent of the total agricultural products and agricultural services turnover, if the Member has less than 10; 6.4. the surplus public members divided in proportion to those given the turnover of goods and services; 6.5. not less than 25 percent of the surplus funds invested in the development of society; 6.6. the company's income from agricultural turnover of goods and services shall constitute not less than 75 percent of the company's turnover; 6.7. the company's agricultural turnover of goods and services with one membership does not exceed 40 percent of the company's agricultural goods and services total turnover; 6.8. the minimum number of members of the public with which the public is agricultural products and agricultural services turnover is 10, but the fruit and vegetable sector – five; 6.9. the company's total tax debt not exceeding 100 lats; 6.10. the Management Board of the company is the majority society, where society was created by the Council; 6.11. the company is registered in the companies register no later than 1 July of the previous year. If the company has not worked the full year, 80 percent of the company before its registration of the founder for at least three years have been agents of economic activity in the agricultural sector; 6.12. the company has declared insolvency proceedings or in accordance with the company registry log information not in the liquidation process. 7. in addition to the provisions referred to in paragraph 6 of the criteria of an agricultural service cooperative society, which lays claim to the milk producer organisations recognised in accordance with the laws and regulations on milk and milk products and for the recognition of producer organisations in their operational supervisory arrangements meet the following criteria: 7.1 public members are producers of milk and not engaged in processing, processing of raw milk and milk-based products, except mājražošan; 7.2. the volume of raw milk, for which the company is conducting the negotiations, the contract is at least 125 tonnes in the past 12 months; 7.3. the company is conducting contract negotiations for raw milk produced by its members ' holdings; 7.4. the company is conducting the negotiations on the contract to at least 75 percent of each Member's raw milk being sold. III. Forestry services cooperative society eligibility criteria 8. Forestry services cooperative society eligibility criteria: 8.1 the company provides services of forestry and forestry products marketed, obtained the property of its members or purchased from the forest owner, who is not a member of the public. If company distributes products purchased from the forest owner, who is not a member of the company, purchased products must be obtained for the owner of the property; 8.2. the minimum forest turnover of goods and services between the society and its members are less than 50 percent of the company's forestry products and services total turnover; 8.3. the surplus public members divided in proportion to those of forestry provided goods and services turnover; 8.4. no less than 25 percent of the surplus funds invested in the development of society; 8.5. the company's income from forestry product sales and forestry service shall constitute not less than 75 percent of the company's turnover; 8.6. the forestry public goods and services with one membership turnover does not exceed 40 percent of the company's forestry and forestry goods services total turnover; 8.7. the minimum number of members of the company has 15; 8.8. company members ' total managed forest area at least 500 hectares; 5.5. the company's total tax debt not exceeding 100 lats; 8.10. the majority of the public Board members of society if society was created by the Council; 8.11. the company is registered in the companies register no later than 1 July of the previous year. If the company has not worked the full year, at least 80 percent of its members have been members of the forest property for at least three years; 8.12. the company has declared insolvency proceedings or in accordance with the company registry log information not in the liquidation process. IV. Agricultural service cooperatives and cooperatives of forestry services screening procedures 9. Agricultural Service cooperative society and forestry services cooperative society each year until 15 March the Association submitted to: 9.1. application for conformity assessment (annex 1); 9.2. list of members and information on agricultural or forestry turnover of goods and services between the public and the members of the public (annex 2). If the Member list is submitted in paper form, it shall also be submitted electronically; 9.3. information on agricultural or forestry turnover of goods and services between the public and the persons that are not members of the public (annex 3); 9.4. non-approved (just the Board signed) project annual report for the last financial year. 10. the Association each year until 15 April: 10.1 shall take a decision on the compliance status of the grant or award not and notify the agricultural service cooperative society or forestry services cooperative society; 10.2. writing to submit to the State revenue service, Ministry of agriculture and rural support service under the agricultural cooperatives of services and corresponding services forestry cooperatives; 10.3. published on its website under the agricultural cooperatives of services and corresponding services forestry cooperatives. 11. the compliance status is granted for a period of one year, which shall begin on the day following its adoption. 12. Calculation of the corporate income tax for the tax period for which the operating results during the period of pēctaksācij the company has been granted compliance status, an agricultural service cooperative society and forestry services cooperative societies apply the law "On enterprise income tax" in the third subparagraph of article 2 of the rules. 13. This provision in paragraph 10.1 and 18 that decision may be challenged in the Ministry of agriculture. The Ministry of agriculture, may appeal to the Court. V. the relevant agricultural service cooperative society and the appropriate services of forestry activities of cooperative societies monitoring 14. Association each year up to October 1 implementing the audit of compliance to the site at least five percent of eligible agricultural cooperatives of services and corresponding services of forestry cooperative society. 15. The Association through the compliance audit, have the right to assess agricultural service cooperative society and forestry services cooperative society is complying with the Statute and the legislative requirements related to the criteria referred to in these provisions. 16. The members of the Commission and invited experts do not have the right to disclose to third parties information that they become known, assessing agricultural service cooperatives and cooperatives of forestry services compliance and conformity audits. 17. The Member of the Commission is not entitled to participate in the agricultural service cooperative society and forestry services cooperative society in the evaluation and compliance audit, if there is a conflict of interests-personal or financial interest. 18. the Association shall have the right to take a decision on the compliance status of cancellation, if the implementation of compliance audit will identify any non-conformity criteria of these regulations or the requirements of the laws associated with this criterion. 19. If the decision is taken on the compliance status of cancellation: 19.1 the Association within five working days, inform the State revenue service, Ministry of agriculture and rural support service for those agricultural service cooperatives and forestry service cooperatives, which terminated with the compliance status; 19.2. The State revenue service within one month of adopting its decision according to the legislation on taxes and fees and surcharges levied the tax received tax credits; 19.3. the rural support service two months after the annulment of the decision according to the regulations on the procedures administered by the European agricultural guarantee fund, European agricultural fund for rural development and the European Fisheries Fund, as well as national and European Union support for agriculture, rural development and fisheries, demanding repayment of the aid.
