Cabinet of Ministers Regulations No. 347 in Riga on 25 June 2013 (pr. No 36 25) rules for the European integration of third-country nationals to fund the 2012 program implementation activities Issued in accordance with the General Programme "solidarity and management of migration flows" within the established fund management law article 14, paragraph 3 (I). General questions 1. determines: 1.1. European third country nationals Integration Fund (hereinafter referred to as the Fund), the 2012 Programme tender procedures for the following activities: 1.1.1.  1. the "a" in activity "and the development of adaptation programmes for the integration of third-country nationals and cohesive society" (hereinafter referred to as the 1. " (a) "activity); 1.1.2.1. " (b) the "activity" of a single coordinating structure and the establishment of third-country nationals integration support (hereinafter referred to as "1." (b) "activity); 1.1.3.2. activity "public institution professional quality of the services provided and the improvement of coordination" (hereinafter 2. activity);
1.1.4.3. activity "effective functioning of integration Assistance policy, through exchanges of experience and good practices with other Member States" (hereinafter referred to as 3. activity); 1.2. the requirements of the project of the Foundation the applicant (hereinafter referred to as project applicant); 1.3. the Fund's project application (hereinafter referred to as the project application) preparation and submission of the project application procedure selection procedure and evaluation criteria; 1.4. the grant award procedure; 1.5. the technical assistance activities. 2. The beneficiary payments fund projects on expenditure incurred up to June 30, 2014, may take during the period from the date of the decision on the application of the project approval or approved on the conditions in the decision of approval of the project application, to grant a contract to the end of the project the review due date, but not later than July 31, 2014. Beneficiary payments 1. To Fund activities relating to the implementation of the General Programme "solidarity and management of migration flows" within the established fund management rules set out in article 7 of the managing authority and the right to exercise the Ministry of culture (hereinafter referred to as the managing authority). 4. To Fund activities relating to the implementation of the General Programme "solidarity and management of migration flows" within the Fund management established in article 9 of the law certain audit the Authority's duties and rights shall be exercised by the Ministry of Finance (audit authority). 5. To Fund activities relating to the implementation of the General Programme "solidarity and management of migration flows" Fund created as part of the management of the law set out in article 10 certification authority obligations and rights implemented the Central Finance and contracts (hereinafter referred to as the certificate authority). 6. the Fund's target group: 6.1. Fund's main target group are the nationals of the Member States of the European Union, as well as stateless persons (hereinafter referred to as third-country nationals) who arrived in Latvia in the last five years and legally resident in the territory of Latvia; 6.2. in order to facilitate the naturalisation of third-country nationals, for the target group may also consider those third-country nationals who legally resident in the Republic of Latvia for more than five years; 6.3. the Fund's target group, you can include third-country nationals having obtained the legal right to enter the Republic of Latvia, to ensure the integration of those entry services; 6.4. the Fund's target group are not included in the nationals of third countries who submitted an application for asylum in respect of which a final decision has not yet been adopted, which is the status of refugee or alternative or eligible for refugee status or asylum in accordance with the law, as well as seasonal work performers.
II. Requirements for the project for the applicant 7. General requirements the project applicant: 7.1. it is not a judgement handed down by the insolvency proceedings or a court judgment is not the legal protection process, or by a court decision is not implemented in the out-of-court redress process, has no previous bankruptcy, or the restoration of a suitable composition or its economic activity is not ended (if applicable); 7.2. it provided false information to the managing authority in relation to the implementation of projects co-financed by the Fund; 7.3. the interest a person is not made a criminal offence in the Republic of Latvia or the European Union's financial interests, and it does not have adequate means of coercive influence (if applicable); 7.4. it has received financing or does not provide for funding for the same eligible costs of other activities in the framework of local, regional, national or European Union funds; 7.5. If it has been the beneficiary of another Fund annual program, it has seen the conditions of funding consistent with the laws governing 74. Implementation of the open project selection, project submissions in the application may provide project implementation in cooperation with partners, with which the applicant concluded a draft partnership agreements for the implementation of project activities for which funding will be allocated for the implementation of the activities. The partners applies this provision in paragraph 7. 10. the implementation of the project, submitted a draft application to the limited selection, the project is not allowed to attract partners.
III. submission of the project selection procedure for organizing 11. the managing authority shall hold a more limited application selection or open the project application selection, taking into account this provision VII, VIII, IX and X in the requirements section. 12. the project application selection in managing authority may organise each activity individually, multiple activities or all activities at the same time. 13. the application of the selection of projects is the following: 13.1. the managing authority shall issue: 13.1.1. open project application selection by advertising in the official Edition of the "journal"; 13.1.2. limited application, selection by sending an invitation to the specific project, applicant indicated these rules in that particular activity; 13.2. the project the applicant shall prepare and submit a project application, which consists of the completed project submission form and you want to add additional documents; 13.3. the managing authority shall ensure that the submission of the draft assessment and shall take a decision on the application for the approval of projects, the approval or rejection of the condition; 13.4. If the application is approved on condition that the managing authority shall ensure the evaluation of the conditions in the decision of approval of the project application; 13.5. the managing authority shall conclude grant agreements with the principal applicant of the project approved. 14. the Announcement of the open project application selection or in the invitation to tender if the limited application of selection of projects, the managing authority shall include the following information: the name of the activity of the Fund, 14.1 and purpose; 14.2. the Fund's activities within available funding; 14.3. the project to the application procedure and deadline; 14.4. an indication of the managing authority home page on the internet that provides information about the project for the preparation of the application and use of materials, project submission evaluation criteria, the European Union and national funding arrangements and questions.
IV. Project application preparation and submission procedures 15. Project applicant project application submitted to the managing body of the rules referred to in point 14 announcement or invitation within the time limit specified. 16. the project application consists of the completed project submission form (annex 1) and the following additional documents to be added: 16.1. project budget form (annex 2); 16.2. a detailed written justification, if the subcontract for the project exceeds 40% of the direct eligible costs (if applicable);
16.3. the project applicant project administration and implementation of the people involved in the original description of dzīvesgait (CV) (if applicable); 16.4. the project partners participate in the certificate of approval of the project (annex 3); 16.5. the project partners in the implementation of the project administration and those involved in the original description of dzīvesgait (CV) (if applicable); 16.6. the statement of the credit institution granting the project applicant or its partners or their account balance, if the project foresees the use of additional financial resources, which is not a fund or the national budget funding for the implementation of the project following its approval of the project will be linked to the applicant or its partner funding. These certificates shall be submitted for an amount that is not less than the planned project, additional financial resources. The project at the date of application to the credit certificate may not be older than 30 calendar days; 10.4. a mandate of supporting documents (if applicable); 16.8. the project covering letter indicating the name of the applicant, the draft annual programme of activities number and name, as well as the name of the project. 17. the application of the project prepared in accordance with the laws and regulations on the development and presentation of the document. 18. the project applicant project application can be submitted by the lead institution: 18.1 in paper form, by personally leading the institution or by sending by registered mail; 18.2. an electronic document. 19. If the project application submitted in paper form, it shall be submitted in one copy together with an electronic copy of the electronic medium with the indications on the data carrier. A copy of the application to a project in the form of a submitted paper, numbered caurauklot, with table of contents, on the back of the last page of the thread ends are glued, stamped with the seal of the applicant and the project on the labels provide information on the number of pages in the document, proof of the correctness of the content of the document, the document author's name, signature, date and place of preparation of the document. If the project application submitted personally or sent by registered mail, place it in a sealed envelope or box, specify the following information: 21.1. indication of "restricted access information"; 21.2. the managing authority the name and address; 21.3. the project the name and address of the applicant; 21.4. "European integration of third-country nationals Fund project submission"; 21.5. the year's program activity number and name; 21.6. the application of the project name. 22. the application shall be accompanied, where the electronic document, sent to the managing authority electronic mail address, e-mail notification, under "subject" indicates that rule 21.1, 21.4 21.5 21.6., and the information referred to in point. 23. If the application is sent by mail, at the time the project is considered the day when a project application is transferred to the post office. In the event of a dispute, the applicant demonstrates the fact that the post put the post up to the project submission deadline. If the application is submitted in person, on the application of the project time is considered when a representative of the managing authority on the application of the project has a reference to its receipt. 24. the application shall be accompanied, where the electronic document in the form, sign it with a secure electronic signature, add time stamp and are presented according to the legislation on the circulation of electronic documents. About the project the application time is considered to be the moment when the project application sent by electronic mail. In the event of a dispute, the applicant demonstrates the fact that the application sent to the project submission deadline. 25. The central authority receiving the project application, register it in the document record management system. If the application is received in paper form, the leading authority on the envelope or box specifies the application receipt date of the project, the time and identification number.
V. Project submission evaluation procedure 26. application assessment project is provided in the Managing Authority created project submission Evaluation Commission (hereinafter the Commission). Commission meetings as observers without the right to vote can participate in a certification body. 27. If the project announced the selection of the application, the Commission launched the project submission evaluation after the project submission deadline. 28. If a limited project announced the selection of the application, the Commission may initiate the evaluation of the application of the project before the project specified in the invitation for the submission of the application if the applicant, the project having sent an invitation, if you submitted the application for the project. 29. the project application to the opening meeting, the Commission finds that the application is submitted the project announcement, or within the time limit set in the invitation: 29.1. project submissions submitted advertisement or invitation, within the time limit laid down in the grant project identification number, and the managing authority shall inform in writing the applicant of the project; 29.2. project submissions filed after announcement or invitation, the deadline set in the open and not looking, and the managing authority shall send the draft back to the applicant with the reason for the examination. 30. the Commission project submissions valued under these rules laid down by the Administration and the specific activity of the quality evaluation criteria laid down. Open the project application selection within the project submissions submitted under these rules to the specific project referred to submission evaluation criteria evaluate the Fund's Management Committee. 31. If there is no information in the project application in order to assess compliance of the application for the project to one or more project submission evaluation criteria, as well as if this information is not legible or not submitted to the Latvian language, believes that the project submission does not meet the relevant criteria, or criteria given lower ratings. 32. first, the Commission shall assess the project submissions according to refine, not administrative evaluation criteria (annex 4). If the application does not comply with something not to be an administrative evaluation criteria, the Commission suspended the application of the evaluation of the project and recommends that the managing authority to reject it. 33. If the application complies with all of the project not to be administrative evaluation criteria, the Commission shall evaluate the application of the project in accordance with the quality evaluation criteria (6, 7, 8 or 9.), specific evaluation criteria (annex 5) and refine administrative evaluation criteria (annex 4). 34. The overall assessment in accordance with the quality evaluation criteria shall be obtained by aggregating the score awarded to the members of the Commission of the number and the amount obtained divided by the number of members of the Commission who valued the project submission. If the application does not correspond to something one has to be the quality evaluation criteria or did not acquire a minimum number of points in accordance with the quality evaluation criteria, the Commission suspended the application of the evaluation of the project and recommends that the managing authority to reject it. 35. The limited application of the selection of projects: 21.8. the Commission acknowledges the project application for the appropriate valuation and moves on to be administrative evaluation criteria if: 35.1.1. project application to the quality evaluation criteria won at least 55% of the maximum possible number of points; 35.1.2. design application has obtained the minimum required number of points in accordance with the quality evaluation criteria; 35.1.3. the Commission determined that need clarification in some quality evaluation criteria, in accordance with these terms is defined as a reservation; 35.1.4. activities are sufficient funding of the project for the implementation of the application; 35.2. the project submissions that do not conform to this rule 35.1. the conditions referred to in the Commission considers inappropriate, not further evaluated and recommends the managing authority to dismiss them; 35.3. the Commission assesses the application of the project according to refine, administrative and evaluation criteria: approval; driven 35.3.1. 35.3.2. drive for approval provided that clarifications are required in the criteria which, in accordance with these terms is defined as a reservation, or to specify the project's application pursuant to section 23.1. these terms conditions referred to in that decision for the project feasibility submission approval; 35.4. the Commission secretariat shall prepare and submit to the managing body of the evaluation report, which includes information about the project submissions, the evaluation and also for approval, approval with conditions and rejected the proposed project applications and their reasons for rejection. 36. Open project application selection: 36.1. the Commission acknowledges the project application for the appropriate evaluation and moves the Management Committee of the Fund after the specific evaluation criteria, if it obtained the minimum required number of points in accordance with the quality evaluation criteria; 36.2. the Commission shall submit project applications in evaluation of the Management Committee of the Fund, in accordance with specific evaluation criteria (annex 5); 36.3. for project submissions that targeted rejected by quality evaluation criteria, the Commission shall prepare a summary of the information management Committee of the Fund; 36.4. each project application under the specific evaluation criteria evaluate at least two members of the Management Committee of the Fund; 22.7. the overall assessment in accordance with specific evaluation criteria shall be obtained by aggregating the members of the Management Committee of the Fund, the number of points awarded and the amount of the fund divided by the number of members of the Management Committee, which valued the project submission; 22.7. the Fund's Management Committee shall prepare and submit to the Commission a draft submission reviews according to the specific project submission evaluation criteria; 22.8. the Commission of these provisions by 22.7. information referred to in the application of the draft assessment of the total number of points earned in accordance with the quality and specific evaluation criteria and arrange project applications in order of priority according to the resulting points; 22.9. If multiple project submissions in accordance with the quality evaluation criteria and the specific evaluation criteria got equal number of points, then, in determining the order of application of projects, it is considered a priority project application, which won the largest number of points after the quality evaluation criteria; 22.9. If multiple project submissions in accordance with the quality evaluation criteria and the specific evaluation criteria got the same number of points and the same number of points are obtained by quality evaluation criteria, it is considered a priority project submissions that received the greatest number of points: 36.9.1.  1. "a" activities within that rule 6.2 and annex 15. quality criteria referred to in paragraph 1; 36.9.2.2. activities under this provision 2 of Annex 8 and 16 the quality criteria referred to in paragraph 1; 36.10. project application is considered appropriate and geared to refine administrative evaluation after evaluation criteria, if all the following conditions are implemented: 36.10.1. the project application to the quality evaluation criteria and the specific evaluation criteria won at least 55% of the maximum possible number of points; 36.10.2. project submission won at least the minimum required number of points in accordance with specific evaluation criteria; 36.10.3. after the project submission ranking in order of priority, taking into account that the project approval submissions, which got the highest number of points, there is sufficient funding for the implementation of the project application to the particular activity; 36.11. the Commission assesses the application of the project according to refine administrative evaluation criteria and move it: 36.11.1. for approval; 36.11.2. approval provided that clarifications are required in the criteria which, in accordance with these terms is defined as a reservation, or to specify the project's application pursuant to section 23.1. these terms conditions referred to in that decision for the project feasibility submission approval; 36.12. the Commission, on the basis of the Fund's Management Committee and the Commission's assessment shall be submitted to the managing body of the evaluation report. It includes information about received submissions, project evaluation, as well as for approval, approval with conditions and rejected the proposed project applications and their reasons for rejection. 37. the managing authority shall, on the basis of the assessment reports submitted by the Commission, shall decide on the application of the project: 37.1. the approval, this provision and paragraph 35.3.1.36.11.1. in these cases; 23.1. the approval, if necessary, impose the following conditions: 37.2.1. to clarify the application of the project to ensure that it complies with the rules referred to in annex 4. refine administrative evaluation criteria, this rule 6, 7, 8 or 9 to be listed in the annex of the quality evaluation criteria and the rules referred to in annex 5, refine, specific evaluation criteria; 37.2.2. preventing conflict in relation to the information in different sections of the application of the project; 37.2.3. to clarify the description of project activities, including the deletion of inappropriate activities and clarify the project time schedule; 37.2.4. specify the target group of the project and the target number of persons belonging to the Group; 37.2.5. to clarify the description of the project results, including the refine numerical indices and the sources of information provided for them; 37.2.6. for additional information or clarification if information specified in the project application is incomplete or contradictory; 37.2.7. to pay the tax or State social security payment of debts; 37.2.8. submit State revenue service current accounts or parts of it (the revenue and expenditure account, donations and endowment overview) (if applicable); 37.3. rejection, if the implementation in at least one of the following conditions: application to project 37.3.1 does not meet even one criterion for the administrative assessment that under these rules to be defined as; 37.3.2. open application in the selection of projects project application to the quality evaluation criteria and the specific evaluation criteria and the limited application of the selection of projects, the quality evaluation criteria have not won at least 55% of the maximum possible number of points; 37.3.3. project application is acquired by at least the minimum required number of points in accordance with a specific quality or specific evaluation, the evaluation criteria (if applicable); 37.3.4. after the project submission ranking in order of priority, taking into account that the project approval submissions, which got the highest number of points is not sufficient funds for the implementation of the project application. 38. the managing authority within 10 working days after this provision in paragraph 37 of the decision shall be forwarded to the project applicant. 39. The fulfilment of the conditions in the decision of approval of the project application, provided the applicant provides a project managing authority within the time limit provided for in the decision. The project, run by the managing authority, the conditions laid down in the decision not to take up the project in another application with the managing authority not agreed changes. 40. the Commission within 10 working days of receipt of the information on the conditions in the decision of approval of the project application, assess their compliance with the conditions laid down in the decision. 41. Open project application in the selection of the managing authority within five working days after the Commission evaluated the conditions in the decision of approval of the project application, the information is sent to the Management Committee, to verify whether the conditions are fulfilled in accordance with specific evaluation criteria. 42. following the evaluation of conditions managing authority shall draw up an opinion. If the conditions in the decision of approval of the project application, are met, the managing authority shall inform the applicant of the project grant agreement. 43. If the conditions laid down in the decision approving the project application provided are not met or are not met within the time limit laid down in that decision, the application shall be deemed to have been rejected and the managing authority shall inform the applicant of the project. 44. If it is found that the project applicant knowingly provided false information in any application evaluation stage of the project, the Commission shall suspend the submission of further evaluation of the project and recommends that the managing authority to reject it. 45. If the application is rejected the limited application of the selection of projects, managing authority, when assessing the financial accessibility of specific activity in specific annual programme, have the right to resend project invitation given to the applicant to participate in the application of the selection.
Vi. the Grant contract for 46 months after the decision on the application of the project approval or adoption of the opinion on the conditions in the decision of approval of the application, the project on condition that the managing authority by the beneficiary grant agreement concluded, which defines the obligations of the Contracting Parties and rights as well as the Fund's project implementation procedures and conditions (including the financing conditions and payment arrangements). 47. the managing authority shall terminate the project application selection without closing the grant agreement if all projects submitted application has been rejected or it has objective justification (force majeure, not available financial means or other special circumstances that preclude the Fund project). 48. After the decision on the application of the project approval or adoption of the opinion on the conditions in the decision of approval of the project application, but before the grant beneficiary of conclusion of the contract or the managing authority shall specify in the application of the project included information that lost the topicality, without changing the substance of the project submission. 49. The beneficiary is responsible for the implementation of the project according to the approved project submission and provide a report to the managing authority on the progress of the implementation and financial implementation in accordance with the grant agreement. 50. If the beneficiary does not reach the monitoring indicators of the project, but the reach project goals, leading authority in proportion to reduced funding for the project in question, except in the case where the beneficiary has reached at least 85% of the monitoring indicator and prove that has taken all the measures necessary to achieve the project monitoring indicators. 51. Funding recipient project open separate accounts for the Treasury, from which is made and which is received by all the project-related payments. 52. the amendments shall be made in accordance with the project grant agreement arrangements. If during the implementation of the project requires amendments to the project, the beneficiary shall submit proposals to the managing authority grant contract amendments and the reasons for them. If the managing authority in assessing the eligibility of proposals submitted that rule 52. the requirements referred to in paragraph 1, as well as the impact of the amendments to the project goal finds the need to amend the grant contract, it prepares the grant agreement, the draft amendments and send it for signing the project funding recipient. 54. The beneficiary shall ensure the target group for the information and publicity measures in accordance with the grant agreement. 55. The beneficiary shall ensure the implementation of the project-related information and documentation storage up to December 31, 2023.
VII. 1. " (a) "activities of the implementation and project evaluation criteria applications 56.  1. "a" the purpose of the activity is to develop and organize high-quality third-country nationals in the adaptation of programmes and measures (language courses, kultūrorientācij courses, support measures for third-country nationals mazākaizsargāt groups) to ensure full access to services and participation in public life, as well as to provide the host society's ability to make otherwise. 57.1. " (a) "activity can leverage the following monitoring indicators: 57.1. language and integration courses trained and involved at least 500 citizens of third countries; 57.2. courses trained and naturalization exam prepared to sort at least 300 citizens of third countries. Information days organised in five regions of Latvia, ensure media publications and internet websites; 57.3. create at least one informational material about Latvia, intended for third-country nationals prior to entry and ensure its availability; 57.4. implemented at least one measure or measure cycle of third-country nationals on civic participation and advocacy, in which the representatives of civil society and local government participation. Create at least one network, involving both third-country nationals and citizens of Latvia; 57.5. create three support mechanisms for vulnerable groups of third country nationals, provided measures to improve Latvian language skills and promote the use of the Latvian language in the family and household. 58. in order to achieve this provision, 57.2 and 57.5 57.1.. the surveillance referred to in point scores, the proportion of non-citizens of Latvia in the project target group 1. Latvian language and integration course design and implementation, to provide third-country nationals the opportunity to acquire basic knowledge of the Latvian language, as well as knowledge of Latvian culture, tradition, history, current social and economic issues, public administration system, fundamental rights and other issues, including the innovative measures that promote the practical use of the language; 59.2. the course and informative activities for the preparation of third-country nationals through naturalization process; 59.3. measures which provide the opportunity to receive information about Latvia before entry; 59.4. measures that encourage third-country nationals and citizens of Latvia, active cooperation and civil participation; 59.5. support mechanisms and the provision of services to third-country nationals vulnerable groups (children, women, the young, the elderly, and people with special needs), including support for families with pre-school and school-age children as well as aid to third-country nationals who left poverty or regional isolation. 60.1. " (a) "activities implemented as an open project application selection. 61.1. " (a) "activity of the project applicant and their partners can be public authorities, municipalities, local authorities, derived public persons, associations and foundations, international organisations, as well as national or local government or other legal person (other than the company) founded in universities. 62.1. " (a) "activities within the funding available is 1,153,205.86 lats (eur 1,640,864.11), comprising 75% of the Fund's funding 864,904.39 lats (€ 1,230,648.08) and 25% national budget funding $288,301.47 (410,216.03 euro). In addition to the Fund and the State budget to finance the project application can be linked to project the financial resources of the applicant. 63.1. " (a) "activity available funding one project application to cover the eligible costs are no less than 14 056 lats (19999.89) and not more than 120 000 lats (170,744.62 euro). 64. within the framework of the project can be implemented only in the Latvian language and integration courses and programs developed before the submission of the application for the project. The course or program updates costs must not exceed 20% of the development costs. The course or program should be considered, if the changes to the updated content exceeds 10%, but not more than 50% of their volume. Course or program changes to content does not exceed 10% of the amount considered not updated. Course or program changes to content up to 50% of their size, are considered developed. 65. within the framework of the project application is planned to implement the Latvian language and integration courses and programs developed in the past, the project applicant 16.8 of these regulations in the project referred to in the covering letter indicates additional information about Latvian language and integration course or program development costs, as well as include a description of the contents. 66.1. General provisions 1. Guiding principles 1.1.
