General questions 1. determine the metrological requirements and metrological control arrangements offered goods in Latvia, which in the case of variables, not defined in nominal amounts, with the same pre-packaged by the manufacturer of the goods value, expressed in units of mass or volume, of not less than 5 g or 5 ml and not more than 10 kg or 10 litres.
2. The terms used in the following terms: prepackaged goods 2.1 offering market-goods supply pre-packaged for distribution, consumption or use on the European market for payment or free of charge;
2.2. prepackaged goods market – the first time offering of prepackaged goods on the market of the European Union; 2.3. the bulk commodity producer, the person who produced the goods in bulk or placed on the market under his name or trademark; 2.4. the bulk commodity importer-a person who is registered in the European Union and placing pre-packaged goods on the market of the European Union from third countries; 2.5. the dealer-bulk supply chain person other than the manufacturer or importer and which offers prepackaged goods market; 2.6. the nominal quantity – quantity of product that is indicated on the packaging; 2.7. content – actual quantity of packaged product or actual mass of actual volume; 2.8. the content of negative deviation quantity – the quantity by which the actual contents of the quantity is less than the nominal quantity of contents; 2.9. the bulk commodity production batch-produced under identical conditions, and packed one unit group with the same items of nominal quantities of contents; 2.10. a reference test-prepackaged goods the actual quantity of contents statistical control method applied through a prepackaged item metrological control of pre-packed, to assess the conformity of the consignment of the requirements of this regulation. 3. Market offers only prepackaged goods which comply with the rules laid down in chapter II metrological requirements and is marked according to the provisions of chapter III. 4. the packaging of the goods to prepackaged products weight (nominal mass) or volume (nominal volume), liquid products saturošaj-fasētaj items indicate their nominal capacity, except when the trade practice in the special law to the contrary. 5. the bulk of the nominal volume of the product indicates the units of volume — litres (l, L), centilitres (cl, cL) or millilitres (ml, mL). The nominal mass of the goods in the case of point mass units, in kilograms (kg) or grams (g). Nominal volume or mass claims is not allowed to add the allowable values of deviations.
II. Metrological requirements laid down for the placing of the market of goods 6. fasētaj bulk commodity quantity of contents shall meet the following requirements: 6.1. equal nominal quantity of goods fasētaj the actual quantity of contents shall not be less, on average, than the nominal quantity indicated on the label; 6.2. the separate quantities of contents of prepackages negative deviation allowed specify that table 1 of annex 1. The number of prepackages containing the negative deviation of the quantity exceeding that allowed values of pre-packaged goods lot, is small enough to fit the lot of prepackaged rules referred to in annex 2 to the reference test acceptance criteria; 6.3. all packaging which contains quantities of negative deviation exceeds the value that is two times the size of that rule 1. table 1 of the annex contains the allowable negative deviation must not be tagged with this rule 10, paragraph "e" mark of conformity. 7. the bulk commodity statistical control methods (reference test) are defined in annex 2 to these rules. 8. If the quantity of the product is expressed in units of volume, the size used for the bulk of the goods the actual volume of the contents, all control activities measured at a temperature of 20 ° C or corrected for 20 ° C accordingly irrespective of the temperature at which the product is pre-packaged or controlled. This requirement does not apply to deep frozen or frozen products, the quantity of which is expressed in units of volume.
III. the bulk commodity information appearing on the label 9. Bulk goods that meet the requirements of these regulations, may be marked with the "e" mark of conformity to the unit next to the product of the nominal weight or nominal volume, certifying that the prepackage meets the requirements of this regulation. IV. the bulk commodity metrological control of Pre-packed goods 11. manufacturer and importer when placing pre-packaged goods market, is responsible for the content of the goods in bulk quantities and indicated on the package label compliance with the requirements of this regulation. For pre-packaged goods of corresponding offering for the Latvian market is responsible for the bulk of the goods dealer. 12. the bulk commodity producer has the following responsibilities: 12.1. production process to ensure the systematic and effective prepackaged product contains the actual quantity control and guarantee this provision as referred to in point 6 requirements. For this purpose: 12.1.1. in the process of packing and the actual contents of prepackages control verify the quantity used or calibrated measurement features, providing the measurement traceability to national or international measurement benchmarks. Measuring means verification in accordance with the laws of the state metrological control of measuring instruments subject to list. If the means of measurement are not included in that list, it will calibrate the user-defined calibration intervals. Mass, volume and density measurement of metrological parameters check funds taking into account the content of the goods in bulk quantity, nominal value; 12.1.2. If a prepackaged product contains a quantity expressed in units of volume and packing of the goods in the process of ensuring compliance with the quantity of contents shall be used for measuring (measuring), those measuring containers and filling conditions must comply with the laws on the metrological requirements bottles used as measuring containers, and their metrological control; 12.2. take a prepackaged product contains the actual quantity control records, documenting the results of inspections and testing, as well as the means of verification of measurement and calibration data. This information shall be kept for one year or until the prepackaged goods expires, if more than one year, and upon request, submit the consumer rights protection centre; 12.3. to carry on with the "e" mark of conformity of prepackaged goods marked a lot of statistical control records, documenting the information for the selected sample mean and standard deviation, the data from which these values are derived, as well as information on product packaging line, packing date and lot identification. This information shall be kept for one year or until the goods expires, if more than one year, and upon request, submit the consumer rights protection centre. 13. Taking the bulk production of goods with the "e" mark of conformity marking, the manufacturer of the goods in the case before the placing on the market shall notify it to the consumer rights protection centre. The notification shall specify: 13.1. manufacturer's name or trade mark; 13.2. the manufacturer's registered office and registration number; 13.3. prepackaged product name; 13.4. nominal quantities of contents of prepackages; 13.5. packaging (handmade, dividing line). 14. Bulk goods, the importer provides a prepackaged product compliance with this provision in point 6. 15. the importer of the goods Packed before the placing on the market with the "e" mark of conformity marked prepacked goods, notify the consumer rights protection centre. The notification shall specify: the name of the importer, 15.1; 15.2. the importer's legal address and the registration number; 15.3. prepackaged goods manufacturer's name or trade mark; 15.4. prepackaged product name; 15.5. content of prepackages the nominal quantity. 16. where a prepacked goods marked with "e" mark of conformity, the importer certifies conformity of the goods, taking all the necessary measures to ensure the systematic and effective bulk goods the actual quantity of content control and guarantee this provision as referred to in point 6 requirements. A prepackaged product contains the actual quantity control records, documenting the results of inspections and testing, as well as the means of verification of measurement and calibration data stored for one year or until the goods expires, if more than one year, and upon request, submit the consumer rights protection centre. 17. If these provisions are not taken the measures referred to in paragraph 16, the importer will provide one of the following documentary evidence the goods in bulk quantity of content for compliance, which, upon request, submit the consumer centres: 17.1. Member State of the European Union or the European Union recognised the competent authorities in the country of the manufacturer issued assurances on pre-packaged goods manufacturer control system assessment results; 17.2. the Member State of the European Union or national competent authorities by the manufacturer of the goods in bulk issued statistical control; 17.3. the manufacturer of the goods in bulk issued statistical control results. In this case, the importer concerned, periodically checks the conformity of the goods in the case of paragraph 6 of these rules. A prepackaged product contains the actual quantity control records, documenting the results of inspections and testing, as well as the means of verification of measurement and calibration data stored in another year or so prepackaged goods expires, if more than one year. 18. Prepackaged goods marked with "e" mark of conformity and manufactured in the Member States of the European Union or the European economic area countries, be considered to satisfy the requirements of this regulation without documentary proof of the prepackaged product contains a quantity of compliance. 19. the bulk commodity metrological control at the manufacturer, importer or distributor shall take consumer protection centre, in order to assess the actual content of the goods in bulk quantity in compliance with paragraph 6 of these rules. For this purpose the consumer rights protection centre officials have the right to take samples of the goods in bulk and make reference to the tests in accordance with the provisions of annex 2 of the statistical control methods and criteria for the selection of the sample. 20. If the rules referred to in point 19 control found that the bulk of the consignment does not comply with this rule 6.2. criteria referred to in regard to the content of the actual quantity of negative deviation of consumer protection officials of the Centre shall be entitled to suspend the marketing of the consignment to the non-compliance found. 21. If the manufacturer, the importer or the Distributor has prevented a discrepancy found, including inappropriate lot is pārfasēt, it changed label or select invalid packing unit, a manufacturer, importer or distributor shall inform the consumer centres. Consumer rights protection centre shall assess the results of the activities or commit a lot of non-conforming and, if discrepancies are resolved, its marketing authorisation.
V. concluding questions 22. Be declared unenforceable on 22 May 2001, Regulation No 201 "provisions on metrological requirements fasētaj of the goods and their metrological control arrangements" (Latvian journal, 2001, nr. 81; 2006, 144. no). 23. the bulk commodity producers and importers who launched the placing on the market of prepacked goods with "e" mark of conformity marking to the date of entry into force of rules for it until 2014 January 1, inform the consumer centres.
