Cabinet of Ministers Regulations No. 243 in Riga 2014 (13 May. 28. § 12) the rules on the State of the European Union and the granting of aid for the promotion of investment in agriculture under the agricultural and rural development Act article 5, fourth paragraph 3.1 and i. General questions 1. determines the order in which the State and the European Union support as well as support the award criteria and the amount of the following measures: 1.1. interest for partial deletion of agricultural primary producers, agricultural service cooperatives and agricultural products processing merchants; 1.2. research and laboratory analyses of related material base development. 2. The objective of the aid is to promote agricultural and rural development of the investment project implementation and improvement of material base in accordance with the following regulations: 2.1 on the national and European support for the open project submissions in the form of a competition event "modernisation of agricultural holdings"; 2.2. about the national and European support for rural development measure "agricultural added value". 3. the aid provided for in these provisions total funding is eur 6 450 000, of which eur 3 500 000 is granted: 3.1.-partial deletion primary agricultural producers; 3.2.350 000 euros interest granted partial deletion appropriate agricultural service cooperatives; 3.3.500 000 euros interest granted partial deletion, agricultural products processing merchants that meet the micro, small and medium company category in accordance with the Commission on 6 august 2008, Regulation (EC) No 800/2008, which recognize certain categories of aid compatible with the common market in application of articles 87 and 88. (General block exemption regulation) (Official Journal of the European Union, august 9, 2008, no L 214) The classification set out in annex I, and type the following in the statistical classification of economic activities (NACE Rev. 2) codes: 3.3.1 group 10.1-meat and meat products production, processing and preservation; 3.3.2. the group 10.3-fruit and vegetable processing and canning; 3.3.3. the group 10.5-manufacture of dairy products; 3.3.4. Group-grain milling 10.6 products, manufacture of starch and starch products; 3.3.5. the band 10.7-confectionery and flour products; 3.3.6. the Group 11.07 – soft drinks, except mineral waters and other bottled waters, production; 3.3.7. the group 10.41-oils and fats production; 2 100 000 euro grant with 3.4 research and laboratory analyses of related material base development. 4. the rules referred to in paragraph 3, eligible legal or natural person who is registered to the State revenue service as a tax payer or agent of economic activity (hereinafter the applicant). 5. In chapter V of these regulations support the eligible expenses include value added tax, if it is not recoverable from the State budget. 6. This provision 17, 26, 28, 35 and application referred to in paragraph 46 and accompanying documents submitted by the applicant in the form of a paper document (by adding or sending an electronic version) or electronic form of a document, if the document has been prepared according to the law on electronic document design. 7. The applicant in the form prescribed in these provisions shall provide support services in the field of formal business or a copy of the summary that indicates the provider name, transaction ID, the requested date, number and the amount paid. 8. Aid shall not be granted: 8.1 ailing tenderer who: 8.1.1. by a judgment is rendered in insolvency proceedings or the legal protection is implemented in the process, with the decision of the Court is an out-of-court redress process, previous bankruptcy, or the restoration of a suitable composition or that economic activity has been terminated; 8.1.2. the date of submission of the application the damage exceeds half of the share capital and the last 12 months – a quarter of the capital and found the provisions of 8.1.4. signs referred to. L 352) (hereinafter referred to as Commission Regulation No 1408/2013) article 1, paragraph 1, the set actions.
9. On this rule 12.2, 12.4, and in paragraph 21.2. aid referred to in paragraph 31 shall not apply the provisions of 8.1.2.8.1.3 and 8.1.4., the requirements referred to in point. 10. the rural support service: 10.1. place on its Web site information about the award and the costs of the aid arrangements; 10.2. in accordance with the laws and regulations on the procedures for granting state aid in the European Union for the development of the rural and fisheries, evaluate the application of the applicant's conformity with the requirements laid down in these provisions and in the month following receipt of the application, shall take a decision on the approval or rejection of the application; 10.3. random checks for no less than one percent of beneficiaries in each event, including public authorities and public corporations, if those rules do not specify other control arrangements; 10.4. the cost of the aid to the applicant in non-cash form of payment, not exceeding the provision referred to in paragraph 3, the funding of the aid measure. If the demand exceeds the allocated funding for rural support service to take account, in proportion to the reduced amount of aid payable; 10.5. this rule 21.2. in subparagraph and paragraph 31, as well as 40.4. and 25.2. aid referred to in this provision 39. applicants referred to in paragraph 1, the aid shall not exceed the cost of the Commission Regulation No 1407/2013 article 3 (2) the amount of the aid specified in one single company in accordance with Commission Regulation No 1407/13 paragraph 2 of article 2; 10.6. This provision of the aid referred to in paragraph 13, does not exceed the cost of Commission Regulation No 1408/2013 article 3 (2) the amount of the aid specified in one single company in accordance with Commission Regulation No 1408/13 paragraph 2 of article 2; 10.7. data on paid support for 10 years from the date of granting of the aid; 10.8. in the month following the detection of the offence according to the laws and regulations on the procedures administered by the European agricultural guarantee fund, European agricultural fund for rural development and the European Fisheries Fund, as well as national and European Union support for agriculture, rural development and fisheries, demanding repayment of the aid, if the applicant provided false information or violated the requirements in these rules. II. Support for the deletion of the partial interest primary agricultural producers 11. Objective of the aid is to promote the rational and efficient agricultural production, reducing the cost of production and the introduction of modern production technologies. 12. the applicant is engaged in the primary production of agricultural products and not found for this rule 8.1.1. signs referred to, can receive support to cover part of the long-term loan actually paid in or capital lease amount of annual interest on long-term (longer than 12 months from the date of conclusion of the contract), or financial leasing loan for the following: 12.1. new agricultural implements (including combine, self-propelled plant grinders , sprinkler), trailers and agricultural technological units, which is used for the operation implements; 12.2. the breeding of farm animals; 12.3. the new structure of agricultural production, construction and reconstruction of existing buildings and the operation of the necessary equipment and technological equipment (including software); 12.4. the acquisition of agricultural land, which is used for the production of agricultural products. 13. support for the long-term loan of breeding livestock purchase and the acquisition of agricultural land, which is used for agricultural production or financial leasing interest for clearance granted in accordance with Commission Regulation No 1408/2013 After receiving aid applicant comply with Commission Regulation No 1408/2013 article 1, paragraphs 2 and 3. 14. The rules referred to in point 12 of the aid shall be granted for the following measures: 14.1 the purchase implements, as well as trailers and agricultural technological units for purchase, if it is used the aid to rural development by the European agricultural fund for rural development (EAFRD); 14.2. the separate facilities and technological equipment purchase, if it is not related to the agricultural production structure construction or reconstruction; 14.3. the loans issued by State joint stock company "Latvian mortgage and land bank" or national joint stock company "Latvian development financial institution", "Viola": 14.3.1. loans associated with long-term investment in agriculture lending program; 14.3.2. loan related to the acquisition of agricultural land in the lending programme; 14.3.3. the loans associated with investment lending programs; 14.4. the loans issued by State joint stock company "rural development" in accordance with the legislation on State aid procedure for acquisition of agricultural land for agricultural production; 14.5. the loans provided by the lender, which does not meet at least one of the following conditions: 14.5.1. has received financial and capital market Commission or consumer protection Center issued permission (license) lending services; 14.5.2. unpublished financial and capital market Commission website for credit market participants ' list; 14.5.3. not considered linked enterprises this provision and 14.5.2 14.5.1. referred to lenders; 14.6. loan transactions conducted up to January 1, 2002 and the related to the acquisition of agricultural land; 14.7. the loan taken for the purchase of the privatisation certificates to redeem the agricultural land; 14.8. to refinance loan transactions conducted up to January 1, 2013 and the related to the acquisition of agricultural land; 9.3. short-term loans (no longer than 12 months), in which the duration is extended every year. 15. The amount of aid is the amount, not exceeding the loan annual interest rate of four percent, or effective rate, if the interest rate is less than four percent. The maximum amount of aid per applicant, during the year does not exceed eur 60 000. 16. The rules referred to in point 12 of the total of long-term investment aid intensity did not exceed 40 percent of the investment amount of eligible expenses and 50 percent if the economic operator is located in a less-favoured area in accordance with a Council of 20 September 2005 Regulation (EC) No 1698/2005 on support for rural development by the European agricultural fund for rural development (EAFRD) (Official Journal of the European Union, 2005 21 October , No L 277) (hereinafter referred to as Commission Regulation No 1698/2005) article 26, paragraph 2, and article 36, point "a" to "i", "ii" and "III". The aid intensity is increased by 10 percent, if an investment implements new farmers who comply with the laws and regulations of the country and the European Union support the procedure for payment of refunds in the form of event "young farmers" explanation given. 17. for the provision of aid referred to in paragraph 12, the tenderer from 2014 1 October to 20 October for the period from 1 October 2013-2014 30 September Field support regional agricultural administration submitted: 17.1. application (annex 1); 17.2. the credit or financial lease a copy of the contract; 17.3. the amended credit agreement or financial lease a copy of the contract, if there is a change in credit or financial leasing agreement; 17.4. a credit institution or financial leasing of the introductory part of this paragraph for the period referred to in the loan on or before the closing date for the interest actually paid. If one credit or financial leasing contracts issued loan more objects, in separate statement indicates the ratio of the amount actually paid in euro for each object, if it is technically possible. If you have a variable interest rate, the certificate shall state the period interest actually paid an average rate; 17.5. credit or financial leasing transactions-copies of documents proving the purchase or the Merchant Agreement (construction contract) and related documents of payment (if purchase is made or service provided without a written contract, submit proof of payment), the fixed asset list trailers intended for agricultural technological units, if they are not registered with the State technical supervisory agency's database; 10.9. ownership of copies of the supporting documents for the technical, trailers for agricultural technological units and structures, if they are put into service within a period of 24 months from the commencement of the construction, as well as the land on which the building, and agricultural land; 17.7. the applicant's evidence that the technological facilities and equipment at the date of application is the property of the applicant and the long-term lease a copy of the contract or a copy of the financial leasing agreement, which provides that after financial leasing payment technological machinery and equipment remain the property of the applicant; 11.1. the adoption of the legislation on building commissioning (if construction is not complete, the planning permission) or, if there is a simplified reconstruction – receipt card and job transfer and adoption of legislation; 11.1. the breeding animal birth certificate copy, as well as transaction and payment, copies of the supporting documents; 17.10.12.2. these rules and 12.4, referred to form of de minimis aid received in accordance with the laws and regulations on the procedures for administering and monitoring State aid granted under Commission Regulation No 1408/13 18. If this provision, paragraph 17, documents have been submitted in support of the regional agricultural administration, the applicant failed to submit them again, except that rule 17.10. referred to. 19. If submissions specified the amount of aid payable exceed this provision provided for in point 3.1, the rural support service be reduced proportionately to the amount of the aid to be paid to the applicant, which during the year more than 40 000 euros. III. Support for the partial deletion of relevant interest for agricultural service cooperatives 20. The objective of the aid is to promote agricultural service cooperatives development of rational and efficient, reducing production costs and introduce modern production technologies. 21. According to the legislation on agricultural service cooperatives recognised conformity assessment for agricultural service cooperative society (hereinafter referred to as the cooperative society) the aid granted: 21.1. new road, a new cargo and compensated in agricultural production structures for construction, as well as the operation of the necessary equipment and technological equipment (including software) designed for the purchase of long-term loans (more than 12 months from the date of conclusion of the contract) or financial leasing interest part of the deletion; 21.2. the short-term loan (no more than 12 months) and factoring interest for partial deletion in accordance with Commission Regulation (EC) No 1407/2013 After receiving aid cooperative shall comply with the provisions of Commission Regulation No 1407/2013 article 1, paragraph 2. 22. aid to cover part of the long-term loan actually paid or financial leasing, as well as short term loan or interest year factoring. The amount of aid is the amount, not exceeding the loan annual interest rate of four percent, or effective rate, if the interest rate is less than four percent. The maximum amount of long-term loans or financial leasing, as well as the short-term loan, or factoring (subject to this rule 8.2 and 10.5. the requirements referred to in point) per applicant, during the year does not exceed 185 000 euros. 23. The rules referred to in paragraph 21 of the aid shall be granted for the following measures: 23.1. implements, trailers and agricultural technological units for purchase; 23.2. the separate facilities and technological equipment purchase, if it is not related to the agricultural production structure construction or reconstruction; 23.3. the loans provided by the lender, which does not meet at least one of the following conditions: 23.3.1. has received financial and capital market Commission or consumer protection Center issued permission (license) lending services; 23.3.2. unpublished financial and capital market Commission website for credit market participants list; 23.3.3. not be considered related business provisions 23.3.1 23.3.2 this. and. lenders referred to; 23.4. loans issued by State joint stock company "Latvian mortgage and land bank" or national joint stock company "Latvian development financial institution" Viola "and" related to working capital or investment lending programs; 14.6. short-term loans (no longer than 12 months), in which the duration is extended each year; 14.7. erode with a full mass up to 3.5 tonnes, as well as trailers, semi-trailers and equipment purchase. 24. in Support of long-term loans (more than 12 months from the date of conclusion of the contract) or financial leasing interest part of the deletion can receive cooperative society, which has received long-term loans or financial leasing of a new road, a new cargo of agricultural structures construction and reconstruction, as well as the operation of the necessary equipment and technological equipment (including software). 25. This rule 21.1. long-term investment referred to in the overall aid intensity does not exceed 40 percent of the investment amount of eligible expenses and 50 percent if the economic operator is located in a less-favoured area in accordance with the Council Regulation No 1698/2005 article 26, paragraph 2, and article 36, point "a" to "i", "ii" and "III". 26. for this rule 21.1. aid referred to cooperative societies from 2014 1 October to 20 October for the period from 1 October 2013 to 2014 and 30 September in the rural support service: 26.1. submission (annex 2); 26.2. the credit or financial lease a copy of the contract; 26.3. the amended credit agreement or financial lease a copy of the contract, if there is a change in credit or financial leasing agreement; 26.4. the credit institution or financial leasing of the introductory part of this paragraph for the period referred to in the loan on or before the closing date for the interest actually paid. If one credit or financial leasing contracts issued loan more objects, in separate statement indicates the ratio of the amount actually paid in euro for each object, if it is technically possible. If you have a variable interest rate, the certificate shall state the period interest actually paid an average rate; 26.5. credit or financial leasing business identity document (2. part 3 of the annex), purchase or merchant agreement (construction contract) and the associated payment document summary (if purchase is made or services delivered without a written contract, submit evidence of payments Summary); 16.5. property rights, copies of the supporting documents for freight transport and buildings, if they are put into operation in the 24 months after the commencement of the construction, as well as the land on which the building; 16.6. the applicant's evidence that the technological facilities and equipment at the date of application is the property of the applicant and the long-term lease a copy of the contract or a copy of the financial leasing agreement, which provides that after financial leasing payment technological machinery and equipment remain the property of the applicant; 16.7. the adoption of the legislation on building commissioning (if construction is not complete, the planning permission) or, if there is a simplified reconstruction – receipt card and job referrals and acceptance. 27. If the rules referred to in paragraph 26 of document is submitted to the rural support service, the applicant failed to submit them again. 28. for this rule 21.2. aid referred to cooperative societies from 2014 1 October to 20 October for the period from 1 October 2013 to 2014 and 30 September in the rural support service: 28.1. submission (annex 3); 28.2. the credit agreement or a copy of the contract of factoring; 17.6. a credit institution or financial leasing of the introductory part of this paragraph for the period referred to in the loan on or before the closing date for the interest actually paid. If you have a variable interest rate, the certificate shall state the period of interest actually paid an average rate; 28.4. the cooperative society of the Board for the purpose of use of credit; 28.5. form of de minimis aid received in accordance with the laws and regulations on de minimis aid tracking and allocation procedure and de minimis aid in the form of samples. 29. If submissions specified the amount of aid payable exceeds that laid down in point 3.2 of the rules, the rural support service shall be reduced on a pro rata basis to the applicant the aid to be paid shall be that portion of the current year exceeds 60 000 euros. IV. Support for the deletion of the partial interest agricultural products processing merchants 30. The objective of the aid is to promote the rational and efficient development of agricultural products processing, reducing the cost of production and upgrading manufacturing technology. 31. support can be obtained from the processing of agricultural products trader (trader) that is assigned a long term (longer than 12 months from the date of conclusion of the contract) the lending or financial leasing of a new acquisition of road freight transport vehicles, which do not carry out commercial, new structures from the processing of agricultural products for the construction and renovation of existing buildings, as well as the economic operator's economic activity and technological equipment required equipment (including software). 32. The amount of aid is the amount, not exceeding the loan annual interest rate of four percent, or effective rate, if the interest rate is less than four percent. 8.2. Subject to this provision and requirements referred to in paragraph 10.5., the maximum amount of aid per applicant, during the year does not exceed 185 000 euros. 35. for the provision of aid referred to in paragraph 31, the 2014 applicant from 1 October to 20 October for the period from 1 October 2013 to 2014 and 30 September in the rural support service: 21.8. submission (annex 4); 35.2. credit or financial lease a copy of the contract; 35.3. the amended credit agreement or financial lease a copy of the contract, if there is a change in credit or financial leasing agreement; 35.4. a credit institution or financial leasing of the introductory part of this paragraph for the period referred to in the loan on or before the closing date for the interest actually paid. If one credit or financial leasing contracts issued loan more objects, in separate statement indicates the ratio of the amount actually paid in euro for each object, if it is technically possible. If you have a variable interest rate, the certificate shall state the period interest actually paid an average rate; 22.1. credit or financial leasing business identity document (annex 4, part 3) – a purchase or contract of the economic operator (construction contract) and the associated payment document summary (if purchase is made or services delivered without a written contract, submit evidence of payments Summary); 35.6. the property right certificate copy of freight road transport and buildings, if they are put into operation in the 24 months after the commencement of the construction, as well as the land on which the building; 22.2. the applicant's evidence that the technological facilities and equipment at the date of application is the property of the applicant and the long-term lease a copy of the contract or a copy of the financial leasing agreement, which provides that after financial leasing payment technological machinery and equipment remain the property of the applicant; 22.2. the adoption of the legislation on building commissioning (if construction is not complete, the planning permission) or, if there is a simplified reconstruction – receipt card and job transfer and adoption of legislation; 22.3. form of de minimis aid received in accordance with the laws and regulations on de minimis aid tracking and allocation procedure and de minimis aid in the form of samples. 36. If the rules referred to in paragraph 35 documents are filed in the Field Service, the applicant failed to submit them again, except that rule 22.3. referred to. 37. If submissions specified the amount of aid payable exceed this provision provided for in point 3.3, the rural support service shall be reduced on a pro rata basis to the applicant the aid to be paid shall be that portion of the current year exceeds 60 000 euros. V. support for investment in research and laboratory analyses of related material base development 38. Objective of the aid is to improve the material basis, to ensure that the sectoral policy development and development-related research, as well as consumer interests associated with laboratory analyses. 39. the support shall be granted following this provision in paragraph 38 that aim to implement related measures: refurbishment of buildings and 39.1. overhaul; 24.4. hardware and software, as well as measuring instruments, equipment and installations; 39.3. forklift, mowers, agricultural implements and the purchase of the unit; 24.5. Office equipment and the purchase of equipment; 24.5. laboratory equipment and installations. 40. support may get applicants that meet at least one of the following requirements: 24.9. is registered to the register of scientific institutions for at least five years and provide students training in accordance with accredited higher education national programs agriculture, food, forestry and veterinary medicine; 40.2. provide students practical training for at least five years, as well as advisory and scientific research activities in accordance with the higher education national programmes in the agricultural sector; 40.3. laboratory and diagnostic examinations in relation to the national monitoring and control of the food chain, animal health, animal feed and the movement of veterinary medicinal products; 40.4. performing national rural and fisheries cooperation network secretariat functions in accordance with the laws and regulations on the procedures administered by the European agricultural guarantee fund, European agricultural fund for rural development and the European Fisheries Fund, as well as national and European Union support for agriculture, rural development and fisheries, and the whole territory of Latvia provides consulting services to agricultural, forestry and fisheries sector and rural development; 25.2. ensure reclamation cadastre data maintenance and updating according to the reclamation Act; 40.6. Scientific institutions is registered in the register and has developed and the Ministry of Agriculture approved the development strategy 2015 and subsequent years, the institutions that perform: scientific work 40.6.1. cereal breeding, as well as to ensure the protection of genetic resources, species, cereals or potatoes and their sustainable use; 40.6.2. scientific work in connection with the selection of perennial grassland and random seed production, as well as agrotehnisko studies crop husbandry industry; 40.6.3. research and education work of the machinery and technology, promoting the practical use of the results; 40.6.4. scientific operations in the area of cultivation, providing expertise in the cultivation sector policy development and scientific grounds for its implementation and promoting science and education, as well as the integrated development of the Latvian fruit and Berry on the protection of genetic resources and their sustainable use. 41. This provision and 40.4 40.5. the tenderer referred to in the aid granted under Commission Regulation (EC) No 1407/2013, if the applicant complies with the provisions of Commission Regulation No 1407/2013 article 1, paragraph 2. 42. This provision and 40.4 40.5. applicants referred to does not apply this provision, 8.1.3 and 8.1.4 8.1.2. the requirements referred to in point. 43. This provision, 40.2, 40.3 24.9..., and 40.6. applicants referred to projects not related to economic activity. 44. the meaning of these provisions with the unrelated economic activities is a project that meets the following criteria: 44.1. the project scientific institution, regardless of its legal status (public law or private law entity) or the type of financing according to its governing documents (statutes, regulations or Constitution) performs the following basic steps-scientific activities and the dissemination of the scientific results of the transfer of knowledge and technology; 44.2. revenue accruing from implementing this rule 44.1. operating activities referred to, are invested in core business; 44.3. the applicant does not distinguish between economic activity and related financial flows of economic actions. 45. no aid shall be granted for the construction of new buildings and erode. 46. Submission (annex 5) acceptance issued in accordance with the laws of the State of the European Union and the granting of aid for rural and fishery development. 47. for investment aid, the applicant submission adds: 29.3. Ministry of agriculture coordinated expenditure; 47.2. VI. final question 49. Be declared unenforceable in the Cabinet of Ministers of 13 November 2012 Regulation No 775 "procedures for granting state aid in the European Union for the promotion of investment in agriculture and the improvement of material base" (Latvian journal, 2012, 185, 197. no; 13.127.233.,, no).
