No 33 56) of electrical and electronic equipment and batteries or batteries producer registration order and payment procedures for the maintenance of the data released under the waste management Act, article 24, second and fourth paragraphs, and article 31, third and fourth part i. General questions 1. determines: 1.1. electrical and electronic equipment manufacturers (hereinafter equipment manufacturers) and their authorized representatives in order of registration; 1.2. the amount of the equipment manufacturer data maintenance of electrical and electronic equipment manufacturer in the register (hereinafter register of producers of equipment) and payment arrangements; 1.3. battery or battery manufacturer (hereinafter referred to as the battery manufacturer) registration procedures; 1.4. the manufacturer of the battery or accumulator register (hereinafter register of producers of batteries) of the holder; 1.5. the amount of the battery manufacturer maintenance battery producer register and payment arrangements. 2. equipment manufacturers or their authorised representatives register equipment manufacturer. Equipment manufacturer registry is a national information system, and they use provide the waste electrical and electronic equipment management monitoring information required. Equipment manufacturer register holder is the Latvian electrical engineering and electronics industry association (hereinafter Registrar). Equipment manufacturer registry administrator is the protection of the environment and regional development Ministry (hereinafter referred to as the Ministry). 3. Battery manufacturers recorded in the register of producers of batteries. Battery manufacturers ' registry is a national information system-registry-equipment manufacturer. The manufacturer of the batteries using the registry ensure that batteries and accumulators waste management monitoring information required. Battery manufacturers register holder is a registrant. 4. for equipment manufacturers or their authorised representatives register of registered equipment manufacturer, but the battery manufacturers-manufacturers of the batteries to the registry, the Registrar shall issue administrative acts. 5. The registrant or their authorised equipment manufacturer representatives are recorded on the basis of the contract concluded with the Ministry. 6. Registrant on its website provides links to other European Union Member States ' registers of producers in all the Member States to facilitate equipment manufacturers or their authorised representatives. The Registrar may cooperate with other institutions from the Member States of the European Union or the European Commission in relation to the electrical and electronic equipment waste management legislation and provide access to relevant information and documents, also using electronic means of communication.
II. Equipment manufacturers or their authorized representatives in order of registration 7. Equipment manufacturer or its authorized representative month after waste management launched a legal action with the electrical and electronic equipment, shall submit an application for the registration of the registrant (annex 1) together with the prepayment card for this rule 37.1. payment referred to and register with the register of producers of equipment that sorts the registrant. 8. If the authorised representative is authorized to represent the number of equipment manufacturers, it made these rules 7 and 8 of the documents referred to in paragraph 1 for each foreign equipment manufacturer that it is authorized to represent. Authorised representative shall carry out this rule 37.1. the remuneration referred to in paragraph separately for each manufacturer that it is authorized to represent. 10. If the electrical and electronic equipment and waste than the equipment manufacturer or its authorized representative, but another operator, equipment manufacturer or its authorized representative shall provide the registrant issued this operator's written acknowledgement of receipt of the contract concluded with the equipment manufacturer or its authorized representative on the waste electrical and electronic equipment management. 11. The Registrant within five working days after receipt of the application, or this provision in paragraph 11 of that information or document, the receipt shall take a decision on the equipment manufacturer or its authorized representative registration, giving it a registration number, or the refusal to register the equipment manufacturer or its authorized representative within three working days by giving the equipment manufacturer or its authorized representative. 14. the decision on refusal to register the equipment manufacturer or its authorized representative, if the registrant accepts: 14.1. This provision has not been submitted in annex 1 or paragraph 10 of these rules mentioned in the document; 14.2. This provision in annex 1 or paragraph 10 of these rules mentioned in the documents are incomplete, do not meet the requirements of this regulation or of these rules have not been submitted within the time limit referred to in paragraph 11; 14.3. the equipment manufacturer or its authorized representative the information supplied is false; 14.4. No prepayment card for this rule 37.1. payment referred. 15. Equipment manufacturer or its authorized representative within 10 working days, inform the Registrar of any equipment manufacturer to include in the message the registry changes, submit a request for changes to the equipment manufacturer information in the registry (annex 1). In this case, the registrant ensure the equipment manufacturer to the updating of the information contained in the register of five working days from the date of receipt of the application. The registrant is entitled to update equipment manufacturer information included in the register on the basis of publicly available from other national information systems of the information received. 16. If the equipment manufacturer or its authorized representative broke the law on waste management activities of electric and electronic equipment, equipment manufacturer, its authorized representative, equipment manufacturer administrator or liquidator or equipment manufacturer's authorised representative, an administrator or liquidator shall notify the Registrar in writing within 10 working days from the date of cessation of operations by submitting an application on the equipment manufacturer or its authorized representative from the equipment manufacturer registry (annex 2). Foreign manufacturer's authorised representative is excluded from the register of producers even if the foreign manufacturer has informed the Registrar that the foreign equipment manufacturer has withdrawn the authority. If that person does not provide such information, the registrant is entitled to use publicly available from other national information systems of the information received. In the cases referred to in this paragraph, a Registrar within three working days following receipt of the decision on the equipment manufacturer or its authorized representative from the equipment manufacturer registry and shall notify the manufacturer of the equipment, the equipment manufacturer's authorized representative, the equipment manufacturer to the liquidator or administrator or the equipment manufacturer's authorised representative, administrator or liquidator. 17. The Registrar in the register of producers of equipment include the following: 17.1. registered equipment manufacturer company, registration number in the register of companies or other national companies register, legal address, contact information; 17.2. the authorised representative of the manufacturer's company, register number in the register of companies, legal address, contact information; 17.3. the registered equipment manufacturer or its authorized representative of affiliate company, affiliate of the registered office, registration number in the register of enterprises; 17.4. the registered equipment manufacturer or its authorized representative the market of electrical and electronic equipment categories, the types and numbers of appropriate legislation on electrical and electronic equipment; 17.5. the registered equipment manufacturer or its authorized representative of Latvia to the market of electrical and electronic equipment; 10.9. the collected, reused, recycled, recovered and exported for processing outside Latvia registered the equipment manufacturer or its authorized representative of electrical and electronic equipment waste and the category under legislation on waste electrical and electronic equipment management; 17.7. news on electrical and electronic equipment and the distribution of electrical and electronic equipment waste. 18. This rule 17.5., 10.9. and 17.7. information referred to in the equipment manufacturer or its authorized representative, the registrant is entitled to submit the waste electrical and electronic equipment, the operator, if the equipment manufacturer or its authorized representative has entered into with the relevant contract. 19. If the equipment manufacturer or its authorized representative within the period in question has not carried out the annual fee for maintenance of equipment manufacturer's data in the register, the Registrar within five working days after this provision 40. the expiry of the period referred to in paragraph written notice the equipment manufacturer or its authorized representative on the shutdown of the equipment manufacturer and the register determined by the extended deadline of five working days, during which must make annual payments for equipment manufacturer maintenance register. If waste batteries and accumulators waste rather than the battery manufacturer, and another operator, battery manufacturer shall submit to the authorities of the registrant issued written acknowledgement of receipt of the contract concluded with the manufacturer of the batteries for batteries and accumulators waste management. 25. If the registrant does not provide all of the rules listed in the annex or not submitted in point 22 of these rules in those documents, the Registrar within five working days after the receipt of the submissions required from battery manufacturers the required information or documents with the identified deficiencies. The requested information or documents must be submitted within five working days of receipt. 26. the registrant information for accuracy and truthfulness is in charge the battery manufacturer or operator. 27. The Registrant within five working days after the application of these regulations or the document referred to in paragraph 25 of the receipt of the decision on registration of the manufacturer of the battery, giving it a registration number, or for a refusal to register the battery manufacturer, three working days notice to the respective battery manufacturer. 28. the decision on refusal to register registrant batteries manufacturers adopt, if not submitted this: 28.1. rule 1. information listed in the annex to these rules or documents referred to in paragraph 22; 28.2. the rules referred to in annex 1 or in point 22 of these regulations the following documents are incomplete, do not meet the requirements of this regulation or of these rules have not been submitted within the time limit referred to in paragraph 25; 28.3. the information submitted by the manufacturer of the batteries is false; 28.4. No prepayment card for this rule 37.2. payment referred. 29. the manufacturer of the Batteries within 10 working days, inform the Registrar of any battery manufacturer to include in the message the registry changes, submit a request for changes in the register of the producers of the batteries included in the information (annex 1). In this case, the registrant provides the battery manufacturer information included in the register of the updating of the five working days from the date of receipt of the application. The registrant is entitled to update the register of producers of batteries included, on the basis of the information available to the public from other national information systems of the information received. 30. If the battery manufacturer to stop waste management legal action with batteries or accumulators, batteries, a battery manufacturer manufacturer's administrator or liquidator shall notify the Registrant within 10 working days from the date of cessation of operations by submitting an application for the exclusion of producers of batteries battery producer registry (annex 2). The Registrar in the register of producers of batteries include the following: 19.3. producer of the registered business name of batteries, the registration number in the register of companies or other national companies register, legal address, contact information; 31.2. the battery manufacturer established affiliate company, affiliate of the registered office, registration number in the register of companies, business addresses, contact information; 31.3. the registered manufacturer of batteries on the market of batteries and accumulators; 19.5. the registered Latvian producer of batteries marketed quantities of batteries and accumulators; 31.5. the collected, processed, processing outside the Latvian export registered a battery manufacturer of batteries and accumulators, the nature and quantity of the waste; 19.6. news about the distribution of batteries and accumulators and waste batteries and accumulators waste. 32. This provision, 31.5 and 31.6 19.5..., the information referred to the battery manufacturer's site, the registrant is entitled to submit the waste batteries and accumulators the operator when the battery manufacturer it has entered into a corresponding contract. 33. If the manufacturer of the batteries during this period has not carried out the annuity payment for producers of batteries and accumulators maintenance register, the Registrar within five working days after this provision 40. the expiry of the period referred to in paragraph written notice battery manufacturer for exclusion from the register of producers of batteries and determine the extension of the period of five working days, during which you must take in consideration of the annual battery manufacturer's maintenance record. If the battery producers or registered for national information systems receive information on battery manufacturer's avoidance of registration or false or incomplete reporting of battery manufacturers register Registrant for five working days in writing inform the Ministry and the National Environment Department. 35. The registrant's decision can be challenged in administrative proceedings of the Ministry in accordance with the procedure prescribed by law. The Ministry's decision may be appealed to the District Administrative Court of the administrative procedure law.
IV. Payment for equipment and battery manufacturer's maintenance register 36. For maintenance of the register of the equipment manufacturer or its authorized representative and the battery manufacturer to make payment of the registrant in accordance with the provisions of paragraph 37. 37. Pay for maintenance of the register: 37.1. equipment manufacturer maintenance-€ 42.69 through registration, and € 42.69 for each subsequent calendar year; 37.2. the battery manufacturer's maintenance-€ 42.69 through registration, and € 42.69 for each subsequent calendar year. 38. After the equipment manufacturer, or the authorised representative of the manufacturer of the batteries received application for first-time registration in the register and verify its accuracy and compliance with the requirements of these rules, the registrant will invoice and shall send it by electronic equipment to the manufacturer, his authorised representative or the battery manufacturer. 39. For the maintenance of the register of the equipment manufacturer or its authorized representative and battery manufacturer paid with credit institutions. 40. the annual fee for the maintenance of the register of the equipment manufacturer or its authorized representative and the battery manufacturer paid in the current calendar year to 31 March, based on the electronic invoice received by the Registrar sends the equipment manufacturer, or the authorised representative of the manufacturer of the batteries before 1 March of the calendar year. 41.
