No 55 § 4) the provisions concerning the measurement procedure for metrological control of funds and the first verification marks Issued in accordance with the law "on a uniformity of measurements" the second subparagraph of article 6, article 9 of the sixth and the law "on conformity assessment" 7. the second paragraph of article i. General questions 1. determines: 1.1. state metrological control of measuring the subject features of metrological control (pattern approval and initial verification); 1.2. measuring means verification of the first markup samples; 1.3. order the state metrological control of measuring the subject features of market surveillance. 2. the rules apply to measuring instruments, measuring instruments, components, and equipment for additional devices, but does not apply to the following products: measuring 2.1. non-automatic scales; 2.2. water consumption meters for net in cold or warm water accounting; 2.3. gas consumption meters and proofreaders; 2.4. active electrical energy meters; 2.5. heat meter; 2.6. liquid (except water) systems; 2.7. automatic weighing instrument (except the automatic vehicle weight); 2.8. the taximeter; 2.9. material measures (length measuring and measuring the amount of beverage marketing); 2.10. the measuring dimensionāl features; 2.11. an exhaust gas analyser. 3. Measuring features are placed on the market, the market and put into use if they comply with the regulations of metrological requirements measuring instruments and metrological control requirements (hereinafter metrological requirements). Metrological requirements measuring before placing on the market, shall be ensured by means of measuring the type approval (hereinafter type approval), the type-approval certificate and type-approval mark. Metrological requirements, transfer of funds, the use of measurement provides a means of measuring the first verification (hereinafter referred to as the first verification), which represents the first verification mark. 4. measuring instruments is carried out at the national or the European Community (hereinafter the EC) type approval, as well as the first national or EC verification. Measuring instruments which the European Union lays down common metrological requirements in the national regulations of metrological requirements measuring instruments concerned, carry out the EC type-approval and verification of the EC first. The Ministry of economy in cooperation with the national metrology institutions and relevant technical standards Committee recommends that national bodies for standardisation in relation to these provisions, the reliance and designing standard applicable list. 10. National standardisation body on its official website published the list of Latvian national standard which can be applied to the requirements of these regulations (hereinafter referred to as the applicable standards). 11. National metrological institutions on its official website published by the international organization of legal metrology (hereinafter international documents) list, you can apply this provision requirements. 12. If the measuring tools designed to meet the applicable standards or published by international documents, considered that the measurement tools meet the metrological requirements. II. Type approval 13. Type approval is a prerequisite for a first-time verification. If according to the metrological requirements measuring features first-time verification is not required, the manufacturer or his authorized representative after the type approval the means of measurement are placed on the market or use. If according to the metrological requirements measuring instruments type approval is not required, take the first verification. 14. the application of the national type-approval of a manufacturer or his authorized representative (hereinafter applicant) shall submit the national metrology institutions, while the application for the EC type-approval shall be submitted in only one certification body. 15. If the means of measuring the type meets the technical requirements, the national metrology body issued a national type approval certificate, while the certification authority issued the EC type-approval certificate. 16. national type approval certificate shall be issued for a period of three years. EC type-approval certificate is issued for 10 years. Type-approval certificate validity period can be extended for the previous period. The applicant shall ensure that each measurement feature would be subject to type approval mark, which certifies its conformity to the approved type and is specified in the type approval certificate. 17. On the manufacturer's measuring instruments made changes or additions, the applicant shall inform the national metrology body or the certification authority which issued the type approval certificate. 18. The national metrology body or certification authority verifies that the changes affect the types of measurement. If the manufacturer's changes affect the type of means of measuring the results of the measurements or measuring instruments under certain conditions of use, the national metrology body or the certification body shall issue a type-approval certificate. If a measuring feature made significant changes (for example, change the metrological characteristics of the design, the material), the national metrology body or certification authority issuing a new type-approval certificate. 19. additional devices of the type-approval certificate shall specify: 19.1. types of measuring instruments, which includes relevant additional device or be equipped with them; 19.2. General conditions for the operation of the measuring means. 20. If the national metrology body or certification authority does not extend to the type-approval certificate, the period of validity of the measuring instruments that have been released for use until the certificate expires, the type approval is in effect. 21. the type approval of measuring instruments that use new technology, which is not designed for metrological requirements, national metrology body after consultation with the Ministry of economy issued a national type approval certificate with limited activity. Certification authority in such cases, the EC type-approval certificate issued with limited activity, after consultation with the Ministry of economy and other Member States of the European Union. Certificate of limited action can be determined: the number of means of measuring 21.1 limits; 21.2. the obligation to inform the applicant in writing of the national metrology body or certification authority for all measurement features installation sites; 21.3. the restrictions on the use of funds; 21.4. specific restrictions on the use of the technique. 22. the EC type-approval certificates with limited activity may be issued only after the entry into force of the relevant measuring instruments determine the metrological requirements, and only if these requirements do not allow derogations from the maximum permissible errors. 23. the type-approval certificate issued with limited activity for a period not longer than two years. Certification authority or national metrology authority may extend the validity period of up to three years. 24. On measuring instruments that meet the metrological requirements and which do not require the EC type-approval, the manufacturer is entitled to impose these rules laid down in annex 1. 25. The national metrology body or certification authority which approved the type, you can cancel the certificate of type approval in the following cases: 25.1. measuring features do not conform to the approved type or metrological requirements; 25.2. failure to comply with the type-approval certificate and this provision, paragraph 21; 25.3. the type-approval certificate granted unduly; 25.4. According to the approved type of measurement produced features found in type-specific defects which the measuring tool is not valid for the intended use. 26. following the withdrawal of the type-approval certificate of measuring instruments of the placing on the market and putting into use is prohibited. Certification body on the abolition of the EC type-approval shall inform the Ministry of the economy. The Ministry of economy shall inform the European Commission and the Member States of the European Union official missions. III. Application for type approval of the type approval Application 27 (hereinafter application) drawn up in accordance with the requirements laid down in these provisions and, together with the relevant documents submitted to the national metrology body or certification authority. A copy of the application for the EC type-approval, the applicant shall send to the Ministry of the economy. The Ministry of Economic Affairs sent a copy of the application to all Member States of the European Union official missions. 28. the application shall specify the following: 28.1. of the manufacturer or of his authorised representative, the name and registered office; 28.2. the measuring tools category; 28.3. field of use envisaged; 28.4. the type of measurement and metrological characteristics; 28.5. the trade mark or type designation. 29. the application shall be accompanied by the following documents (in the case of EC type-approval two copies): 29.1. measuring features Description: measuring the 29.1.1 construction and operating principles; 29.1.2. the protection measures that ensure the proper functioning of the measuring means; 29.1.3. means of measuring device for adjustment and control; 29.1.4. a first verification marks and a timestamp to be placed, if necessary; 29.2. General design drawings and, if necessary, detailed drawings of the main components; 29.3. the scheme illustrates the operating principle of the measurement, as well as, if necessary, the measurements of the photograph; 18.3. If the measuring instrument has been made a national type-approval, the EC type-approval application for the occasion of relevant documents. IV. Type evaluation the national metrology institutions 30 or certification authority performs document type of measurement and metrological evaluation. Certificate shall include the descriptions, images, and diagrams necessary to identify the approved type and measuring features. 36. Type-approval marks prescribed in these rules the model in annex 1. National type-approval mark is a rectangle that contains the distinguishing mark, certificate number and the year of issue. 37. the EC type-approval mark is a stylised letter "ε", which includes the following information: 37.1. upper part-approval of the issuing national identification mark (B-Belgium, BG-Bulgaria, CZ-Czech Republic, DK-Denmark, D-Germany, EST-Estonia, IRL-Ireland, Greece, Spain – EL-E, F-I-Italy, France, CY-Cyprus, Latvia, Lithuania, LT-LV, L-Luxembourg, (H) Hungary, (M) Malta, NL: Netherlands, –, A-Austria, PL – Poland , Portugal, RO-P-SI-Slovenia, Romania, Slovakia, FI-Finland-SEE, S – Sweden, UK – United Kingdom) and the approval of the last two digits of the year; 37.2. the bottom-type-approval identification number, which is granted by registration of the approved type. 38. the EC type-approval with limited activity approval mark the letter "P", which is the same size as a stylized letter "ε" which is placed before the EC type-approval mark. 39. the means of measurement, which requires no EC type-approval, marking, you can use the EC type-approval mark which the stylized letters "ε" reverse symmetrically along the vertical axis. 40. the means of measurement, which do not require verification of the EC first, apply the EC type-approval mark, put in the hexagon. 41. the type approval mark shall be affixed in a prominent place at each of the measuring means and all accessories. Type-approval mark must be clearly legible and indelible. Vi. Notice of the type approval certification authority issued 42. the applicant for a type-approval certificate and forward the original EC type-approval certificate a copy of the economic Ministry. The Ministry of economy, this information is sent to the European Commission and the other Member States of the European Union official representations, which, if necessary, may require additional documents relating to the conformity with the metrological requirements for evaluation. 43. The certification body on the refusal of EC type-approval shall inform the Ministry of the economy. First-time verification in the First 45. verification is new or updated product evaluation of measurement according to the approved type or metrological requirements. 46. the first verification, the inspection body: 46.1. make sure that the measuring instrument is performed on the type-approval and component type-approval mark; 46.2. determine whether a measuring tool to conform to the approved type; 46.3. If the measuring instrument is not required for type approval, check that it complies with the characteristics of the measuring and metrological requirements laid down in the technical construction and operating conditions; 46.4. evaluate measuring instruments and metrological characteristics of the maximum permissible error according to the metrological requirements; 46.5. the verification of the design of measuring compliance with the conditions of use of the label compliance, verification of the first mark, and a timestamp for the site; 46.6. appropriate metrological requirements oblige national first verification mark or the EC verification of the first mark (annex 2). 47. measurement features that are assigned to the EC first verification mark, until the end of the year in the Member States of the European Union without the restrictions placed on the market or put into use unless the metrological requirements measuring feature concerned is not specified otherwise. 48. On the means of measurement which is not required in the first verification, the manufacturer of the EC imposes special mark according to the provisions of annex 1. VIII. First stage of verification verification carried out 49. First one or several (usually two) stages. 50. the first verification carried out in one stage measuring means, which by their manufacturing to be delivered to the installation site, it is upsetting. 51. the verification of the First two or more stages take the measurement with the correct transaction is subject to the terms of use and installation. 52. X. First verification marks 56. EC verification marks first: 56.1. If the first verification shall be carried out in one stage, the verification tag consists of two stamps: 56.1.1. first stamp (2.1 and 3 of annex a) the letter "e", which includes the upper part of the distinguishing sign of the State (B-Belgium, BG-Bulgaria, CZ-Czech Republic, DK-Denmark, D-Germany, EST-Estonia, IRL-Ireland, Greece, Spain – EL-E, F-I-France, Italy , CY-Cyprus, Latvia, Lithuania, LT-LV, L-Luxembourg, (H) Hungary, (M) Malta, NL: Netherlands, –, A-Austria, PL-Poland, Portugal, Romania, P-RO-SI-Slovenia, SK, Slovakia, FI – Finland –, S – Sweden, UK – United Kingdom) together, where necessary, with one or two numbers that represent the territorial distribution. The seal is at the bottom of the inspection bodies of the identification number; 56.1.2. second seal (2.2 and 3 of annex b) form a hexagon that includes verification of the last two digits of the year; 56.2. the partial verification mark first creating this rule 56.1.1. referred to the first stamp (2.1 and 3 of annex a); 56.3. This provision of the annex 2 figure 1 and 2 reflect the EC seal of verification for the first different parts (shape, dimensions and outline of the letters), 3 a and 3 b – samples of stamps in the picture. The size indicated in the images (around the small letter "e", around the Hexagon, and drawn an ellipse of diameter circle) is relative. The actual diameters of the circles can be 1:6 mm, 3:2 mm, 6:3 mm, 5 mm. 57.12: national first verification mark (annex 4, Figure 2) is an ellipse, which includes the inspection body accreditation number, tag number and verification time. 58. the inspection bodies of the Member States shall exchange the EC first verification of the original image. 59. verification marks first taxation: 59.1. If measurement is verified and found to be appropriate metrological requirements, first on the verification of the measuring instrument in the space provided; 59.2. the partial verification marks first imposed: 59.2.1. the place where the attached stamp with a date, or at the place specified metrological requirements, if the verification of the first measurement is carried out in several stages, or the last stage of the measurement shall be carried out at the place of installation; 59.2.2. as a means of measuring the stamp location defined in the laws on the metrological requirements. XI. Market monitoring (the state metrological supervision) 60. consumer rights protection Centre carries out measuring market supervision, ensuring that the market would be put, and placed in service offered only by means of metering shall meet the metrological requirements and, according to the installed, maintained and used without risk to human health and life and did not cause any damage to the environment. 61. If the consumer rights protection Centre finds that measuring tool that has a type-approval mark and the first verification mark applied correctly for its intended purpose, however, is not an adequate metrological requirements or pose a threat to human health and life, or cause damage to the environment, it shall suspend release of the measuring and prohibit its placing on the market, use and send the measuring instrument to the manufacturer or its authorized representative reasonable notice as well as inform the Ministry of the economy. As regards the means of measurement with the EC type-approval of the Ministry of the economy shall report to the European Commission and the Member States of the European Union official missions on discrepancies and the measures taken. 62. If the consumer rights protection Centre finds that the measuring instrument is used for the marking of means of measurement that could be confused with the EC mark or marking, it concerned the measuring stop placing and placing on the market. XII. concluding issues 63. Be declared unenforceable in the Cabinet of Ministers of 28 June 2005, the provisions of no. 455 "arrangements are being made to measure the type approval, initial verification and market surveillance" (Latvian journal, 2005, nr. 102.; 2006, 25, 163.
