The Republic of LATVIA Cabinet of Ministers 1998 April 14, regulation. 136 in Riga (19.2) nuclear material accounting and control procedures are Issued in accordance with the law "on radiation safety and nuclear safety" 9. in the first paragraph of article i. General questions 1. terms used in the rules: 1. a protective boundary, methods or physical barriers that prevent access to nuclear materials and radioactive substances and their dispersal in the environment;
1.2. enrichment: uranium (U235 or U233) isotope mass relative to the total mass of uranium or plutonium (Pu239, or Pu241) the mass of the isotope ratio against the total plutonium mass;
1.3. effective kilogram, a special unit in the application of the guarantees to nuclear material: 1.3.1. plutonium — weight in kilograms;
1.3.2. for uranium with an enrichment of 0.01 and higher-weight in kilograms multiplied by the square of its enrichment;
1.3.3. for uranium with an enrichment below 0.01, but greater than 0.005-weight in kilograms multiplied by 0.0001;
1.3.4. for depleted uranium with an enrichment of 0.005 and less-weight in kilograms multiplied by 0.00005;
1.3.5. thorium — weight in kilograms multiplied by 0.00005;
1.4. actual quantity of nuclear materials — all directly measured or indirect methods of measurement estimated quantity of nuclear material, the amount of time the measurements of the material balance area.
1.5. guarantees and commitments – measures which the public performance pursuant to the Treaty on the non-proliferation of nuclear weapons and the Republic of Latvia and the International Atomic Energy Agency for the application of the agreement on guarantee in accordance with the Treaty on the non-proliferation of nuclear weapons, to ensure effective tracking and control of nuclear material, to prevent unauthorised use of nuclear material and prevent the possible threat of nuclear terrorism;
1.6. the raw material — uranium containing the mixture of isotopes in natural or depleted uranium, and thorium metal, alloy, chemical compound or concentrate;
1.7. nuclear waste: nuclear use 1.7.1 in the disposal site;
1.7.2. radioactive material from a nuclear installation and is not processed or moved out of nuclear installations, for further use in science, medicine, industry, agriculture or business;
1.7.3. nuclear material belonging to or objects that have been contaminated by radioactive material and for this reason no further use;
1.7.4. after the radioactive components of nuclear installation operating nuclear installations full termination;
1.8. nuclear: nuclear construction 1.8.1, operation, operations, full suspension or liquidation;
1.8.2. the acquisition of nuclear materials and nuclear waste processing, transport, possession, storage, rental, or any other similar activity;

1.10. inventory change — physical inventory of nuclear material in connection with the increase in supply from other material balance areas, due to the production or the application for the renewal of the guarantee or the actual reduction in the quantity of nuclear material due to nuclear material to other material balance areas, due to their losses and exemption from the application of the guarantee or if the processing nuclear material or technological emergency result changed into the nuclear waste temporarily stored for possible use in the future;
1.11. the categories of nuclear materials, raw materials and special fissile materials;
1.12. the loss of nuclear materials — losses that arise as a result of accidental nuclear reaction at the nuclear waste or nuclear theft;

1.14. material balance area: the area within or outside a nuclear installation which can be established: 1.14.1. quantity for each consignment of nuclear material out of the area or zone;
1.14.2. physical inventory in order to guarantee the application of certain of the material balance;
1.15. the nuclear material — not listed in the inventory and recorded physical inventory difference;
1.16. "shipper/receiver difference — the difference between the quantity of nuclear material which is presented to the party sending a material balance area, and the quantity of the batch concerned presented the receiving material balance area done measurements;
1.17. the party — part of nuclear material, which is used as a single unit for reporting critical measurement points and which the composition and quantity are defined by a single set of specifications or measurements.
1.18. clarification — entry in the accounting records or reports, to correct the error, reflect the improved measurements and produce a shipper/receiver difference or not nuclear materials listed;
1.19. the registered quantity of nuclear materials — entry in the accounting records of the material balance area, the existing inventory, which is calculated as the actual inventory and all inventory changes;
1.20. special fissile material — plutonium 239, plutonium, uranium 233, 241 with uranium 233 or uranium-235 enriched uranium.
2. The purpose of these provisions is to establish and maintain in the territory of the nuclear materials (both raw materials and special fissile materials) accounting and control system to: 2.1. ensure the continued use of the material in the national inventory and control and to prevent unauthorized use;
2.2. comply with Latvia's international obligations pursuant to the Treaty on the non-proliferation of nuclear weapons and the Republic of Latvia and the International Atomic Energy Agency for the application of the agreement on guarantee in accordance with the Treaty on the non-proliferation of nuclear weapons (hereinafter referred to as the guarantee agreement).
3. These rules determine the order in which operations with nuclear national nuclear facilities where nuclear materials production, separation, reprocessing of nuclear fuel, nuclear import, export, transport, sale, transfer, leasing, acquisition, use, and storage of the property.
4. to determine the physical inventory and inventory change, inventory tracking, do the following: 4.1. material balance area;

4.3. physical inventory;

4.5. the accounting reporting;

II. 7. If the operator of a nuclear installation is based on a request received control part may extend the time limit for the submission of information for 30 days. In this case, the operator of a nuclear installation shall provide the information in his possession, and shall be submitted within 30 days, complete the required information.
8. For special fissile materials provided for the dispatch or arrival of the nuclear operator control part no later than 30 days before the date of the operations.
9. A Person who intends to carry out nuclear, no later than 45 days before the first planned materials or special fissile materials shall be submitted to the control of the party receiving the information in part (in accordance with the provisions of annex 1) of proposed activities or construction of new equipment.
III. Programme of activities of the operator of a nuclear installation 10 no later than 40 days in advance of the planned activities for the application of the guarantees submitted to the control part of the following information: 10.1. planned activities for the program and the next calendar year;
10.2. the counting program before the physical inventory counting;
10.3. application of the envisaged work changes in a reactor core reactor before the suspension.
11. any circumstances which impede the provision laid down in paragraph 10 of the rules, the operator of a nuclear installation shall immediately report to the control.
IV. Warranty conditions 12. Nuclear operator determines the person responsible for the guarantee agreement to the additional rules (hereinafter referred to as the owner of the guarantees). All information about the guarantees are summarized in a single accounting system, but book quantity and inventory changes, as well as other data on all nuclear materials — in one common accounting books.

V. nuclear material accounting system 16. Nuclear operator updates the tracking system of all the property or possession of the existing nuclear materials and provides control and the International Atomic Energy Agency inspectors to check the submitted information.
17. Nuclear material accounting system includes: 17.1. accounting records;
17.2. the operational records;
17.3. information on the quantity of nuclear material, form, composition and exact location;
17.4. Special warranty conditions of application;
17.5. sender/recipient information (if nuclear material from one owner or the user is redirected to another);
10.9. clarification of inventory accounting.
18. Accounting records for each material balance area shall include the following information: 18.1. all identified changes in the quantity of nuclear material with the explanatory information that is sufficient to make these changes at any time to check;
18.2. all physical inventory used in the measurement and calculation of the results;
18.3. all adjustments made to the registered quantity of nuclear material in connection with the physical inventory, to correct the errors.
19. the minimum information in accounting records are: 19.1. nuclear material identification;
19.2. data on batches of nuclear material;
19.3. the measurement and calibration data;
19.4. empirical data which identify nuclear material and allows you to calculate data for the batch of nuclear material;
19.5. the changes to the data for the inventory quantity.
20. for each category of nuclear material and each batch of nuclear material responsible for guarantees individual accounts for plutonium, uranium and thorium, indication of each element of nuclear material and the total quantity of the isotopic composition of the individual elements of a lot of weight, then summing the rounding to the nearest unit of weight: 20.1. a quantity of plutonium — in grams;
20.2. the total quantity of uranium — in grams;
20.3. uranium 233 and uranium 235 — the quantity in grams (for uranium enriched in these isotopes);
20.4. thorium, natural uranium and depleted uranium — the quantity in kilograms.
21. If the inventory changes in the material balance area due to their shipment or receipt, accounting records indicate the change detection date and sender/recipient information.
22. Operational records, for each material balance area shall include the following information: 22.1. information on inventory, change in the composition and enrichment;
22.2. the calibration data to perform the quality control of measurements and determine their random and systematic errors of the range;
22.3. physical inventory in order to ensure that the description and verify the completeness of the inventory taking;
22.4. the loss of nuclear materials (if any are found) and their size and causes discovery.
23. all accounting data is gathered in accounting books in total, of which storage period is 25 years.
Vi. Accounting reports 24. Accounting report form filling and submission procedures for determining the control part. Control part may provide a special, simplified reporting procedures for equipment that use only a few grams of nuclear material and the registered quantity of nuclear material shall not vary by more than three years.

26. 27. If there is a reason why accounting is not possible to submit the report on the specified date, the operator of a nuclear installation shall provide the explanation in part to control and coordinate with the control part of the new accounting period for submission of the report. In this case, the control part may extend the time for submission of the report to 30 days.
28. If the control part according to the guarantee agreement, the additional terms 10. code requires additional information or tracking information provided in the report of the officer of explanation guarantees provide that information within 21 days of the receipt of a written request.
29. The owner of the guarantees submitted to the control part of a report on the inventory of all nuclear installations in the change-hand materials. Such a report is not required for the movement of nuclear materials between different material balance areas within nuclear installations of one.
30. The report on changes in the quantity of nuclear material shall: 30.1. nuclear material identification;
30.2. the information for each lot;
30.3. the dates that the inventory change occurred;
18.9. explanation of inventory changes (based on operational records);
5. the planned activity program (nuclear installations concerned);
19.0. physical inventory program according to warranty conditions.
31. the report on the changes in the quantity of nuclear material, the total accounting books and updates to send the control part, within 15 days after the end of the month, which have occurred or become known to the inventory change, but: If changes to counting 31.1. data are not held responsible for guarantees, indicate that the situation has remained unchanged;
31.2. If minor changes have occurred to the data, inventory can be grouped as appropriate, collect and report as per the change in inventory data.
32. the operator of a nuclear installation shall be submitted in part to control the material balance report for each material balance area. Material balance reports showing: 32.1. physical inventory taking the start date;
32.2. physical inventory;
32.3. the data for the inventory change (per lot);
32.4. the collected data about the registered inventory;
32.5. the physical inventory taking date;
32.6. the release of nuclear material.
33. Material balance reports to send control part no later than 30 days after the physical inventory taking.
34. The natural or legal person may submit the request in part about the control of nuclear material exemption from the application of the guarantee (annex 2) for them in the property of the person concerned in which the nuclear material is not used in nuclear activities and: 34.1. containing plutonium with isotopic concentration Pu238 above 80%;
21.3. used as a benchmark for measuring sensitivity, and they do not exceed 1 g;
3. which their use changed under kodolmateriālo or kodolatkritumo, in which the nuclear material is practically irrecoverable.
35. the control part, receive a request for the release of nuclear material from the application of the guarantee: 21.8. examine the compliance of the request provided for in the agreement of guarantee cases such a procedure;
35.2. check that the nuclear material is not processed or stored together with nuclear materials, which are suitable safeguards;
35.3. prepare and transmit to the International Atomic Energy Agency's request to release the relevant nuclear materials from the application of the guarantee.
36. If the International Atomic Energy Agency approved the removal of nuclear material from declared material, part of the list control notifies the owner of nuclear material and nuclear material relevant exempt from application of the guarantee.
37. Where a natural or legal person property is exempt from the application of the guarantees of the nuclear material, the person concerned shall ensure that the said nuclear material are not processed or stored together with nuclear materials, which are suitable safeguards.

38. If a natural or legal person property is exempt from the application of the guarantee nuclear material, but the person concerned nuclear materials referred to plans to use any nuclear activities or nuclear materials referred to quantities exceeding one effective kilogram, then that person shall submit a request for the control part of the application for the renewal of the guarantee applicable to nuclear materials (annex 3), and control the part after coordination with the International Atomic Energy Agency renewed guarantee nuclear materials concerned.
39. If the control part of the International Atomic Energy Agency received information that some of the provisions referred to in paragraph 34 of the conditions for the application of the guarantee claim does not cease to be in force, it shall immediately inform all the types of users of nuclear materials and at the same time notify the environmental protection and regional development Ministry, which prepares proposals for the amendments to those provisions.
VII. Extraordinary accounting report 40. Extraordinary accounting reports shall immediately be submitted in the following cases: 24.9. the event of an accident;
40.2. If the circumstances that have arisen or may arise from loss of nuclear material in excess of the guarantee agreement additional terms specified limits;
40.3. If due to the protective boundary changes possible unauthorized movement of nuclear material out of them.
41. The owner of the guarantees submitted to the control part of the extraordinary inventory report as soon as he become known or suspected loss or containment of nuclear material.
42. the extraordinary report of accounting be provided all of the information required accounting reports, as well as the loss of nuclear materials to be indicated or protective barrier causes changes.
43. further explanations concerning the extraordinary accounting report after the submission of the request for the control part immediately.
VIII. Nuclear export or import of special fissile materials 44. export and import business with a country not party to the agreement on the non-proliferation of nuclear weapons, the Member State shall be prohibited.
45. Exports to countries that have nuclear weapons, only to be taken if there is a prior international agreement, arrangements for the nuclear materials be sent to the applicable warranty.
46. A legal person that deals with source materials or special fissile materials for export and import trade in the Treaty on the non-proliferation of nuclear weapons, Member States shall submit to the control part of the advance notice of any such proposed export or import transaction if: 46.1. the consignment exceeds one effective kilogram;
46.2. from nuclear facilities three months to one and the same country sent a quantity of nuclear material that exceeds one effective kilogram, although the quantity of each consignment exceeds one effective kilogram.
47. This provision, paragraph 46, the previous notification of the export of nuclear materials (annex 4) or previous notification of imports of nuclear materials (annex 5) completed in duplicate. 49. If necessary physical protection requirements, responsible for the guarantees agreed on with the inspection part of the previous notification.
50. If the operator of a nuclear installation received information on nuclear material delay due to the import or export transactions or disclosed to shipper/receiver difference, responsible for warranties shall immediately notify the control part.
51. Responsibility for warranties shall immediately inform the control part of the changes to the planned and previously communicated in the control part of the receipt or shipment of nuclear material dates.
IX. Special conditions 52. Legal person within the territory of Latvia in dealing with raw materials or special fissile materials transport or temporary storage during carriage, may adopt or put these materials only with the surrender and acceptance, stating: the sender and the receiver 52.1.;
52.2. the quantity of nuclear material being transported;
52.3. types of nuclear material, shape, and composition.
53. the origin and destination of this provision in paragraph 52 above documents stored for not less than one year after the execution of the shipment.
54. the intermediary (authorised agent, representative, broker or trader), under the authorisation given to supply or receive raw materials or special fissile materials, document the following information: 54.1. legal parties addresses and names;
54.2. the contract date;
54.3. inventory, properties, form and composition;
54.4. the nuclear industry and shipping destination.
55. the intermediary that rule 54 documents mentioned in the stores no less than one year after the execution of the contract in question.
56. If it takes physical protection requirements, the carrier agreed on with the inspection part of it, as it will ensure the transfer of information and the confidentiality of adoption.
X. transitional issues 57. the operator of a nuclear installation initial information in accordance with the provisions of annex 1 shall be submitted to the control part within 30 days after the date of entry into force of the provisions.
58. If the control is already in part the Declaration for natural or legal persons in possession of the property or the construction of nuclear installations and nuclear materials, nuclear installations the operator within 30 days after the date of entry into force of the rules shall be submitted to the control part of the missing information.
