The Republic of Latvia Cabinet of Ministers 1998 October 6, Regulation No 388 (in Riga. No 55, § 14) rules on procedure for trade markets, fairs, street markets and on excursions are Issued in accordance with the Cabinet of Ministers Act article 14 machine (3) i. 1.2. the street trade-trade authorities specially designated and equipped public places;
1.3. external trade – trade in food and non-food products, mass actions (such as song and dance festivals, sports and cultural activities, religious holiday);
1.4. the own-produced agricultural products-legal land users ' own agricultural production, as well as self-produced agricultural products processed products obtained;
1.5. public place-path (any traffic built area consisting of roadways, sidewalks, the suburbs, the split bar, Island), tunnels, areas, pedestrian subways, railway station, bus station and airport halls, corridors and traffic routes, as well as parks, other specially arranged outdoor rest areas and not leased, not built or otherwise decorated in national or municipal land;

1.7.-designated market area, which has been assigned status of market in which goods are sold. 1.1. market manager-register of enterprises registered company (company), which carries out market areas, structures and equipment management, organized the market work and responsibility for these rules in specific market management, organizational management, and trade policy;
1.2. market-market management plan developed and approved a document that shows the location and point of sale number market area.
2. Those rules shall determine the arrangements for commercial markets, regardless of their form of ownership, as well as trade fairs, trade and external trade in the street.
3. Markets, trade fairs, trade and external trade in the streets to follow the rules and other retail trade regulatory laws, as well as the movement of goods, distribution, or advertising of public demonstration of special arrangements laid down in the legislation.
4. The following markets: 4.1. grocery markets-markets, which distributes agricultural and food products. Grocery markets can realize also art, applied arts and folklore articles;
4.2. non-food market-a market in which distributes new and used for non-food goods;
4.3. mixed markets-markets, which distributes 4.1., and 4.2. goods referred to.
5. Trade markets are eligible: 5.1 companies registered in Latvia (company) (further-legal persons) whose registration documents as business type is intended for trade;
5.2. individual labour inspectors who, in accordance with the issued patents or certificates of registration exercises the same goods produced or obtained from natural resources, as well as the purchased goods;
5.3. the population of Latvia (hereinafter persons), which distributes the following: 5.3.1 self-produced agricultural products, indicating the municipality or its authorised institution to issue a certificate for the land use rights;
5.3.2. the law in fishery products obtained and game fishing or hunting, by presenting a special permission (licence) or an approved copy thereof;
5.3.3. the wild herbs, berries, mushrooms and nuts according to the law "On forest management and the use of";
5.3.4. use personal effects;
5.4. The Republic of Estonia and the Republic of Lithuania citizens who enforce the self-produced agricultural products;
5.5. other neighbourhood residents in the border area, where the border area of Latvia implements self-produced agricultural products.
6. Trading markets are only allowed at the point of sale specified in the market. The plan specified the market outlets are numbered. Trade outside market plan the commercial sites are not permitted to trade places.

8. Street outlets are prohibited from exercising any other items not mentioned in point 7 of these rules, and the municipality shall not be entitled to issue licences to trade in such goods. Other trade Street outlets are not allowed to trade places.
9. external trade fairs and places of legal and natural persons and individual performers have the right to work to realize the food and non-food items in accordance with the procedure laid down in these provisions.
II. procedure for use of point of sale markets 10. Legal persons and individual performers have the right to work to realize the food items, with cash registers, food markets and mixed markets that market paviljono and other fixed objects in a closed commercial.

17. The Republic of Estonia and the Republic of Lithuania citizens, as well as other neighbouring countries in the border-area citizens are entitled, by presenting the import declaration, to realize the own agricultural production without the use of cash registers, the border area of the country the food commodity markets and mixed markets open in market areas, under awnings and from vehicles.
18. is authorised to be marketed on the markets of agricultural products produced by themselves, without the use of cash registers, following with the value added tax to taxable persons not:

18.1. the peasant and fishing farms and individual companies;
18.2. individual workers;
18.3. the natural persons.
19. the legal persons and individual labour inspectors enforce the farms and individual enterprises, agricultural products produced using the cash register.
20. food commodities markets and mixed markets, legal and natural persons and individual labour inspectors enforce the agricultural products at the following locations: 20.1. market paviljono and other fixed objects in a closed commercial;
20.2. market open areas;
20.3. under awnings;
20.4. from vehicles.
21. The right to use the stationary tables under awnings arranged trade places and places to trade from grocery markets and mixed markets existing in open market areas are given in the following order: 21.1. farmer and fishing farms, individual companies, individual workers and the natural persons that enforce the same production (goods);
21.2. the individual workers who deal with the product purchased, and the entities;
21.3. The Republic of Estonia and the Republic of Lithuania citizens who enforce the self-produced agricultural products;
21.4. another neighbouring people of the border area, which distributes self-produced agricultural products.
22. The right to use the marketing site that our grocery market and mixed market paviljono and other fixed objects in a closed commercial, to be allocated in the following order: farmers and fishermen 22.1 holdings, individual companies, individual workers and the natural persons acting in the same production (goods), which trade on the territory or in the open market under the shelters is prohibited;

24. The right to use non-food market and mixed market area closed in the stationary trade facilities or separate outlets for these objects to be allocated in the following order: 24.1. legal persons;
24.2. the individual workers who distributes self-fabricated and purchased non-food items.
III. Organization of work of the market and market manager responsibilities 25. Trade markets do not need the permission of the municipal territory concerned.
26. market manager determines the order in which legal and natural persons and individual workers to be granted rights to use commercial sites (e.g., subscription agreement, the setting of the day the market fees payable).

29.4. to present a limited natural resources (fish, game, berries, plants and other resources) mining permit (license).

45. the market operator shall ensure public order, veterinary, sanitary and hygiene requirements and fire regulations in the territory of the market.

IV. Charges for the use of point of sale and on market services 47. Charges for the use of point of sale market and market services rendered (equipment rentals, stores, and other services) are determined by the market manager.

48. The fee for the use of point of sale and market services rendered by market managers to be the approved prices. Market manager is responsible for charges for the use of point of sale and market services rendered charged according to the price list.
49. Legal and natural persons and the individual Installer all settled on the use of point of sale market and market services rendered only with the market managers organize, which provides a special place for the installation of the settlement.
50. legal and natural persons and individual workers received cash for the use of point of sale and market services rendered are recorded using the cash register, and shall issue a receipt to the payer.
V. trade body fairs, street trade and external trade places. 51 street trade allowed only in areas of trade, established by the local government and have got. Trade outside these trading venues, as well as trading in public places without local permission is not allowed to trade places.
52. In fixed and temporary (seasonal) outlets, which in our public places, is not comparable to street trading venues, and trade in permitted only through the cash register.
53. 54. The street trade in books and bought flowers is allowed if used in cash registers.
55. the itinerant trade of mass action is allowed only for the duration of the measure.
56. Trade fairs and itinerant trading places trading is allowed from the vehicles and outlets that are furnished to the duration of the measure.
57. Fairs and itinerant trading sites have banned perishable food products, if it does not ensure the storage and disposal of the sanitary, veterinary and hygiene rules.

59. Fairs and itinerant trading places peasants, farmers, fishermen, fishermen holding individual companies, individual work providers and natural persons who own or marketed output, entitled Trade, if the local government allows and paid to the municipal charge on trading in public places.

Alcoholic beverages and tobacco products trade, not subject to the said requirements, are not allowed to trade places.
Vi. the role and functions of the municipal trade 63. by organizing Local markets: 39.2. Decides on the new market of the usefulness of the municipal administrative territory, as well as the market location and boundaries of the territory;
39.3. granted market status.
64. the market creation and installation work shall be performed in accordance with the approved project, for which the relevant public authority or service written proof that has created the necessary preconditions for sanitary, veterinary, hygiene and fire safety rules.
65. the market concerned is granted the status of City Council or Parish Council.
66. The municipality shall adopt the decision on the market status for newly created markets, if fully all the projects in the works.
67. market projects should provide for the following requirements: 67.1. market reveals a whole area must be covered with a hard cover;
67.2. open market area and under awnings fixed tables must be provided and specific places in the trade of motor vehicles;
67.3. the market closed must be provided for stationary trade facilities to trade in food products that perishable, and trade with non-food goods;
41.9. in a closed hospital in the grocery trade objects must generate conditions of sanitary and hygiene standards of the food storage and distribution of goods that are perishable;
67.5. food commodities markets and mixed markets create preconditions for veterinary supervision;
67.6. closed in trading in fixed objects to create prerequisites for the use of the cash register.
68. The municipality of statutory powers and with the market managers signed agreement (Agreement) are familiar with the market in its administrative territory.
69. the Government, through the street trade: 69.1. down the street selling the site and its facilities or authorised to do so by other institutions;

69.3. in accordance with the provisions of point 7 of the authorisation and control of street trading permits that such conditions are met;

70. The municipality shall issue the authorisation for the marketing of the street with the provision in paragraph 7 of the goods, if the applicant for a permit shall produce documentary proof that Government duties have been paid on trade in public places, and law registered in the cash register, the technical passport.

72.3. after consulting the territorial environmental health center and the veterinary services in the country is determined by the fair trade actors or external application procedures, provided that they must provide information about marketable goods assortment and their origins (self-produced goods, manufactured goods, food produced in Latvia, non-food items, imported food items, imported non-food goods);
72.4. authorization to trade fairs and itinerant trading venues, as well as control the permits that such conditions are met;
72.5. establish and collect a fee for commercial location in the municipality organised fairs and itinerant trade;
72.6 at. shall be applied and collected fees for trading in public places.
73. If a trade show or trade is not an external sponsor, sponsor of these measures shall be submitted to the relevant authorities. The application shall indicate the officials whose duties include those provisions for the enforcement of the requirements of the operation. 74. The municipality shall issue authorisations for trade fairs and itinerant trading places, where the applicant has paid the fee for local trade public places and appropriate presentation of limited natural resources mining permit (license) of the original.

76. The municipality shall provide the national authorities referred to in these provisions, the control and supervision of the following: 76.1. of markets and street layout of point of sale relevant administrative territory;
76.2. fairs and itinerant trading venue and time.
VII. responsibilities of traders 77. Legal and natural persons and individual workers who use outlets in markets, fairs, street trade and external trade, must comply with these rules and other legislation governing trade.

78. the legal persons and individual Installer, trading in the purchased item, ensure that, in the trade were in place: 78.1. company registration certificate or the individual installer's registration certificate or a copy of the patent;
78.2. sale of goods in the accompanying documents, presented in accordance with the requirements of the laws or customs declaration;
78.3. documents that certify the origin of goods, quality and safety;
78.4. limited natural resources mining permit, if applicable;
78.5. seller's personal medical notebook, if product is food.
79. the legal person is placed at the point of sale sign, indicating the company's (the company) name, address, opening hours and the first name and last name of the person who is responsible for trade in the trade.

VIII. Monitoring and control 83. Markets, fairs, street trading and marketing activities, external site monitoring and control: 83.1. market manager, which provides that the rules set out in paragraph 79 of the compliance control of markets and the provision in paragraph 80 and 82, monitoring of compliance with the requirements;
51.7. authorized officials of the local government, which provides: 83.2.1. This provision in paragraph 7 and 60 and 72.4 69.3 69.4., and in compliance with the requirements;
83.2.2. the rules set out in paragraph 75 of the compliance control if the event organizer is a municipality;
83.2.3. the rules set out in paragraph 79 of the compliance control street trade, authorities organized outings in fairs or trade;
83.3. State revenue service officials that provides: 83.3.1. This provision 10, 11, 19, 43, 50, 52, 54 and 62, specified in the cash register and letting the compliance control;
83.3.2. This provision in paragraph 33 and 81 and 78.2 in compliance with the requirements;
83.4. State police and municipal police officers, ensuring that they are 6, 8, 39, 51, 61 and 62, and the requirements in paragraph 78.1. monitoring of compliance with this provision and paragraph 45 of monitoring of compliance with the requirements relating to public policy, and the direct infringers of penalties for illegal trade;
83.5. Consumer Protection Center officials, who support the provision laid down in paragraph 42 the requirements with regard to weight, measure and pay the correct determination of this provision in paragraph 79 monitoring of compliance with the requirements of these provisions and 78.3. the requirements in point control for non-food goods;
83.6. National Sanitary Inspectorate and the national veterinary service officials who support this rule 38, 45 and 57, and 78.3 78.5 in and requirements for monitoring and control of compliance in accordance with the statutory Division of powers between the ministries of food surveillance and control;
83.7. Latvian National standardisation and Metrology Center officials, who support this rule 42 and 43 in the monitoring of compliance with the requirements for weighing and measuring instruments and set out in paragraph 58 compliance control;
83.8. national fire and rescue service officials who support the provision laid down in paragraph 45 the requirements with regard to fire safety rules.
IX. Liability 84. The cash register to the registered amount of money not considered hidden income and recorded in the cash register.

88. Market, fairs and street trading participants a month from the date of entry into force of the provisions of the trade that broke organized without the decision of the local authorities (authorization), or in accordance with the procedure laid down in these provisions shall be the trade concerned.
89. The municipality is entitled to market that are made to this provision to the date of entry into force of up to six months to grant the temporary status of the market, and determine the measures to be taken to market, to market manager to match the market status.
90. If the market manager during the trading site is assigned a temporary market status, do not take local measures, market status shall not be granted.
91. Mixed market status for newly created markets are allowed to grant only if the decision of the local authorities for their creation is taken up to the date of entry into force of the provisions.
92. With the entry into force of the provisions o this day is ended of the marketing authorisation for the marketing of books street stall.
93. Be declared unenforceable: 93.1. The Cabinet of Ministers on 4 June 1996 the provisions of no. 201 "rules for trade in the markets of Latvia, fairs, street markets and on excursions" (Latvia's journal, 1996, 100/101, 114, no. 167);
