Cabinet of Ministers Regulations No 729 Riga 2014 (November 25. No 65 81. §) rules on the action programme "entrepreneurship and innovation" 2.1.1.3.3. apakšaktivitāt "Appendix scientific institutions institutional capacity development" Issued under the European Union's structural and cohesion funds act 18 paragraph 10 of article i. General questions 1. determines: 1.1. procedures for implementing the action programme "entrepreneurship and innovation" Appendix 2.1. priorities "Science and innovation" 2.1.1. actions "science, research and development" activities "2.1.1.3. Scientific and research infrastructure development" 2.1.1.3.3. apakšaktivitāt "scientific institutions institutional capacity development" (hereinafter activity); 1.2. requirements the project applicant; 1.3. the application of the project evaluation criteria; 1.4. the responsible institution and liaison body, the distribution of competence between these institutions and cooperation arrangements, as well as the responsible authorities and cooperation agencies functional form of subordination. 2. The terms used in the following terms: 2.1 with economic activities related project – a project that meets the following criteria: 2.1.1. project scientific institution that meets the definition of research organisations; 2.1.2. the project activities, which are not of an economic nature, or restricted areas; 2.2. economic activity-related project – a project that meets one or more of the following criteria: 2.2.1. project scientific institution that does not meet the definition of research organisations; 2.2.2. projects implemented within the framework of economic activities; 2.3. date of award of the aid – the day that meets the Commission's June 17, 2014 Regulation (EU) No 651/2014, by which certain categories of aid compatible with the internal market, applying the contract article 107 and 108 (Official Journal of the European Union, 2014 26 June, no L 187) (hereinafter referred to as Commission Regulation No 651/2014), article 2 the definition laid down in paragraph 28; 2.4. development project-scientific institutions development strategy relevant scientific institutions research infrastructure, management or resource management development project, implemented during the period from 2015 to 2020; 2.5. the human resources development plan – scientific employee attraction and development plan developed pursuant to this provision the research referred to in paragraph 2.24 program and which consists of the following sections: 2.5.1. twinning development with: 2.5.1.1. higher education institutions, increasing student involvement in research and the involvement of universities in leading researchers or professors of the Institute's Scientific Council, if the applicant is a scientific Institute; 2.5.1.2. the scientific institutes, involving leading scientific Institute researchers University dissertation, thesis and the boards of studies or field of study in the Councils of action, if the applicant is an institution of higher education; 2.5.2. foreign scientific institutions, attracting top scientists 2.24 this provision referred to the implementation of the research programme; 2.5.3. customised research staff development plans, including identification of prospective new scientists and their talent and career development plan; 2.6. the employer, person conducting business or professional practice with the aim of generating revenue and labour relations on the basis of employing one or more persons for payment; 2.7. the transaction, which is not economic in nature, research activities of the Organization, which does not include the Treaty on the functioning of the European Union (Official Journal of the European Union, 30 March 2010 No. 83/47 C) Article 107 paragraph 1 scope defined, including: 2.7.1. training to bring staff numbers and qualifications; 2.7.2. independent research and development, in order to gain more knowledge and better understanding, including joint research and development, a research organization engaging in effective cooperation; 2.7.3. the dissemination of research results, without exclusivity and discrimination, for example, through teaching, open access, open the database of publications or open source software; 2.7.4. knowledge transfer, where all profits from the knowledge management activities is reinvested in research organisations and key actions carried out: 2.7.4.1. the research organisation (including its Department or subsidiary); 2.7.4.2. the research organisation jointly with other research organisations or on their behalf; 2.7.4.3. a research organisation with a third party, if the appropriate services are ordered by third parties through the open competitions; 2.8. The ERDF intensity-the European Regional Development Fund (ERDF) funding (as a percentage) of the project total eligible costs; 2.9. the difficulty merchants – merchants, who delivered the judgment of the Court of insolvency proceedings or the legal protection is implemented or out-of-court redress process, has launched bankruptcy proceedings, the appropriate remediation or composition, or its economic activity is terminated, whether it conforms to the law laid down criteria to be applied at the request of the creditor in the insolvency proceedings; 2.10. restricted areas of operation, the research organisation or research infrastructures in the economic activities which meet the following criteria: 2.10.1. it is directly linked to research organisations or research activities and infrastructure with an economic activity in the area; 2.10.2. it consumes the same resources (such as materials, equipment, labor, and capital) as to economic activity-related core activities; 2.10.3. each year it allocated financial capacity does not exceed 20 percent of the body's total annual financial capacity; 2.11. new functional unit – scientific institutions as a result of the reorganisation or winding-up created a new unit, including scientific Institute, scientific group or other entity that is created by merging, splitting or transfer of the reorganized or eliminate scientific institutions, the dibināto scientific institutes, departments or research groups; 2.12. to consolidate the functional unit – in reorganizējam or scientific institution in liquidation, scientific institutions founded Research Institute (derived public person, public agency or Department), a private-law legal person or a scientific group that plans to add or put the scientific institution that meets this provision in paragraph 11 above; 2.13. the big merchant-a merchant that correspond to Commission Regulation No 651/2014 article 2 the definition set out in paragraph 24; 2.14. the parties – beneficiaries or partner who entered into a cooperation agreement for the implementation of a project; 2.15. the beneficiary, beneficiary, partner or to consolidate the functional unit; 2.16. tangible assets – assets that comply with Commission Regulation No 651/2014 article 2 the definition set out in paragraph 29; 2.17. tiny (micro), small and average business person – trader that complies with Commission Regulation No 651/2014 article 2 the definition laid down in paragraph 2; 2.18. the twinning measures – measures directed to the improvement of the cooperation between scientific institutions, universities or employers according to registered scientific institutions of international recommendations of the evaluation in 2013 make the Northern secretariat of the Council of Ministers of Latvia, analyzing the situation of science of Latvia in the European Union and the common research area in the context of research cooperation (hereinafter referred to as the external evaluation of science);
2.19. intangible assets – assets that comply with Commission Regulation No 651/2014 article 2 the definition set out in paragraph 30; 2.20. the partnership-a collaboration between at least two parties to exchange of knowledge or technology, provide access to research infrastructures or achieve the common goal, which is based on the Division of labour, the parties will jointly determine the scope of the cooperation projects, participating in its implementation and the allocation of risks, as well as the results. One or more of the parties may take the full costs of the project and thus release the other party from the financial risks of the project. Contract research and research services are not considered forms of cooperation; 2.21. research infrastructures-equipment, resources and related services that correspond to Commission Regulation No 651/2014 article 2 the definition laid down in paragraph 91; 2.22. transparent aid category-the type of support that corresponds to Commission Regulation No 651 5. Article 2, paragraph "a" of the definition laid down in point and provided in the form of grants; 2.23. the research organisation – an institution that complies with Commission Regulation No 651/2014 article 2 the definition set out in paragraph 83; 2.24. the research programme-scientific institutions research programme 2015-2020, which meet the following criteria: 2. it is certainly scientific institutions short-, medium-and long-term research objectives, performance indicators, their numeric values and tools of research objectives and results. The research program includes the following sections: 2.24.1.1. medium-term direction for priority research description, based on the feasibility study on the development potential of the sector, scientific institutions and research specialization description twinning development plan; 2.24.1.2. plan for membership of the European Union's research and innovation framework programme "Horizon 2020" competitions and other research and innovation support programs and technology initiatives; 2.24.1.3. the action plan to increase the number of international publications (publications, journals of the citation index reaches at least 50 percent of the industry average citation index), including access to industry databases, increasing the effectiveness of the scientific activities; 2.24.1.4. knowledge and technology management development plan, promoting the commercialization of research results and transfer in the economy; 2.24.1.5. research infrastructure development plan; 2.24.2. the development and implementation of the project is involved in the institution of the applicant established an International Advisory Council (International Advisory Board) (if applicable), which also includes representatives of the employer and foreign scientific institutions, scientists; 2.24.3. it is designed according to the European Commission strategy "Europe 2020: a strategy for smart, sustainable and inclusive growth" to those initiatives and the development of science, technology and innovation guidelines 2014-2020, which includes the Latvian intelligent strategies and smart specialisation areas of specialization and growth priorities and is aligned with the employers ' representatives; 2.24.4. these rules have the 2.28. the assessment referred to in subparagraph; 2.25. the results management system – the results-oriented management system of institutions that are subject to the institution's strategic objectives and performance indicators for the Department and the scientific level of the Group and the workers ' daily work tasks at the individual level (objectives cascade), organizing body of the internal work processes according to the main business objectives and results to be achieved, as well as promoting the work of the institutions targeted employees of key tasks. This provision mentioned in paragraph 2.25.1. scientific institutions strategic objectives and achievable results indicators form a cascade of objectives to lower levels to the scientific group, or scientific level of the employee; 2.25.3. improved planning and management system of the organisation; 2.25.4. improved or created the remuneration and motivation system based on indicators of the results of the scientific group, or scientific level of the employee; 2.25.5. create or improve the performance management system; 2.25.6. created the change implementation plan and determine the persons responsible for its implementation; 2.26. the action plan science external evaluation of the implementation of the recommendations – an action and results plan science external evaluation of the implementation of the recommendations in the period up to 2020, which focuses on the human resources capacity of institutions and institutional capacities; 2.27. economic activity -any activity that involves the offering of goods or services on the market, including the leasing of research infrastructure, implementation tasks of traders services or contract research; 2.28. internationally comparative assessment – programmes of research external evaluation to be conducted by foreign experts (hereinafter referred to as the EC experts) that meet the following criteria: 2.28.1. they are registered in the database of experts of the European Commission, set up to evaluate the European Union's research, innovation and technological development framework programme projects; 2.28.2. these assessments do not represent independent research institutions and the application developer does not exist in the activities the circumstances that cause a conflict of interest; 2.29. one single company, a merchant who satisfies the Commission 18 December 2013 Regulation (EU) no of 1407/2013 for the Treaty on the functioning of the European Union and article 107.108. application of the de minimis aid (Official Journal of the European Union, 2013 December 24, no. L 352/1) (hereinafter referred to as Commission Regulation No 1407/2013) article 2, paragraph 2 these criteria; 2.30. the development strategy of the scientific institutions, scientific institutions and the development of a resource strategy 2015. consolidation-2020, developed under the smart specialisation strategy and includes the following sections: 2.30.1. the research programme; 2.30.2. the institutional development plan for authority, performance and management efficiency, which includes: 2.30.2.1. scientific institutions and the Scientific Institute established the institutional development plan; 2.30.2.2. resource and result management system development plan and result management system; 2.30.3. human resources development plan; 2.31. the scientific employee-academic, scientific, Science Service staff and scientific technical staff; 2.32. the scientific personnel, according to the scientific activities of the laws governing elected and the Latvian Academy of Sciences scientific staff are included in the database of principal investigators, researchers and research assistants, as well as the persons within the company that performs the leading researcher, investigator and Research Assistant; 2.33. the scientific group – scientific employee group, established for the implementation of specific research in the science industry or industry sector; 2.34. scientific institutions – scientific institution in the Republic of Latvia in the register (hereinafter register) established scientific institutions liquidated, thus reducing the registered scientific institutions. The liaison body: 7.1. within 10 working days following the entry into force of the agreement or contract, drawn up for the implementation of a project (hereinafter referred to as the agreement on the implementation of the project) form (hereinafter referred to as the agreement form) project, defining the requirements for the implementation of the project beneficiaries in accordance with these rules and regulations of the European Union's structural and cohesion funds, implementation, and monitoring of implementation, and shall submit it to the authority responsible for the coordination. If the liaison body shall make any amendments to the agreement in the form of an updated form of the Treaty, it shall be submitted to the body responsible for coordination; 7.2. the agreement concluded with the beneficiaries of the project, specifying the project recipient of funding requirements in accordance with these rules and regulations that govern the European Union's structural and cohesion funds, implementation, and monitoring of implementation; 7.3. on the basis of this provision, the decision referred to in paragraph 6.10.2., fill in the form of de minimis aid (in the form of a paper document in triplicate) in accordance with the laws and regulations on de minimis aid tracking and award procedures. One copy shall be issued by the responsible authority, the second store in cooperation, and the third issue of de minimis aid beneficiary; 7.4. the de minimis aid, the inventory of one single company level in accordance with the laws and regulations on de minimis aid tracking and award procedures; 7.5. provide implementation monitoring and control, including checks at the place of implementation of the project and monitor the Regulation No 1083/2006, article 93 and in principle referred to in paragraph 2, the performance of the project; 7.6. the funding requested procurement plan and submit it to the procurement monitoring Bureau; 7.7. preparing and submitting information to the responsible body for the implementation of the activity and funding available to it, at the request of the competent authorities providing the information about a single project; 4.8. preparing activity payment projections and submit it to the paying authority; 4.9. preparing ERDF funds demand forecasts for the current year and shall submit it to the leading authority and the responsible authority; 7.10. checking and confirming the beneficiary's payment request and prepare the Declaration of expenditure; 7.11. provide information about the recipient of the funding agreement for the implementation of a project execution procedures and requirements; 7.12. the review and approval of amendments to the project, subject to this provision. and the conditions of paragraph 71; 7.13. the accumulated data for project application and implementation of the project according to the laws of the European Union's structural funds and the cohesion fund management information system design and use; 7.14. provide the public with information and provides publicity on matters related to the implementation of the activity; 7.15. where non-compliance is detected, ensure recovery of irregular expenditure in accordance with the laws and regulations establishing procedures for reporting on the implementation of the structural funds of the European Union in the perceived inadequacies, shall take a decision on the use of funding granted and recover the irrelevant; 7.16. monitor compliance with this provision of the draft 15.8., paragraph 22, and 23.3. the requirements referred to in point during project implementation and five years after the implementation of the project; 7.17. provides a selection of EC experts developed scientific institutions of international research programme for comparative evaluation. 8. the cooperation body is the functional supervision of the responsible authority. 9. the activities implemented in the framework of projects co-financed by the ERDF. II. The parties requirements 11. Project applicant is registered in the register of scientific institutions: 11.1. Scientific Institute (derived public person or private-law legal person) that the external assessment of science rated at "4" or "5"; 11.2. School (derived or private public law legal person) that the external assessment of science rated at "4" or "5" or the science departments of the external assessment rated at "4" or "5"; 11.3. the University, if the project's scientific institutions planned reorganization or liquidation, on the basis of these provisions referred to in paragraph 34.2. the decisions of the budgetary authority which results in at least one of reorganizētaj or likvidētaj scientific institutions are excluded from the register. 12. the project applicant project application be submitted and implemented individually or in partnership with other scientific institutions. 13. as of the cooperation project partners may involve scientific institutions that meet at least one of the following requirements: 13.1. scientific authority complies with the provisions referred to in paragraph 11; 13.2. a scientific institution that is registered in the register and that according to this rule 21.3. decisions referred to plans to reorganize. 14. where the project involves the building of partnership: the project application submitted to 14.1. managing partner, corresponding to paragraph 11 of these terms and conditions which received this rule 34, paragraph invitation. The lead partner is responsible for the implementation of the project and is considered to be the beneficiary of the financing if the project is approved; 14.2. the partners switch on the draft cooperation agreement and the joint exploitation of results as well as results (hereinafter referred to as cooperation agreements), stating: 14.2.1. project implementation and results, including each partner the de minimis amount (if applicable) (in euro); 14.2.2. the objectives and principles of cooperation; 14.2.3. the common cooperation project funding, each project partner (hereinafter referred to as the subproject) funding (if applicable) and each partner's contribution to the breakdown of the types of investments; 14.2.4. a project for the provision of financial flows; 14.2.5. the partner's rights, duties and responsibilities; 14.2.6. conditions for the use of the project results (if applicable); 14.2.7. the order in which revise or terminate the cooperation agreement; 14.2.8. penalties, failure to comply with the obligations contained in the agreement of cooperation. 15. Parties may receive the aid that meets the following requirements: 15.1. it is not in financial trouble under this provision in paragraph 2.9.; 15.2. to Parties not subject to recovery orders referred to in Commission Regulation No 651/2014 article 1, paragraph 4, in the "a"; 15.3. in accordance with the State revenue service administered by the tax debtor (fees) in the database of the information available it is not a tax or fee debt or debts not exceeding eur 150; 15.4. it is not punished for the Latvian Code of administrative offences of the third paragraph of article 189.2 administrative infringement or it does not have adequate means of influence on the coercive criminal law 280. According to scientific laws governing: 15.7.1. the University has issued reports on the scientific activities in a separate Edition and published by the University website for the last three reporting years concluded; 15.7.2. Scientific Institute is submitted by the Ministry of education and science of the scientific activity reports for the last three reporting years concluded; 15.8. If parties make both economic activities and activities which are not economic in nature, it differentiates the kinds of activities and their costs, funding and revenue so as to effectively prevent cross-subsidisation of economic activity. III. eligible actions and funding conditions 16. activities within the funding is available for the following aid measures: 16.1. development support scientific excellence; 16.2. the consolidation of scientific institutions. 17. This provision 16.1. support may listed under eligible research institution that meets this provision in paragraph 11.1 or 11.2. 18. This provision of the aid referred to in paragraph 16.2. eligible research institution that complies with the rules laid down in paragraph 11 and that the project intends to carry out a reorganization of the scientific institutions or liquidation, with at least one registered in the register of scientific institutions from the registry. 19. This rule 16.2. support referred to within the funding granted to the following eligible activities: 19.1. scientific institutions function and task of the external audit, institutional management model development; 19.2. scientific institutions development strategy development or development; 19.3. the Association strategy development or development measures within the County; 19.4. the international comparative research programme evaluation; 19.5. the scientific institution associations developing strategies twinning measures; 12.2. the scientific institutions of resource management system development, including: 19.6.1. resource management and performance management system development, or development, remuneration and motivation system of the external evaluation and the proposals on results-oriented remuneration and motivation system; 19.6.2. scientific institutions of financial management and accounting policy the original ex-ante audit or project improved financial management and accounting policy end (ex-post) audit; 19.6.3. financial management and accounting software for the acquisition, construction, expansion or alignment functionality, and its use in briefing; 19.7. intangible assets acquisition or creation, including long-term access rights to scientific literature databases for the implementation of the scientific activity, excluding the intangible assets acquired or created or where the acquisition or creation of a planned action programme "entrepreneurship and innovation". apakšaktivitāt "2.1.1.3.2 Appendix information technology infrastructure and information system accessible to the scientific activity"; 19.8. intangible asset acquisition, construction, or installation of the alignment of the provisions referred to in paragraph 2.18 twinning measures; 12.4. development project technical feasibility studies, including socio-economic reasons (cost-benefit economic analysis) to develop technical documentation (financial and technical feasibility, the technical documentation of the works); 19.10. reorganization of the scientific institutions or for the necessary legal documents, including real estate inventory, real estate property and re-registering, archiving the documentation of scientific institutions; 19.11. reorganizējam or scientific institutions in liquidation tangible assets the dismantling, moving, installation or adaptation in the new functional units; 19.12. job creation scientific personnel planned to be linked to from reorganizējam or likvidējamaj scientific institutions. 20. This provision 16.1. aid referred to within the funding granted this rule 19.1, 19.2, 19.3, 19.4, 19.6, 19.7, 19.8.., 12.4. and actions referred to in paragraph 19.10. 21. The ERDF aid intensity is 100 percent. 22. If is implemented with economic activities related project, the parties will ensure that the activities of the parties under the funds allocated during project implementation and five years after completion of the project will not increase the total amount of the transaction amount limited to levels that exceed this provision limits referred to 2.10.3. 23. If it is implemented with an economic activity-related project: 23.1. support is provided by the transparent support categories; 23.2. the project the applicant justified the project planned the stimulative effect on public support, according to Commission Regulation No 651/2014 article 6, paragraph 2 and 3; 23.3. the project is not realised actions that correspond to Commission Regulation No 1407/2013 article 1 paragraph 1; 23.4. in any period of three fiscal years, the total amount of de minimis aid, which is granted to the parties under these provisions, together with other support programmes allocated does not exceed the de minimis Commission Regulation No 1407/2013 article 3 (2) de minimis aid laid down in the amount of one single company level; 14.6. the de minimis registration is carried out in accordance with the laws and regulations on de minimis aid tracking and allocation procedure and de minimis aid in the form of samples, in view of this provision, the conditions in point 2.3; 14.7. for de minimis aid, the parties responsible body and authorities shall provide cooperation: 23.6.1. de minimis aid application; 23.6.2. form of de minimis aid received in accordance with the laws and regulations on de minimis aid tracking and award procedures; 23.6.3. additional information (where applicable), justifying a de minimis amount of one single enterprise level compliance with this provision, the conditions of subparagraph 14.5.; 23.7. de minimis aid will be deemed to be granted on the date of granting the aid, irrespective of the date of the de minimis aid paid to parties. 24. the parties to the maximum the available ERDF funding shall be determined according to the provisions in annex 1 of the methodology, while observing the rules in paragraph 23.4. limits. 25. cooperation authority, if it is available in the State budget, after the conclusion of a contract for the implementation of a project, provides funding to the recipient of the advance payment in the contract for the implementation of a project within the deadlines laid down and order pursuant to the regulations on the procedures foreseen in the State budget for the European Union structural funds and the Cohesion Fund co-financed project implementation and any outstanding payments and prepared in the Declaration of expenditure. IV. Eligible and ineligible costs 26. activities within the eligible costs are the following: 26.1. costs these rules referred to in point 19 implementation of the activities supported: 26.1.1. remuneration costs project personnel involved, including the employer made the State compulsory social insurance contributions, if involved in the implementation of project activities is not registered as a business income tax payer; 26.1.2. mission expenses, travel costs, in accordance with the laws of the order in which the recoverable costs associated with business travel, this rule 19.2 and 19.6. implementation of activities referred to in point; 26.1.3.2.18. these provisions referred to twinning measures necessary for the implementation of research infrastructure costs the acquisition or creation: 26.1.3.1. intangible assets acquisition or creation costs, if the deal is made and there is no secret deal was; 26.1.3.2. financial statements included in tangible assets or the acquisition costs of establishment according to the laws and regulations on accounting that defines and explains the asset accounting and information related to fixed assets in the financial statements indicate that up to 40 percent of the total eligible costs of the project; 26.1.4. following external costs: 26.1.4.1. consultants and experts ' remuneration and related costs; 26.1.4.2. sworn auditor services; 26.1.4.3. audit services; 26.1.4.4. financial management and accounting services; 26.1.4.5. legal services; 26.1.4.6. translation services; 26.1.4.7. tangible assets the dismantling, movement (including the leasing of means of transport), installation, testing, calibration and other research results ensuring repeatability related services; 26.1.4.8. development project technical feasibility studies, including socio-economic reasons (cost-benefit economic analysis); 26.1.4.9. good development strategy in development projects for the preparation of technical documentation; 26.1.4.10. archiving services; 26.1.5. work equipment (furniture and equipment, computer software and licenses) the cost of the scientific employees scheduled to be linked to from reorganizējam or scientific institution in liquidation; 26.2. the eligible costs not recoverable value added tax payments; 16.3. information and publicity of the project activities according to the legislation of the European Union's structural and cohesion funds publicity and funded projects visual identity assurance requirements not exceeding 0.2% of the total cost of the project. 27. The provision laid down in subparagraph 26.1.3.2. eligible costs may create the following expenditure headings: 27.1. scientific institutions development project public works technical documentation development costs that are directly attributable to the long-term investment costs in accordance with the laws and regulations on accounting that defines and explains the asset accounting and with the identification of the related information on fixed assets in the financial statements; 27.2. building reconstruction (end-of-life construction of load-bearing structural element or replacement or functional or technical improvements without changing the size of the construction or bearing part bearing capacity); 27.3. housing renovation (construction part change the amount or the design of load-bearing elements or enhancement, without changing the route of Administration); 27.4. scientific hardware, tool kit, the information and communication technology infrastructure and the other with these rules 2.18. twinning referred to measures directly related to the acquisition or creation of funds; 17.1. these terms 27.4. tangible assets referred to in the supply, installation, testing and servicing instruction costs and maintenance costs associated with the preparation of a long-term investment for use for the intended purpose until their commissioning. 28. the project costs are eligible if they are in fact arose the parties and meet the following conditions: 28.1. they are experiencing cost incidence for the period that is specified in the agreement for the implementation of a project; 28.2. they are related to the objectives of the project and are provided for in the approved project budget and satisfy the rule set out in paragraph 26 cost; 28.3. they are reasonable and necessary for the implementation of the project; 28.4. they are spent only for the project's objectives and results and is made pursuant to cost-effectiveness, efficiency, and effectiveness; 28.5. the payment is actually made, within 30 days after the agreement on the implementation of the project of the given cost incidence period end date and they are included in the project accounts; 28.6. they are listed good accounting and tax accounting registers, identifiable, separate from the rest of the cost, and verifiable, and they acknowledge the original source document concerned; 28.7. they incurred, subject to the laws and regulations on public procurement or purchase of public service needs. 29. activities not eligible are the following cost items: 29.1. costs incurred after the agreement for the implementation of a project deadline or for payments made later than the month after the expiry of the implementation of the project; 29.2. costs that are not directly related to the project activities and are not justified by the cost of supporting documents, or are experiencing legislative non-compliance; 29.3. the transaction costs that do not meet this provision, paragraph 33; 29.4. the administrative costs of the project; 29.5. the value added tax, if the parties can recover it according to the laws and tax policy; 29.6. General costs related to project application preparation, including advisory services; 18.5. insurance costs; 29.8. real estate (buildings and land) acquisition cost; 29.9. current maintenance costs; 29.10. vehicle acquisition costs; 29.11. costs relating to leasing and rental transactions; 29.12. fee for loan processing, design, booking and service fees, charges for financial transactions, interest on arrears, penalties and expenses of litigation; 29.13. costs that do not meet the reasonable financial management, in particular value for money and cost-effectiveness; 29.14. the project required for account opening and maintenance costs; No 29.15. other costs that are not included in the eligible costs of the project. 30. The eligible costs shall include only those long-term investments, for which the final report of the project date will be fully paid for and who will be the beneficiaries of the estate. 31. activities financed under only the eligible costs directly related to the project activities meet the costs laid down in these rules limits, are reasonable and justified and comply with the principles of sound financial management. 32. funding granted under these rules, not combined with other aid programmes or individual aid project. 33. the eligible are the actions undertaken: 33.1. the date of entry into force of the rules, if the parties in implementing this provision, paragraph 22; 33.2. after agreement on the conclusion of the project with the cooperation of the authority if the parties implemented the provisions referred to in paragraph 23 of the project and meet the definition of a great merchant; 33.3. following the submission of the project application in the body if the parties responsible for implementing this Regulation referred to in paragraph 23 of the project and meet tiny (micro), small or medium's definition. V. Project application selection and application of project tender submission 34. Call for project submissions for selection limited (hereinafter referred to as the notice) the responsible authority shall send the scientific bodies which comply with the provisions referred to in paragraph 11 and 10 working days after the date of entry into force of the provisions of the Ministry of education and science has provided the following documents: 34.1. decision-making bodies of scientific institutions (universities or scientific institutes of the Senate's Scientific Council, subject to the legal status of the beneficiary) of the plan of action approved science external evaluation for the implementation of the recommendations; 21.3. the reorganization of the scientific institutions and the institutions of the authority of the reorganizējam (University Senate or scientific Institute, the Scientific Council pursuant to the legal status of the beneficiary) the decisions on the reorganization of the scientific institutions or liquidation, which contain information on consolidation and new functional units, which planned to build after the reorganization of the scientific institutions or liquidation, if the parties intend to qualify for this rule prescribed in paragraph 16.2. support; 21.3. The Latvian Science Council opinion on the reorganisation of State Scientific Institute or liquidation (if applicable), if the parties intend to qualify for this rule prescribed in paragraph 16.2. support; 21.4. the information needed for the parties the maximum available funding for the calculation under this provision is laid down in the annex and include the following particulars: 34.4.1. Parties-universities (if applicable) attached to the research funding over the past three years, the report concluded. 34.4.2. beneficiaries – University (if applicable) research funding linked to the past three sealed reference years; 34.4.3. Parties and beneficiaries founded business unit (which science has received external assessment rating "4" (if applicable)) research funding linked to the past three reporting years to be concluded; 34.4.4. reorganizējam or kill the scientific institutions-universities (if applicable) attached to the research funding over the past three years, the report concluded. 34.4.5. reorganizējam or kill the scientific institutions that you want to add to your department or the parties or hold scientific groups (if applicable) scientific personnel load full time equivalent (further – PL) expression in the last three years, the report concluded, and on October 1, 2014 for the breakdown of the categories of scientific staff, scientific personnel, technical personnel of science, Science Service staff; 34.4.6. new functional unit of the scientific staff involved in the planned load FA expression by scientific personnel categories for the period from 2015 to 2017.;. 34.4.7. other information required by the parties for the available ERDF funding. 35. the responsible authority shall send the invitation no later than 20 working days following the entry into force of these regulations. 36. The invitation shall: 36.1. the project submission deadline; 36.2. the application of the project site and order; 36.3. the total project available to the maximum ERDF funding for it by the parties, which shall be calculated according to the rules set out in annex 1 of the methodology; 36.4. the website which published the application to be used for the preparation of project documents; 22.7. other information the competent authority considers it necessary to specify in the call. 37. the project applicant project application submitted to the responsible body, subject to the following requirements: 37.1. activities within the allowed to submit one project submission; 37.2. the project application form a completed project application form (annex 2) and the following annexes: 37.2.1. copies of documents proving the legal status of the parties (including statutes, regulations, rules or equivalent documents and other documentation), or written confirmation that appropriate scientific governing regulations, the Ministry of education and science of the legal status of the submitted supporting documents correspond to the actual situation; 37.2.2. worked in the Central Administration of statistics national statistics submitted a copy of the report for the last three reporting years concluded on scientific or research or written proof that the document is a copy of the submitted to the responsible body of the operational programme "entrepreneurship and innovation" Appendix 2.1. priorities "Science and innovation" 2.1.1. action, "science, research and development" in the framework of the implementation of the activities (responsible authority received report of national statistics are used only for grouping data and means, economic processes and scientific analysis); 37.2.3. good accounting policies and financial management (copy) or written proof (with reference to the specific document) that the current version of the document copy is submitted to the responsible body of the operational programme "entrepreneurship and innovation" Appendix 2.1. priorities "Science and innovation" 2.1.1. action, "science, research and development" in the framework of the implementation of the activities. A copy of the description submitted separately, not attached to the project submission; 37.2.4. effect return on cash flows over the past three years by economic classification codes and dimensions, including the nature of the activity, the activity, the source of financing, the client, the project and other dimensions according to the research organization approved resource management system architecture. The report shall be submitted to the Microsoft Excel file format (annex 3); 37.2.5. certificate of the applicant of the project project implementation, which will be made in investments (including the address of the location); 37.2.6. statement from the land registry or cadastre of the State land service, indicating that the infrastructure for the project funds will be allocated to investments, is good, the State or local government property; 37.2.7. a statement that the infrastructure for the project funds will be allocated to investments, is transferred to the possession of the parties or, if the owner of the infrastructure are State or local government, and there are scientific institutions, the balance sheet, or proof that the applicant has long-term lease rights for at least five more years after the completion of the implementation of the project and they are registered in the land registry; 37.2.8. restoring or rebuilding of the construction cost estimate made certified tāmētāj and containing all the distinct labour and materials cost positions that are included in or eligible ineligible project costs (if applicable); 37.2.9. acquisition of tangible assets technical specification (if applicable); 37.2.10. form of de minimis aid received in accordance with the laws and regulations on de minimis aid tracking and award (if applicable); 37.2.11. the beneficiary of financial management and accounting policy system self-assessment, which justify the project's planned resource management system development costs; 37.3. the project application to the institution of the applicant, the signature of the project manager or his authorised person, project submission by adding the appropriate authorisation. 38. the project the applicant in addition to the provisions in the annex referred to in 23.1. you can submit: 38.1. The State revenue service certificate of applicant and project partners (if applicable) payment of taxes, issued no earlier than 20 working days prior to the application of the project; 38.2. the company registry certificate attesting that the applicant of the project by a decision of the Court of Justice has not been declared bankrupt, including not in the bailout process, or the process of legal protection, the economic activity is not terminated or in accordance with the commercial register of the information available, it is not in the process of liquidation (if applicable); 38.3. other documents which the applicant projects considered necessary to justify the application of the project's compliance with the rules referred to in annex 4 draft application evaluation criteria. 39. Where the applicant do not submit this rule 38.1 or 38.2. bottom. documents referred to in paragraph 1 or the responsible authority, they acquire a law on administrative process. 40. the project applicant or his authorised representative shall submit an application to the responsible body in one of the following ways: 24.9. paper form; 40.2. the electronic document. 41. If the application is submitted in paper form: 25.5. it shall be submitted in one copy in the caurauklot, with numbered pages, on the back of the last page of the thread ends are glued on the label is the information on the document number and the number of sheets caurauklot, certify you for a copy of the document, the project name of the applicant, the preparation of the application projects of the date, place and preparation of the document requesting the project officer's signature. If the project application submitted in electronic form of a document: 42.1. it shall be submitted in one copy, signed by the applicant of the project responsible for the secure electronic signature, in addition to the original document to be submitted must be signed for each individual with a secure electronic signature, by a certified time stamp and send to the responsible authority for the project call for the submission of the application to the specified e-mail address, electronic mailing subject field must specify the project name of the applicant. If additional documents are copies of the documents must be certified by each individual to the project the applicant secure electronic signature and a time stamp prior to the submission of the draft selection deadline; 26.2. the project application submitted to DOC (Microsoft Office Word document) file format. The project financing plan and project budget summary shall be submitted to a Microsoft Excel file (Microsoft Excel) format. Statistics and copies of the financial statements and other documents submitted in PDF (portable document format) file format. 43. in paragraph 34 of these rules the invitation specified in the project application submission period end date is the last day when the project applicant project application may be made in person, in the form of electronic document or sent by mail. 44. the responsible authority shall register the project application submitted to it on the date of receipt. Proof of receipt of the application, the project authority in charge of the project to the applicant immediately personally or within 10 working days after the application deadline date by post or electronically signed with a secure electronic signature according to the regulations on electronic document design. Vi. evaluation of the application of projects 45. activities within the project, the evaluation of the application, provide the responsible authority. 46. activities within the project application submitted to the evaluation of the quality, compliance, administrative and funding criteria to ensure the Commission: 46.1. panelists include representatives from the Ministry of education and science, Ministry of Economic Affairs, the Ministry of health and Ministry of agriculture; 46.2. the meetings of the Commission as an observer without the right to vote can participate in the managing authority, in cooperation with the authorities, Scientific Council of Latvia and the Latvian Academy of Sciences. The Commission in the evaluation process may invite one or more experts without voting rights. 47. The Commission shall determine the responsible authorities developed and approved the rules of procedure. 48. Launching the work of the Commission, Commission members, experts and observers (if applicable) signed a declaration that: 29.9. during the meetings of the Commission and the information content of the document will not disclose to third parties; There are no circumstances 48.2. that they may violate the laws of the European Union's structural and cohesion funds limits the structural funds of the European Union in the management of the person involved, and not the circumstances that it could be argued that they are interested in a specific project in the project submitted by the applicant for the approval or rejection of the application. 49. the project submissions valued under the provisions referred to in annex 4, quality, compliance, administrative and funding criteria using the project application selection and evaluation methodology and project submission form of valuation set out in the Act, regulations on the procedures of the European Union structural funds and the cohesion fund management and control system. 50. the project applicant and project submissions valued under the provisions set out in annex 4 of the draft application evaluation criteria in this order: 50.1. administrative criteria; 50.2. eligibility criteria; 50.3. quality criteria and funding criteria. 51. the project submission compliance project application administration, eligibility and funding criteria assessed with "Yes" or "no" ("Yes", "no" – meets does not meet). Application of project compliance with quality criteria assessed by giving a certain number of points. If there is no information in the project application in order to assess compliance of the application for the project to one or more of the evaluation criteria, or if the said information is not legible, believes that the project submission does not meet the criterion or criteria is assigned the lowest rating. VII. adoption of the decision and notification of the approval of the project application, approval with conditions or disapproval 52. the responsible authority shall take a decision on the application for approval of a project if: 52.1. compliance with all these rules referred to in annex 4 to the application project, administrative, compliance and funding criteria have been assessed with "Yes"; 52.2. the project submission each Annex 4 to these regulations 3, 4, 5 and 6 the quality criteria referred to in point of assessment is received at least the minimum score the number and the quality criteria that at least 46 total points. 53. the responsible authority shall take a decision on the rejection of the application for the project and it does not continue the assessment, if any of the following conditions: 53.1. the project submission does not comply with any of the provisions of annex 4, 7, 10, 12, 17 or 18 of the project referred to in the application of the eligibility criteria; 33.1. the parties do not match one of these rules, annex 4, 19, 20, 21, 22, 23, 25, 26 or 27, paragraph eligibility criteria; 53.3. the project submission does not comply with any of the provisions of annex 4, 28. referred to in paragraph 29 or administrative criteria; assessment of compliance with 53.4. This provision 4. in paragraph 3 of the annex to the abovementioned quality criteria for project submission received less than 20 points; 13. assessment of compliance with the provisions of this annex 4, paragraph 4 of the above quality criteria for project submission received less than 15 points; assessment of compliance with 53.6. This provision 4. in paragraph 5 of the annex to the abovementioned quality criteria the project application has been received by less than five points; assessment of compliance with 53.7. This provision of the annex referred to in point 6 the quality criteria for project submission received less than six points; 53.8. quality criterion total project application is received at least 46 points. 54. the responsible authority shall take a decision to reject the application of the project, if this provision of the annex referred to in paragraph 39 financing criteria is evaluated with "no". 55. The competent authority may take a decision on the approval of the application, the project on condition that must be met for the project, the applicant can enter into a contract for the implementation of a project. That decision may include the following conditions: 55.1. clarification of the application of the project according to the rules of annex 4, 8, 9, 11, 13, 14, 15, 16, 24, 30, 31, 32, 33, 34, 35, 36, 37. or referred to in paragraph 38 the assessment criteria; 55.2. clarification of the costs, provided that those rules are not exceeded 26.1.3.2. referred to cost limit; 55.3. other specific legal authority to justify action, which is focused on the implementation of the agreement on the conclusion of the project. 56. the responsible authority shall within five working days after the date of adoption of the decision: 56.1. project sent to the applicant, the decision on the application for the approval of the project, the project submission, or the rejection of an application for the approval of the project; 56.2. cooperation authority-the decision on the application for the approval of the project and submission of the project approved original filed in paper form, or project submission, presented in the form of electronic documents signed with secure electronic signatures, and confirm with the time stamp according to the regulations on electronic document design. If the application is filed on paper, the five working days following the agreement or contract concluded for the implementation of a project liaison body of the competent authorities receive the original of the application of the project back to the responsible authority. 57. If a decision is taken on the application for the approval of the project, the project applicant, within the time limit laid down in the decision of not more than 10 working days from the date of entry into force of the decision, shall ensure the fulfilment of the conditions and submitted to the responsible body for evaluation information on the fulfilment of the conditions. Decision within the time limit set in the information about the conditions of the project, the applicant may submit a maximum of two times. 58. the responsible authority within 10 working days after this provision in paragraph 57 that decision deadline assessed projects the information submitted by the applicant and drawing up an opinion on the conditions in the decision (hereinafter referred to as the opinion). 59. The project shall ensure that the decisions referred to in paragraph 57 of the conditions contained within the time limits laid down in the decision and the opinion of the responsible authority is positive, responsible authority within five working days from the date of signing the opinion sent: 59.1. the project applicant, opinion; 59.2. the cooperation body – a decision on project approval, and submission of the approved project, which filed the original paper, or project submission, presented in the form of electronic documents signed with secure electronic signatures, and confirm with the time stamp according to the regulations on electronic document design. 60. If the applicant does not provide this in paragraph 57 of the rules referred to in that decision the conditions contained in the decision or within the time limit set in the opinion of the responsible authority is negative, the project application is considered to have been rejected. The opinion that the decision contained in the conditions are not met, the responsible authority shall send the draft to the applicant not later than five working days from the date of its signature. VIII. Implementation of the General provisions 61. Beneficiary is obliged within 10 working days after the invitation of the liaison bodies to conclude the agreement on the implementation of the project. 62. The project site is the territory of the Republic of Latvia. 63. The beneficiary within 10 working days after the contract has been concluded for the implementation of a project procurement plan shall submit to the institution of cooperation. If the beneficiary of the project is purchasing before conclusion of the contract for the project implementation, it before launching a procurement procedure, cooperation in harmonization of procurement plans submitted. 64. The implementation of the project completed by 31 December 2015. 65. The rules referred to in paragraph 2.28. international comparative assessment has attracted to the EC experts. The EC expert selection provides the liaison body. 66. The beneficiary up to 2015 1. September submitted these provisions of the cooperation institution. 2.24 it referred to the research programme, approved by the authority, the scientific institution indicating the research programme in the science sector and subsector in accordance with the common European research classification scheme (Official Journal of the European communities, L 189, 1991). 67. cooperation authority until 2015 October 1 under the EC expert selection, the selection using the following selection criteria: 67.1. scientific institutions specialised for scientific qualifications; 67.2. appropriate professional experience and competence. 68. the number of EC experts is attached to research program evaluation, depends on research in the field. EC experts is attached to each of the research programme of the field under evaluation. 69. The beneficiaries of the structural funds of the European Union provides publicity and visual identity requirements consistent with the laws of the European Union's structural and cohesion funds publicity and visual identity requirements, as well as the provision of information to the public about this Fund projects, including the implementation of the project related loading snapshot, the beneficiary authority Web site at least once every three months. 70. the amendments to the project is carried out in accordance with the laws and regulations that govern the European Union's structural and cohesion funds, implementation, and monitoring of implementation. 71. The beneficiary, without making amendments to the project, you can perform the reallocation of costs: 71.1. these provisions, between 26.1.1, 26.1.2.26.1.3.1..,.,., and 26.1.5 26.1.4 26.1.3.2. set point cost positions, not exceeding five percent of the cost of a transferable and subject to this provision in certain 26.1.3.2 cost constraints; 71.2. This provision 26.1.4. cost referred to under the heading. 72. The beneficiary, giving to the liaison body of the payment request, accompanied by an explanation of the rules referred to in paragraph 71 of the redistribution of costs. If this explanation is not submitted or not justified, liaison body cost redistribution is deemed not to have occurred. 73. The project achieved the following results: at least 73.1. developed scientific institutions development strategy that complies with the rules laid down in paragraph 2.30., including research program that complies with the rules laid down in paragraph 2.24; 73.2. developed a results management system that complies with the rules laid down in paragraph 2.25; 73.3. implementation of twinning measures under this provision in paragraph 2.18; 45.6. the reorganization of the scientific institutions or liquidation, with at least one registered in the register of scientific institutions from the registry, if the parties receiving this rule 16.2. aid referred to; 73.5. your resource management system development, providing a result management system. 74. If the project occurs during non-eligible expenditure or expenditure incidence, the beneficiary shall be borne by them from their own funds. 75. the responsible authority shall have the right to request information from beneficiaries on the implementation of the project and results achieved compliance with the planned results. 76.
