The Republic of Latvia Cabinet of Ministers of February 8. Regulation No. 44 (in Riga. Nr. 7, § 5.) the provisions concerning the minimum safety and health requirements for the use of work equipment in accordance with the law "On labour protection" article 16 i. General questions 1. these provisions lay down minimum requirements for equipment (machines, mechanisms), machines, tools or equipment (the equipment), so their use is free of risks to the safety and health of employees, as well as the obligations of the employer in the implementation of these requirements.
2. These provisions apply to any operation on work equipment (launch (start) stop, use, transfer, modification, repair, maintenance (maintenance), room service, cleaning) (hereinafter referred to as use), except for specific actions in areas such as, for example, the armed forces, police, fire and rescue service, if the specific nature of the activities is contrary to the requirements of this regulation.
3. For compliance with these rules is the responsibility of the employer.
4. Compliance with these rules is controlled by the State Labour Inspectorate.
II. Minimum requirements for work equipment 5. Work equipment control devices which affect safety in its use is clearly visible, marked accordingly, and their meaning is easily understood.
6. Work equipment control devices deployed as outside the hazardous area (zone around work equipment in which it is threatened or the safety or health of the employee) so that they do not create additional hazards. Not designed for operation with the control device must not cause any risks.
7. employees who use work equipment (hereinafter operator), ensure that the zone would not be a dangerous man.

11. paragraph 10 of these rules also apply to the requirements for work equipment restart (starting) after the withdrawal or the operation mode (e.g. speed, pressure), but to run again (starting), as well as regime change should not pose a risk to employees. These requirements do not apply to equipment operating in automatic mode.

18.4. they do not limit the visibility of the work area of the equipment;
18.5. they do not interfere with the work equipment repair and maintenance (maintenance). If possible, repair and maintenance (maintenance) time boundaries or protective devices do not remove.
19. the operating or maintenance of the equipment or in the area, the area around the installation according to the nature of the work.

26. Work equipment may be used only under the conditions and for the intended operations.

32. work equipment shall be installed, located and used in such a way as to minimize the risk to the operator and other safety and health of workers (for example, mobile work equipment and fixed or moving parts are at a sufficient distance), as well as provide energy and substances used or produced in the secure delivery and/or removal.
33. Work equipment mounted or dismantled under safe conditions, by taking all the manufacturer's instructions.

III. Additional minimum requirements for mobile work equipment 35. This chapter applies to the mobile work equipment, including powered (hereinafter equipment) that may pose a risk to plant movement.

43. the use of powered equipment To avoid any risk to the safety and health of workers, the need to meet the following conditions: 43.1. equipment shall be fitted so as to prevent its unauthorized launch (start);

43.3. the equipment shall be fitted with braking and stopping devices, if required, also with the emergency device with automatic system that stops the machine if damaged the main braking and stopping device;
43.4. If the driver's direct field of vision is not sufficient for safe work, be suitable accessories (mirrors, or other optical or electronic devices) to improve visibility;
43.5. If the equipment is used at night or in dark places, shall be provided with sufficient, appropriate to the characteristics of the light work;
27.1. where equipment or its load is moved, use the apparatus inflammable spot near the place the appropriate fire-fighting equipment. If it is not possible to ensure that the equipment supplied with fire-fighting appliances;
27.2. the remote equipment, leaving outside the control zone, stops automatically;
43.8. remote equipment be equipped to work to avoid the risk of shock or collision. This condition does not apply to remote equipment already fitted with appropriate protective devices to prevent the collision.
44. Self-propelled equipment allowed to drive only the trained employees.
45. the employer shall comply with the safety provisions drawn up by powered equipment that move work area.
46. An area where the use of powered equipment, employees must not be. If without their presence to carry out work is not possible, the need for appropriate measures of powered equipment should not represent a risk to the safety and health of employees.
47. To carry workers to power-operated equipment will be permitted only if the equipment is then specially equipped. The machine's movement speed is adjustable according to the work to be carried out.
48. Equipment with a combustion engine may be operated and used only where it can provide sufficient quantity of air to the exhaust gases do not cause a risk to the safety and health of employees.
IV. Additional minimum requirements for work equipment designed for lifting of gravity 49. This chapter applies to the work equipment designed for lifting of gravity (hereinafter lifting equipment).
50. If the lifting appliance is installed permanently, its strength and stability during use ensure, taking into account the size of the load and the load on the mounting structure or mounting points.

56. If the lifting appliance intended for lifting and moving of employees, it shall meet the following requirements: 56.1. it is equipped with a safety device that prevents pacēlājgroz fall. 56.2. prevent employee fall from pacēlājgroz;

57. If the lifting equipment is mobile or dismantled, ensure the stability of the equipment during use under all foreseeable working conditions, taking into account the specific characteristics of the base.
58. Travel staff with lifting equipment shall comply with the following requirements: 58.1. in all work operator is located at the control console;
58.2. employees who are raised, are fitted with high-quality means of communication;
58.3. If a dangerous situation arises, employees are provided a safe means of escape.
59. staff members may not be in the ground equipment, and raised loads. Loads may not be moved above unprotected workplaces in which workers are usually present. If the nature of the nature of the work it cannot be provided, the employer shall take appropriate security measures to prevent risks to the safety and health of employees.

63.3. where the motion path is not sufficiently transparent, the operator shall, directly or with the assistance of the communications contact with competent employees who give him instructions, and take appropriate measures to prevent the risk of collision and cargo of the safety and health of employees;
63.4. gravity and detach by hand must not present a risk to the safety and health of employees, the same time as the employee directly or indirectly control lifting equipment;
63.5. lifting operations plan and above provides for appropriate monitoring to prevent risks to the safety and health of employees;
63.6. when the severity of the road with two or more lifting equipment time operator for better coordination of work comply with the employer's developed this specific safety rules;
63.7. when lifting the machine does not provide cargo delivery is totally or partially interrupted power supply, appropriate measures should be taken to prevent risks to the safety and health of employees;

V. employer's responsibilities 64. the employer comply with the equipment manufacturer's instructions attached, to ensure the safety and health of employees in the safe use of work equipment.
65. The employer shall ensure: 65.1. the compliance of equipment with the work process and its correct use, in order to avoid the risk of the safety and health of employees. If you prevent the risk completely is not possible, the employer shall take measures for the reduction of risk factors;
65.2. to, by selecting work equipment, to take into account the working conditions and the risks related to the safety and health of employees in the company (the company) and in each place of work;
65.3. the compliance of equipment with the requirements of this regulation and the relevant maintenance (maintenance) throughout its lifetime;
65.4. work equipment test after installation and before use, as well as by the Assembly to a new location or to a new position when the safety of the equipment determines the installation conditions;
65.5. the following tests work equipment exposed to conditions that can cause it to tear, creating a risk to the safety and health of employees: 65.5.1. periodic inspection and, if necessary, the testing;
65.5.2. special checks, if you have extraordinary circumstances (e.g. accidents, accidents, adverse weather conditions), as well as when the equipment is not used for long periods or modified;
65.6. to work equipment, which can result in increased risks to the safety and health of workers (for example, dangerous machinery), use only the specially designated and trained staff;
65.7. to work equipment would be the document of the last security check, if it is used outside of the company (the company).
66. This provision and 65.5 65.4. verification shall be referred to the employer or the competent employee designated by a competent authority for the inspection, as determined by the law or if the employer cannot provide verification.
67. the inspection reports are employer and authority of inspection (if the inspection body made the check). Inspection reports of work equipment owner and employer, as well as inspection body for 10 years, then handed it to the archives.
68. in order to ensure the compliance of equipment with the minimum safety and health requirements, the employer shall take into account the nature of the workplace, employee position, posture and ergonomic principles for the use of work equipment.
69. the employer shall provide the employee with clear information and required written instructions on the work equipment.

70. the information and the written instructions on the work equipment includes safety and health requirements for the use of work equipment, rules, possible special situation description and conclusions arising from the experience of use of work equipment.
71. inform workers on the job site or near the existing work equipment and any changes in it, even if they are not in use, as well as explaining the dangers of the work equipment.
72. the employer shall provide the employee instruction (including information on any risk associated with the use of work equipment) regulations.
73. This provision referred to 65.6. employees the employer provides special training.
74. The employer shall ensure employees and their representatives and participation in all occupational safety and health matters, particularly as regards work equipment.
Vi. Closing questions 75. rules shall enter into force on 1 July 2000.
76. Work equipment, the use of which started up on 1 July 2000, to be transformed according to the requirements of this regulation until 1 July 2004.
