Cabinet of Ministers Regulations No. 137 Riga, 26 March 2002 (pr. Nr. 13, 5. §) rules on D1, C1, (C) and (D) a driving licence in the category of the vehicle according to the driving and rest time and it records released under the Highway Traffic Act article 31 first part i. General questions 1. provisions laying down the requirements for working and rest time and tracking drivers who run in Latvia registered in C1, D1, (C) and (D) a driving licence in the category of the vehicle.
2. the driver within the meaning of these provisions is any person that controls C1, D1, (C) and (D) the category of driving licence for the vehicle, or who is carried in that vehicle in order to be able to control it if you need it.
3. Work time includes driving time, standby time, time spent beside the driver and (or) furnished sleeping place in the vehicle when the vehicle is in motion, a time when it is made with the vehicle related work (documentation, vehicle maintenance, cargo loading, unloading, preparation for work), as well as the time when a driver is available for the performance of the job responsibilities, to order the employer to drive vehicle If you need it.
4. Rest period is any discretion by the driver free to use continuous period which lasts at least an hour.
5. Subject to the provisions of this Regulation referred to in paragraph 2, drivers, except in the case where the driver drives a vehicle 5.1: used in passenger transport, regular international if the route does not exceed 50 kilometres;
5.2. the vehicle to be used by regular passenger domestic shipments, if the route length does not exceed 150 kilometre 5.2.1.;:
5.2.2.100 kilometres;
5.2.3.50 km;
5.3. vehicle with a maximum speed not exceeding 30 km/h;
5.4. a vehicle which carries no commercial cargo vehicle;
5.5. the vehicle used for the carriage of mail, road maintenance and control, refuse collection and removal, Telegraph and telephone services, as well as jobs with waste water, flood protection, water, gas and electricity supply, radio and television broadcasts and radio or television transmitters or receivers to locate;
5.6. the vehicle to be used in emergencies or rescue operations;
5.7. a specialized vehicle designed for medical use;
5.8. the vehicle carrying circus and amusement facilities;
5.9. the specialized emergency vehicle;
5.10. the vehicle road test to determine its structural improvement, and new or rebuilt vehicles which have not yet used for transport;
5.11. the national armed forces and the Ministry of the Interior of the vehicle is held;
5.12. the vehicle shall be used for milk, milk or milk products;
5.13. the vehicle used by agricultural, horticultural, forestry or fishery undertakings for carrying goods within a radius of 50 km from the place where the vehicle is based;
5.14. the vehicle to be used on shop local markets or supply of the goods to the door for mobile banking Exchange or saving transactions, for worship, book, record or cassette rentals, cultural events or exhibitions, and specially fitted for such use;
5.15. the vehicle carrying driver's job requires materials or equipment for a 50 kilometre radius of the place where the vehicle is normally based, provided that driving the vehicle is not the driver's principal activity;
5.16. the vehicle shall be used for driving training for a driving licence.
 
 
II. duration of driving 6. driving between two daily rest periods or between a daily rest period and a weekly rest period shall drive a vehicle nine hours. During the period from Monday 00.00 a.m. until Sunday at 24.00 (week) periods of driving time maximum two 24-hour will be extended to 10 hours.
7. the total driving duration is two weeks in a row shall not exceed 90 hours.
 
 
III. the Break in work, daily and weekly rest periods 8. Driver after four-and-a-half hours of continuous driving needs at least 45 minutes long break, except when starting this provision, paragraph 13, daily rest periods, or 19 of these regulations, paragraph weekly rest period.
9. The rules referred to in point 8 break allowed to replace with a number of at least 15 minutes long breaks in the four-and-a-half hours of driving time and immediately after it.
10. when passengers at regular national transport driver needed at least 30 minutes long break if driving duration does not exceed four hours. This allowed in such cases, if the longer break could hinder the city's traffic and the driver is not able to use the break under these rules 8 and 9 points in those conditions.
11. These rules 8, 9 and 10, paragraph breaks, a driver may not carry out other work. For other work does not believe in idle time as well as time spent beside the driver while the vehicle is in motion, a ferry, or a train.
12. These rules 8, 9 and 10 above, paragraph breaks are not considered daily or weekly rest periods.
13. within each period of 24 hours the driver shall use at least 11 hours of uninterrupted daily rest time, which allowed reduced to nine hours not more than three times a week, if the daily rest periods decrease driver offset to the end of the following week.
14. If the daily rest period shall not be reduced, the day can be divided into two or three separate periods, one of which runs continuously for at least eight hours. In this case, the minimum daily rest period shall be increased to 12 hours.
15. If the vehicle is driven at least two drivers, 30 hours each driver required rest period that lasts continuously for at least eight hours.
16. Daily rest periods can be used in a vehicle equipped with a bunk, if the vehicle is not in motion.
17. If the driver of the vehicle transporting goods or passengers accompanies a vehicle which is transported by ferry or train, you can ignore this rule 13 and once to stop the daily rest period, subject to the following conditions: 17.1. the daily rest time spent on land use before or after the daily rest period spent part of the ferry or train;
17.2. the period of time between two daily rest periods are possible parts of the brief and do not exceed one hour before embarkation or after disembarkation on the ferry from it, including the call for the customs formalities and similar operations;
17.3. the daily rest period in both parts of the driver is available on the bunk or couchette;
17.4. the daily rest period which is interrupted in this way, extended by two hours.
18. Every week one of these rules 13, 14 or 15 daily rest referred to in the times adds a weekly rest period, so that it would last 45 hours continuously. This rest period may be reduced to 36 hours, if the driver resting place where the vehicle is based, or in the driver's seat. This rest period may be reduced to 24 hours, if the driver shall rest in any other place. Each of the short rest period shall be compensated by an equivalent (continuous) time, used one time no later than three weeks after the end of the week.
19. driving no more than six daily driving periods used for weekly rest.
20. Weekly rest allowed to postpone until the end of the sixth day, if the total duration of driving in six 24-hour time will not exceed the maximum corresponding to six daily driving periods.
21. the occasional international services, the driver shall, not later than twelve daily driving periods used for weekly rest. Weekly rest allowed to postpone until the end of the 12th day, if the total driving duration will not exceed twelve 24-hour maximum time corresponding to the twelve daily driving periods.
22. in carrying out these regulations referred to in paragraph 21 of the transport weekly rest time after the first week, adding allowed to postpone next week's weekly rest.

23. a weekly rest period which begins in one week and continues into next week, allowed to include any of the following weeks.
24. the rest period granted as compensation for daily or weekly rest period, added another for at least eight hours ' rest periods. It shall be granted at the request of the driver of the vehicle in the parking lot or in the driver's seat.

27. not scheduled domestic passenger transport and freight transport driving and rest time allowed to list, with working time and rest time tracking personal kontrolgrāmatiņ (hereinafter kontrolgrāmatiņ) (annex). Kontrolgrāmatiņ is not required, if the occasional domestic service, the employer shall designate a driver who serviced daily scheduled passenger transport of domestic routes, and his work and leisure time is listed in accordance with the provisions referred to in paragraph 26 of the accounting work schedule.
 
 
V. Kontrolgrāmatiņ of procedure 28. Kontrolgrāmatiņ are issued to non-profit organization public limited liability company "road transport administration" (hereinafter referred to as the Directorate) and according to the requirements of the laws and registers them as mandatory documents.
29. for kontrolgrāmatiņ, the employer shall refer to the Directorate of road transport licence shall submit a motivated application, or if, in accordance with legislative requirements, a license is required.
30. the Directorate for the kontrolgrāmatiņ repeatedly, have the right to request information about previously received personal kontrolgrāmatiņ.

VII. responsibilities of 33 employers. the employer shall organise the work of drivers so that they can meet the requirements of this regulation.
34. the employer shall conduct regular checks on compliance with these provisions. If irregularities are detected, the employer within the limits of its competence shall take appropriate measures to prevent irregularities and referred to prevent it from happening again.
35. Work schedule and kontrolgrāmatiņ used to driving and rest time, the employer shall keep, for at least 12 months from the date of the last entry. At the request of the control authorities officials the employer presented documents, but at the request of the driver, issue an appropriate statement.

VIII. Closing questions 37. Rule 5.2 shall come into force as follows: 37.1.5.2.1 shall be valid until 31 December 2004;
37.2.5.2.2 shall be in force from 1 January 2005 to 31 December 2007;
37.3.5.2.3. subparagraph shall enter into force by 1 January 2008.
38. the provisions of paragraph 27 requirements for vehicles registered for the first time in Latvia, up to July 1, 2002 and are not fitted with recording equipment referred to in paragraph 25, in force up to 31 December 2004.
39. the rules shall enter into force by 1 June 2002.
