Cabinet of Ministers Regulations No. 144 in Riga 2003. April (1. No 18, § 13) the rules on the rest of the shipbuilding, the assessment of conformity and placing on the market are Issued in accordance with the law "on conformity assessment" article 7 of the first and the second part 1. 2.10. air-cushion vehicles;
2.11. hydrofoils.
3. recreational vessels are chartered or used in the training of boatmasters, subject to all the requirements of this regulation if the vessel is offered for the rest of the market.
4. these provisions shall apply to recreational craft, partly completed boats and components of the design (both built-in and stand-alone), referred to in paragraph 5 of these rules.

3. 57. 4. Warranty conditions

58. 5. Conformity assessment procedures 60. 64. the rest of the category C vessels with a hull length from 12 to 24 metres, take the CE test sample (module B) pursuant to this provision, subsection 6.3 supplemented by consistency (C module) or any of the modules B + D, or B + F, or G, or H. 65. 66. Recreational craft construction materials used in one of the modules B + C, or B + D, or B + F, or G, or H. 6. Conformity assessment procedures 6.1. Internal production control (module A) 67. 76. The applicant shall forward to the notified product model authority (hereinafter sample).

78. If necessary, the notified body may request further samples, to carry out the test programme.
79. The technical documentation shall enable the conformity of the product with the requirements of this regulation. It includes (to the extent necessary for such assessment) product design, manufacture and operation of the description in accordance with the provisions of Chapter 7.
80. the notified institution: 80.1. examine the technical documentation, verify that the model is built in accordance with the technical documentation and identify the components of the structure which are and which are not constructed in accordance with the adapted standards for which there are published references to the official;
80.2. carry out appropriate inspections and tests necessary to check that the Builder, the solutions adopted meet the requirements of the rules, if not the adapted standards applied;
49.9. take appropriate and necessary tests to check whether the selected construction standards have been applied;
80.4. agree with the applicant on the inspection and verification of the required tests.
81. If the sample meets the requirements of this regulation, an authorized institution shall issue to the applicant a CE certificate samples. The certificate shall contain the name and address of the Builder, the conclusions of the examination, the conditions of validity and the information necessary to identify the approved sample.
82. The certificate is added to the relevant parts of the technical documentation. A copy shall be deposited with the notified body that issued the certificate.
83. If the constructor are rejected sample certification institution authorized detailed to justify the refusal.
84. The applicant shall inform the notified body that holds the technical documentation concerning the CE examination certificate, the model for changes to the approved product which requires additional approval where such changes may affect compliance with the requirements or conditions of use of the product described. Additional approval is given in the form of an addition to the CE examination certificate of the sample.
85. Each notified body shall give the other notified bodies the necessary information on the CE sample examination certificates and certificates issued or refused the supplements.
86. The other notified bodies may receive CE sample examination certificates and their additions. The annexes to the certificates are available to the other notified bodies.
87. the Builder or his authorized representative shall keep the sample in CE examination certificate and its additions with the technical documentation a copy of at least ten years after the last product has been manufactured.
88. where the Builder or his authorized representative is located in Latvia, technical documentation, which markets products in Latvia.
6.4. Consistency (C module) 89. 91. the Builder or his authorized representative shall keep a copy of the Declaration of conformity for at least 10 years after the last product has been manufactured.

6.5. the product quality assurance (module D)

93. Builder ensures and declares that the products concerned conform to the pattern described in CE sample examination certificate and comply with the requirements of this regulation. 97. the elements of the quality system requirements and conditions accepted by the constructor, systematically documented, presenting them as written plans, procedures and instructions. The quality system documentation shall ensure the quality programmes, plans, manuals and protocols for common understanding.
98. quality system documentation includes: 98.1. quality objectives and the organizational structure, responsibilities and powers of the management with regard to product quality;
98.2. manufacturing, quality control and quality assurance techniques and processes;
98.3. the examinations and tests that will be carried out before construction, during and after, as well as the frequency of the conduct;
98.4. quality records (such as inspection reports and test messages, calibration, qualification reports of the personnel concerned);
98.5. the requested product features quality monitoring and effective operation of the quality system.
99. the notified body shall assess the quality system compliance with the requirements of this regulation. The notified body assumes that its quality systems which implement the adaptēto standard meets these requirements.
100. the quality system conformity assessment group has at least one person with experience in the relevant product technology concerned. The assessment procedure includes a visit to the manufacturer's premises.
101. The decision shall be communicated to the constructor. The notification shall contain the conclusions of the examination and assessment.
102. the Builder undertakes to fulfil the obligations arising out of the approved quality system, and maintain the quality system adequate and efficacious.
103. the Builder or his authorized representative shall inform the notified body of any planned quality improvement of this system. The notified body shall evaluate the modifications proposed and decide whether the premium quality system complies with the requirements of this regulation or repeated assessment is required. The notified body shall notify its decision to the constructor. The notification shall contain the conclusions of the examination and the grounds for the decision.
104. the notified institution: 104.1. the audits to make sure that the Builder duly fulfils the obligations arising out of the approved quality system;
104.2. conformity assessment periodically checks to make sure that as the Builder is maintaining and applying the quality system. The notified body shall submit the audit report to the Builder;
104.3. without warning can perform extraordinary inspection. During such inspections, the notified body may carry out tests or have them carried out, to check the quality of the system. The notified body shall submit the inspection report and the Builder, if the testing has taken place, and the test results.
105. to the notified body for inspection, the Builder provides the notified body free access for construction, inspection, testing and storage locations and provide all required information including: 105.1. quality system documentation;
105.2. quality records (inspection reports, test and calibration results, qualification reports of the personnel concerned).
106. Ten years after the last product has been manufactured, keep at the following constructor of control bodies available documents: 106.1. the quality system documentation;
106.2. documentation on the quality system improvements;
106.3. decisions and notified bodies of reports on the compliance of quality system standards, adapted for periodic audits and for the additional tests. the Builder
4.2. product inspection (module F) 107. This module describes the procedure whereby the manufacturer or his authorized representative (in Latvia) checks and attests that the products subject to the requirements of this regulation, shall conform to a model that describes the sample CE examination certificate and with the requirements of this regulation.

109. the notified body shall carry out appropriate inspections and tests to check the conformity with the requirements of this regulation. Check after the choice of the manufacturer: 109.1. examining and testing every product in accordance with the provisions of paragraph 111;
109.2. checking and testing the products by statistical methods in accordance with the provisions of paragraph 112.
110. the manufacturer or his authorized representative shall keep a copy of the Declaration of conformity for at least 10 years after the last product has been manufactured.
111. the inspection and testing of the product: the product of the individual test 111.1. and tests set out in the standards adapted, or equivalent tests, to ensure that the product is in conformity with the type as described in the sample of the CE examination certificate and with the requirements of this regulation;
111.2. authorized institution to be affixed, its identification number to each approved product and draw up a written certificate of conformity concerning the tests carried out;
111.3. the manufacturer or his authorised representative shall ensure that the notified bodies the conformity certificates issued are available on request.
112. statistical verification: 112.1. the manufacturer shall present his products as a uniform group, and take measures to ensure that the manufacturing process each group produced uniformity;
112.2. all products shall be available for inspection in a uniform group. Choose from each group. The model of individual product inspection and tests performed, which certainly adapted in the standards, or equivalent tests, to ensure that the product is in conformity with the requirements of this regulation and to determine whether the group is validated or rejected;
112.3. statistical inspection, the following elements: 112.3.1. statistical method;
112.3.2. the sampling plan with its characteristics of the implementation;
112.4. If product is approved, the authorized institution to be affixed, its identification number to each product and draw up a written certificate of conformity relating to the tests carried out. All products in the group can offer the market, except those who were identified as non-compliant;
If the product group 112.5. is rejected, the notified body or by the market surveillance authorities shall take appropriate measures to prevent the sale of this product on the market;
If the product group 112.6. has been rejected several times, the notified body may void the results of statistical tests;
If the notified body 112.7. responsibility, the manufacturer may affix the body's identification number during the manufacturing process;
112.8. the manufacturer or his authorised representative shall, on request, be produced to the authorized authorities issued certificates of conformity.
6.8. the unit verification (module G) 113. This module describes the procedure whereby the Builder ensures and declares that the product concerned, which has issued the certificate referred to in paragraph 115, meeting the requirements of this regulation. The Builder or his authorized representative (in Latvia) affix the CE marking to the product and draw up a declaration of conformity.
114. the notified body shall examine each product and carry out the tests laid down in the standards adapted, or equivalent tests, to check the conformity of the products with the requirements of this regulation.
115. the notified body shall affix its identification number to the approved product and shall draw up a certificate of conformity relating to the tests carried out.
116. The technical documentation shall enable the conformity of the product with the requirements of these provisions and provide an explanation of the product's design, manufacture and use.
4.3. Full quality assurance (module H) 117. This module describes the procedure whereby the Builder, which performs the duties referred to in the rules, ensures and declares that the products concerned meet the requirements of these regulations applicable to them. The Builder or his authorized representative (in Latvia) affix the CE marking to each product and draw up a written declaration of conformity.

118. The CE marking supplemented by the notified body identification number, which is responsible for this rule set in 130 CE test.
119. the Builder supports this rule 6.10. sub-chapter quality system with respect to the product's design, manufacture and final inspection and testing, as well as the supervision order is subject to the rules laid down in paragraph 130.
6.10. the quality system 120. to evaluate the quality system, the manufacturer shall submit to the institution of the application, the authorized which shall include information on the expected products and quality system documentation.
121. the quality system shall ensure compliance of the products with the requirements of this regulation.
122. the elements adopted by the manufacturer, the requirements and the conditions for systematic document, presenting them as written plans, procedures and instructions.
123. the quality system documentation shall ensure a quality policy, procedures, quality programmes, plans, manuals and protocols for common understanding.
124. the quality system documentation includes: 124.1. quality system objectives and structure, responsibilities and powers of the management with regard to design and product quality;
technical instructions, 124.2. including the standards which will be applied (if standards were not applied in full, the means that will be used to ensure that requirements are met);
124.3. control and construction design verification techniques, processes and actions that apply to the product category;
124.4. the corresponding manufacturing, quality control and quality assurance techniques, related to the processes and systematic actions;
124.5. the examinations and tests that will be carried out before, during and after manufacture, and inspection and testing frequency;
124.6. quality records (such as inspection reports and test messages, calibration, qualification reports of the personnel concerned);
124.7. features of the required design and product quality monitoring and effective quality system.
125. the notified body shall assess the quality system to determine its compliance with this provision, 121 122 123 and 124, the requirements set out in paragraph and assumes that a quality system which implements the adapted standard meets these requirements.
126. the conformity assessment expert team has at least one person with experience in the product technology concerned. The assessment procedure includes a visit to the manufacturer's premises.
127. the decision shall be notified to the manufacturer. The notification shall contain the conclusions of the examination and assessment.
128. The manufacturer shall undertake to fulfil the obligations arising out of the approved quality system, and maintain the quality system adequate and efficacious.
129. the manufacturer or his authorized representative shall inform the notified body of any planned quality improvement of this system. The notified body shall evaluate the modifications proposed and decide whether the premium quality system complies with these provisions 121.122, 123, 124 and the requirements set out in paragraph or repeated assessment is required. The notified body shall notify its decision to the manufacturer. The notification shall contain the conclusions of the examination and the grounds for the decision.
130. the notified institution: 130.1. checks to make sure that the manufacturer duly fulfils the obligations arising out of the approved quality system;
130.2. periodically carry out audits to make sure that the manufacturer maintains and applies the quality system. The notified body shall provide the manufacturer with audit reports;
130.3. without warning can make the manufacturer's inspection. During such inspections, the notified body may carry out tests or have them carried out, to check the quality of the system. The notified body must provide the manufacturer with an inspection report and, if a test has taken place, and the test results.
131. the authorized institution To perform the test, the manufacturer shall allow the notified body free access to design, manufacture, inspection, testing and storage locations and provide all required information including: 131.1. quality system documentation;
131.2. quality records, relating to the construction (the results of analyses, calculations, tests);
131.3. quality records that are related to the production (inspection reports, test and calibration results, qualifications of the personnel concerned ones).
132. Ten years after the last product has been manufactured, keep at the manufacturer of such control bodies available documents: 132.1. quality system documentation;
132.2. documents on quality system improvement;
132.3. the notified bodies decisions and reports on compliance with the quality system standards, adapted for periodic audits and on additional inspections of the manufacturer.
133. Each notified body must, on request, give the other notified bodies information on issued and withdrawn the approval of the quality system.
7. The manufacturer's technical documentation submitted 134. Modules A, B, C and D referred to in the technical documentation includes information, and the way the manufacturer provides the constructive components of vessels and their compliance with the requirements.
135. technical documentation provides information about the product's design, manufacture, installation and operation and assess compliance with the requirements of this regulation.
136. in order to carry out the evaluation, the technical documentation includes: 136.1. General description of the sample;
136.2. conceptual design and components, Assembly parts, chains, and other elements of the drawings and diagrams and the explanatory descriptions and instructions for use of the product;
136.3. adapted a list of the standards applied in full or in part, and descriptions of the solutions adopted to meet the requirements of this regulation if the adapted standards do not apply;
design and calculation of 136.4. results of checks;
136.5. test results or estimates regarding stability in accordance with paragraph 16 of these terms and conditions of the buoyancy in accordance with the provisions of paragraph 17.
8. the CE marking 137. Holiday craft and this provision in paragraph 5 that the design of the components which comply with the provisions of paragraph 6 of these requirements by offering market, marked with the CE marking.

Other signs can be placed on a recreational craft and the rules set out in paragraph 5 of the structure components and their packaging provided that the visibility and legibility of the CE marking is not thereby reduced.
140. If a notified body establishes that the CE marking is positioned incorrectly, the manufacturer or his authorized representative (in Latvia) is obliged to end the infringement.
141. If further failure to comply with the requirements set out in these rules for the labelling of the product, the notified body shall take measures to limit or prohibit the placing on the market of such products, or to ensure that it is withdrawn from the market, subject to this provision in the chapter 4 requirements.
9. the written declaration of conformity 142. written declaration for the rest of the Board and the rules laid down in paragraph 5 of part of compliance with this rules is located on the Recreation Board and is connected to the ship's owner's manual.
143. The written declaration of conformity shall include the following: 143.1. the manufacturer or his authorized representative (in Latvia) name and address;
143.2. recreational craft or components of the structure;
143.3. adapted standards or references to instructions, in accordance with which conformity is declared;
143.4. If necessary, information on CE sample examination certificate issued by a notified body;
143.5. name and address of the institution;
143.6. personal data, the signatory who has been empowered to represent the manufacturer in Latvia;
143.7. manufacturer's representative Company (name and address). Authorised representative of the manufacturer's company provides name and address;
143.8. where necessary, the construction of the product description, model, and serial number.
144. the written declaration of conformity is issued in the language of the country.
10. the notified body 145. traffic Ministry newspaper "journal" publishes the list of bodies authorised to carry out the provisions referred to in Chapter 5 of the conformity assessment procedures of any relevant institutions in tasks are mandated to take and what their ID number.
146. the notified body, its Director and the personnel conducting the rest or check tests of the components of the structure must be the recreational craft or components of the design engineer, manufacturer, supplier, installer or their authorised representatives. They may not be directly or as authorized representatives involved in this product design, manufacture, marketing or maintenance.

147.146 those rules the conditions referred to in paragraph shall not preclude the possibility of exchanges of technical information between the manufacturer and the notified body.
148. The notified body shall have at its disposal the necessary human resources, financial resources and equipment, in order to be able to efficiently perform examination with the technical and administrative tasks.
149. the institution is registered in the commercial register of the Republic of Latvia.
150. the staff responsible for inspection shall comply with the following requirements: 150.1. appropriate technical and vocational education and training;
150.2. knowledge of the tests to be carried out and the test-taking experience;
150.3. skill to design certificates, notes and reports, which are required to verify the tests.
151. the institution guarantees the impartiality of inspection staff. Staff remuneration does not depend on the number of tests or test results.
152. the notified body shall take out liability.
153. the staff of the notified bodies shall be obliged not to disclose the resultant professional activities of commercial information.
11.154. Market surveillance market surveillance authority under the national budget resources to fulfil consumer centres. Consumer rights protection Centre carries out the laws and measures to prevent the provision of inadequate recreational vessels and their equipment distribution market.
155. If recreational vessels and their equipment, the manufacturer or his authorized representative in Latvia has not fulfilled the requirements laid down in these provisions, the trade of the product concerned is not permissible.
12. concluding issues 156. Recreational vessels are not equipped with the provisions referred to in paragraph 49 of the port reception facilities completely emptied the toilet contents collection system must be fitted with the system until 1 January 2005.
