Cabinet of Ministers Regulations No. 252 in Riga, 13 May 2003 (pr. No 28, § 9) agricultural or forestry tractors and components conformity assessment rules Issued in accordance with the law "on conformity assessment" article 7 i. General questions 1. determines: 1.1. conformity assessment General provisions for agricultural or forestry tractors with a maximum calculating speed of between 6 and 40 km/h, fitted with wheels, with at least two axles, the main function of which lies in its tractive power. They are especially designed to pull, push, move or operate certain agricultural or forestry tools and machinery or trailers (trailers), and can be equipped for the carriage of goods and passengers (tractors);
1.2. the conformity assessment procedures of the General Assembly, wheeled nodes, mechanisms, devices, assemblies, systems and equipment (components) that are offered to the market or intended to be used in Latvia.
2. the rules shall not apply to: 2.1 tractors registered in Latvia until the date of entry into force of the provisions;
2.2. tractors, which registered the previous standing abroad and had been made up to 31 December 2002;
2.3. tractors registered in foreign countries and imported from there for a time;
2.4. components, imported tractors or produced in Latvia until 31 December 2004.
3. Market allowed to offer (sell, bestow, put into use against consideration or not) the only type of tractors and components which compliance assessed in accordance with the requirements of these provisions and technical regulatory requirements laid down by the Minister of agriculture.
 
II. The type approval procedure General 4. Type approval within the meaning of these provisions is the administrative procedure of the conformity assessment carried out by an authorized certification authority (hereinafter referred to as the certification authority) to, on the basis of the report provided by the test laboratory and the type-approval certificate set out in the assessment of the results of the inspections, or component type tractors in compliance with the relevant technical requirements of the regulations.
5. to confirm or component type wheeled tractors, the manufacturer, his authorized representative or the importer shall submit to the institution of the certification application.
6. The application shall be accompanied by the following: 6.1 sample specific information document with tractors or component type technical description;
6.2. conformity assessment required for or component type wheeled drawings and photos;
6.3. the manufacturer, or held other independent testing lab reports and other documents that can provide information on tractors or component type (after the certification authority or the manufacturer or his authorised representative);
6.4. specific sample certificate of compliance, with which the manufacturer or his authorised representative certifies compliance with each specific tractors to the approved type.
7. for each component type or wheeled to a separate application must be submitted in only one Member State (the State of the European Union or any other country that is legally binding in Geneva the UN European Economic Commission of 20 March 1958 in agreement "on the adoption of uniform technical prescriptions for wheeled vehicles, equipment and parts which can be fitted and/or be used on wheeled vehicles, and in accordance with these provisions the approval to be granted for the conformity assessment of the conditions for mutual recognition" added provisions) certification body.
8. certification institution within 30 working days of the documentation submitted and the type-approval of tractors applied sample (chosen by random selection method) checks awarded: 8.1. type-approval of wheeled type which matches the submitted technical description, has passed the type approval certificates required check and comply with the relevant technical requirements of the regulations;
8.2. the type-approval of daudzetap an incomplete or completed type of tractors that meet the technical description and submitted the relevant technical requirements of the regulations, taking into account the State of completion of tractors;
8.3. component type-approval of tractors which satisfies the technical description and submitted the relevant technical requirements of the regulations;
8.4. the type-approval of a component type tractors which comply with the technical description and submitted the relevant technical requirements of the regulations.
9. the Certification Body shall issue the respective tractors type approval certificate.
10. Type-approval costs shall be borne by the legal or natural person who submitted these rules referred to in point 5 of the application or component type tractors.
11. If the certification body finds that tractors or its ingredients may compromise traffic safety, human health, life or the environment, it does not meet all the particulars in the information document or not passed all of the type approval certificate set out in the examination, it shall adopt a reasoned decision not to grant approval within 30 working days and shall inform the other Member States of the certification bodies.
12. Following another Member State certification authority certification authority that it assessed the compliance month send information on type approvals granted and outstanding tractors types.
13. If these rules or technical regulations are amended and certification authorities granted type approval no longer meets the requirements, the certification body shall immediately inform the manufacturer or his authorised representative.
14. further to this provision, the information referred to in paragraph 13, the manufacturer or his authorized representative shall submit an application for the amendment.
15. If there is a change in the design of wheeled, for which the certification authority has issued type-approval, and to changes in the type of content in the document, the manufacturer, the authorised representative, the importer or the application for amendment shall provide the certification authority the information document relating to the above changes, indicating the change and the series number of the changed constructs tractors started production. After evaluation of the amendment applied for certification authority, if necessary, you can assign a new type-approval.
16. The application for the amendment of the granted type-approval shall be submitted by a Member State certification authority, which granted the original type-approval.
17. If the certification body finds that need additional tests or checks, it shall inform the manufacturer or his authorised representative. In this case, the certification authority assigns a new type approval only after a successful additional test or tests.
18. If the type-approval certificate is amended, a new type-approval granted or approved type production stopped, wheeled certification body during the month, notify the competent authorities of the other Member States the serial numbers of the last tractor produced according to the old certificate and, where appropriate, the serial number, which started production under the wheeled amended or a new certificate.
 
III. individual approval of wheeled tractors individual 19 approval within the meaning of these provisions are administrative technical conformity assessment procedure performed by the certification body to assess compliance with the appropriate specific tractors technical regulatory requirements.
20. the individual approval of tractors may make a single copy of the foreign countries imported or produced in Latvia, where tractors tractors does not comply with an approved type of tractors tractors above or if Latvia permanently was not registered.
21. the owner or his authorised Wheeled person shall provide the certification authority an application for individual approval of tractors. The application shall be accompanied by the following: 21.1. a technical description of the wheeled;
21.2. the wheeled picture or photograph;
21.3. the verification protocol; tractors
21.4. test lab reports or other documents relating to the type approval of wheeled tractors (after the certification authority or the manufacturer, importer or distributor).
22. Certification Authority within 10 working days after the evaluation of the documentation submitted and issued the approval granted individual approval certificate tractors, if it matches the submitted technical description and wheeled the relevant technical requirements of the regulations, or a reasoned refusal.
 
IV. ensuring the conformity of production 23. Before granting type-approval certification body shall verify that the manufacturer shall take necessary measures and procedures to ensure effective control of the production of tractors or components conform to the approved or component type tractors.

24. After the type approval the manufacturer: 24.1. ensure each wheeled tractors or its components conformity or component type wheeled tractors;
24.2. the control of wheeled tractors or its components conformity or component type tractors in the production process;
24.3. the availability of test equipment provided, so that you can periodically check the tractors or production components conform to the approved type or component tractors;
15.2. supports the registration of test results and availability, as well as coordination with the certification body is determined by how long the stored test results;
15.2. constantly analyzes the test results to verify and ensure that the parameters or elements thereof wheeled conform to the approved type or component tractors;
24.6. perform repeat tests, if found in the sample or the sample serial non-compliance approved or component type tractors as well as soon as possible, provide remedial and restoration of compliance.
25. The certification body shall periodically checks the conformity of components or wheeled control methods and the choice of samples (with random selection techniques) that compliance with the approved or component type wheeled the test laboratory of the manufacturer or of the manufacturer or other certification authorities selected testing laboratory.
26. the manufacturer shall provide the certification authority an opportunity to make its constituents and wheeled the production process control.
 
V. type of recognition and registration procedures in General 27. recognition of type approval within the meaning of these regulations is administrative in the conformity assessment procedure performed by the certification authority in accordance with the laws and regulations to confirm that other national certification authorities granted type-approval (issued the type-approval certificate and its accompanying documents) meeting the requirements of this regulation.
28. Tractors and components that have a recognized type approval, can offer to the Latvian market without additional conformity assessment.
29. in Latvia are recognized: 29.1. European Union countries and the assigned tractors component type-approval, where a type-approval certificate issued in accordance with the procedure laid down in the European Union;
29.2. Member States and the assigned tractors component type-approval, where a type-approval certificate issued in accordance with the relevant technical requirements of the regulations.
30. The European Union provided tractors type approval certificate shall be registered in the following order: 30.1. the manufacturer of the wheeled authorized representative or the importer shall submit an application in the certification authority type approval certificate for registration. The application shall be accompanied by the following documents: 30.1.1. type approval certificate or a copy of it;
30.1.2. wheeled tractors or component type information document;
30.1.3. wheeled tractors of type image or photograph;
30.1.4. test lab reports or other documents relating to tractors type (at the discretion of the manufacturer or importer);
30.1.5. specific sample certificate of compliance, with which the manufacturer, his authorized representative or the importer certifies the compliance of each specific tractors to the approved type;
30.2. the certification authority within 10 working days of the appearance of the documents submitted and shall decide on the type-approval certificate, registration or refusal to register a type approval certificate;
30.3. If not submitted all the required documents, the certification body shall inform the manufacturer of tractors, the authorized representative or the importer and the decision shall be taken after receipt of all required documents.
31. Tractors component type-approval certificates shall not be registered.
 
Vi. the certificate of conformity and the type-approval mark 32. manufacturer, it wheeled authorized representative or the importer each specific complete or incomplete compliance with approved tractors tractors type certified by the certificate of conformity. Certificate and the information determines the Minister of agriculture.
33. the manufacturer of the components of each Wheeled components conformity in a Member State-approved components of wheeled type on the label. The mark consists of a type-approval mark composed of type approval symbol and country code, and additional signs according to the technical requirements of the regulations. Ingredients not labelled, if technical regulations under which have been granted component type approval, it is not required.
34. and components manufacturer of Tractors, his authorized representative or the importer of tractors and components stored in the type-approval documentation and ensure its availability to market surveillance authorities the employees at their request.
 
VII. 35. Market surveillance market surveillance bodies performing public functions to technical supervision Inspectorate (Inspectorate).
36. in Latvia allowed on the market (sell, bestow, put to use against or without payment) or constantly track tractors, if it has a valid certificate of conformity which certifies that Latvia complies with the approved tractors or for tractors recognised type, or a type of wheeled approval is registered, or if it is an individual approval certificate.
37. in Latvia authorised the placing on the market of components or wheeled entry if the ingredients meet the State-approved type of ingredients and tractors are marked according to the provisions in paragraph 33.
38. If the inspection finds that the tractors on the market, accompanied by a certificate of conformity or components do not conform to the approved or adjudged or component type wheeled tractors, the Inspectorate shall inform the certification body. The offering of these tractors market, registration or operation, as well as tractors offering market components or operating in Latvia can be restricted to the prevention of non-compliance. Certification institution within 30 working days of receipt of the information on non-conformity shall inform the manufacturer of components or wheeled, its authorized representative or the importer.
39. If the inspection finds that the tractors on the market, accompanied by a certificate of conformity or their components may pose a serious risk to road safety, the Inspectorate shall inform the certification body. The offering of these tractors market, registration or operation, as well as tractors offering market ingredients or operation is prohibited in Latvia. The certification body shall inform within 30 working days of non-conformity with the national certification authority which has granted type approval.
40. If the certification body receives information regarding tractors or their components do not conform to the approved type of wheeled or their components, depending on the nature of non-compliance it alert the manufacturer, his authorized representative or the importer, invalidate the certificate of compliance and to the prevention of non-compliance will void the certification authorities granted the type approval.
41. This provision 40. in the case referred to in paragraph the manufacturer performs these rules laid down in paragraph 24.6. The certification body shall notify the other Member States certification authorities.
42. If the certification authority of another Member State indicates that the component or wheeled, which Latvia has granted type approval, and accompanied by a certificate of conformity or the appropriate marking do not conform to the approved type of wheeled or component, the certification body shall carry out the necessary checks and inform the manufacturer about it. If the lack of conformity, the manufacturer as soon as possible, but not more than six months after the receipt of the instructions, take this rule 24.6. the measures laid down in point.
43. The certification body within 30 working days, inform the other Member States of the certification bodies for each withdrawal of type-approval, giving reasons for its decision.
 
VIII. notification of the decision and the Appeals Authority 44. certification decision on type approval, refusal or revocation or refusal to register type approval certificate to the manufacturer or importer shall notify in writing, by reason of the refusal.
45. A manufacturer, importer or authorised representative of the certification authority's decision can be appealed against in accordance with the procedure prescribed by law.
