Cabinet of Ministers Regulations No. 126 in Riga on 10 March 2015 (pr. 14. § 12) system of direct payments to farmers have been issued in accordance with the agricultural development Act unlauk article 5, fourth paragraph 1. General questions 1.  The rules determine the order in which the State and the support of the European Union agriculture direct aid scheme within the European Parliament and of the Council of 17 December 2013 Regulation (EU) no 1307/2013, establishing rules on farmers for direct payments made under the common agricultural policy support schemes, and repealing Council Regulation (EC) No 637/2008 and Council Regulation (EC) No 73/2009 (hereinafter Regulation No 1307/2013) and of the European Parliament and of the Council of 17 December 2013 Regulation (EU) no 1306/2013 for the financing of the common agricultural policy, management, and monitoring and Council Regulation (EEC) no 352/78, (EEC) No 165/94, (EC) No 2799/98, (EC) no 814/2000, (EC) No 1290/2005 and (EC) No 485/2008 (hereinafter Regulation No 1306/2013). 2. The farmer can receive this Union direct payments: 2.1 single area payment; 2.2. payment for climate and environmentally friendly agricultural practices; 2.3. payment to young farmers; 2.4. voluntary support related to dairy cows; 2.5. voluntary support related for the goat; 2.6. voluntary tied aid for cattle; 2.7. voluntary support related to the ovine; 2.8. voluntary support related protein; 2.9. voluntary tied aid for starch potato; 2.10. a voluntary linked aid for certified seed potatoes; 2.11. voluntary support of related certified grasses and fodder plant seed; 2.12. voluntary support of related certified cereal seed; 2.13 voluntary tied aid for barley; 2.14. voluntary support related to spring swede rape; 2.15. voluntary support related on vegetables; 2.16. voluntary tied aid for fruit and berries; 2.17. the small farmers ' payment of the aid scheme. 3. farmers in 2015. in 2016 and may receive such transitional state aid payments to: 3.1 transitional state aid for suckler cow premium; 3.2. the transitional national aid for the transhumance of sheep mothers; 3.3 separated transitional state aid areas; 3.4 separated transitional national aid for arable crops area; 3.5. separate the transitional state aid for potato starch. 4. you can force majeure or exceptional circumstances pursuant to Regulation No 1306/13 article 2, paragraph 2, shall be considered for the following cases: 4.1.  the death of the beneficiary; 4.2. support long-term professional incapacity of the beneficiary; 4.3. the severe natural disaster substantially affecting the holding; 4.4. livestock breeding for the accidental destruction of the farm; 4.5. an epizootic or plant disease, which affects part or all of the beneficiary owned livestock or crops; 4.6. all farms or a large part of the holding if that seizures could not be foreseen at the date of submission of the application. 5. If there was a case of force majeure or exceptional circumstances, a farmer in accordance with the Commission's March 11, 2014. the delegated Regulation (EU) no 640/2014, supplementing the European Parliament and Council Regulation (EU) no 1306/2013 as regards the integrated administration and control system, the refusal or withdrawal of the payment conditions and administrative penalties applicable to direct payments and rural development support in the context of cross-compliance (hereinafter Regulation No 640/2014) 4. paragraph 2 of article 15 working days from the date on which such opportunity arises, Field support services, submit to: 5.1.  detailed description of a case of force majeure or exceptional circumstances clause; 5.2. force majeure or exceptional circumstances can the supporting documents. 6. Decision on the direct payment of advance payments in accordance with Regulation No 1306/2013 article 75 (1) of the Minister of agriculture shall adopt. 7. Regulation No 1339/2013 referred to in article 8 of the financial discipline of the rate adjustment does not charge in advance for payment of direct payments in accordance with the Commission's March 2014 July 17 of the implementing Regulation (EU) no 809/2014, laying down rules for the European Parliament and Council Regulation (EU) no 1306/2013 shall apply in relation to the integrated administration and control system for rural development measures and mutual consistency (hereinafter Regulation No 809/2014) laid down in article 10. 8. Under Regulation No. 809/2014 article 3, point "a" and "b" to point this rule aid referred to in paragraph 2, for which the application is submitted by a person holding is transferred, or that the person who requested the holding is transferred, the transferee of a farm shall be granted where, in the period from 16 June of the current year up to 15 October notify the transferee of the rural support service of the transfer and requests payment of the aid. Proof of the signature of the person taking over the farm, and the holding is transferred. 11. the budget of the European Union the European agricultural guarantee fund earmarked revenue credit accounts, 20 percent of the amount of direct payments, which are recovered, taking into account the identified infringements, and of this amount, the accrued interest as flat-rate recovery costs including the State budget in accordance with Regulation No 1306/2013 article 55. 12. The State budget includes 25 percent of the amount of a payment reduction and it is not granted in accordance with Regulation (EC) no 1306/2013 article 99. 2. Integrated Administration and control system for single application 13 2.1. joint submission (annex 1) in accordance with Regulation No 1306/2013 article 72, paragraph 4 of the farmer in the rural support service shall be submitted to the May 15 of the current year by logging in to this provision in paragraph 2 and 3.3, 3.4 and 3.5. aid referred to. According to Regulation No 1306/13 paragraph 2 of article 72 of the farmer can not declare agricultural parcels that do not exceed 0.1 hectare in area, if it is not applying for receipt and payment if such plots of land total area does not exceed one hectare. 2.3. Control System 22.  Field support services shall support the applicant's submission, the administrative review and the holding of, and in accordance with Regulation No. 809/2014 conditions are documented and recorded the checks carried out. 23. supports the applicant provides field support to carry out an on-the-farm and rural support service after officials certify compliance with the request of the 2 and 3 of the provisions referred to in the conditions for receipt of the aid. 24. the applicant is entitled to participate in the test, which is carried out on the holding, and familiarize yourself with the test results. 25. supports the applicant does not participate in the examination does not affect the reduction of aid and Regulation (EC) no 1306/2013 referred to in article 64 the application of administrative penalties, if the conditions for granting the aid and violation of. 26. on the basis of the administrative checks and inspections carried out by holding the results obtained, the rural support service shall decide on the amount of the aid or the rejection of the application in accordance with Regulation No 1307/2013, Regulation No 1306/2013, Commission 2014 March 11 delegated Regulation No 639/2014, supplementing the European Parliament and Council Regulation (EU) no 1307/2013, establishing rules on farmers for direct payments carried out under the common agricultural policy support schemes and amending Annex X to that Regulation (hereinafter Regulation No 639/2014), Regulation No. 640/2014, 2014 the Commission of June 16 in the implementing Regulation (EU) No 641/2014, laying down rules for the application of the European Parliament and Council Regulation (EU) no 1307/2013, establishing rules on farmers for direct payments carried out under the common agricultural policy support schemes (hereinafter Regulation No 641/2014), Regulation No. 809/2014 and the procedure laid down in these provisions. 27. If a farmer when applying this provision and paragraph 2 3.1. and 3.2. aid referred to, has provided false information or violated the conditions for granting the aid, it does not receive payment for a particular item in a given year, as well as field support released aid, if any, is paid before the finding of infringement. 28. If a field support service requires additional information on the documents submitted or relating to eligibility conditions, farmers within 10 working days of receipt of the request in writing to the relevant information and, if necessary, add additional documents. If the rural support service does not receive the requested information, the aid shall not be granted, or it reduces the payments unit, which has received the requested information. 29. If the farmer hinder inspection, the officer holding the control report and the farmer's application is rejected pursuant to Regulation No 1306/2013 point 7 of article 59. 30. a farmer familiar with the control message, and sign it, affirming their presence on the holding have been subjected to examination. The farmer's rights when signing the control report, agree or disagree with control information provided in the report. 31. a farmer within 10 working days of the receipt of the inspection report shall be entitled to submit the field support service of the explanations or clarify information in connection with the control message. 3. Active status of farmers (applies to farmers who work in non-agricultural activities) 32.  The conditions for the granting of direct payments is not Regulation No 1339/2013 article 9 paragraph 2 of the persons referred to in the evidence of compliance and active status shall apply to the farmer in accordance with Regulation No 1339/2013 article 9 and Regulation No 639/2014, Chapter 1 section 3. 33. According to Regulation (EC) no 1307/2013 article 9 4 of active farmer's condition does not apply to the farmer who in the previous year the total amount of direct payments did not exceed 5000 Euro. 34. According to Regulation (EC) no 1307/2013 article 9 paragraph 2, persons: 34.1.  manages the construction of waterworks, Water service provider is registered; 21.3. manages the airport's Civil Aviation Agency's database of registered civil aviation aerodrome operators; 3. manage the continual sports courts, is the Ministry of education and science of sports based on the register of registered persons; 21.4. manages the permanent sports and recreational areas, people who state land cadastre in land use of the service is given as a sport and recreation outfitted natural areas; 34.5. provide rail services, rail infrastructure in the national register of registered persons; 21.5. providing services in the real estate area, there are persons whose activity, declared the State revenue service, or one of the types of activities indicated in the register of enterprises or the Lursoft database corresponds to NACE revision 2 statistical classification of economic activities in class or 68.31 68.32.. According to the European Parliament and of the Council of 20 December 2006, Regulation No 1893/2006 establishing the NACE revision 2 the statistical classification of economic activities in the and amending Council Regulation (EEC) No 3037/90 and certain EC regulations on specific statistical domains (hereinafter Regulation No 1893/2006). 35. the Person complies with this provision in paragraph 34 above requirements, if it is registered in the register until May 15 of the current year. 36. paragraph 34 of these rules shall not apply to the educational institutions that implement the agricultural education program. 37. in accordance with Regulation No 1339/2013 article 9 paragraph 2, third subparagraph, point "b" of the agricultural activity is not considered to be insignificant if the income from agricultural activity last year concluded, for which information is available, at least one third of the total revenue for the year. 38. in accordance with Regulation No 1339/2013 article 9 paragraph 2 of the third paragraph of point "c" of the person or persons to conduct the main target is agricultural activity, if its turnover constitutes the largest proportion of the total turnover last year concluded, for which information is available. 39. This provision, paragraph 38 turnover from agricultural activities are: 24.3. net sales associated with agricultural activity on the holding of Regulation No 1339/2013 article 4 paragraph 1 of point "c"; 24.4. net sales associated with your property, including shopping, Regulation No 1339/2013 article 4 paragraph 1 referred to "d" processing of agricultural products, if the processing of such products is Regulation No 1339/2013 article 4 paragraph 1 "d" referred to agricultural product; 39.3. aid granted from the European agricultural guarantee fund (EAGF) and the European agricultural fund for rural development (EAFRD), as well as any public aid granted for agricultural activities. 40. The rules referred to in paragraph 38 turnover rate in determining the classification of the type of action used in Regulation No 1893/2006 certain NACE revision 2 statistical classification of economic activities in the two-digit numeric codes. Agricultural activities: 24.9.  Chapter 01 the steps above, except those in Group 01.7 01.6 and activities; 40.2. On non-agricultural activities considered to be activities that comply with the Regulation No 1893/2006 of the NACE revision 2 statistical classification of economic activities in the two-character codes, except those referred to in paragraph 40 of the rules of the code. On non-agricultural activities also considered classified by the following codes: 41.1.  01.6 and 01.7 Group; 41.2. a group of 32, if economic activity is related to processing of agricultural products through the service agreement, and raw materials and the finished product shall not remain the property of the farm, as well as with your property, including shopping, Regulation No 1339/2013 article 4 paragraph 1 referred to "d" from the processing of agricultural products does not acquire regulation No 1307/13 article 4, paragraph 1 "d" of agricultural products referred to in (a); 41.3. Part II – compliance with Regulation No 1307/2013 article 9 paragraph 2 of the third paragraph under "b" specific criterion; 27.5. Part III: compliance with Regulation No 1307/2013 article 9 paragraph 2 the third subparagraph in point "c" criterion. 45. This provision of the Declaration referred to in paragraph 44 of the farmer accompanied by sworn auditor's report confirming the accuracy of the information provided in the Declaration. 46. According to Regulation No 639/2014 article 11 revenue represents the net change, value added tax, excise duties and State and received support from the European Union. 4. the payment reduction 49.  Single area payment amount, which the farmer in the calendar year concerned for granting, in accordance with Regulation No 1307/2013 article 11 (1) of the reduction in the duty of five percent of the amount exceeding 150 000 euros. 50. before Regulation No 1339/2013 article 11 reduction referred to in paragraph 1, the application of the field support service at the request of the farmer from the single area payment amounts deducted in preceding calendar year salary paid, related to agricultural activity, as well as the payroll tax, State social security payments and business risk State duty. 51. If the employee responsibilities are associated with both agricultural and non-agricultural activities, it is applicable to wage deductions calculated in proportion to the amount of wages for each activity. 52. for the purposes of applying the rules referred to in paragraph 50 of the deductions, the farmer up to the current year's October 1 Field support services shall provide a declaration of the previous year under wages associated with agricultural activities (annex 4). The Declaration provides for the inspection of messages the farmer gives you access to the accounting data. 53. If, in accordance with Regulation (EC) no 1306/2013 article 60 is found in artificially created conditions, signs or risk the conditions for granting the aid to bypass or undue advantage, the farmer within 10 working days of the field support service request with proof of receipt of proof that the conditions are not created artificially. 6. the minimum conditions for receiving the aid 57.  Farmer direct payments granted in the areas of agricultural land: 57.1.  What is the property of the farmer or the legal possession of the (use) 15 June of the current year; 57.2. If the aid applied for eligible agricultural land of the holding's total area has at least one hectare, in accordance with Regulation No. 1307/13 paragraph 1 of article 10 in the "b" section. 58. The minimum size of agricultural parcels in respect of which, in accordance with Regulation No 1306/2013 article 72 paragraph 1 may submit an application for direct payments in respect of areas is 0.3 hectares. 59. the agricultural land under Regulation No 1306/2013 article 67. "a" section is a flat agricultural area: 59.1.  occupied by permanent grassland or arable land to grassland and sown in the Regulation No. 1307/13 paragraph 2 of article 36 of the said requirements, and what of 2016 is declared by one farmer, log on to the small farmers ' payment of the aid scheme; 59.2. the occupied permanent plantings or arable land, except the configuration of arable land and area lawns, occupied by cannabis and complying with Regulation No 1307/13 paragraph 2 of article 36 of the said requirements, and what of 2016 is declared by one farmer, log on to the small farmers ' payment of the aid scheme; 59.3. occupied by vegetable crop species which can be allocated to voluntary tied aid under this provision, paragraph 2.15. If each species takes less than 0.3 hectares and the total area of arable land is less than 10 hectares; 59.4. occupied by fruit and Berry (except strawberry) crop species which can be allocated to voluntary tied aid under this provision, if 2.16. each species takes less than 0.3 hectares and the total area of arable land is less than 10 hectares; 59.5. what made by farmer and pursuant to annex 2 of these rules takes no more than one crop or which is not more than one type of land use. This also applies to the area of cannabis from 2016 is declared by one farmer, log on to the small farmers of the payment scheme. 60. a farmer after the rural support service request, produce evidence that the aid applied for agricultural land area by State 15 June of the current year in the legal possession of it (use), if it does not confirm the entry in the land register. 61. A farmer whose property or legal possession (in use) existing agricultural land area of one hectare, this rule 2.4, 2.5, 2.6 and referred to in point 2.7. aid shall be granted in accordance with Regulation (EC) no 1307/13 article 10, paragraph 3, if the total amount of direct payments is less than 100 euro. 7. agricultural land Eligible criteria for determining 62. According to Regulation (EC) no 1307/13 article 4, paragraph 2 (a) of "a" on the back lawn of the arable land and permanent grassland is maintained in a suitable condition to graze where they up to 15 august for the year is noganīt or flat and harvested except: 66.1.  configuration of the cultivated soil lawns and outdoor lawns to be Bee Nectar collection, or the collection of medicinal plants, if they are flat and picked up another on 15 September; 66.2. outdoor lawns, which are recognised as valuable biological lawn or from agricultural activities depend on the interest of the European Union habitats and birds, grassland habitats where they are noganīt or flat and harvested within the time limit laid down in the legislation on the national and European aid, administration and monitoring of the environment, the climate and the countryside to improve the 2014 – 2020 programming period; 66.3. lawns that are used solely for the lawn and in the current year is logged in viewing the State plant protection service, if they are nokult to the current year's October 1; 66.4. area occupied by energy production grown Wattle millet and miežubrāl the flowering phase has been reached in the previous year, if this area is flat and picked up 1 may of the current year. 67. The proportion of areas under cultivation of crops has been maintained in a suitable condition, if the spacing width exceeding one metre are izpļaut or mechanically processed until 15 September of the current year. 68. in the area may include Eligible ditches, hedges and tree lines that are not more than two metres. 69. If the eligible elements of landscape, trees and brush that area does not exceed 0.01 hectares-are identified and located both on arable land and permanent grassland or permanent plantations area, this element of the landscape occupied area is applied to the appropriate land-use types in proportion to the busy area. 70. If the eligible elements of landscape – growing individual trees – are identified and located on the border between agricultural land with different use, landscape elements occupied area divided equally between each area of land concerned. 71. If the arable land and over five consecutive years is declared fallow, and comply with Regulation No 1339/2013 article 4 paragraph 1 of the "h" point conditions, and are not declared as environmentally significant area, it is classified as permanent grassland. 72. The single area payment rate for the rural support service calculated in accordance with Regulation (EC) no 1307/13 paragraph 2 of article 36. 10. Additional conditions for granting direct payments for hemp area 85.  The farmer is eligible for the single payment area, small farmers ' payment of the aid scheme and the voluntary support of associated protein plants of cannabis, if areas in accordance with Regulation No. 809/2014 45. cannabis is included in the tetrahydrocannabinol (hereinafter referred to as THC) monitoring. 86.
