Cabinet of Ministers Regulations No. 284 in 2004 (April 13. No 21 37) labour protection requirements for the protection of workers against the risks arising from vibration in the working environment Issued in accordance with the Labour Protection Act article 25 paragraph 18 i. General questions 1. labour protection requirements for the protection of workers against the risks arising from vibration in the working environment. 2. Distinguish between the following types of vibration: 2.1 the hand and arm vibration: the vibration that is transmitted through the hands employed by the equipment which is connected with blows and rotations, there is a risk to the safety and health of workers, in particular vascular, bone and joint, muscle and nervous system disorders;
2.2. whole-body vibration: the vibration that is transmitted through stagnant or ride through support surfaces and based on prejudice to the entire body, creating the risk of employee safety and health, particularly in the lumbar spine disease risks and trauma of the spine. 3. the rules apply to all areas of employment, in which workers are or may be exposed to risks caused by vibration, except for the whole-body vibration on ships, which frequency is lower than 1 Hz. 4. Of these rules is the responsibility of the employer. 5. the employer under the labour protection requirements set out in law consult workers or their fiduciaries on matters related to vibration risks in the working environment, as well as to ensure the participation of the workers. 6. Compliance with these rules is controlled by the State Labour Inspectorate. II. the assessment of risks from vibration and vibration measuring 7. the assessment of risks to the employer under the company's internal monitoring of the working environment and working environment risk assessment procedures involving agents and employees. 8. The vibration level is to be measured if the risk assessment finds that the risk to workers ' safety and health are removed or reduced to acceptable levels. 12. in the area of vibration measured certified professionals, as well as the competent institutions and accredited laboratory, using legislation registered and calibrated measuring equipment and subject to the requirements of standards EN ISO 5349-1 EN: 2002 "mechanical vibration — the magnitude of the human hand measuring and evaluation of vibration — part 1: General requirements", LVS EN ISO 5349-2:2002 "mechanical vibration — the human hand and the measurement of vibration magnitude assessment — part 2 : Practical guidance for measurement at the workplace ", EN ISO 2631-1:2003" mechanical vibrations and shock-human exposure to whole-body vibration evaluation – part 1: General requirements "and EN ISO 2631-2:2003" human exposure to whole-body vibration evaluation-part 2: long lasting and shock called vibration in buildings (1 to 80 Hz) ". 13. Hand and arm vibration measurement in compliance with the following requirements: 13.1 the measuring methods used include discrete measurement detection, which describes the vibrations of the individual exposure on the population;
13.2. the measuring methods to be used and the hardware adjusts certain measured vibration characteristics, ambient factors and the characteristics of the measuring apparatus in accordance with the standard EN ISO 5349-2 EN: 2002 "mechanical vibration — the human hand and the measurement of vibration magnitude assessment — part 2: practical guidance for measurement at the workplace";
13.3. If work equipment must be held with both hands, measurements shall be made on each hand. Exposure is determined taking into consideration the greater value of the two, providing information on the other hand;
13.4. vibration measured sequentially each orthogonal axis direction;
13.5. the vibration spectrum measurement and analysis is made, if the developing employment protection measures, a more in-depth study of vibrations and the results of these measurements is not calculated on individual vibration exposure of employees. 14. measurement of whole-body vibration, the following requirements shall be met: for 14.1. the measuring methods used include discrete measurement detection, which describes the vibrations of the individual exposure on the population;
14.2. the measuring methods to be used and the hardware adjusts certain measured vibration characteristics, ambient factors and the characteristics of the measuring apparatus in accordance with the standard EN ISO 2631-2:2003 "human exposure to whole-body vibration evaluation-part 2: long lasting and shock called vibration in buildings (1 to 80 Hz)";
14.3. in the General case, the vibration is assessed with the weighted acceleration value weighted average method (basic method);
14.4. not stationary vibration and vibration, which contains the regular individual shocks, assessed by the average weighted (effective) values. 15. in order to assess the risk caused by vibration of the workers, States: 15.1 hands and arm vibration exposure, which is assessed on the basis of the weighted vibration acceleration of the frequency of the exposure value of A day (8), which converted to the standard eight-hour period, and expressed as the square root of the sum of the squares of the acceleration value (root mean squared) (total value of the orthogonal axes ahwx, ahwy, ahwz, in the standard LVS EN ISO 5349-1:2002 "mechanical vibration — the magnitude of the human hand measuring and evaluation of vibration — part 1 : General requirements ");
15.2. exposure to whole-body vibration, which is assessed on the basis of vibration acceleration days exposure size A (8), expressed as equivalent continuous acceleration in eight hours and calculated as the greatest mean squared value or frequency weighted acceleration of the highest vibration dose value (HSE) set out in the three orthogonal axes (awx awy awz 1.4 1.4, seated, or standing worker), according to the standard EN ISO 2631-1:2003 "mechanical vibrations and shock-human exposure to whole-body vibration evaluation: part 1 : General requirements ". 16. Is defined by vibration exposure limit values and exposure action values: 16.1 hand and arm vibration: 16.1.1. standardized reference period of eight hours a day exposure limit value of 5 m/s2;
16.1.2. a standardized reference period of eight hours of daily exposure action value is 2.5 m/s2;
16.2. to whole-body vibration: 16.2.1. standardized reference period of eight hours a day exposure limit is 1.15 m/s2;
16.2.2. standardized reference period of eight hours of daily exposure action value is 0.5 m/s2. 17. If the vibration effects on employment in the work place are mostly lower than the rules set out in paragraph 16 of the exposure action values and the only times the vibration exposure, the employer has the right to make these rules 16.1.1. and the day referred to in paragraph 16.2.1. the exposure limit values, provided that the average vibration exposure of 40 hours is less than 5 m/s2 hand and arm vibration and less than 1.15 m/s2 for whole-body vibration and subject to the following requirements: 17.1. all week is carried out monitoring of the level of vibration, and the average value of the 40 hours of exposure does not exceed the exposure limit values;

17.2. the employer shall submit to the national labour inspectorate in the vibration level of monitoring results and an explanation of the context in which the work is necessary to exceed the daily exposure limit value;
17.3. the employer provides employment protection measures, to minimize the risk of vibration and ensure workers ' safety and health. 18. the State Labour Inspectorate after reading this rule 17.2. information referred to is entitled to prohibit employer daily exposure limit value being exceeded if: 18.1. it presents a risk to the safety and health of employees;
18.2. any breach of this provision in paragraph 17 above;
18.3. There is reason to believe that during the week continuous vibration level monitoring results are inaccurate;
18.4 no such working conditions, which need to exceed the daily exposure limit value. 19. Ensure a vibration of the assessment of risks, the employer shall take into account: 19.1. vibration exposure, the results of the measurements, vibration type and duration of exposure, as well as any periodic vibrations or repeated shock effects;
19.2. the exposure limit values and the exposure action values;
19.3. vibration and the workplace or other equipment equipment interaction indirect effects on worker safety and health;
19.4. work equipment manufacturer information about equipment vibration;
19.5. the existence of replacement equipment designed to reduce the level of vibration;
12.2. the exposure to whole-body vibration time effect on the safety and health of employees in excess of the normal hours of work;
19.7. the specific environmental conditions of work and other special effects on the risk of the safety and health of workers (such as low temperatures, elevated noise levels, health harmful chemicals);
19.8. the compulsory health examination, as well as to research-based information on the vibration effect on the safety and health of employees;
12.4. the vibrating effect of the risks to the safety and health of workers belonging to particularly sensitive risk groups (for example, adolescents, pregnant women and women who have recently given birth, disabled). 20. the employer shall document and keep all vibration of the assessment and measurement of results at least 45 years, then handed it to the archive. 21. the workers and fiduciaries are entitled to consult the vibration generated by the results of the risk assessment, including the results of measurements, and, if necessary, to require a better understanding of the employer or his or her designated health professional explanations. 22. the employer shall ensure that the vibration would cause the results of the risk assessment, including the results of measurements available to the physician or the medical authority responsible for the worker's health care. III. Prevention of risks from vibration and shrinking 23. 15.2. appropriate work equipment and work arrangements for maintenance;
24.6. employees information and training, in particular with regard to the correct and safe use of work equipment in order to reduce their exposure to vibration;
24.7. vibration exposure duration and intensity, to limit the working time of employees exposed to elevated vibration levels exceed those specified in the annex of the rules of vibration exposure duration;
15.4. the appropriate work schedules with adequate rest periods;
15.5. appropriate work clothing (such as clothing, which are subject to vibration protects workers from cold and damp). 25. Workers should not be exposed to vibration, which exceed these rules determine the exposure limit values. 26. If, after the labour protection measures the vibration level of vibration in the workplace exceeds the exposure limit values, the employer: 26.1. immediately take steps to prevent the exposure of workers to these vibrations and reduce vibration to levels not exceeding vibration exposure limit values;
26.2. identifies and analyzes the reasons why the exposure limit value is exceeded;
26.3. making changes to labour protection activities in order to avoid repeating the exposure limit value being exceeded. 27. the employment protection measures in risk caused by vibration for the elimination or reduction of, the employer shall ensure that the measures applied in the protection of their employees, which in accordance with the laws and regulations are laid down special protection (persons under 18 years of age, pregnant women, women who have recently given birth, individuals with special needs). 28. the employer shall provide employees with relevant municipal and rest rooms that are heated and have a chance to rest for employees without vibration impact risk. 29. The employer shall ensure that workers who are exposed to risks caused by vibration in the workplace, and that worker representatives are trained and receive intelligible form the information about: 29.1. vibration risks to the safety and health of employees, as well as the possible injuries that may result from the work equipment in use;
29.2. the protection measures, particularly those that minimize vibration effects on the risks in the safety and health of workers;
29.3. vibration exposure limit values and exposure action values;
29.4. vibration measurement and the results of a risk assessment;
29.5. the health problems caused by vibration characteristics, early detection of health problems and conduct disorders;
18.4. the circumstances in which workers are entitled to health and the importance of these checks;
18.5. safe working methods, proper and safe use of work equipment to avoid vibration risks;
29.8. employment action, in case of accident at work involving vibration effects on employment. IV. the use of personal protective equipment for employees, 30 work place is or may be exposed to risks caused by vibration, the employer shall provide free of charge, with a sufficient quantity of personal protective equipment. 31. Personal protective equipment chosen, using them properly, vibration risks to the safety and health of employees is eliminated or reduced to a minimum. 32. Personal protective equipment is suitable for the worker and his or her specific working conditions in accordance with the laws on personal protective equipment and how to use them. V. health check 33 employees. If the employee is exposed to vibration, which exceed this provision in paragraph 16.2.2.16.1.2. and values, the employer shall ensure compulsory health checks legislation on minimum health checks in order to early detect vibrations damaging the health and ensure the quality of health workers. 34. the employer regularly document the results of the health surveillance of employees. The results of the health surveillance of employees, if required, is available to the competent institution and the State Labour Inspectorate. 35. Information for workers and employers on the health inspection results, for the necessary treatment and State of health of employees additional medical investigations and treatment services provides health care to regulatory legislation. 36. If the health check finds health employed by certified occupational physician evaluates the effects of exposure to vibrations, the doctor informs employees about his findings and provide information and recommendations on health care after the vibration impacts, as well as inform the employer of the health tests according to the legislation on minimum health arrangements. 37. If workers ' health check results show that employee health is caused by vibration exposure, the employer: 37.1. review of vibration risks assessment results;

37.2. the report measures vibration risks for the elimination or reduction;
37.3. take into account occupational illnesses or in doctor certified occupational health, the competent authority or competent institution of recommendations, measures the vibrations of risks for the elimination or reduction of, and provides the opportunity to designate the employees in other jobs, which he is not subject to vibration;
37.4. ensure regular monitoring of the health of workers and shall immediately arrange for a medical examination of employees who were subjected to similar vibrations. 38. the employer shall take into account the results of the health surveillance, planning and determining protection measures vibration risk prevention or reduction to acceptable levels. 39. on the basis of the risk assessment and health inspection results, the employer shall determine the employees who need special protection measures. 40. the employer shall keep all employment health results of at least 45 years, then handed it to the archive. The worker is entitled to consult the results of the health surveillance which relates to him personally. Vi. Closing questions 41. Regulations shall enter into force by 1 July 2005. 42.
