Cabinet of Ministers Regulations No. 297, 2004 in Riga on April 13 (Mon. No. 21) order in which the Republic of Latvia shall be appointed and maintained by the citizens of the Union and their family members are Issued in accordance with article 69 of the immigration law of the i. General questions 1. determines the order in which the Republic of Latvia shall be appointed and maintained by the citizens of the Union and their family members. 2. the provisions do not apply to citizens of Latvia on the entry and residence of family members of the order of the Republic of Latvia. 3. A citizen of the European Union is entitled to enter and reside in the Republic of Latvia, if he has a valid travel document and did not pose a threat to national security, public order or health. 4. If a citizen of the European Union, wants to stay in the Republic of Latvia for more than 90 days, 6 months, from the date of first entry, he registered in the citizenship and Immigration Board (hereinafter the Board) and received a residence permit. II. the citizens of the European Union termiņuzturēšan permit 8. European Union citizen can get a termiņuzturēšan permit: 8.1 for labour relations based on a contract of employment or other kinds of civil contracts, on which he is employed in the Republic of Latvia as the worker exceeding 90 days but not more than one year;
8.2. for five years, on the basis of the contract of employment or other kinds of civil contracts, on which he is employed in the Republic of Latvia as a worker and more than one year;
8.3. for five years, where he is self-employed in the Republic of Latvia;
5.2. for the period referred to in the contract for the provision of services or receipt in the Republic of Latvia, if he is a service provider or the recipient, or the employee to the Member State of the European Union registered merchant, who is under contract by the provider;
8.5. the training or a period of study in an accredited academic institution in the Republic of Latvia, but for no longer than a year;
8.6. for five years, if he has sufficient livelihood security. 11.3. copies of documents certifying the right to perform a specific action in the Republic of Latvia, if envisaged activities, the conduct of which the Republic of Latvia has the necessary permission. 12. the European Union citizen who wishes to reside in the Republic of Latvia in accordance with the provisions of subparagraph 8.4. submit a copy of the contract for the civil service or receipt of compensation. 13. the European Union citizen who wishes to reside in the Republic of Latvia in accordance with the provisions of section 8.4. and is a staff member at the Member State of the European Union registered merchant, which under the Treaty is the service provider, in addition to the provisions referred to in paragraph 12 of document submitted by: 13.1. document proving employment relationship with the company, which is the service provider copies;

14.2. a valid copy of the health insurance policy that guarantees health insurance against all risks and valid for at least a year. 15. the European Union citizen who wishes to reside in the Republic of Latvia in accordance with the provisions of this section, shall be submitted by: 8.6.15.1. documents proving sufficient means of support while he was staying in the Republic of Latvia;
15.2. a valid copy of the health insurance policy that guarantees health insurance against all risks and valid for at least a year. 16. If a citizen of the European Union received the termiņuzturēšan permit in accordance with the provisions of section 8.2 or 8.3, and the circumstances have not changed, which received permission to termiņuzturēšan, a citizen of the European Union can get new termiņuzturēšan permit for five years, the production of a valid travel document and submit a specific sample questionnaire for requesting a residence permit. III. 21.5. the payment document certifying payment of the State fee. 22. the family member who wishes to reside in the Republic of Latvia with the citizen of the Union who reside in the Republic of Latvia in accordance with the provisions of section 8.5 or 8.6. in addition to paragraph 21 of these regulations contains documents submitted to: 22.1. documents proving the necessary livelihood security;
22.2. valid health insurance policy that guarantees all copies with the healthcare costs in the Republic of Latvia and which is valid for at least a year. IV. European Union citizens and their family members for permanent residence permit 23. European Union citizen and his family member who legally resided in the Republic of Latvia with the permission of termiņuzturēšan continuously for five years in accordance with the provisions of paragraph 8 or 17, can receive permanent residence. 24. 25.5. after three years of continuous residence in the Republic of Latvia will continue to work in another Member State as a worker or self-employed person in the Republic of Latvia, going back at least once a week. 26. The family is entitled to a permanent residence permit before this provision in paragraph 23 deadline, if a citizen of the European Union receives permanent residence this provision set out in paragraph 25. 27. A citizen of the European Union, who received the termiņuzturēšan permit in accordance with this rule 8.3., 8.4., 8.5 or 8.6., within five working days after the conclusion of the contract shall inform the administration of the contract or other liability agreement, on which he will be employed in the Republic of Latvia as a worker. 38. a citizen of the European Union issued a new residence permit for a period specified in the decision on the grant of a residence permit, if: 38.1. valid residence permit lost;
38.2. the citizen of the European Union received a new travel document;
23.8. changed the name of the person (name) or the last name;
23.9. found inaccuracies in records;
38.5. the residence permit is corruption, which makes it impossible to identify the person and read the information specified in the residence permit;
24.0. significant change in the appearance of the person. 39. in order to receive a residence permit that rule 38. in the cases referred to in point, a citizen of the European Union present a valid travel document and submit: 24.3. two photographs;
24.4. the previous residence permit if the person in possession of any;
39.3. explanation of abduction of the residence permit, the circumstances of the loss or destruction, if a valid residence permit lost;
24.5. the police authorities in response to the report submitted by the person, if the residence permit is kidnapped. 40. A new residence permit shall prepare and issue the 15 days following the submission of all required documents. 41. If a citizen of the European Union gets a new residence permit, prior authorization is voided and after elections left his citizens. Vi. Restrictions to stay in 42. A residence permit shall not be issued if: 42.1. A citizen of the European Union or his or her family member has not submitted all the documents specified in these provisions a residence authorisation or disclaims the required explanations, related to receiving a residence permit;
26.2. the residence grounds specified does not meet the conditions referred to in these provisions that there is a European Union citizen or his/her family member can receive a residence permit;
26.3. A citizen of the European Union or his or her family member poses a threat to national security, public order or health;
26.3. false news;
26.4. a citizen of the European Union or his or her family is not a sufficient livelihood security. 43. the Termiņuzturēšan permission is withdrawn, if:

43.1. no longer exist or have changed, the circumstances a citizen of the European Union or his or her family member has received permission to termiņuzturēšan except if the employment or self-employed activities interrupted owing to temporary incapacity sickness or accident or involuntary unemployment situation;
43.2. the citizen of the European Union or his or her family is not a sufficient livelihood security;
43.3. the benefit, giving false information;
43.4. European Union citizen or family member residing outside the Republic of Latvia for more than six months during the year, except when the citizen of the European Union or his or her family member can prove that the absence was for good reason;
43.5. national authorities have provided the opinion that the European Union citizen or his/her family member poses a threat to national security, public order or public health. 44. the permanent residence permit shall be cancelled only if it was gathered: 44.1. providing false information;
44.2. A citizen of the European Union or his or her family member poses a threat to national security and the law limitation is commensurate with the benefit of society and the State;
27.5. A citizen of the European Union or a family member staying constantly outside the Republic of Latvia for more than two years, unless the European Union citizen or his family can prove that absence has been supporting reason. 45. the Government Commissioner or his delegate shall issue a departure order, which required 15 days, if a citizen of the European Union or his or her family member has not yet been granted a residence permit, or a month in other cases leave the Republic of Latvia, where a European Union citizen or his family member, staying in the Republic of Latvia, posed a threat to national security, public order or health. 46. 2) Council of 15 October 1968 of Directive 68/360/EEC on the abolition of restrictions for workers of Member States and their families movement and residence within the community;
3) Council of 18 May 1972 by Directive 72/194/EEC, which expands the scope for staff who use the right to remain in the territory of a Member State after having been employed in that State, 25 February 1964 for a directive on the co-ordination of special measures concerning the movement of aliens and their place of residence, which is justified on grounds of public policy, public security or public health;
4) Council of 21 May 1973 directive 73/148/EEC on the freedom of movement and residence of citizens of the Community restrictions with regard to establishment and the provision of services;
5) Council of 17 December 1974 Directive 75/34/EEC on the right of citizens of the Member State to stay to live in the territory of another Member State after the transaction performed in a self-employed capacity;
6) Council 1974 17 December Directive 75/35/EEC extending the scope of Directive No 64/221/EEC on the co-ordination of special measures concerning the movement and residence of foreign nationals which are justified on grounds of public policy, public security or public health to include nationals of Member States who use the law to stay on a permanent basis in the territory of another Member State after it has carried out activities in a self-employed capacity;
7) Council of 28 June 1990 directive 90/364/EEC on the right to settle;
8) Council of 28 June 1990 directive 90/365/EEC on the worker and self-employed person for permanent residence who have ceased their occupational activity;
9) Council on 29 October 1993 of Directive 93/96/EEC on the right of residence of students;
