Cabinet of Ministers Regulations No. 405 in 2004 (April 22. No 24 41) milk and milk products market intervention measures, administration and monitoring procedures issued under the agricultural and rural development Act, 6 the second subparagraph of article i. General questions 1. determines the order in which are administered and monitored a European Union market intervention measures in the milk and milk products (hereinafter referred to as the product).
2. the intervention measures are initiated and terminated by the Council on 17 May 1999, Regulation (EC) No 1255/1999 on the milk and milk products the common organisation of the market (hereinafter referred to as the Council Regulation No 1255/1999), the Commission's December 16, 1999, in Regulation No 2771/1999 laying down detailed rules for applying Council Regulation (EC) No 1255/1999 as regards intervention on the market in butter and cream (hereinafter referred to as Commission Regulation No 2771/1999) and of the Commission of 12 January 2001, Regulation (EC) No 214/2001 laying down detailed rules for applying Council Regulation (EC) No 1255/1999 as regards intervention on the market in skimmed-milk powder (hereinafter referred to as Commission Regulation (EC) No 214/2001), established through such intervention measures: 2.1. purchasing-procurement of products from the manufacturers of products for the specific intervention price;
2.2. the private storage aid for certain products.
3. the administration of the intervention arrangements and supervision in Latvia is implementing the rural support service.
II. Milk processing company approval procedure for the implementation of the intervention measures, the dairy company (hereinafter undertaking) shall submit a written rural support service of the application for approval for the application of intervention measures. The application shall be accompanied by the following: 4.1 food and veterinary service issued a copy of the certificate of recognition;
4.2. a written undertaking to notify intervention products started two days before the commencement of production;
4.3. a written commitment to ongoing production accounts for products intended for intervention;
4.4. written consent be subject to unannounced control of production by this provision in paragraph 9 of this notice in the filing.
5. the rural support service registers the company application for confirmation and check the company's compliance with the Council Regulation No 1255/1999, Commission Regulation No 2771/1999 and Commission Regulation No. 214/2001 approval specified eligibility criteria.
6. If the company complies with Council Regulation No 1255/1999, Commission Regulation No 2771/1999 and Commission Regulation No. 214/2001 established criteria, the field support service within two working days, following the adoption of the decision in writing to the company for approval.

8. the company carried out compliance checks and issued, suspended and withdrawn approvals field support service within one month of the adoption of the decision in writing to the Directorate-General for agriculture of the European Commission Directorate of milk (hereinafter the Commission).
9. Two days before the start of production the company is notified in writing to the rural support service of intervention products. The notification shall be accompanied by the food and veterinary service issued a copy of the certificate of recognition and intervention measures of the company for the production of the products during the period.
III. submission of the purchase application 10. approved company (hereinafter applicant) shall provide support services in the Field of writing application for purchase and receive acknowledgement of receipt of the application. The application shall be accompanied by the following: 10.1. identity documents for Commission Regulation No 2771/1999 and Commission Regulation No 214/2001, in particular the Security (hereinafter — the guarantee money) contribution to the rural support service in given account;
10.2. a written commitment to the Council Regulation No 1255/1999, the Commission's regulāNr 2771/1999 and Commission Regulation No 214/2001, in particular the quality of the products offered.
11. the rural support service registers the application with the date of receipt of the applicant's name and address, the amount of the proposed product, the manufacturing date and place of storage as well as the tender offer price.
12. the rural support service within five working days shall inform all tenderers of the outcome of their participation in the contest. If the application referred to in the offer is rejected, the rural support service to repay the guarantee money to the applicant.
13. the rural support service the Tenderer shall issue a dated and numbered application approval (delivery order). The approval shall indicate the quantity of product to be delivered, the delivery date and the warehouse (stores) the address to which the delivery of the product.
IV. Procurement procedures the Administration 14. minimum purchase amount of the batch of the product in accordance with the Commission's regulāNr 2771/1999 and Commission Regulation No. 214/2001 specified conditions is only offered full tonnes.

17. in the case of products manufactured in Latvia the applicant is offered for intervention in another European Union country, after written request of the applicant, the rural support service and the food and veterinary service in writing issued by the Commission Regulation No 2771/1999 and Commission Regulation No 214/2001, in particular the relevant supporting information.
18. the rural support service products considered to take over the day when the full quantity of the product proposed for rural support service in given in the warehouse, but no earlier than the day after the delivery order is issued.
19. the rural support service for every quantity of product taken over the calculation and payment of Commission intervention buying-in price determined in accordance with Council Regulation No 1255/1999, Commission Regulation No 2771/1999 and Commission Regulation No 214/2001, in the conditions defined by the specified time and product acquisitions.
20. the butter shall treat the rural support service in given cold storage Commission Regulation No 2771/1999 lays down the inspection time and after to check compliance with the laws and regulations of the characteristics set out — the national quality class (annex).
21. V. application to the submission, and the conclusion of the contract for private storage 23. Applicant shall submit in writing the rural support service application for private storage and receiving a written acknowledgement of receipt of the application.
24. the rural support service registers the application with the date of receipt of the applicant's name and address, the amount of the product offered, the dates of manufacture and the place of storage.
25. A contract for private storage is concluded the rural support service no later than 30 days after the date of registration of the application for which the product is packaged in accordance with Commission Regulation No 2771/1999 and Commission Regulation No. 214/2001 established the packaging requirements and on the package with the code or text is given in Commission Regulation No 2771/1999 and Commission Regulation No 216/2001 information (butter-also the national quality class).

26. If the applicant for products manufactured in Latvia offers private storage in another Member State of the European Union, at the written request of the applicant, the rural support service and the food and veterinary service of the Commission shall be issued in writing regulāNr 2771/1999 and Commission Regulation No 214/2001, in particular the relevant supporting information.

VII. Market surveillance intervention measures 34. To carry out the monitoring of market intervention measures, field support service at least once intended for intervention at the time of production of the product make an unannounced check of the company in accordance with the Council Regulation No 1255/1999, Commission Regulation No 2771/1999 and Commission Regulation No 214/2001, the conditions and requirements laid down, on the basis of the applicant's statement in intervention products intended for the production schedule.

37. The food and veterinary service shall make a written report on the checks carried out. The report indicates the date of the check, duration, made during the test and the test results. The report shall be signed by the food and veterinary service of the IIC. The food and veterinary service check results are notified in writing of the Field support service.

VIII. Intervention sales of products bought 41. 42. the purchaser shall provide support services in the Field of writing purchase application. The application shall be accompanied by proof of Council Regulation No 1255/1999, Commission Regulation No 2771/1999 and Commission Regulation No. 214/2001 guarantees that cash contributions to the rural support service within the account.
43. the rural support service to record the purchase date of receipt of the application, the buyer's company name and legal address of the specified quantity of the product in the application and the application specified in the warehouse (stores) address.
44. before the product sales field support service enables all customers to check the State veterinary diagnostic laboratory in the center of the products offered for sale. These costs shall be borne by the buyer of the inspections.
45. Before each transfer a quantity of the product concerned, the buyer paid field support service account specified by the corresponding quantity sold amount and take over of the products by Council Regulation No 1255/1999, Commission Regulation No 2771/1999 and Commission Regulation No. 214/2001 within the time limit.
IX. Closing questions 46. Field support service shall inform the Commission in accordance with the laws of the European Union on market intervention and the conditions laid down by the Ministry of agriculture on relevant product quantities: 46.1. the previous week were specified for the submission of tenders and the interventions taken over (purchased);
46.2. the previous week included the purchase offers and take over (sold);
46.3. the previous month were included in the private storage contracts.
47. the National Agrarian Institute shall inform the Commission of the economy, the rural support service and the Ministry of agriculture, in accordance with the laws of the European Union on market intervention and legislation on the conditions laid down by the vāktaj and registered in the market prices of butter.
48. the rules shall enter into force on 1 May 2004.

Annex a Cabinet of 22 April 2004, regulations No 405 national quality class for butter 1 name "extra class butter" granted by the European Community legislation the requirements according to butter that laws prescribed in the sensory evaluation is obtained: 1.1. appearance — at least four points from the maximum five points;
1.2. by consistency, at least four points from the maximum five points;
1.3. to taste and smell, at least four points from a maximum five points.
2. at the written request of the applicant for submission to the food and veterinary service service Inspector in accordance with the regulations set out the conditions and requirements shall take representative samples for sensory evaluation.
3. The assessment shall be carried out in accredited laboratories (State veterinary diagnostic laboratory in the Centre) in accordance with the standard EN 354:2002 "milk and milk products in the evaluation of sensory to the point method".
4. State veterinary diagnostic laboratory of the Centre shall prepare a test report on the results of the assessment carried out in accordance with paragraph 3 of this annex.

5. The national quality class for butter shall be granted in accordance with the order of the Minister of agriculture to create the Commission. The Commission shall include the odd number of assessors — at least one representative from the Ministry of agriculture, the rural support service, the food and veterinary service, the Central Union of Latvian dairy farmers and state veterinary diagnostic laboratory of the Centre.
6. on the basis of paragraph 4 of this annex the above test report within five working days after the testing report for the preparation of this annex referred to in paragraph 5, the Commission granted the national quality class for butter "extra class butter".
7. Two working days after the decision, on the basis of paragraph 4 of this annex the above test report, the Commission shall notify the applicant in writing of the butter or the assigned national quality class.
8. If the national quality class is not granted, the applicant may request in writing to the representative sampling for repeat sensory evaluation in accordance with the law specified conditions.
