GIS also includes the evaluation of topographic, hydrographic, or aeronautical features for their effect on military operations or intelligence. The data may be presented in the form of topographic, planimetric, relief, or thematic maps and graphics; nautical and aeronautical charts and publications; and in simulated, photographic, digital, or computerized format.

Government contractors are not considered to be Third parties for the purpose of the disclosure and use by them of products, information, data and materials for the purpose of this agreement.

Article II OBJECTIVE 2.1 of the. The objective of the Basic Exchange and Cooperative Agreement Concerning Geospatial Information and services (hereinafter referred to as the agreement) with: 2.1.1. To exchange information for the use of the Government of both parties for Defense and Government purpose, which may include co-productions programs, cooperative production, and cooperative efforts. The items to be exchanged will include, but are not limited to, maps, charts, information, data, and related materials in printed or digital format; geomagnetic, geodetic, geophysical, and gravity data; reproduction materials; and other related specifications, publications and materials. 2.1.2. To provide for cooperative production programs and others technical assistance as mutually determined in the production of geospatial products, data, and other related materials required by GIS both parties. 2.1.3. To exchange technical and procedural information related to the standardization of methods, procedures, specifications, and formats for the collection, evaluation, processing, and production of geospatial products, data, and GIS related materials. Such exchanges will be designed to promote international standardization in general and it is also between the facilitat parties. 2.1.4. To establish technical assistance and exchange of technology information relevant to cartographic, geodetic and geophysical developments, and production processes and techniques. 2.1.5. The Exchange production programming and production status information on an annual basis. 2.1.6. To establish training programs in Andean implementations that discipline relevant to the objective of this agreement. Article II of the APPENDIX to ANNEX AND IMPLEMENTING a 3.1. The terms, procedures, obligations, and technical details for the subjects mentioned in article I of this Agreement shall be set forth in the individual "Implementing Annexe" to this agreement. Each Implementing Annex shall state the specific purpose, obligation, terms, Exchange and/or co-production procedures, the responsibilities of each Party, to of products, data quantit, publications, and related materials to be exchanged, GIS and other related GIS matters agreed upon by the parties. Implementing Annex shall be signed of by the parties to the agreement or by a person authorized by the parties. 3.2. The Implementing Annex will include guidance on use and release. The parties will carry out the Implementing Annexe in accordanc with the existing and developing capabilities of both parties, subject to the availability of GIS resources (equipment, personnel, facilities, and finance) for such purpose. 3.3. the Appendix may be added to an Implementing Annexe to effect the Implementing Annexe. The Appendix include, but are not limited to, information such as: description and quantit to of the geospatial products, data, publications, and related GIS material to be exchanged, co-produced, or loaned, distribution procedures and address of the recipient. Article IV MUTUAL OBLIGATION AND responsibilities 4.1. In the Exchange and reproduction of products, data, publications, and related GIS materials, the parties agree to comply with the restriction concerning the use, release, reproduction, and distribution imposed by the providing Party as set forth in the Implementing Annexe. Either Party may reproduce the geospatial products, information, data, publications, and related GIS materials received from the other Party in accordanc with the guidance received from the providing Party. Matters related to reproduction, copyrights, trademark, u.s., and release the restriction of products, GIS data, and related materials will be addressed separately in the Annex and/or axis of Implementing specified in subsequent to the Implementing of the Appendix Annexe. 4.2. Topographic, aeronautical, and nautical products and data, publications, reproduction materials, geodetic or geophysical data, digital data, or related materials, GIS including parts thereof, provided by one Party to the other may be provided to any federal organization of the recipient Party, but will not be provided to any Third Party without written approval of the providing Party, unless you specifically authorized in the relevant Implementing Annexe. Items provided to other federal organizations or to a national contractor to a Party's Government will be marked with classification or release codes to ensur that the materials, information, data, or stay within the organization for you. The data exchanged and reproduced products, publications, and related GIS materials will be utilized by both parties in accordanc with the purpose of this agreement. 4.3. In cases where a Party's cop to any geospatial data of products, publications, or related materials become damaged! GIS and not usable and available from the cop to the other Party, then this other Party may provide, on a reimbursabl base, cop out of the relevant material to allow for GIS sufficient production to be re-established to meet the mutual and individual national GIS requirements. The quantit to of the geospatial products, information, or data to be provided and the duration of the subject support will be determined mutually by both parties on a case-by-case basis. 4.4. geospatial products exchanged Hardcopy or co-produced under the terms of this agreement may be converted to a digital format without requiring additional approval from the originating Party. 4.5. The parties agree to establish accounting procedures for individually exchanged and co-produced products, geospatial data, publications, and related GIS materials or services under this agreement. Review to ensur equity of the terms of this agreement and the Implementing of the Annexe will be conducted on an annual basis. 4.6. the facility will be employed to do this pursuan agreement in which geospatial products, data, publications, or related materials supplied by GIS a Party with to be used where the financial or management control of such facility is directed by an entity other than those of the parties to this agreement, without the prior written approval of the Party supplying the geospatial products , data, publications, or related materials, except as a GIS in the relevant Implementing Annexe. 4.7. The parties agree that all NG/MoD exchanged or co-produced data, geospatial products, and related GIS materials provided to NG under the terms of this agreement and the annex may be provided of implementing by the multinational coalition, NGA, or other combined operations forces Nations for Defense, peacekeeping, humanitarian and related activities, so long as both parties to the participants in the activity. If there is a defense, peacekeeping, humanitarian, or related activity in which only one Party is a participant, the authorization of the other Party is required to provide that party's products, data, and related GIS materials it others participants of the activity. Article V FINANCIAL PROVISION 5.1. Each Party will bear the costs it will incur for performing, managing, and administering its activities under this agreement. Any such costs will be included as part of each Party's contribution to the support of the agreement. Variation from this financial provision will be addressed in the specific Implementing Annex as required. 5.2. A Party will promptly notify the other Party if available funds are not adequat to fulfill its responsibilities under this agreement. If a Party to the other Party the notifu that it is reducing or terminating its funding in support of this agreement, both parties will immediately consult with a view towards mutually determined continuation on a modified basis. 5.3. It is the intent of this agreement, insofar as the eliminat possible, payments in cash for the products, data, publications, and related GIS materials exchanged. Article VI SECURITY It is the intent of the parties that all the efforts under this agreement and the Annex shall be conducted of Implementing at the unclassified level. Information shall be provided from the classifieds or generated under this agreement. Article VII CONTROLLED UNCLASSIFIED INFORMATION 7.1. Except as otherwise provided in this agreement or as authorized in writing by the originating Party, Controlled Unclassified Information provided or generated pursuan to the agreement shall be controlled as follows: 7.1.1 Controlled Unclassified Information will be used only for the purpose of the authorized in this agreement. 7.1.2. Access to such Information shall be limited to Controlled Unclassified personnel whose access is not permitted use cessary for the above and shall be subject to the provision of article VIII, (THIRD PARTY sales AND transfers). 7.1.3. Each Party shall take all lawful steps, which may include national classification, available to it to keep such Controlled Unclassified Information free from further disclosure (including requests under any legislative provision), except as provided in the preceding paragraph, unless the originating Party consent to such disclosure. In the event of unauthorized disclosure, or if it's probabl become that the Controlled Unclassified Information may have to be further disclosed under any legislative provision, immediate notification shall be given to the originating Party. 7.2. To assist in providing the appropriate controls, the originating Party shall ensur that Controlled Unclassified Information is appropriately marked. The Parties shall decide, in advance and in writing, on the marking to be placed on the Controlled Unclassified Information. 7.3. Unclassified Information provided or generated Controlled pursuan to this Agreement shall be handled in a manner that the axes provided for in ensur control this article. 7.4. Prior to authorizing the release of Controlled Unclassified Information to contractors, the Parties shall ensur the Contractor with a legally bound to control such Controlled Unclassified Information in accordanc with the provision of this article. 7.5. The security responsibilities of the parties led in this article shall continue notwithstanding termination or expiration of this agreement. Article VIII of the THIRD PARTY sales AND transfers the Parties shall not sell, transfer title to, transfer possession of or disclos geospatial products, data, publications, and related GIS materials or jointly acquired equipment exchanged pursuan to this agreement or which of what was exchanged incorporat pursuan to this agreement to anyone who is not an officer, employee or agent of the parties (excluding transportation agencies) unless in accordanc with Implementing United Nations Annex , and shall not use or permit their use for purpose other than those authorized for, unless the written consent of the providing Party has first been obtained. The providing Party shall be solely responsible for authorizing such transfers and, as applicable, specifying the method and provision for implementing such transfer. Article IX the visits TO Each ESTABLISHMENT 9.1. Party shall permit the visits to its establishment, government agencies and laboratories, and Contractor industrial facilities by employees of the other Party or by employees of the other Party's Contractor (s), provided that the visit is authorized by both parties and the employees have any cessary and not appropriate security clearance and a need-to-know. 9.2. All visiting personnel shall be required to comply with security regulations of the host Party. Any information disclosed or made available to visitors shall be treated as if supplied to the Party sponsoring the visiting personnel and shall be subject to the provision of the agreement. 9.3. Requests for the visits by personnel of one Party to a facility of the other Party shall be coordinated through official channels and shall conform with the established visit procedures of the host country. 9.4. Lists of personnel of each Party required to visit, on a continuing basis, the facilities of the other Party shall be submitted through official channels in accordanc with the host Party's established international visit procedures. Article X loans, sales, AND TRANSFER OF equipment AND materials Either Party may furnish equipment or materials identified as mutually agreed and it being not cessary for executing the terms of this agreement to the other Party. Any equipment or materials that are loaned or transferred shall be used by the receiving Party only for the purpose of access set out in this agreement and according to the terms of a separate ' Loan Agreement. " Article XI of The status OF FORCE agreement between the States parties to the North Atlantic Treaty regarding the status of their forces, done in London 19th of June 1951 (NATO sofa). Article XII settlement OF DISPUTE between the Disagreement of the parties arising under or relating to this agreement or any of the Implementing Annex shall be resolved only by the consultation between the parties at the lowest possible level and shall not be referred to any national or international tribunal or other third party for settlement. Article XIII GENERAL PROVISION 13.1. All activities of the parties under this Agreement shall be carried out in accordanc with their national law and are not intended to conflict with the national legislation of the parties or with international law. In case of conflict, international law and national legislation will prevails. The participants will notify each other in the event of any conflict arising. 13.2. The responsibilities of the Parties shall be subject to the availability of appropriated funds for such purpose. 13.3. All actions to this pursuan agreement shall be carried out on behalf of the Department of Defense of the United States of America and the Ministry of defence of the Republic of Latvia by the designated organizations identified in the individual Implementing Annex to this agreement. 13.4 In the event of a conflict between an article of this agreement and any Implementing Annexe it to this agreement, the article of the agreement shall prevails. Article XIV amendment, TERMINATION, ENTRY into effect AND DURATION this agreement 14.1. and it is Implementing the Appendix may be Annexe and amended by written mutual determination of the parties. Implementing Annex and the Appendix may be amended and new Annexe may be added by the written, mutual determination of the persons authorized to sign Implementing Annexe or their written designe. The Appendix may be added the new Implementing Annex by written, mutual determination of the persons authorized to sign Implementing Annexe or their written designe. Amendment of the Annex or Appendix of Implementing shall not require re-negotiation or amendment of the agreement, and additions of new Appendix shall not require the re-negotiation or amendment of the Implementing Annexe. Parties may delegate authority to sign implementing Annexe or to other entities in the Appendix of their Governments. 14.2. This agreement and/or any of it may be terminated by Implementing the Annex at any time upon mutual written agreement of the parties. In the event that the parties agree to the termination of the agreement and/or any of the Implementing Annex, the Parties shall consult prior to the date of termination to ensur a termination on the most economical and equitable terms. 14.3. Either Party may terminate this agreement or an Implementing Annex upon 180 days written notification to the other Party. Such notice shall be the subject of immediate consultation by the parties to decide upon the appropriate course of action. In the event of termination of this agreement or any Implementing Annexe, the following rules shall apply: 14.3.1. In the event of termination of this agreement or any Implementing Annexe, both parties agree to prepare a mutually agreed it "Termination Protocol" which shall include procedures for satisfying the obligation of uncompleted arising during the period the agreement or Implementing Annex was in force. 14.3.2. The parties will continue participation, financial or otherwise, up to the effective date of termination. Each Party will pay the costs it will incur as a result of the termination. 14.3.3. All information, products, data, materials, GIS and related rights therein received under the provision of the agreement will be retained by the parties, subject to the provision of the agreement. 14.4. Termination of the Agreement to terminate all of Implementing Annex. 14.5. The respectiv rights and responsibilities of the parties regarding article VI (SECURITY); Article Vii (CONTROLLED UNCLASSIFIED INFORMATION); Article Viii (THIRD PARTY Sales AND Transfers); and, article XI (status OF forces) shall continue notwithstanding termination or expiration of the withdrawals from,, of this agreement. 9.1. This agreement, which consist of the preamble, fourteen (14) articles, and two (2) Implementing Annex A (Topographic products, Data, publications, and Related Geospatial Information and services materials) and B (Geodetic and Geophysical Data, publications, and Related Geospatial Information and services materials), shall enter into effect upon signature by both parties and shall remain in effect until terminated or suspended. Stock: requests for additional cop, including planning and operational stocks of hard copy/digital topographic products, data, publications, and related GIS materials listed in Appendix I will be considered and provided by the producing Party to the other Party. 2.2. Where applicable, digital topographic products, data, publications, and related GIS materials transferred under the provision of this Annex shall be subject to Implementing the Digital Geographic Information Exchange Standard (Digest). In most cases, digital topographic products, data, publications, and related GIS materials shall be exchanged on CDROM in ISSS the 9660 format, or via File Transfer Protocol (FTP) utilizing the Internet. For finished Vector product format (VPF) products, the digest is to be used (C). Shall provide a copy of the NG of the most current applicable manuals and VPF Digest standard upon request, the MoD. 2.2.1. Digital Data Appendix: Digital topographic products and data provided for in the Appendix of the axles shall be supplied by either Party to the other without charge. 2.2.2. Publications and related materials to GIS: Cop of publications related to digital topographic data and GIS related materials shall be exchanged as specified in the applicable Appendix-without charge. 2.2.3. the Application software: 2.2.3.1. Nga may at its discretion supply one (1) copy, free of charge, of all the releasabl GIS applications software, and any changes related to digital topographic theret, products and data as outlined in the Appendix. 2.2.3.2. MoD agree of use of as a condition of the supplied GIS applications NG software, not to reverse engineer, nor attempt in any way or manner to duplicate such software without prior written authorization from NG. 2.2.3.3. The fashion line shall any and all changes to the GIS application software supplied NG with NG. 2.2.3.4. Nga shall consider the MoD requests for source code of any software supplied by GIS applications NG on a case-by-case basis. 3. Copyright, use AND release of Each Party 3.1 RESTRICTION shall honor the copyright, trademark, use and release of restriction on all hard copy/digital topographic products, data, publications and related GIS materials provided by the other Party relevant to this Implementing Annexe in accordanc with specific guidance from the providing Party at the time the hard copy/digital topographic products, data, publications and related materials transmitted by a GIS. 3.2. Notwithstanding paragraph 3.1 above, each Party grants to the other Party gratis (no cost) permission to use either Party's produced or provided hard copy/digital topographic products, data, publications and related materials for use by GIS either Party's Government. 3.3. The parties will mutually determin title it and use of co-produced products, information and related GIS materials. 4. SHIPMENT OF materials 4.1. All shipment of hard copy/digital topographic products, data, publications, and related GIS materials by either Party to the other shall be accompanied by appropriate transmittal documents that list the contents of the shipment. Two or three of the transmittal to Copa shall be prepared as follows: one copy shall be forwarded in advance to the consigne by mail immediately prior to shipment, and one copy shall be enclosed in the shipment (two cops to return if receipt is required). All hard copy/digital topographic products, data, publications, and related GIS material to be exchanged under this Implementing Annex shall be sent free of freight charges. All hard copy/digital geodetic and geophysical data, publications, and related GIS materials provided under this Annex shall be done Implementing according to the shipping instructions in Section 4 (below): "Shipment of materials." Geodetic and Geophysical Data 2.1.1: Releasabl hard copy/digital geophysical, geodetic, gravity and magnetic data is accomplished by governmental or civilian organizations or activities, including index and final computation, shall be exchanged upon request. 2.1.2. Publications and related materials to GIS: Cop of geodetic and geophysical publications and related materials shall be exchanged as a GIS specified in Appendix I, without charge to either Party. Additional cop to geodetic and geophysical of publications and related GIS materials provided for in Appendix I shall be requested in accordanc with Appendix II and may be provided by either Party to the other. 3. Copyright, use AND release of Each Party 3.1 RESTRICTION shall honor the copyright, trademark, use and release of restriction on all hard copy/digital data, geodetic and geophysical publications and GIS related materials provided by the other Party relevant to this Implementing Annexe in accordanc with specific guidance from the providing Party at the time the hard copy/digital geodetic and geophysical data , publications and related materials transmitted by a GIS. 3.2. Notwithstanding paragraph 3.1 above, each Party grants to the other a free (no cost) non-exclusive unlimited use license on either Party's produced or provided hard copy/digital data, geodetic and geophysical publications and related materials that shall be a GIS used as source material by either Party in the production of hard copy/digital data, geodetic and geophysical publications and related materials for use by GIS either Party's Government. 3.3. The parties will mutually determin title it and use of co-produced products, information and related GIS materials. 4. SHIPMENT OF materials 4.1. All shipment of hard copy/digital geodetic and geophysical data, publications and related materials by either Party GIS it shall be accompanied by the other appropriate transmittal documents that list the contents of the shipment. Two or three of the transmittal to Copa shall be prepared: one advance copy shall be forwarded to the consigne by mail immediately prior to shipment, and one copy shall be enclosed in the shipment (two cops to return if receipt is required). There shall be from the advance of transmittal to Copa for Automatic Distribution. 4.2. All hard copy/digital geodetic and geophysical data, publications, and related GIS material to be exchanged under this Implementing Annex shall be sent free of freight charges. All shipment shall be borne the costs by the sending Party. 4.3. All packages shall be clearly marked with the notation "UNITED States/REPUBLIC OF Latvia Bilateral Agreement Exchange Material — a GIS Non reimbursabl." 4.4. Transmittal of new index and notification by either Party of a discontinued hard copy/digital geodetic and geophysical data, publications, and related GIS materials shall automatically constitut the revisions to this Implementing Annexe in accordanc with article XIV (amendment, TERMINATION, ENTRY into effect AND DURATION) of the agreement. 6. RETURN OF materials 6.1. In the event of termination of the agreement or this Implementing Annexe, all hard copy/digital data, geodetic and geophysical and GIS related publications, materials that have already been exchanged, excluding hard copy/digital geodetic and geophysical data, publications, and related GIS materials on loan, need not be returned and shall remain the property of the holder unless otherwise agreed to. 7. VALIDITY 7.1. This Annex shall enter into Implementing effect on the date of the last signature and shall remain in effect in accordanc with article XIV (amendment, TERMINATION, ENTRY into effect AND DURATION) of the agreement. 8. Signatures IN WITNESS WHEREOF, the undersigned, being duly the authorized, have signed this Implementing Annexe. Prepared in duplicate, in the English and Latvian languages, each of which shall be of equal authenticity. One copy in each language shall be duly signed and exchanged between the parties.

The National Geospatial-Intelligence Agency (NGA) shall, upon request and free of charge, provide each of the following in the hard copy, magnetic tape, CD-ROM, or other available media, as appropriate, to the Ministry of defence (MoD): 1.1 the precise Positioning System (GPS) ephemerids. 1.2. the Geodetic point positioning data, to include satellite derived positional data of releasabl area. 1.3. the Releasabl marine Gravity data for selected geographic regions of interest in open ocean waters. 1.4. Publications and related Geospatial Information and services (GIS) materials. 2. shall, upon request to the MoD and free of charge, provide each of the following in the hard copy, magnetic tape, CD-ROM, or other available media, as appropriate and agreed upon, the NG: Geodetic point positioning data 2.1, to include satellite derived positional data over the sovereign territory of the Republic of Latvia. 2.2. the Land and marine Gravity Data over the sovereign territory of the Republic of Latvia and the territorial waters of the Republic of Latvia. 2.3. Publication and related materials to GIS. Appendix II TO ANNEX B IMPLEMENTING requests FOR data AND GEODETIC AND GEOPHYSICAL RELATED GEOSPATIAL INFORMATION AND services materials 1. At the discretion of the sole National Geospatial-Intelligence Agency (NGA), it may satisfy the Ministry of defence (MoD) requests for the cop to any of NGA-produced hard copy/digital data, geodetic and geophysical publications and related Geospatial Information and services (GIS) material, with the exception of those items subject to other bilateral agreements or other restriction. 2. At the sole discretion of the MoD, it may satisfy requests for cop to NGA of any MoD-produced hard copy/digital data, geodetic and geophysical and GIS related publications, materials, with the exception of those items subject to other bilateral agreements or other restriction. 3. the Distribution of the items exchanged upon request shall be as specified in Section 4, the "Shipment of materials" of Implementing Annex B.
