Cabinet of Ministers Regulations No. 908, 2004 in Riga in November (pr 2. No 63 37) procedures, prepare, approve, implement, monitor and evaluate the financial instrument of the European Union's "transition facility" for the strengthening of the administrative capacity of the program Issued in accordance with the Cabinet of Ministers of 14 law equipment of the first paragraph of article 3 i. General questions 1. determines the order in which prepare, adopt, implement, monitor and evaluate the financial instrument of the European Union's "transition facility" for the strengthening of the administrative capacity of the programmes (hereinafter referred to as the transition program), as well as the duties of the officials responsible.
2. the transition programme aims to develop and strengthen the administrative capacity of the Republic of Latvia in respect of European Community legislation and enforcement, as well as professional experience.
3. the transition programme priority setting, project application and selection criteria shall be determined in accordance with the following documents: 3.1. Agreement between the Kingdom of Belgium, the Kingdom of Denmark, the Federal Republic of Germany, the Hellenic Republic, the Kingdom of Spain, the French Republic, Ireland, the Italian Republic, the Grand Duchy of Luxembourg, the Netherlands, the Republic of Austria, the Portuguese Republic, the Republic of Finland, the Kingdom of Sweden, the United Kingdom of Great Britain and Northern Ireland (Member States of the European Union) and the Czech Republic, the Republic of Estonia, the Republic of Cyprus The Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia, the Slovak Republic, the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic to the European Union;
3.2. features of transition programming and implementation guidelines, which were approved by the European Commission on 19 December 2003, decision No. 4884;
3.3. the European Commission of February 2003, may and November monitoring reports on the fulfilment of obligations laid down in the negotiations for accession to the European Union;
3.4. other documents that transition programming and project selection criteria.
4. the transition programme and the use of the criteria determined in accordance with the following documents: 4.1 the European Commission decision on the financing of the transition of the European Union (hereinafter referred to as a financial decision);
4.2. the memorandum of understanding between the European Commission and the Government of the Republic of Latvia for the implementation of the transitional programme (hereinafter the memorandum of understanding);
4.3. the administration of the Member States of the European Union twinning project (Twinning) and smaller amounts of the twinning project (Twinning Light) manual;
4.4. other European Commission guidance on the implementation of the transitional programme;
4.5. the Republic of Latvia regulatory enactments procurement.
II. The National Coordinator of the foreign financial assistance matters 5. National Coordinator of the foreign financial assistance is the Finance Minister.
6. The National Coordinator of the foreign financial assistance: 6.1. is responsible for the preparation of the programme of transition management;
6.2. coordinate the implementation of the transitional programme for officials responsible for posting;
6.3. provide transitional programme monitoring and interim evaluation;
6.4. jointly with the National Executive shall be responsible for coordinating the programme of transition to other financial instruments of the European Union.
III. The national officer 7. National Officer is the Secretary of the Ministry of finance.
8. The National Officer: 8.1 is responsible for the European Commission's transitional program features assigned to financial management;
8.2. in order to ensure financial management, instructs and lays down the requirements for the transition program officer and senior officials of the sector;
8.3. the switch with each financial institution of the implementation contract for certain transitional arrangements for the implementation of the draft programme;

8.5. the establishment of a financial reporting system and ensure its functioning;
8.6. is responsible for the observed discrepancies, irregularities and fraud cases, reporting to the European Commission, as well as for such cases, control and reporting system;
5.4. financial decision by the end of the payment period shall draw up a report on the use of common resources and submit it to the European Commission;
8.8. ensure the financial decision of execution of the transfer of the remaining funds of the European Commission;
8.9. the national fund procedures and is responsible for its activities.
9. The national officer to ensure performance of the duties entrusted to it, may authorise a maximum of two other officers to carry out their respective responsibilities, but the National Executive shall be responsible for the performance of the duties in accordance with the memorandum of understanding and these terms it is assigned.
IV. the transition programme officer 10. National Executive after coordination with the national coordinator of the foreign financial assistance shall adopt transitional programs of the officials responsible for the implementation of each institution.
11. the transition programme officer: 11.1. is responsible for the introduction of the institution;
11.2. in accordance with the provisions referred to in paragraph 4 of document is responsible for the implementation of the transitional programme of administrative and financial management, related to the procurement and grant contracts and twinning (Twinning) projects and small-scale twinning (Twinning Light) project implementation of the administrative and financial management arrangements, which the transitional program officer assigned to the National Coordinator twinning (Twinning) projects;
11.3. is responsible for the implementation of the transitional programme technical management, if the transition program of the technical management of the project in accordance with the financial decision is not made in the older industries official;
11.4. ensure the necessary arrangements to ensure adequate publicity all activities financed from the programme of transition;
11.5. the switch with senior industry officials a cooperation agreement on the conditions for the implementation of the programme of transition and transition programs for the implementation of technical projects management;

16.5. in accordance with the instructions of the national officers for reports submitted on the transition program of the implementation of the project;
16.6. is responsible for the achievement of the objectives of the project;
16. take the necessary measures to ensure adequate publicity all activities funded from the transition programme in accordance with the provisions of the documents referred to in paragraph 4, the requirements;
16.8. scheduling of co-financing and the use of appropriate financial decision and of contracts;

16.9. provides project documents the controls proposed by the national coordinator of the foreign financial assistance, National Coordinator (Twinning) twinning project, national officer, transition programs officer, as well as the European Commission and other institutions of the European Union authorised representatives.
Vi. National Coordinator twinning (Twinning) projects 17. National Coordinator twinning (Twinning) projects are the Ministry of Finance of the European Union and International Affairs Department Director.
18. The National Coordinator twinning (Twinning) projects: 18.1 is responsible for twinning (Twinning) projects and small-scale twinning (Twinning Light) project administrative and financial management;
18.2. ensure project preparation and the coordination and monitoring of implementation;
18.3. the European Commission and the institutions involved in the project coordination;
18.4. participate in the senior officials meeting of the sector to evaluate and approve submitted small twinning (Twinning Light) project applications.
VII. preparation of the transitional programme and the approval of 19. in the preparation of the transition is the following: 19.1. priority setting;
19.2. project development and application selection.
20. The transition programme during the preparation of the national coordinator of the foreign financial assistance: 20.1. organizes preparation of transition;
20.2. ensure the availability of information and the provision of advice to senior officials of industry and institutions involved in the preparation;
20.3. cooperate with the National Executive, transition programs officer, senior industry officials and institutions involved in the preparation;
20.4. The Cabinet of Ministers informed about the course of preparation of the transitional program, launching programs and complete their preparation;
20.5. carrying out other measures to ensure the transition program.
21. the priorities of the transitional programme raises the Ministry of finance, Ministry of Justice, the Office for European Affairs and the Foreign Ministry, on the basis of this provision of the Treaty referred to in point 3.1 and 3.3 of these regulations referred to in the monitoring report of the European Commission.
22. The National Coordinator of the foreign financial assistance in transition priorities submitted for approval to the Cabinet.
23. Senior officials of the industry provide transitional program project application development.
24. Senior officials of industry, developing the project application, provides project funding (including co-financing), planning according to the rules referred to in paragraph 3 of the documents to the requirements and procedures laid down by the Ministry of finance.
25. Where the design provides several senior officials of industry, it is mutually agreed as the main officer responsible for the project development of the application.
26. Senior industry officer presented a project application to the national coordinator of the foreign financial assistance.
27. The National Coordinator of the foreign financial aid issues in project applications submitted to assess quality.
28. The National Coordinator of the foreign financial assistance in application of quality assessed by the following criteria: 28.1. actions provided for in the compliance with the priorities established;
28.2. the application of and compliance with the objectives of the project;
28.3. the application of and compliance with the transitional programme objectives;
28.4. the eligibility of the application of the draft transitional program guidelines.
29. If the application does not comply with the provisions referred to in paragraph 28 of the criteria, the national coordinator of the foreign financial help is right to reject the application, or send the project for the improvement of the older application industry executive.
30. The National Coordinator of the foreign financial assistance matters shall submit an application for approval to the European Commission.

34. The National Coordinator of the foreign financial assistance in matters concerning the amendments to the draft financial decision in line with the National Executive and transition programs, and the officials responsible in accordance with the provisions of the documents referred to in paragraph 4, the requirements laid down in the European Commission submitted a request on the need to amend the financial decision.
IX. implementation of the transitional programme 35. transitional programme implemented under the extended decentralised implementation system, under which the transitional program partner contracting and payments project performers provided free through the European Commission, in application of the legislation of the Republic of Latvia to the requirements of the procurement and national officer taking full financial responsibility for the transition programme.
36. the implementation of the transitional programme concluded such contracts: 36.1. procurement contracts (supply, service or works);

36.3. grant agreements;
36.4. the institution of cooperation agreements;
22.7. other agreements after coordination with the European Commission.
37. the implementation of the transitional program project, the administrative and financial management, by the transition of the programme officer, conclude contracts, includes the following measures: 37.1. procurement procedures realization stage: 37.1.1. call for proposals, RFP, the terms of the negotiated procedure or technical specifications, tender, price, other surveys or marketing of the negotiated procedure for harmonisation required documents before purchasing and the decision of the Commission this document harmonization amendments, when assessing whether the subject procurement and meet the financial requirements set out in the decision;
37.1.2. harmonization of the draft contracts before the conclusion of the contract of purchase;
37.2. the procurement stage of performance of the contract: the contract amendment 37.2.1. harmonisation when assessing whether the amended budget, procurement and payment for performance of the contract within the time limits correspond to the financial decision and the laws of the Republic of Latvia to the requirements, as well as the European Commission's instructions;
37.2.2. carrying out the supply and works contracts;
37.3. payment period: 37.3.1. senior industry officials approved the project artist of the payment request and its supporting documents, as well as the fulfilment of the contract and concluded that rule the documents referred to in paragraph 4, the requirements set out in the evaluation and approval;
37.3.2. preparation of the request for payment of the expenses of the transition program and its submission to the Treasury to make the payment.
38. transition programs project technical management by senior industry officials, concluding contracts, includes the following measures: 38.1. procurement procedures realization stage: 38.1.1. purchase Commission approval of their operating activities, project procurement documentation, providing the financial objectives set out in the decision, the documentation and the necessary amendments with transitional programs, purchase of officials responsible for the organisation, as well as the provision of activities associated with the project task result for applicants procurement process, and recording information about the procurement process;
38.1.2. purchase contract by matching with the transition program officer;
38.1.3. If intended to conclude a works contract, all necessary preparations for conducting, in accordance with the laws and regulations in the construction area to ensure the conclusion of the contract the construction works;
38.2. the procurement contract performance stage: 38.2.1. preparation of necessary amendments to the contracts and their coordination with the transition program officer;
38.2.2. support of the project Executive for the project in accordance with the purchase agreement, project monitoring, the activities of bailiff of expenses to ensure compliance with the contractual procurement of project objectives, Project Executive Overview evaluation and approval;
23.8. payment period: receipt of invoicing 38.3.1. contracts referred to in the receipt of the goods or services or carrying out the works, the artist payment request and supporting documents for approval;
38.3.2. payment order on the national co-financing of the project, the national co-financing of the project contractor and wage payment orders, sending a copy of the transitional program officer;

38.3.3. monitoring the implementation of the programme of transition phase — permanent transition programs project supervision, industry monitoring report preparation and submission of the national coordinator of the foreign financial assistance, the project generated goodwill in accounting, project dissemination and provision of application in accordance with the project goals.
39. transitional program project administrative and financial management by the national coordinator of the twinning (Twinning) projects through small-scale twinning (Twinning Light), the contract shall include the following: 39.1. the tender preparation stage: 39.1.1. ensuring cooperation with senior industry officials in the preparation of project applications;
39.1.2. examining the project, project quality assessment in accordance with paragraph 28 of these terms the criteria referred to in the comments on the quality of projects. If the project does not meet certain criteria, it may be rejected or sent to senior officials of industry improvement;
39.1.3. assess the project application for approval and submit the compilation for the senior officials meeting of the European Union;
24.4. the administration of the Member States of the European Union, and a small selection of the twinning (Twinning Light) contract award stage: 39.2.1. approved projects, sending the application to the Member States of the European Union after the adoption of the financial decisions;
39.2.2. Administration of the Member States of the European Union submitted an offer of cooperation on the collection and transmission of transition programs officer;
39.2.3. Administration of the Member States of the European Union's offer of cooperation in the selection meeting, organizing and participating in it as an observer;
39.2.4. Administration of the Member States of the European Union's offer of cooperation in the selection meeting report review and approval;
39.2.5. the administration of the Member States of the European Union on the outcome of the meeting of the selection;
39.2.6. small twinning (Twinning Light) contract review and approval;
39.3. small-scale twinning (Twinning Light) contract performance stage: 39.3.1. participation in the project management committee meetings;
39.3.2. project the artist submitted the start and final review and approval;
39.3.3. small twinning (Twinning Light) contract review and approval of the amendments, if necessary, according to the nature of the amendment.
40. The transitional program project technical management by the senior officials of the industry by closing small twinning (Twinning Light), the contract shall include the following: 56.1. project preparation stage: 40.1.1. small-scale twinning (Twinning Light) project application development. Where the design provides several senior officials of industry, they shall agree on a key official responsible for application development;
40.1.2. small-scale twinning (Twinning Light) the submission of the project national coordinator twinning (Twinning) projects;
40.1.3. project funding (including co-financing), planning according to the rules referred to in paragraph 3 of the documents to the requirements and procedures laid down by the Ministry of finance;
40.2. the administration of the Member States of the European Union, and a small selection of the twinning (Twinning Light) contract award stage: 40.2.1. project provider selection and administration of the Member States of the European Union, the meeting reviewed the selection;
40.2.2. small-scale twinning (Twinning Light);
40.3. small-scale twinning (Twinning Light) contract performance stage: 40.3.1. the necessary amendments, preparation and conduct small-scale twinning (Twinning Light) the Treaty after consulting the national coordinator of the twinning (Twinning) projects and transition programs officer;
40.3.2. support of small scale (Twinning Light) twinning project Executive for the project under the small scale twinning (Twinning Light) the terms of the contract, the project activity, Superintendence of artist spending compliance for small twinning (Twinning Light) specified in the contract, the project objectives, project evaluation and review executive approval, specific objectives and the provision of appropriate use of funding for small-scale twinning (Twinning Light);
25.1. the payment phase — receipt on small-scale twinning (Twinning Light) measures referred to in the contract, the project's executing the payment request and supporting documents.
41. The transition programme of implementation of the administrative and financial management by the national coordinator of the twinning (Twinning) projects through small-scale twinning (Twinning), the contract shall include the following: 41.1. the tender preparation stage, ensuring cooperation with senior industry officials in preparing the project;
41.2. the administration of the Member States of the European Union, the selection and contract award stage: 41.2.1. approved projects, sending the application to the European Commission.
41.2.2. Administration of the Member States of the European Union, the selection of the organisation and management of the meetings, as well as the report of the meeting on the project's artist choice approval;
41.2.3. the work plan for approval by transmission of the European Commission;
41.2.4. received from the European Commission comment into the twinning (Twinning) in the draft Treaty;
41.2.5. the twinning (Twinning) contract review and approval;
41.3. twinning (Twinning) contract performance stage: 41.3.1. twinning (Twinning) prepared amendments to the contract review and approval, if necessary, according to the type of amendment;
41.3.2. participation in the project management committee meetings;
41.3.3. project the artist submitted quarterly and final report for review and approval.
42. The transitional program project technical management by senior industry officer through twinning (Twinning), the contract shall include the following: 42.1. the administration of the Member States of the European Union and for the selection of the twinning (Twinning) contract award stage: 42.1.1. artist selection processes, the administration of the Member States of the European Union, the meeting reviewed the selection of partner selection or rejection of preparation and submission of National Coordinator (Twinning) projects twinning;
42.1.2. the project manager and the direct cooperation of the person posting;
42.1.3. the twinning (Twinning) preparation, signing and submission for approval to the National Coordinator twinning (Twinning) projects;
26.2. the twinning (Twinning) contract performance stage: 42.2.1. preparation of necessary amendments and the twinning (Twinning) contract after coordination with the national coordinator of the twinning (Twinning) projects and transition programs officer;
42.2.2. support of the project Executive for the project under the twinning (Twinning) contract, project monitoring, the activities of bailiff of expenses to ensure compliance with the twinning (Twinning) specified in the contract, the project objectives, project evaluation and review executive approval, specific objectives and providing the use of funding under the twinning (Twinning);
26.3. payment period: receipt out of the twinning (Twinning) measures referred to in the contract, the project's executing the payment request and supporting documents.
43. The National Coordinator twinning (Twinning) projects transition programs delegated officer the following small twinning (Twinning Light) project of the administrative and financial management measures: 43.1. the administration of the Member States of the European Union the selection phase: project evaluation compliance to the instructions of the European Commission;
43.2. small-scale twinning (Twinning Light) contract period, documentation preparation and harmonisation;
43.3. small-scale twinning (Twinning Light) during performance of the contract, contract amendment and harmonisation, where necessary, according to the type of amendment;
43.4. payment period: 43.4.1. senior industry officials approved the project artist of the payment request and supporting documentation, as well as their compliance with the contract concluded by that provision and paragraph 4 contains documents those requirements;
43.4.2. preparation of the request for payment of the expenses of the transition program and its submission to the Treasury to make the payment.
44. The National Coordinator twinning (Twinning) projects transition programs delegated officer following a twinning project (Twinning) administrative and financial management measures:

44.1. the twinning (Twinning) contract period: budget of the contract review and coordination of the project, as well as provision of advice to the selected project Executive and senior industry officer for financial management of the project;
44.2. twinning (Twinning) during performance of the contract, the contract amendment and harmonisation, where necessary, according to the type of amendment;
44.3. the payment period: 44.3.1. older industry officials approved the project artist of the payment request and supporting documentation, as well as their consistency with the approval of the twinning (Twinning) concluded agreement and paragraph 4 this provision contains documents those requirements;
44.3.2. preparation of the request for payment of the expenses of the transition program and its submission to the Treasury to make the payment.
45. Grant Scheme and direct grant allocation after the signing of the financial decision of organized donation allocation method that corresponds to the European Council of 25 June 2002 Regulation No 1605/2002 and the provisions of Chapter 6 of the instrument for pre-accession assistance grant guidelines for the implementation of the scheme and to make the purchase, and that you use to select projects for funding, as well as implement and control them.
46. the Grant Scheme for administrative and financial management, by the transition of the programme officer, includes the following measures: 46.1. application of open project tendering stage, grant schemes, guidelines development, grant schemes, the issue of the guidelines for applicants and, if necessary, grant schemes explaining the guidelines for applicants, assessing applications for review by the Commission and the applicant information, not proposals;
46.2. the contractual stage — contract negotiation, contract documentation, preparation of contracts and amendments of contracts;
46.3. the contract implementation phase, monitoring of the implementation of the evaluation report, the performers and the approval of the grant checks the performance of the contract;
46.4. the payment period, payment of bailiff request and supporting documents for compliance with the contract concluded by the evaluation and approval, preparation of the request for payment of the expenses of the transition program and its submission to the Treasury to make the payment and the payment order in the preparation of the State budget co-financed by the payment of part of the contract, if any, and its submission to the Treasury to make the payment.
47. Grant Scheme, technical managers, conducted by senior industry officer, includes the following measures: 29.3. unveiled proposals for organizing the stage — a project application and eligibility criteria for applicants, providing the financial objectives set out in the decision, the tender evaluation Commission appointment and its operating activities, decide on the projects to be supported and the tender evaluation report from the Commission;
47.2. the contract implementation phase — grant scheme monitoring and evaluation, dissemination of results of the project and the provision of application in accordance with the project goals.
48. the implementation of the transitional programme participating institutions provide the documentation related to the project storage for five years after the European Parliament has adopted a report on the last year of the general budget of the European communities relating to the implementation of the transitional programme.
Transitional programs x monitoring 49. transitional programme monitoring objectives are: to assess the transition program 49.1. the implementation;
30.6. to assess the transition program for the efficiency of the use of funds under the transition program objectives;
30.6. to give proposals on the improvement of the implementation of the transitional programme;
49. propose amendments transitional program projects and direct it for approval to the European Commission.
50. The transitional program is supervised by the Joint Monitoring Committee (hereinafter the Committee) in accordance with the Committee's Charter.
51. The composition of the Committee is the national coordinator of the foreign financial assistance, national officer, transition programs officer and representatives of the European Commission. The Committee may invite other interested officials to participate in the meetings of the Committee. Meetings of the Committee at least twice a year, hosts the national coordinator of the foreign financial assistance. The functions of the Secretariat of the Committee carried out the Ministry of finance.
52. the Committee not less than twice a year, review and assess the implementation of the transition programme in accordance with the financial decision.
53. The National Coordinator of the foreign financial assistance in establishing monitoring sub-committees (Subcommittee). Subcommittees are responsible for the ongoing transition program for monitoring the implementation of projects in the sectors concerned.
54. the Subcommittee shall consist of the national coordinator of the foreign financial assistance, and a national officer or their authorised persons, transitional program officer or the authorized person, and senior officials of the sector, as well as representatives of the European Commission as observers. Subcommittee meetings not less than twice a year, hold the national coordinator of the foreign financial assistance. The Secretariat of the Subcommittee on the financial Ministry.
55. The Sub-Committee shall have the following responsibilities: 55.1. to assess the ongoing transition in the implementation of the project;
55.2. to assess the effectiveness of the use of the funds granted under the transitional programme objectives;
55.3. to develop and provide proposals for transitional programs for improving the implementation of the project;
55.4. to provide the Committee with reports on the European Commission's financial leverage.
56. The transition programme under the supervision of the national coordinator of the foreign financial assistance: 56.1. prepares the annual work plan of supervision;
56.2. prepare a report each year on progress in the implementation of the programme of transition;
56.3. transitional programme monitoring reports.
57. The National Executive shall provide the financial reports on the use of the transitional programme, if so requested by the national coordinator of the foreign financial assistance.
