No 26 § 11) aid modalities for participation in the international cooperation programmes in the field of research and technology Issued in accordance with scientific activity article 13 of the law of the third subparagraph of paragraph 4, i. General questions 1. determines: 1.1. procedures for granting support for membership of the European Union's research and innovation agenda (hereinafter referred to as the program) projects; 1.2. research and development projects (further – projects), which meets under these regulations for aid; 1.3. requirements support the applicant. 2. the objective is to ensure the implementation of the project according to: 2.1. European Parliament and Council decision No 1982/2006/EC of 18 December 2006 concerning the seventh framework programme of the European Community for research, technological development and demonstration activities (2007-2013) (Official Journal of the European Union of 30 December 2006, L 412) (hereinafter referred to as the 7th Framework Programme); 2.2. The European Parliament and of the Council on 11 December 2013 to Regulation (EU) No 1291/2013, establishing research and innovation framework programme "Horizon 2020" (2014-2020) and repealing Decision No 1982/2006/EC (Official Journal of the European Union, 2012 20 December, no L 347) (hereinafter referred to as the "framework programme" Horizon 2020 "); 2.3. Council December 16, 2013 Regulation (EURATOM) No 1314/2013 for the European Atomic Energy Community for research and training programme 2014-2018, which complements the research and innovation framework programme "Horizon 2020" (Official Journal of the European Union, 20 December 2013, no L 347) (hereinafter referred to as the EURATOM programme); 2.4. European Parliament and Council of 15 may 2014. decision No. 553/2014/EU membership of the Union undertaken by several Member States research and development programme (Eurostars 2), which aimed at supporting research and development performing small and medium-sized enterprises (Official Journal of the European Union, 7 June 2014, no L 169); 2.10. The European Parliament and of the Council on 11 December 2013 decision No 1312/13/EU of the European Institute of innovation and technology (EIT) strategic innovation agenda: here the contribution in promoting innovation in Europe (Official Journal of the European Union, 20 December 2013, no L 347). 3. The terms used in the following terms: 3.1 research organisation-scientific institutions of the Republic of Latvia in the register (hereinafter register of scientific institutions) registered scientific institutions (hereinafter referred to as the scientific authority), which meets the European Commission 14 June 2014 to Regulation (EU) No 651/2014 (Official Journal of the European Union, 2014 26 June, no L 187/1) to the specified categories of aid compatible with the internal market, the application of the Treaty and article 107.108 (hereinafter Regulation No 651/2014) 2. Receive State aid, the research organisation, regardless of its legal status as a company if they equate public funds meet all of the Treaty on the functioning of the European Union (Official Journal of the European Union, 30 March 2010 No. 83/47 C) Article 107 (1) these conditions; 3.3. economic activity-any activity that involves the offering of goods or services in the market (including the leasing of research infrastructures), as well as on behalf of traders implemented research services or contract research; 3.4. with economic activities related project-project, within which the research organization pursuing activities which are not economic in nature, or restricted areas; 3.5. with economic activities related project – a project that meets one or more of the following criteria: 3.5.1 project scientific institution that does not meet the definition of research organisations; 3.5.2. project activities, which are economic in nature; 3.6. the transaction, which is not economic in nature, the main activity of the research organisations, which do not include the Treaty on the functioning of the European Union article 107 the scope defined in paragraph 1 which manifested as follows: 3.6.1. educational measures to bring staff numbers and qualifications; 3.6.2. independent research and development, to get more knowledge and better understanding, including joint research and development, a research organization engaging in effective cooperation; 3.6.3. the dissemination of research results, for example, through the training process, open access, open the database of publications or open source software; 3.6.4. knowledge transfer activities, if all profits from such activities are reinvested in basic research organisations; 3.7. the applicant company or research organisation; 3.8. aid: State budget funds and national co-financing for the project in the form of State aid; 3.9. national co-financing – support to economic activities related to the project; 3.10. restricted areas of activity – the economic research organisations operating or research infrastructures that meet the following criteria: 3.10.1. it is directly related to the activity of the research organisations or research infrastructure and its use in the field, which does not have an economic nature; 3.10.2. it consumes the same resources (such as materials, equipment, labor, and capital) as to economic activity-related core activities; 3.10.3. it funds allocated each year will not exceed 20 percent of total annual funding of research infrastructure; 3.11. State aid — aid to economic activities related to the project, corresponding to the Treaty on the functioning of the European Union article 107 paragraph 1; 3.12. the project research categories (research category), if the State aid, fundamental research, industrial research, experimental development of Regulation No 651/2014 article 84.85.86., and the definition laid down in paragraph 1. Research categories, if provided for by national co-financing – fundamental research, industrial research, experimental development, according the Organization for economic cooperation and development (OECD) statistical methodology of science published in the inventory of the Frascati Manual definitions provided; 3.13. effective cooperation — cooperation that comply with Regulation No 651/2014 article 2 the definition set out in paragraph 90; 3.14 small (micro), small and medium company, a company that complies with Regulation No 651/2014 the definition laid down in annex I; 3.15. a large company, a company that complies with Regulation No 651/2014 article 2 the definition set out in paragraph 24; 3.16. fair competition – competition corresponding to Regulation No 651/2014 article 2 the definition set out in paragraph 89; 3.17. knowledge transfer-the process by which the goal is to get, collect and disseminate clear and tacit knowledge, including skills and competencies of both business activity and with them not related activities, such as research collaboration, consulting, licensing, new business creation, publication, and the researchers and other staff involved in these activities in mobility. In addition to the scientific and technical knowledge, it includes other types of knowledge (for example, knowledge about how to use the standards and rules that they included, on the environmental conditions of operation), organisational innovation, as well as the method of knowledge management related to the definition of intangible assets, acquisition, protection, defence and use; 3.18. research infrastructures-equipment, resources and related services used by the scientists to carry out research in the relevant fields, including scientific equipment or sets of instruments, knowledge-based resources such as collections, archives or structured scientific information, information and communications technology infrastructure, for example, GRID type, Web, computer equipment, software and communication equipment, or any other unique nature resort, which is essential to the research. This infrastructure can be deployed together or diffuse (organized resource network); 3.19. the project implementer – the company or research organisation, which these terms have been granted support. II. eligible projects and applicants for the aid requirements 4. aid under Regulation No 651/2014 25. and article 28 and national co-financing provides: 4.1 FP7 collaborative projects, networks of excellence projects and research projects for specific groups; 4.2. the "Horizon 2020" framework programme projects, including projects of innovation; 4.3. the framework programme and the 7th framework programme "Horizon 2020" framework according to the Treaty on the functioning of the European Union on article 185 Member States created the joint research and innovation agenda (hereinafter referred to as the joint program) projects; 4.4. the framework programme and the 7th framework programme "Horizon 2020" framework according to the Treaty on the functioning of the European Union article 187-created public-private partnership joint venture (JV) projects; 4.5. F4 joint projects; 4.6. The EURATOM programme projects; 4.7 cost activities; 4.8. FP7 era-NET, the era-NET plus activities and "Horizon 2020" framework programmes era-NET COFUND activities (hereinafter referred to as the era-NET activities); 4.9. to cover the membership of Latvia in the Consortium and ERIC this consortium study, including study of the period 7 EU (European Social Survey); 4.10. to cover the membership of Latvia in European academic network GEANT (Gigabit European Academic Network) (GEANT) Association, the Consortium, GEANT projects, including to cover the Latvian annual connection fee of GEANT channel and GEANT internet (World Service Commodity). 5. the aid shall be granted to: 5.1 in the form of grants from the Ministry of education and science of the State budget programme "70.00.00 other EU policy instruments and measures of the project" 70.06.00 "sub membership of the European Union's research and technology development programmes" for the current year national budget resources available for this purpose. State budget execution process transferable funds "80.00.00 in" unallocated funding instrument of the policy of the European Union and other foreign financial assistance and projects co-financed measures "planned redistribution of funds; 5.2. subject to the maximum amount of aid per project exceeds eur 1 million per year, except for this provision, paragraph 17, the amount of the aid for the membership cost activity within a year. 6. supports the applicant: 6.1. is eligible for support under these rules, if, pursuant to the provisions of paragraph 14, it is a contract for the implementation of a project with the European Commission, the Academy of Sciences of Latvia (hereinafter referred to as the Academy) or national educational development agency (hereinafter Agency) and is submitted to the Agency: support the applicant's application for 6.1.1. concerning the granting of aid for the implementation of the project (hereinafter referred to as the application); 6.1.2. the support of the applicant's application for the grant of aid (hereinafter referred to as the application), as well as between the applicant and the Academy, which runs the national financing institutions function, the contract has been concluded for the implementation of a project and the allocation of public funding; 6.2. public aid shall be granted in accordance with Regulation No 651/2014 6. paragraph 2 of article has launched the project before the application is made to the agency or the application. 7. the applicant has identified the following requirements: 7.1 that is directly responsible for the preparation and implementation of the project; 7.2. it is available in a stable and sufficient financial resources, appropriate research and technical personnel (operators and technicians) as well as for the implementation of the project required logistical support; 7.3. to support the applicant is not the subject of a recovery order pursuant to Regulation No 651/2014 article 1, paragraph 4 (a) of "a", if he qualifies for State aid; 7.4. it under the administration of the State revenue service tax (duty) the debtor of the information available in the database is not a tax or fee debt; 7.5. it is not a court ruling declared insolvency proceedings, with the Court ruling are not legal or out-of-court redress process is not initiated bankruptcy proceedings, is not suitable for rehabilitation or arrangement, as well as its economic activity is not terminated; 4.7. it is not punished for the Latvian Code of administrative offences of the third paragraph of article 189.2 administrative infringement or it does not have adequate means of influence on the coercive criminal law 280. Article referred to in the second paragraph of Commission of a criminal offence; 7.7. where State aid is received, it is not a company in difficulty pursuant to Regulation No 651/2014 article 2, paragraph 18; 7.8. it has received or intends to receive, for the same eligible costs of the project funding from other financial sources of the European Union, or other financial resources that are not institutions of Latvia, direct or indirect control; 7.9. the project costs for activities planned in the project does not overlap with the activities funded by other European Union fund activity and other foreign financial instruments; 7.10. it within these rules the aid granted in respect of the same actions and the eligible costs of the project does not amount to de minimis support; 7.11. the same costs and activities under the project is financed from the national funding; 7.12. If the applicant is a company, it has submitted financial statements for the last two financial years concluded; 7.13. If the applicant is a research organisation, which according to the scientific activities of regulatory laws is presented by the Ministry of education and science in public statements over the past two years, the report concluded. If a research organisation is founded less than two years ago, it must provide a public report on the conclusion of the financial year, following the date of registration of scientific institutions, scientific institutions in the register; 7.14. If claim to State support, it provides information on the incentive effect of the aid under Regulation No 651/2014 6. paragraph 2, if applicable; 7.15. where the applicant is a research organisation, receiving State aid, it differentiates the economic activity of the action, that is not the nature of the business, and this transaction costs, financing and income (if applicable) so as to effectively prevent cross-subsidisation of economic activities, within the regulatory framework for the order in which financial statements recording the State, local, foreign, European Union, other international organisations and institutions, financial aid (financial assistance), gifts and donations, whether in cash or in kind. 8. Aid intensity of aid applicants to apply as follows: 8.1 the allocation of public co-funding – 100 percent of the eligible costs of the project; 8.2. where public aid is granted pursuant to Regulation No 651/2014 article 25 (5): 8.2.1. fundamental research – up to 100 percent of the eligible costs of the project; 8.2.2. industrial research: up to 50 percent of the eligible costs of the project; 8.2.3. experimental development (including prototyping) – up to 25 per cent of the eligible costs of the project; 8.3. where public aid is granted pursuant to Regulation No 651/2014 article 28 (3), small (micro), small or medium enterprise innovation support eligible costs relating to patent or other industrial property rights acquisition, validation and defended more than 50 percent of the eligible costs of the project. 9. This provision and 8.2.2.8.2.3. referred to industrial research and experimental development according to Regulation No 651/2014 article 25 paragraph 6 of the State aid intensity may be increased, subject to the condition that the maximum intensity of aid to the applicant not more than 80 per cent of the eligible costs of the project: 9.1.10 percent of the project's eligible costs, aid where the aid is granted to the tenderer who has the average business; 9.2.20% of the eligible costs of the project if the aid is awarded to the tenderer who has supported small (micro) businesses; 9.3.15% of the eligible costs of the project in addition to the provisions in point 9.2 9.1 or specified about where: 9.3.1. the project involves effective cooperation in one of the following cases: 9.3.1.1. between the companies, at least one of which is a tiny (micro), small or medium-sized enterprise or a project implemented in at least two countries, and no single undertaking bears more than 70% of the eligible costs of the project; 9.3.1.2. between the company and one or more of the research organisation bears at least 10% of the eligible costs of the project and have the right to publish the project research results; 9.3.2. the project results disseminated in technical and scientific conferences or published in scientific or technical publications, publicly available databases or open source software. 10. State aid in the framework of these rules shall not be granted if there someone from Regulation no 651/2014 article 1 point 5 or laid down in Regulation No 651/2014 article 1, paragraph 2, "c" and "d" in those conditions. 11. the applicant submits to the Agency: 11.1. application support for the conclusion of the contract, subject to this provision subparagraph 12.1.1.; 11.2. the application under this rule, if the 12.1.3 between the applicant and the Academy, which runs the national financing institutions function, the contract has been concluded for the implementation of a project and the allocation of public funding. 12. Agency: 12.1. Drawing up and, after coordination with the Ministry of education and science and the approval of project evaluation Commission (hereinafter the Commission), with the exception of those rules 4.7 and 4.8. activities referred to in point, within 15 working days from the date of entry into force of the rules shall be published on its website: 12.1.1. application form, they fill the conditions under this regulation, as well as the documentation that you want to add the application procedure and deadlines; 12.1.2. the application and evaluation of the application; 12.1.3. application form, they fill the conditions under this regulation, as well as the documentation to be added to the application procedure and deadlines, if between the applicant and the Academy, which runs the national financing institutions function, the contract has been concluded for the implementation of a project and the allocation of public funding; 12.1.4. form of agreement on the granting of aid for the implementation of the project (hereinafter referred to as contracts), the conditions of filling out a form, as well as the conclusion of the contract procedure and deadlines; 12.2. the registered applications; 12.3. granting aid, on the basis of the Commission's decision, if between the applicant and the Academy, which runs the national financing institutions function, the contract has been concluded for the implementation of a project and the allocation of public funding; 12.4. the switch support contract with the support of an applicant; 12.5. shall prepare and provide to the Ministry of education and Science: 12.5.1. information on national budget planning for project implementation; 12.5.2. State budget request forecast next year; 12.5.3. information on aid learning, on the basis of a written request; 7.8. examine and approve, after consulting the Commission supports the amendments to the agreement; 12.7. based on this rule 19.8. the decision referred to in point, regain according expenses incurred; 12.8. provide information and advice on the implementation of the project supports learning issues; 12.9. gives the public information and provides publicity on matters related to the implementation of the projects under these rules; 12.10. ensure State aid inventory and storage of information 10 years pursuant to Regulation No 651/2014 12, thus making the monitoring of State aid; 12.11. check the stimulative effect of State aid pursuant to Regulation No 651/2014 article 6 paragraph 2; 12.12. published on its website information on the granting of State aid under Regulation No 651/2014 article 9 1, 2, and paragraph 4, pursuant to the provisions of Regulation No 651/2014 (II) and (iii) the requirements laid down in the annex; 12.13. ensure Regulation No 651/2014 article 4 paragraph 1 of the "i" referred to in the notification thresholds for compliance with the conditions of each project, for which the conclusion of the support agreement; 12.14. requests from the project promoter's information on the implementation of the project and results achieved compliance with the planned results; 12.15. Project Executive (employee, performing specific tasks in the project) – up to € 14.00 per hour; 13.1.2. staff mission expenses, travel costs, in accordance with the laws of the order in which the recoverable costs associated with missions; 13.1.3. the scientific equipment and equipment (fixed assets) to the extent and as long as they are used for the purposes of the project. If the equipment and use of equipment in the project does not cover the entire depreciation period for eligible considers only its depreciation costs covering the period when the equipment and facilities used in the project, and which is calculated in accordance with good accounting practice; 13.1.4. costs of buildings and land, to the extent and for the period used for the implementation of the project according to their intensity of use in the project. As regards the buildings eligible to be considered as only the depreciation costs corresponding to the duration of the project, and is calculated in accordance with generally accepted accounting principles. In relation to the ground shall be considered ineligible costs of commercial transfer or actually incurred capital costs; 13.1.5. the cost of contract research, knowledge and patents bought or licenses received from outside sources of fair competition, as well as the cost of consultancy services and equivalent services used exclusively for the attainment of the objectives of the project. These costs must not exceed 25 percent of the project total eligible costs; 13.1.6. charges for equipment, instruments and materials (e.g. chemicals, laboratory utensils, medicines), to the extent and as long as they are used in the project, as well as their purchase and delivery costs, which are listed under the accounting regulatory regulations and are directly attributable to the performance of the project; 13.2. a small (micro), small or medium enterprise innovation support eligible costs relating to patent or other industrial property rights acquisition, validation and defense, pursuant to the provisions of Regulation No 651/2014 article 28 paragraph 2, "a" is: 13.2.1. all costs preceding the grant of the right in the first legal jurisdiction, including costs relating to the preparation of the application, registration and examination, as well as costs incurred in renewing the application before the right has been granted; 13.2.2. translation and other costs incurred in order to obtain the granting or validation in another jurisdiction; 13.2.3. costs incurred in defending the right to a formal review of the application and possible appeals, even if such costs occur after the right is granted; 13.3. r & d project indirect costs that are directly associated with the project, do not exceed 25 percent of the direct costs of the project amount is not included in the cost of outsourcing: 13.3.1. utilities payments according to tariffs and regulations laid down by the framework; 13.3.2. communications services; 13.3.3. Office expenses; 13.3.4. common-use equipment maintenance, maintenance and repair costs; 13.3.5. space, including the sharing of premises, maintenance and repair; 13.3.6. holding materials; 13.3.7. transport costs; 13.3.8. other indirect costs; 13.4. the research and development of external audit costs. III. Support for membership and joint venture projects 14. the Agency shall, pursuant to Commission decision State aid granted pursuant to Regulation No 651/2014 article 25 with respect to the acquisition of patents or other industrial property rights acquisition, validation and defended, in the light of Regulation No 651/2014 article 28 paragraph 2 ' a ' section, and national co-financing rules 4.1, 4.2, 4.3, 4.4, 4.5, 4.6, 4.7 and 4.8 referred projects and project implementers : 14.1. If the project tendering within project has reached the necessary assessment of the aid, which represents one of the following documents: 14.1.1. joint programmes, joint ventures, including a joint venture or the EURATOM programme F4 authority, (the decision); 14.1.2. the applicant and the European Commission signed the agreement on the implementation of the project in accordance with this rule and section 19.1 19.2 has established national funds by providing public funding for project implementation; 14.1.3. the applicant and the academies or agencies under contract for the implementation of a project and the allocation of public funding, if the Academy or the execution of the Agency's national financing institutions; 14.2. If the tenderer that, within this article provides for the grant of State aid, are rated according to this provision the requirements of chapter II, 12.1.2. subject to this provision. IV. Support for membership cost activities and era-NET activities projects 15. Agency national co-financing granted membership at the cost of the activity, the implementation of which the memorandum of understanding has been concluded and is nominated for the representatives of Latvia cost activities in the Management Committee. 16. the national co-financing the COST of activities the representative of the Agency, the Management Committee shall: 16.1. application support cost activity (annex 1); 16.2. the cost of the financing required for the activity calculated year (annex 2). 17. in order to ensure participation cost activity, the agency assigns national co-financing pursuant to this provision to the annex 1 and 2, but not more than 2 200 euro per year (excluding the costs related to the COST of activities planned in the framework of the international organization of Latvia and their progress) to cover: 17.1. participation cost the activity Management Committee meetings for those professionals who have not been approved as a representative of Latvia in the activities of the Steering Committee; 17.2. participation cost activities working group meetings; 17.3. participation cost activities within organised events (conferences, seminars and training activities); 17.4. the cost of the activity coordinator functions as participating in the activities of this administration. 18. the Agency awarded national co-financing for the era-NET activities supported under the project if: 18.1. it is presented within the era-NET activities in an open design competition, assessed and received the relevant era-NET activities for the implementation of the recommendations of the Consortium; 18.2. all concerned on the implementation of the era-NET activities for the participants in a project have been signed by the Consortium (cooperation) agreement. V. evaluation of the application and the decision of the Commission adopted 19 decisions: 19.1. the quota for each of these rules 4.1, 4.2, 4.3, 4.4, 4.5, 4.6, 4.7 and 4.8. framework programme, referred to in the joint programme, and activities to the joint venture; 19.2. the State budget funding for participation in framework programmes, joint programmes and joint era-NET activities in open project competitions (European); 19.3. the Latvian participation in cost actions and approve the Latvian representatives work cost shares in the Management Committee (cost of activities); 19.4. the support of the era-NET activity within open project competitions and virssliekšņ submitted a scientific assessment of the quality of the projects which have received Latvian participants and communicate it to the era-NET project consortium activity; 19.5. the cost of the activity within the planned organisation of international events and developments in Latvia; 12.2. the granting of aid for participation in activity, subject to the cost the cost National Coordinator to the Commission written opinion; 19.7. the refusal of the granting of aid for the membership cost activity, subject to the cost National Coordinator to the Commission written opinion; 19.8. the granting of aid for the project and the amount of the aid, based on the support application or submission of the applicant; 12.4. the refusal of the granting of aid for the project. 19.10. inadequate recovery of the expenditure incurred, the implementation of the project agreement. 20. the Commission, acting in accordance with the regulations established by the Agency. Before the approval of the Statute of the Agency with the Ministry of education and science. Minister of education and science established the Commission, which is made up of the Ministry of education and science, Ministry of Economic Affairs and the Ministry of industry, Academy, the Latvian Science Council and delegated representatives of the Agency.
