Cabinet of Ministers Regulations No. 154 in Riga on 22 February 2005 (pr. No 10) 32 amendments to the Cabinet of Ministers of 30 March 2004, the Regulation No 218 "plant quarantine regulations" Issued under the plant protection act article 5, paragraph 1, to make the Cabinet of 30 March 2004, the Regulation No 218 "plant quarantine rules" (Latvian journal, 2004, 65, 108 no) the following amendments: 1. provisions supplementing with 2.6., 2.7., 2.8., 2.9, 2.10, 2.11, 2.12, 2.13 and 2.14. subparagraph by the following : ' 2.6. point of entry — the border inspection post through which the European Union customs territory initially imported plants, plant products and contact firms items; 2.7. the official body of point of entry, the responsible official body of the Member State carrying out phytosanitary control point of entry; 2.8. the official body of destination, the responsible official body of the Member State carrying out phytosanitary control in this area and in which the Customs Office of destination; 2.9. the original Customs-Customs Office at the point of introduction; 2.10. the Customs Office of destination, customs office where the goods placed under the Community transit procedure must be presented in order to end the procedure; 2.11.-homogeneous lots on plants, plant products and contact with them came a set of units of which has the same composition and origin, and forming part of the load; 2.12. cargo — a set of goods covered by a single document in the customs or other formalities (such as phytosanitary certificate or other document) or markings. One shipment may consist of one or more lots; 2.13. customs-approved treatment or use: 2.13.1. Customs procedure; 2.13.2. the importation of goods in a free zone or free warehouse; 2.13.3. re-exportation from the customs territory of the community; 2.13.4. destruction of goods; 2.13.5. upon surrender of the goods to the State; 2.14. transit: customs procedure allowing to move under customs supervision under the goods from one point to another point in the customs territory of the community. " 2. Express 3 and paragraph 4 by the following: "3. For plant-health control under the plant breeders, as well as the said plants, plant products and contact with them in the articles (annex 1) processor, Storer, traders, importer and exporter (hereinafter referred to as persons subject to registration) register for plant-health control is subject to the plants and plant products circulating in the registry of parties (hereinafter register). If the service's Inspector finds that a registered person is deleted from the commercial register or stopped functioning with these rules referred to in annex 1. plants and plant products; 17.3. If the service's Inspector finds that a registered party does not comply with the scope of regulatory plant protection regulations (hereinafter referred to as the regulations) requirements. " 7. Chapter III be expressed as follows: "III. Plants, plant products and contact with them came the importation of items 18. The rules referred to in annex 1 of the plants, plant products and contact with them in the firms authorised to import through border inspection posts set out in the regulations on the placement of the border inspection post to the State border of the Republic of Latvia. 20. The rules referred to in annex 1 of the plants, plant products and contact objects after their arrival at the plant health inspections in the Community customs code, article 4, paragraph 16, "a", "d", "e", "f" and "g" in certain customs procedures, release for free circulation, inward processing, processing under customs control, temporary importation and outward processing. 21. the Imported plants, plant products and plant health items in contact controls include the following: 21.1. inspection of documents; 21.2. identity check; 21.3. plant health inspection; 21.4. sampling inspection or laboratory investigation. 22. This rule 21.1. the verification referred to in point of entry. 23. This rule 21.2 21.3 21.4., and referred to the test can be performed: 23.1. point of entry; 23.2. If the service permission — a location that is not the point of importation, customs warehouse, free zone, the customs service's premises or at the place of receipt of the goods (hereinafter referred to as the approved place of inspection). 24. the phytosanitary control location point of entry, customs warehouse or free zone customs complies with the rules referred to in annex 3 requirements, phytosanitary control service premises or at the place of the cargo — this rule 2.2 of annex 3 and in point 2.3. 25. the Imported plants, plant products and plant health items in contact controls carried out at the point of entry to the food and veterinary service of sanitary border inspection (sanitary border inspection) the Inspector who has the required qualifications in the field of plant protection. 26. the Imported plants, plant products and plant health items in contact controls the site, which is not the point of entry, out: 26.1. customs warehousing and free customs zone — sanitary border inspection; 26.2. the premises or at the place of receipt of the goods, service. 27. the Department is assessing the point of entry customs warehouses and free zones in compliance with the customs rules. 28. in order to obtain permission for the plant health checks at the place of shipment, the importer or owner of the place of receipt or the possessor shall provide service: 28.1. submission by adding documents that include information about: 28.1.1. plants, plant products and contact with them coming on subjects intended for imports into, and receive location where the imported plants, plant products and items in contact will be stored; 28.1.2. the way in which plants, plant products and contact with them will put items away from the origin the European Union plants, plant products and those coming into contact with objects; 28.2. a copy of the document (the presentation of the original) as the recognised status of the consignor, if the person intended for plants, plant products and items in contact, granted such status and have met the Commission of 2 July 1993, Regulation (EEC) No 2454/93 laying down provisions for the implementation of the Council of 12 October 1992 Regulation (EEC) No 2913/92 establishing the Community customs code, 406 in the first subparagraph of article conditions. 29. during the month of application look and assess the compliance of the cargo at the place of the provisions of this annex and paragraph 2.3 2.2. 30. where the receiving site meets the requirements of these regulations, the Department shall take a decision on the authorisation of phytosanitary controls at the place of receipt of the goods. 31. If the receipt does not comply with the requirements of this regulation, the Department decides not to allow the cargo the phytosanitary control at the place of receipt. 32. If it is established that the importer or owner of the place of receipt or the possessor failed to comply with the law requirements or this person does not meet the requirements contained in these rules, the service shall decide on the withdrawal of the authorisation of the cargo at the place of the control. 33. If it is found that a part of the plants, plant products or objects in contact with them loads of infected or infested with legislation established plant quarantine organisms, prevent infected or infested plants, plant products or objects in contact with them import and distribution in Latvia and the European Union, but the remaining parts allow imports if it does not present a health risk; place the appropriate 35.164. plants, plant products and contact firms subject to customs supervision until the available laboratory test results; not allow relevant 35.165. plants, plant products and contact firms to send objects in transit through the European Union; destroy relevant 35.166. plants, plant products and contact firms subjects. 35.17 Where plants, plant products and items in contact do not meet the phytosanitary requirements and it does not allow you to import or distribute in Latvia, from Latvia, sanitary border inspection or service Inspector phytosanitary certificates for export (export) or phytosanitary certificate for re-export (re-export) stamped with triangular stamp in red with the word "certificate revoked", indicate the date of cancellation and confirm it with a signature. 35.18 where the sanitary border inspection or service Inspector has doubts about the cargo contents for plant genus, species or origin, he checks it. 35.19 On plants, plant products and contact with them in non-compliance of phytosanitary requirements or phytosanitary certificate for export (export) or a phytosanitary certificate for re-export (re-export) non-compliance with the requirements of these regulations sanitary border inspection inspector within 24 hours, inform the service. 1.
