Cabinet of Ministers Regulations No. 177 in Riga, 15 March 2005 (pr. 14. § 3) the procedure for the grant and the owner of the animal shall receive compensation for losses incurred by the State supervision of animal infectious diseases or epizootic outbreak Issued in accordance with article 35 of the law on veterinary medicine, second subparagraph, and article 38, the second part of rule 1 defines the procedure for the grant and the owner of the animal shall receive compensation for losses incurred by the State in the supervision of infectious diseases of animals (annex 1) and during the outbreak of the disease.
2. Compensation paid to the owner of the animals of the Field support service regional agricultural administration (Administration).
3. Management of infectious animal disease and epizootic outbreaks during the loss to the animal owner is compensated for in the following: 3.1 the outbreak of an epizootic disease and its loss in the fight, according to this provision, 2., 3., 4., 5 and 6 of the annex;
3.2. the transmissible spongiform encephalopathies (BSE and Skrēp disease) outbreak and its loss in the fight — in accordance with these rules 2, 5 and annex 7;
3.3. bovine tuberculosis, bovine, ovine and caprine brucellosis and enzootic bovine leukosis outbreak and its loss in the fight – up to 50% of the average of kautprodukt.
4. where products of animal origin are exported, but the outbreak of the disease and its fighting during the limitation of economic activity, product sales prohibition or animal vaccination policy is terminated the export production, compensation shall be calculated on the basis of the difference between the export price and the local market price.
5. food and veterinary service officer (hereinafter Inspector) draw up legislation on forced and destroy animals slaughtered, the carcasses destroyed, products of animal origin, ova, embryos, and animal feed, as well as destroyed equipment or damage caused from animal housing sanitation. A copy of the Act shall be issued to the owner of the animal.
6. the Inspector in paragraph 5 of these rules in the Act for forcibly or destroy animals slaughtered shall check on the amount of compensation payable and shall indicate: "reduce the amount of compensation payable" or "do not reduce the amount of compensation payable", taking into account the following assessment criteria: 6.1 forcibly destroyed the animals slaughtered or age;
6.2. diseases caused by the impact of changes in the value of the products;
6.3. the live weight;
6.4. market value;
6.5. forcibly animals slaughtered subsequent processing food, feed or other people not to use the product;
6.6. the forced destruction of the animals slaughtered.
7. Compensation for forced and slaughtered the animals destroyed, taking into account the indication of the Inspector in paragraph 5 of these provisions in the Act, the Board may be paid: 7.1, not exceeding 75% of the provisions laid down in Appendix 2 the amount of the refund, if compensation is paid to the disease or transmissible spongiform encephalopathies (BSE, Skrēp disease) during the fight to cover expenditure incurred;
7.2. up to 25% of the average of kautprodukt, where the refund is paid for bovine tuberculosis, bovine, ovine and caprine brucellosis, or enzootic bovine leukosis during the fight to cover the expenditure incurred.
8. to receive compensation, the owner of the livestock sector: 8.1. applications;
8.2. a mandatory if the Bill of lading, have purchased animal feed, animal products, live animals, embryos, ova, inventory;
8.3. documents proving ownership of the animal (purchase agreement, or animal movement of accounting documents);
8.4. This provision in the legislation referred to in paragraph 5, if the force is killed or destroyed animals, destroyed carcasses, animal products, eggs, embryos, and animal feed, as well as destroyed equipment or due to damage to animal housing sanitation.
9. The Board examined the documents, taking into account the provisions of paragraph 6 of the Inspector referred to in a statement of the amount of the refund (reduction or reduction), and the quarterly cost of compensation to the owner of the animal, the animal owner's transfer to a bank account.
10. Be declared unenforceable in the Cabinet's June 3, 2003 Regulation No 293 "procedure for granting and animal owner shall receive compensation for losses due to the disease or State supervision of infectious diseases of animals at the time of the fight" (Latvian journal, 2003, no. 85; 2004, nr. 19).
Informative reference to European Union directive rules included provisions deriving from Council 13 December 1977 Directive 78/52/EEC laying down Community criteria for national plans related to enhanced of brucellosis, tuberculosis and enzootic bovine leukosis as regards bovine herds of the fight.
