Cabinet of Ministers Regulations No. 198, Riga, 22 March 2005 (pr. No 15 20) fodder plant and seed trading solely rules Issued in accordance with the law of the movement of the Seed article 2 1, point "a" section and article 17 fifth i. General questions 1. solely determine the marketing of fodder plant seed and the construction procedures of sales these rules referred to in annex 1, as well as crops of the institution that controls the importation of seeds from countries which are not Member States of the European Union.
2. the national plant protection services in the framework of the Organisation for economic cooperation and development (OECD) scheme of fodder plants: 2.1. submit for inclusion in the economic cooperation and development (OECD) in organ sation in the list of varieties only varieties that are included in the catalogue of plant varieties of Latvia and meet this organization scheme of fodder plants;
2.2. provide information on breeds of providers;
2.3. works with providers of varieties;
UR2.4.sl ēdz a written agreement with the notified bodies on the seed propagation outside the country;
2.5. delivers the Latvian original varieties of seed samples of propagating varieties kontrollauciņ sow with genuine seed varieties;
2.6. the supply of formal descriptions of varieties, propagating the hybrid varieties, inbred component descriptions;
UR2.7.atz short the reproduced seed identity.
3. If the marketing of fodder plant seed are propagated outside the European Union, the national plant protection service recorded contracts for seed multiplication in non-Member States of the European Union, in accordance with European Union law requirements for seed production in countries which are not members of the European Union, and the registration of contracts in the Member States. To register contracts for seed multiplication in a State which is not a Member State of the European Union, will be submitted to the national sēklaudzētāj of the plant protection service of the application and be accompanied by the following information: 3.1. State in which seeds will be produced;
3.2. forage plant species;
3.3. the quantity of seed to be produced, origin and category of seeds;
3.4. the contract provided for the marketing year, the estimated quantity into the European Union, the planned delivery period.
4. national plant protection officers decisions and administrative acts issued by the marketing of fodder plant seed and solely in the field of trade can be a challenge to the laws prescribed by written application to the national plant protection service Director.
II. categories of seed 5. Seed shall be divided into the following categories: 5.1. random seed (IR);
5.2. pre-basic seed (PB);
5.3. basic seed (B);
5.4. certified seed (C);
5.5. commercial seed (K).
6. the random seed (IR) is a specially selected seeds, in quantities that ensure the preservation of the characteristics of the variety for several generations. This seed is obtained and the application of the scheme for the pav establish breeder or maintainer of the variety. After the breeder or maintainer of the variety of initiatives can make a random seed certification (IS) to determine their actual quality.
7. Pre-basic seed (PB) is a seed which: 7.1 grown directly from a random seed (IS) the breeder or maintainer of the variety in the monitoring, in accordance with generally accepted practices for the maintenance of the variety;
7.2. for the production of basic seed and certified seed (B), (C) Kate crews seeds;
7.3. comply with the requirements set out in these provisions of the basic seed (B) or in accordance with a special indication – pre-basic seed (PB);

8.2. grown varieties of the breeder or maintainer of supervision, in accordance with generally accepted practices for the maintenance of the variety;
8.3. designed for the production of certified seed (C) category;
8.4. meet basic seed in these provisions (B);

9. Certified seed (C) are seeds which: 9.1 produced directly from basic seed (B) (as the breeder or breed of rētāj desires-uzt from high-grade seed);
9.2. comply with the requirements set out in these provisions of the certified seed (C) of the category;
UR9.3.nav intended for the production of seed, but for other purposes (such as for food, fodder, grass);
UR9.4.vis like a seed and preparation period is the national plant protection service control.
10. For certified lupins (Lupinus spp.), pea (Pisum sativum), vetch (Vicia spp.) and Lucerne (Medicago sativa) seed (C) is two generations: 10.1. certified seed of the first generation (C1);
UR10.2.otr third generation certified seed (C2).
11. the certified seed of the first generation (C1) (Lupin, peas, vetch and Lucerne) is a seed that: 11.1. grown from basic seed (B) (by the breeder or maintainer of the variety of desires – from the higher category seed);
11.2. comply with the requirements laid down in these rules for certified seed (C), or in accordance with a special indication – certified seed of the first generation (C1);
11.3. for certified seed, second generation (C2) production or for other purposes (such as for food, fodder, grass);
UR11.4.vis like a seed and preparation period is the national plant protection service control.
12. certified seed, second generation (C2) (Lupin, peas, vetch and Lucerne) is a seed that: 12.1 grown from certified seed of the first generation (C1) (by the breeder or maintainer of the variety of desires – from the higher category seed);
12.2. comply with the requirements laid down in these rules for certified seed (C), or in accordance with a special indication – the second generation of certified seed (C2);
UR12.3.nav designed solely for the future;
UR12.4.vis à cultivation and preparation period is the national plant protection service control.
13. Commercial seed (K) are seeds: 13.1.ir can be identified as belonging to the species of seeds;
13.2. comply with the requirements laid down in these rules for commercial seed (K);
UR13.3.vis like the run-up to seed is the national day of a plant protection control.
14. Commercial seed (K) can be the following species of fodder plants: 14.1. Maura grass (POA annua l.);
UR14.2.mie žabrāl (phalaris l. arudinace);
14.3. sowing esparset (onobrychis viciifoli the Scop.);
14.4. Eastern Galega (Galega orientalis Lam.);
14.5. the White Lotus (Melilotus Albus L.).
III. requirements 15. Solely Sēklaudzētāj can grow one or more species or varieties, or for the marketing of fodder plant seed unless it provides for different species or varieties, or categories of seed not mixing.
16. Sēklaudzētāj article history field, specify the location of the schema information for the given field used seeds, fertilisers and plant protection products.
17. in order to maintain the purity of the breed and to prevent the spread of disease and pests, the marketing of fodder plant species and varieties of volumes only deploys solely by priekšaug, which provides variety and species not be mixed. 18. If sēklaudzētāj owns both the organic company (or its part) and the company (or its part), which produces about the futility of conventional seed of fodder plants, the organic agricultural companies did not obtain its own varieties of seed or these rules referred to in point 14 species of fodder plants and seeds as a conventional farm (or part of it).
19. the minimum spatial isolation zone between the cross-pollinated forage plant varieties of the same species, or in one of the category of fields is solely determined in Appendix 2 to these regulations.
20. In the event of non-compliance with spatial isolation zone, State plant protection service officer (hereinafter Inspector) warns of the need. Sēklaudzētāj repeatedly log on field inspection of the establishment of this zone.

23. Spatial isolation zone between one species or varieties and one category solely of fodder plant fields shall not be taken into account if there is sufficient protection against undesirable foreign pollination.
24. Self-pollinated species of lupines (Lupinus spp.), pea (Pisum sativum), vetch (Vicia spp.) and Lucerne (Medicago sativa) varieties of spatial isolation zone between the volume of other species or the same species and the same kind of volumes of other categories must be such that the seed harvest would not be possible during the mixing.
IV. field of view Solely

25. in order to assess the field solely the general condition and their compliance with the rules laid down in chapter III, as well as determine the purity of the species and variety in accordance with the provisions of annex 3 requirements, the Inspector is carrying out field inspection.
26. Sēklaudzētāj each year until 1 June to submit application (annex 4) national plant protection services in the marketing of fodder plant seed of field viewing.
27. If the field of application solely is submitted after this provision paragraph 26 the deadline, the application shall be accompanied by written information lag on the reasons for non-compliance with the time limit.

29. the field shall be made public by the plant protection service Inspector.
30. Before the field inspection officer familiar with the quality of seed, the supporting documents and records in the history of the field.
31. Seeded seeds quality certifies: 31.1. in Latvia the seed-certified seed packing label with "European Union rules and standards" (if the seed is intended for the agricultural trading) and a certificate of seed;
UR31.2.izs delegate that the random seed varieties for seeding the next maintainer of order, pav-maintainer of the variety written proof;
He UR31.3.cit in a Member State of the European Union for the seed-certified seed ie-packaging label marked "European Union rules and standards";
19.5. a State which is not a Member State of the European Union, certified seeds, between-the control of seed Exchange Association (ISTA) certificate and the Organization for economic cooperation and development (OECD) certificate.
32. the national plant protection services shall decide to refuse a field guide and volume of solely for unusable before inspections if: UR32.1.nav seeded seeds quality supporting documents or they do not comply with this provision, paragraph 31;
32.2. checking the records in the history of the field, the Inspector finds that rule 17 violations of or non-compliance with the information contained in the application;
UR32.3.nav field history.
33. the inspection carried out at least once during the period of vegetation in the crop development phase, e. g., phenology, best visible when Visual variety in morphological features, the most accurate determination of varietal purity and the detection of infected plants.
34. feed solely on the fields is not tolerated the presence (of Avena fatua, Avena sterilis) and Ludovik oatmeal (Avena ludoviciana) presence.
35. basic seed legumes fields not allowed-(Melilotus spp.).
36. If the presence of field notes solely (Avena fatua, Avena sterilis) or Ludovik of oats (Avena ludoviciana) or basic seed legumes field-(Melilotus spp.), the Inspector may give directions in writing of a seed grown in them izravē or separate part of the field with the colonies of plants harvested separately. After the due date, but not later than five days after the previous viewing field inspection carried out repeatedly.
37. If, during a field inspection or inspection of seeds sown, finds that irregularities or non-compliance with the relevant volume for a category of seed, seed category to the appropriate category lowered, in the light of these provisions for the acquisition of seed categories, or recognised as not solely usable. If the deficiencies may prevent the execution of instructions of the Inspector, field inspection carried out repeatedly, but not later than five days after the previous view.
38. If a field inspection found that the volume meets the requirements of these regulations, the inspector shall take a decision on its conformity with the relevant categories of seed production.
39. If the volume does not comply with the rules laid down in chapter III, as well as the requirements of the species and variety purity requirements, State plant protection service of the solely volume unusable. The resulting harvest shall not be included in the further evaluation of the seed.
40. After the last field inspections, based on field inspections results, national plant protection services prepares a fodder plant solely field inspection protocol in two copies (annex 5).
41. Fodder plant solely field inspections protocol first copy shall be issued by the sēklaudzētāj, the second copy will remain on the national plant protection service.
42. Fodder plant solely field inspections Protocol shall be issued within three days after the completion of the field of view solely.
V. evaluation of seed quality At the request of 43 sēklaudzētāj (annex 6) receive an average seed sampling, analysis and the production of labels the Inspector to assess the quality of the seed removes a sample from each batch of seeds produced.
44. the seed samples removed by the Inspector, who has won the national plant protection service seed strippers or qualifications of the international seed testing Association (ISTA) seed remover.
45. the seed removed from uniform seed lot. If the seed lot is not sufficiently uniform and do not meet the international seed testing Association (ISTA) rules, assessment of the seed lot refuses.
46. the weight of the seed lot is laid down in annex 7 of these rules. The maximum weight of a seed lot size may not exceed more than five percent.
47. If the weight of the seed lot exceed the provisions laid down in annex 7. size of more than five percent, splits it into several batches of seed according to the species.
48.No removes the seed lot average quality of seed samples for evaluation and follow-up. The average sample consists of the following parts, which set the minimum mass of this provision in annex 7:29.9. sample seed quality characteristics;
48.2. the post-control of seed samples;
48.3. the sample moisture content and seed pest invasion (placed in hermetically sealed containers).
49. the seed samples for quality indicators of national plant protection services in at least a year. Follow-up sample of seed remaining stores, to complete the evaluation of the sample.
50. The quality of the seed is certainly this provision in annex 8.
51. Fodder plant seed is not permissible in the presence (of Avena fatua, Avena sterilis) and Ludovik oatmeal (Avena ludoviciana) seed oil.
52. If the pre-basic category (PB) or the base category (B) seed germination identified in the analysis do not meet these rules laid down in annex 8 minimum germination of seed, at the national plant protection service authorization can certify seed with reduced germination. The special category in accordance with the label Specifies the seed germination, seed lot number as well as the merchant's last name (legal person – name) and address.
Vi. packaging of seed 53. For small packages of seed shall be considered packaging with a net weight of up to ten kilograms and bundles of basic seed, certified seed, commercial seed or seed mixture.
54. Small package of the European Union shall be classified as follows: (A) the type of packing of 54.1. (net weight up to two kilograms), mixtures of seed packages which are not intended solely for fodder plants and the production of fodder plants. When used in the form of plant protection products, dražējam materials or other solid additives, their weight is not counted in the total weight;
54.2. (B) the type of packaging (net weight up to 10 kg), pack of basic seed, certified seed, commercial seed or seed mixtures. When used in the form of plant protection products, dražējam materials or other solid additives, their weight is not counted in the total weight.
55. Fodder plant seed marketed in the form of homogeneous lots packed. Going to seed-ņojum closed (except in small packages of the European Union) or repackaged State plant protection service of the. Some European Union type B packaging repackaged State plant protection service of the.

VII. labelling of the packaging of the seed with the official labels 58. Package of seeds official label is under strict State plant protection service. Label minimum size is 110x67 millimetres. 59. the use of the label the following seed packs: 59.1. pre-basic seed;
59.2. basic seed (including small European Union type B packaging);
59.3. certified seed (except a small Union of wrapping type B);
59.4. commercial seed (except a small Union of wrapping type B);
59.5. seed mixtures (except a small Union of wrapping the type A and B);
59.6. seeds, which are not fully certified.

60. at the request of the packer of seed national plant protection services in the small European Union type B packages of seed can be issued the official label for the purposes of this provision the requirements of Chapter VII.
61. In concluding this rule 59. package of seeds referred to in paragraph 1, they shall be affixed on the outside do not use the official label, which corresponds to the information provided in this provision in annex 10 (packaging, commercial annex 11) certain content.

67. the genetically modified seed varieties to any label or document, official or otherwise, which is affixed to or accompanies the seed lot shall clearly indicate that the variety has been genetically modified.
68. Packing and seed mixtures etiķetēj, follow that rule in chapter VI and VII. The information on the label correspond to those provisions laid down in annex 12.
69. Seeds that are not fully certified, but grown and harvested UR69.1.kas: Member State of the European Union or in a country where the European Union allocated to the equivalence of field inspections and for the production of certified seed and meeting organisation for economic cooperation and development (OECD) fodder plant seed schemes and the chain law to the requirements of article 7, can fully certified in Latvia. Seeds are packaged and labelled in accordance with the Organisation for economic cooperation and development (OECD);
UR69.2.kas harvested in Latvia and intended for certification in another Member State of the European Union, wrapped the State plant protection service of the. Seeds are packaged and labelled in accordance with the law of the movement of the seed and the provisions of chapters VI and VII. The label must be affixed to the packaging of seed and add accompanying document (annex 13);
UR69.3.kas picked one agricultural company in Latvia and intended for certification for other agricultural company in Latvia, packaged State plant protection service of the. Seeds are packaged and labelled in accordance with the law of the movement of the seed and the provisions of chapters VI and VII. The label must be affixed to the packaging of the seeds in the seed that is not fully certified.
70. This provision 69 requirements of packaging and labelling do not apply to the cases for which a national plant protection service agreed with the other public body.
VIII. the labelling of the packaging of the seed with the packer labels 71. Packer (supplier) label used for such seed packs: 71.1. small European Union type A package;
71.2. small European Union type B packages (except packages of basic seed and the provisions referred to in paragraph 60 of the package).
72. the European Union's small type A packaging label Packer points this provision 14. information referred to in the annex.
73. Packer, by a small Union type (A) and (B) the packaging of the seed, ensure that they cannot be opened without damaging the system of seals or without leaving visible damage on the label or packaging.

IX. Seed mixtures 79. Latvia is permissible: 79.1. different genera of fodder plants, species and varieties of seed mixture preparation;
79.2. different fodder plant and cereal seed mixture preparation;
79.3. different fodder plant and oil seed mixture.
80. This provision, paragraph 79 of seed mixtures used in the preparation of crop variety, if: they included 80.1. The European Union's common catalogue of varieties of agricultural plant species or the catalogue of varieties of Latvia;
80.2. catalogs do not have comments on certain specific characteristics of the variety, which does not allow you to create blends.
81. prior to preparation of the seed mixtures shall evaluate its components conformity with the relevant categories of seed quality.
82. establishment of seed mixtures: 82.1. preparation of seed mixtures are used in equipment that will ensure the finished mixture is uniform; the seed
82.2. develop seed mixing job descriptions of procedures to ensure the quality of the seed mixture. Seed mixing job descriptions of procedures before work submitted to the national plant protection service;
82.3. approves of the seed mixture preparation procedure the responsible person;
82.4. seed accounting log indicates all information included in mixtures of seeds for the seed lots, providing traceability of the seed lot and the possibility to check the identity of the seed.
83. prior to preparation of seed mixtures are mixtures of seed establishments submit national plant protection services following information: 83.1. seed weight of the components of a mixture, the percentage indicating, by species or, where appropriate, by variety;
51.7. the name of the mixture if it is used for the marking of packaging.
84. the preparation of the mixture of seeds (production) by random checks of the national plant protection service: 84.1. controlling each of the components of a mixture of identity and weight, as well as checking the labels identifying the packages of seed;
52.3. in checking the mixing operation and finished mixtures.
85. the information on use of the seed mixtures indicate on the official label or a label of the packer.
Seed x 86. seeds to market after being recognised by the description "pre-basic seed (PB) (B) of basic seed, certified seed or commercial seed (C), (K) of the category. State plant protection service of the imported seed controls the market of Latvia, in accordance with the provisions of the EU law. In accordance with the law of the movement of the Seed article 17, second paragraph, point 5 miežabrāļ (phalaris l. arundinace), Eastern Galega (Galega orientalis Lam.) and White Lotus (Melilotus Albus l.) seeds may be imported and marketed also in cases where variety of the species listed in the European Union are not included in the common catalogue of varieties or varieties of plants in Latvia, but it complies with the requirements laid down in these provisions.
87. In accordance with the provisions of section 69.3. may never sell certified seed, if there is a written agreement between the buyer and the seller is informed about it and the national plant protection service.
88. in Latvia the market of seed mixtures prepared in Latvia this provision in accordance with the procedure laid down in IXnodaļ or in other Member States of the European Union under European Union law.
89. the commercial component of blends of seed germination match the germination capacity, provided for in these regulations, each specific to the certified seed of the species category.
90. A small Union of wrapping type (A) and (B) containing a mixture of seeds with a reduced germination can be traded for a separate stand or site with "seed germination reduced". In such cases, each package Unit indicates the actual seed germination.
91. The dealer every year until august 1 to notify Field support services to regional agricultural administration, the marketing of fodder plant seed (by species) the quantity (in quintals) not realized until 30 June.
XI. Sēklaudzētāj, a seed producer, packer and the Merchant Registration 92. State plant protection service registers seed establishments, sēklaudzētāj, Packer, traders and importers of seeds and sēklaudzētāj and seed dealer shall issue the certificate of registration.
93. To register Sēklaudzētāj and seed merchants in the register, the person shall submit to the national plant protection services in the application (annex 15), and depending on the occupation, the following information: 93.1. sēklaudzētāj: 93.1.1.ar related solely to rural plans, indicating the area (ha);
93.1.2. the field of history;
93.2. Packer-establishments or facilities description, specifying its membership. Establishment of seed mixtures also adds information about the preparation of seed mixtures, which will ensure the finished mixture is uniform; the seed

93.3. Seedsman-information about the origin of seed intended for marketing, including cooperation partners;
93.4. importer-information about the origin of seed intended for marketing, including cooperation partners.
94. the national plant protection services in ten working days evaluate applications and information and decide on the establishment of seed sēklaudzētāj, Packer, importer or dealer registration Sēklaudzētāj and seed dealers.
95. The decision taken by the national plant protection service shall inform the parties within five working days after the decision. If the decision is positive, the person shall be issued within five working days and sēklaudzētāj seed dealer registration certificate (annex 16).
96. Each sēklaudzētāj, a seed establishment, Packer, importer, marketer and is granted registration code. The code is the first two characters specify the address (postal district the first two digits), the other characters – serial number.
97. the national plant protection services in the cancelled registration two weeks: 60.3. after sēklaudzētāj, a seed establishment, Packer, trader or importer's written application;
97.2. If it is established that these rules are not satisfied, VII, VIII, X or the requirements set out in chapter XI, and composed of the Act;
60.5. If the national plant protection services in two years is not applied for the marketing of fodder plant seed certification.
98. the decision on the cancellation of the registration sēklaudzētāj, seed saver, prepare Packer, trader or importer shall notify in writing within five working days following its adoption.
XII. documentation of seed 99. Based on field inspections and seed evaluation results, national plant protection services in Sēklaudzētāj and seed merchant register persons established within the seed quality of issued documents.
100. The quality of the seed is the seed of the identity document certificate (annex 17). If the quality of the seed not satisfying the requirements of this regulation, issued a report on the results of the evaluation (annex 18).
101. the certificate shall be issued when the seed all the average seed lot sample assessment results indicators meet certain species of seed for the category requirements and is conducted solely before viewing the field.
102. Commercial seed (K) certificate shall be issued when all the average seed lot and the results of the evaluation of the sample corresponds to the seed of the species in commercial seed category (K).
103. the report "evaluation of the results of seed" shall be issued where: 103.1. what of the resulting seed lot quality characteristics do not match the corresponding category of seed;
UR103.2.nov ērtēt only individual indicators;
103.3. seed samples are not removed by the inspector or sampling does not meet the international seed testing Association (ISTA) requirements.
104. the certificate or report of seed ' seed evaluation results "issued three days after completion of the seed evaluation.
105. the period of validity of the certificate of seeds, seed germination, from the date of completion of the analysis are as follows: 105.1. one year, all species of fodder plants and seeds (including mixtures), if the moisture content is not more than: 105.1.1. the cabbage family fodder plants (fodder turnips, fodder for cabbage, oil rutk) to 9 percent;
105.1.2. Fabaceae (Slavonian vanagnadziņ, alfalfa, clover, esparset, to the East and White Lotus Galega) – 13 percent;
105.1.3. grasses, peas, lupins and vetches, beans – 15 percent;
UR105.2.tr short months – seeds infested with live mites or other living seed pests that destroy the seed storage, and in which the specified moisture content does not exceed: 105.2.1. cabbage family fodder plants (fodder turnips, fodder oil-cabbage, rutk), 12 percent;
