Cabinet of Ministers Regulations No. 448 in Riga on 21 June 2005 (pr. No 36 34 §) rules on national mineral deposits and their use, national mineral policy, as well as the use of the subsoils of authorization of licences or contest or auction order Issued in accordance with the law "on the Earth" in article 18, paragraph 1 and article 10, second, seventh, tenth and eleventh part i. General questions 1. determines: 1.1. national mineral deposits (deposits of national importance);
1.2. deposits of national importance and national significance of the use of mineral resources;
1.3. the underground water deposits Passport content;
1.4. national mineral policy if the use of the land and national mineral mining guards owner are one and the same person;
UR1.5.gad ons, when to hold a contest or an auction to get use of the subsoils license (license) or common mineral mining permit (hereinafter permit) mineral extraction in national and local ownership of existing land areas;
UR1.6.at allows or issue, the tender or auction the General order.
2. These provisions apply to national minerals beneficial — groundwater (fresh-water, mineral, thermal and industrial waters), but does not apply to hydrocarbons.
3. the national significance of these provisions set the lookup in the annex, in the management of the scheme and the rules laid down by the coordinates 2., 3., 4., 5., 6., 7., 8., 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27 and 28 in the annex.
4. the State land Department land boundary plans highlights: 4.1 national lookup or national nogabal of the subsoils;
4.2. water hole that is deeper than 20 metres, and those in certain zones.
II. deposits of national importance and public interest, the use of mineral resources of national significance 5 valid minerals may acquire: 5.1 the national wells — after receiving a licence in accordance with the requirements laid down in these provisions;
5.2. ground water — in accordance with the laws and regulations governing water use permit or A or B category contaminating activity licences.
6. the national wells one of the subsoils user license area is not less than 25% of the deposits.
7. for environmental laws regulating certain permissions, groundwater groundwater collector requires groundwater deposits passport (annex 29): 7.1 if a day you will get more than 100 m3 groundwater;
7.2. If underground water by mining implements.
8. The underground water deposits Passport indicates the prospecting for basic information about the underground water deposits, accepted the underground water supplies, and service quality, as well as the protection zone of ūdensgūtn and requirements to be observed when operating the underground water deposits.
9. The operator shall submit to the Latvian environment, geology and Meteorology Agency (hereinafter Agency) coordination: 9.1 after the water hole is created — water borehole passport (annex 30);
9.2. by source research geological and hydrogeological — source passports (annex 31).
10. in paragraph 9 of these regulations that a merchant Passport Agency shall submit two copies, one of which remains in the Fund, the State Geological second pass bore or research customer.
11. Ground water shall be classified: 11.1. adequate underground water hydrogeological, stratification (Annex 32);
11.2. in accordance with the groundwater water horizon classification (33. at law);
11.3. after the chemical composition and specific characteristics (annex 34).
12. If the winner broke ground water use water drilling, it provides the preservation or salvage of the borehole.
13. If the land and ground water abstraction boreholes or source kaptāž owner are one and the same person, a borehole or a spring kaptāž the owner of ground water may be obtained if the land owner concluded an agreement on the use of the subsoils.
14. If the rules referred to in paragraph 13 of the extraction hole in the land as a recorded lien, land owner and the owner of the drilling contract shall: 14.1. According to the area of land use rights transfer to the owner of the drilling to ensure groundwater mining bore (included in the protection zone around the water sampling sites);
14.2. the order in which the access hole.
15. If the land owner wants to use another person belonging to the drilling, it concludes a contract with this person about the hole.
III. organisation of the tender or auction 16. Competition or auction, which grant the right to acquire valid minerals (except ground water), held in the following cases: 16.1. If State or local governments or owned by the State or municipality in land area, the assent which get valid minerals are: 16.1.1. greater than 50 ha peat deposits;
16.1.2. greater than 5 ha of other mineral deposits;
16.2. If valid mining is expected to acquire continental shelf of the Republic of Latvia;
16.3. If valid minerals expected to get deposits of national importance.
17. The contest, in which grant the right to acquire valid minerals (hereinafter referred to as the competition) national deposits, proposes: 17.1. land owner;
17.2. other person, if the deposits of national importance or part of a landowner agrees in writing to the tender.
18. the invitation to tender: 18.1. — the Agency for the right to get a valid mineral deposits of national importance;
18.2. the land owner, in other cases.
19. Mineral extraction rights auction auction holding granted for the contest rules and the contest has selected a number of applicants that submitted the offer to the average final ranking of more than 40% of the maximum possible points.
20. The Contest Organizer, the agency or the land owner-draw contest rules and creates a tender Commission.
21. The invitation to tender shall include the following: 21.1. General information: 21.1.1. uses of subsoils, tender object name and description;
21.1.2. the Contest Organizer's property;
21.1.3. rights and duties of the Commission;
21.1.4. fee for geological information package;
21.1.5. cost of participation in the contest;
21.2. the information about the submission of tenders and opening of the place, date, time and order;
21.3. the requirements and design of the offer;
21.4. bids submitted for the evaluation of the criteria and procedures;

21.5. land lease project.
21.6. the conditions of the land, if the tender to assign the right to use the subsoils of fields of national importance;
21.7. information about an auction Centre, time, and agenda for, if, in accordance with the tendering procedure shall hold the land auction.
22. the tender shall be determined following assessment criteria applicants: 22.1. financial capacity;
22.2. technical support;
22.3. experience in the mineral extraction and valid processing;
22.4. the valid embed the rational mineral development;
22.5. environmental protection measures;
22.6. staff qualifications mineral mining;
14.1. the labour protection measures;
22.8. other criteria which the competition Commission considers necessary.
23. In order to assess candidates in accordance with the provisions of point 22, the contest organizer requires the following documents: a copy of the certificate of UR23.1.re ģistrācij or register a certificate attesting that the applicant is registered in accordance with the procedure prescribed by law;
23.2. the company registry certificate attesting that the applicant has not been declared bankrupt, is being wound up or its business operation is not suspended or terminated;
23.3. details of staff qualifications and technical work;
23.4. information on the applicant's experience in mining or mineral valid processing;
14.6. the annual accounts of the applicant, but not more than for the three preceding years;
14.7. the use of the object of the competition programme of work that includes the valid mineral deposits development techniques for environmental protection measures, work protection measures and, if necessary, other information.
24. The tender organizer shall be published in the newspaper "Latvian journal" invitation stating: 24.1. Contest Organizer's name;
24.2. the contest rules and the receipt of the order;
15.1. use of subsoils and name of an object;
15.2. tenderers submit time and place;
15.2. the contact address and phone number for more information;
24.6. other information, if the Contest Organizer considers it necessary.
25. the deadline for submission of the tender may not be less than 60 days after the publication of the newspaper "journal".
26. the purpose of the competition agency prepare geological information package, which contains a collection of data about the structure of the subsoils, mineral properties and items for the competition or auction the released object.
27. the Commission of the tenders evaluated after five-point system for each of the criteria set out in the Statute. For the best recognised proposal that got the highest average final judgement in accordance with the provisions laid down in point 22 of the applicant evaluation criteria.
28. the Commission is entitled to request information required to evaluate the offer. If the applicant does not provide, or give false information, the applicant shall be deleted from the list of contestants.
29. If the contest one tenderer, the tenderer the tender Commission can be declared winner, if the tender the tenderer's average final ranking of more than 40% of the maximum possible points.
30. If the competition that are granted rights to obtain valid mineral deposits of national importance, more applicants obtained the same amount of points as the winner be the tenderer who has obtained the most amount of points that 23.4. criteria referred to in the assessment, except for this provision, the case referred to in paragraph 31.
31. If the competition that are granted rights to obtain valid mineral deposits of national importance, more applicants obtained the same amount of points and one of them is the object of the competition, the land for the contest winner admits the land owner.
32. the contest winner gets the right to permit or license the use of the subsoils tender object.
33. the Tender shall be deemed not to have occurred if not logged on any applicant or any of the applicant's average final bid rating of not more than 40% of the maximum possible points.
34. The tender shall be published in the newspaper "journal" 10 days after the competition Commission's decision takes effect.
35. the rules shall enter into force on 1 July 2005.
