Cabinet of Ministers Regulations No 647 in 2005 (30 august. 49.3 §) rules on recreational craft construction, assessment of conformity and placing on the market are Issued in accordance with the law "on conformity assessment" article 7 of the first and the second part 1. General questions 1. determines the rest of the vessel design and construction safety requirements applicable to the offering on the market, as well as the rest of the vessel conformity assessment procedures. 2. 2.5. the authorized representative in the European Union, any natural or legal persons established in, which has received a written mandate from the manufacturer to act on their behalf. 3. the rules apply to vessels and structures, as well as on the engine exhaust and noise emissions and apply: 3.1. recreational craft and partly completed boats;
3.2. water motorcycles;
3.3. the rules referred to in point 7 of the recreational craft components, if they are offered on the market of the European Union and is intended for installation. 4. the provisions referred to in paragraph 3, the products rules apply only for the first time offering them on the market or put into service in use. 5. The rules referred to in paragraph 3 of the products conform to the safety, health, environmental protection and consumer protection requirements set out in section 2 of these regulations. 6. the provisions do not apply: 6.1., to the following vessels projects and structures: 6.1.1. vessels designed solely for racing, including rowing racing boats and training rowing boats, which the manufacturer is labelled accordingly;
6.1.2. canoeing, smailīt, gondola and water bikes;
6.1.3. sailing surfboards;
6.1.4. surfing boards, including boards, with drive;
6.1.5. the original historical craft and individual replicas designed and built before 1950 are mostly from the original materials and labelled as a producer;
6.1.6. experimental vessels, if they are not offered in later European Union market;
6.1.7. the vessels built for personal use, if for the next five years they will not be offered in the market of the European Union;
6.1.8. the vessels, which provide with the crew to perform the carriage of passengers;
6.1.9. underwater vessels;
6.1.10. the vessels to the air bag;
6.1.11. vessels with hydrofoils;
6.1.12. vessels whose engine uses steam energy plant by burning coal, coke, wood, oil or gas;
6.2. the following engine exhaust emissions: 6.2.1 propulsion engines installed or intended for installation: 6.2.1.1. shipping products intended exclusively for competition and which manufacturer is labelled accordingly;
6.2.1.2. pilot shipping when they later will not be at all in the European Union market;
6.2.1.3. the shipping products, with the crew for the commercial carriage of passengers;
6.2.1.4. submarine navigation products;
6.2.1.5. shipping products on air cushions;
6.2.1.6. shipping products with low water wings;
6.2.2. the original historical engines and their individual copies, of which the project was designed before 1950 and which were not produced in series and set this rule and 6.1.5.6.1.7. shipping referred to in media;
6.2.3. engines built for personal use if they are within five years (from commissioning) will not be offered in the market of the European Union;
6.3. the noise emissions: 6.3.1. all vessels referred to in paragraph 6.2. of these rules;
6.3.2. the vessels built for personal use if they are within five years (from commissioning) will not be offered to the European Union market. 7. 12.1.3. serial number;

12.1.5. the model year;
12.2. manufacturer's plate with the following information: 12.2.1. name of manufacturer;
12.2.2. the CE marking (annex 1) according to this provision the provisions of Chapter 9;
12.2.3. the category according to the rules laid down in point 10;
12.2.4. maximum load capacity stated by the manufacturer pursuant to paragraph 22 of these rules, except the built-in tank content when they are full;
12.2.5. the number of persons stated by the manufacturer, the carriage of which the ship is intended. 13. Depending on the category of the recreational craft shall be so constructed as to reduce the risk of falling overboard and facilitate boarding the ship. 14. The electrical system is designed and installed so as to ensure that all circuit protection against overload and short circuits, except engine starting circuits that use a battery. 39. The electrical system has ventilation to prevent the accumulation of gases that can be released from batteries. 40. The batteries are firmly secured and protected from water penetration. 41. the management system is designed, constructed and installed so as to ensure the management team putting the foreseeable operating conditions. 42. The engine shall be so designed, constructed and assembled so that after correct installation under normal working conditions the emissions do not exceed the allowable size (annex 2). 54. the engine manufacturer To prepare the necessary instructions and to add all new engines when they are first placed on the market before the endurance test (based on normal operating cycle of the engine) the engine manufacturer may obtain the relevant information to calculate engine fatigue. 55.2. water motorcycle engine: 350 hours or 5 years (if the engine is run at less than 350 hours);

55.3. uzkaram engines: 350 hours or 10 years (if the engine is run at less than 350 hours). 56. for each engine is added to the owner's manual in one of the languages of the European Union or its Member States in a specific language, in which the engine is offered in the market. The notified body 58. The notified body is independent and not controlled by neither the manufacturer nor the supplier. 61. This provision 60. the conditions referred to in paragraph 1 shall not preclude the possibility of exchanges of technical information between the manufacturer and the notified body. 62. The notified body shall have at its disposal the necessary human resources, financial resources and equipment, in order to be able to efficiently perform examination with the technical and administrative tasks. 63. the staff responsible for inspection shall comply with the following requirements: 39.2. appropriate technical and vocational education and training;
39.3. knowledge of the tests to be carried out and the test-taking experience;
63.3. design skills certificates, notes and reports, which are required to verify the tests. 64. the notified body shall ensure the impartiality of inspection staff. Staff remuneration does not depend on the number of tests or test results. 65. The notified body shall take out civil liability. 66. the staff of the notified body are obliged not to disclose the resultant professional activities of commercial information. 4. Recreational craft and their components of the structure of the market offering 67. The notified body shall take the necessary measures to ensure that the rules laid down in paragraph 3, the products are built and maintained according to the requirements, can offer the market and put into service according to its intended purpose only if they do not endanger the safety and health of persons, property or the environment. 68. Latvia is not prohibited, restricted or impeded the provision laid down in paragraph 3, the product offering on the market or putting into service If they are labelled with these rules specified in Chapter 9 and CE marking in conformity with the requirements of these provisions, including the conformity procedures set out in Chapter 7 of these rules. 69. in Latvia it is not prohibited, restricted or impeded the partly completed recreational craft of offering on the market, if the manufacturer, or his authorised representative established in the European Union, or person responsible for the placing on the market, in accordance with the provisions of paragraph 70, declares that the rest of the ship's construction will be completed. 70. 70.3. a statement that the partly completed construction of the vessel will be completed and that the ship complies with this construction applicable requirements. 71. in Latvia it is not prohibited, restricted or impeded the provision set out in section 7 of the construction component of the offering on the market and putting into service unless they are marked with the CE marking, is approved for compliance with the relevant essential requirements and these components are accompanied by a written declaration of conformity according to Chapter 10 of these rules, as well as where these components are intended to be incorporated in the rest of the ships in accordance with the provisions laid down in paragraph 70 of the Declaration submitted by the manufacturer, his authorized representative in the European Union or the person that these components offer the Latvian market. 72. Warranty conditions 75. 80.2. where non-compliance with the applicable standards for stability, free port and buoyancy, take the internal production control plus tests (module Aa) or CE sample test (module B), complemented with the test specimen (C module) or any such module: B + D, or B + E, or B + F, or G, or H. 81. Ckategorij the rest of the ships hull length from 12 to 24 metres take the sample test, CE (module B), complemented with the test specimen (C module) or any such module: B + D, or B + E, or B + F, or G, or H. 82. Category D recreational craft, hull length from 2.5 up to 24metr, take the internal production control (module A), or the internal production control plus tests (module Aa) or CE sample examination (module B) supplemented with the test specimen (C module) or any such module: B + D, or B + E, or B + F, or G, or H. 83. Recreational craft construction material using one of the following modules: B + C, or B + D, or B + F, or G, or H. One of these modules are also applicable: 83.1. pretaizdegšan equipment in all internal and rear engines;
51.7. protector against starting the engine when the gearbox is in neutral, all boarding engines;
83.3. corner rooms, steering mechanisms and cable assemblies;
83.4. fuel tanks and fuel hoses;
83.5. industrially produced hatches and scuttles. 84. A water bike, take the internal production control (module A), or the internal production control plus tests (module Aa) or the CE test sample (Bmodul), complemented with the test specimen (C module) or any such module: B + D, or B + E, or B + F, or G, or H. 85. Recreational craft with stern drive engines without integral exhausts or with inboard regarding noise emissions shall apply: 53.5. internal production control plus tests (module Aa) or module G or (H) module, where the test is carried out using the applicable standards for noise measurements; 86.2. internal production control (Amodul), or the internal production control plus tests (module Aa) or module G or H module when the estimate used for power/water-rate method, and the Frūd number ν-the speed of the ship; g — free fall acceleration; L: length of the vessel; 86.3. internal production control (module A), or the internal production control plus tests (module Aa) or module G or H module, if the assessment is used to refer to the ship's official data, established in accordance with this rule 86.1. section.

87. Water motorcycles, outboard engines and stern drive engines with integral exhaust which are intended for installation in recreation vehicles for noise emissions shall apply the internal production control (module A), or the internal production control plus tests (module Aa) or module G or H module. 7. Conformity assessment procedures 7.1. Internal production control (module A) 88. the manufacturer or his authorized representative in the European Union provide the products concerned are in conformity with the requirements of this regulation. Internal production control tests (module Aa, option 1) 93. Internal production control with the addition of Amodul to the test requires that the recreational craft shall take one or more tests for stability and buoyancy properties according to the requirements of these regulations or equivalent calculation or control. 94.93. These provisions the tests referred to in paragraph 1 or the equivalent calculation or control shall be carried out by the notified body chosen by the manufacturer. 95. One or more recreational vessels with integrated engine or engine with Z-shaped propeller driven without a single exhaust system and water motorcycles producer or on his behalf and selected by the manufacturer under the responsibility of the notified body carry out noise emission test. If one or more of the engines are tested, exhaust and noise emission conformity assessment (annex 4) to keep consistency. 96. One or more of the uzkaram engines and engines with Z-shaped Zen screw drive with single exhaust system engine producer or on his behalf and selected by the manufacturer under the responsibility of the notified body carries out noise emissions test as defined in section 2 of these regulations. If one or more of the engines are tested, exhaust and noise emission conformity assessment (annex 4) to maintain consistency. 97. If you test multiple engine manufacturer in order to verify the conformity of the sample comply with the provisions of annex 2 to these rules. 7.3. the CE test sample (module B) 98. The applicant shall place at the disposal of the notified body a specimen of the product (hereinafter sample). 101. The sample may cover several versions of the product provided that the differences between those versions do not affect the level of safety and the other requirements relating to a product. 102. If necessary, the notified body may request further samples, to carry out the test programme. 103. The technical documentation shall enable the conformity of the product with the requirements of this regulation. It includes (to the extent necessary for such assessment) product design, manufacture and operation of the description in accordance with the provisions of Chapter 8. 104. The notified body: 104.1. examine the technical documentation, verify that the model is built in accordance with the technical documentation and identify the components of the structure which are and which are not constructed in accordance with the applicable standards;
104.2. take appropriate and necessary tests to check whether the solutions adopted by the manufacturer meet the requirements of this regulation if the applicable standards have not been applied;
104.3. carry out appropriate inspections and tests necessary to check that the manufacturer's selected suitable standards are actually applied;

104.4. agree with the applicant on the inspection and verification of the required tests. 105. If the sample meets the requirements of these provisions, the notified body shall issue the applicant a CE certificate of inspection of the sample. The certificate shall contain the name and address of the manufacturer, conclusions of the examination, the conditions of validity and the information necessary to identify the approved sample. 106. The certificate is added to the relevant parts of the technical documentation. A copy shall be deposited at notified body that issued the certificate. 107. If the manufacturer is denied a sample certification, the notified body shall justify refusal to detail. 108. The applicant shall inform the notified body that holds the technical documentation concerning the CE examination certificate of the sample and of the changes to the approved product which requires additional approval where such changes may affect compliance with the requirements or conditions of use of the product described. Additional approval is given in the form of an addition to the CE examination certificate of the sample. 109. each notified body shall give the other notified bodies the necessary information on the CE sample examination certificates and certificates issued or refused the supplements. 110. The other notified bodies may receive CE sample inspection certifi cate and/or supplement it. The annexes to the certificates are available to the other notified bodies the Thai. 111. the manufacturer or his authorised representative shall keep the sample in CE examination certificate and its additions with the technical documentation a copy of at least ten years after the last product has been manufactured. 112. If the manufacturer or his authorized representative is not in the cou childhood, technical documentation, which markets the product in the European Union. 7.4 consistency (C module) 113. the manufacturer or his authorized representative in the European Union, ensures and declares that the products concerned conform to the pattern described in CE sample examination certificate and satisfy the requirements of this regulation. The CE marking is accompanied by the identification number of the notified body which has carried out this provision set out in paragraph 147. 119. the manufacturer shall ensure that the provisions laid down in sub-section 7.10 of the high quality of the system and abide by the rules set out in paragraph 147. 7.6. The product quality assurance (module E) 120. the manufacturer or his authorised representative shall affix the CE marking to each product and draw up a written declaration of conformity. The CE marking shall be accompanied by the identification number of the notified body responsible for surveillance. 121. the manufacturer of the finished product inspection and testing is used for transmit quality exhausted system. 122. the quality system assessment and product quality inspection in accordance with the provisions of this sub-section 7.10. 123. Each notified body must, on request, give the other notified bodies information on issued and withdrawn the approval of the quality system. 7.7. the product verification (module F) 124. This module describes the procedure whereby the manufacturer or his authorized representative in the European Union checks and attests that the products subject to the requirements of this regulation, shall conform to a model that describes the sample CE examination certificate and with the requirements of this regulation. 125. the manufacturer shall take necessary measures for the manufacturing process ensures conformity of the sample described CE sample examination certificate and with the requirements of this regulation. The manufacturer or his authorized representative in the European Union shall be marked with the CE mark to each product and draw up a declaration of conformity. 126. The notified body shall carry out appropriate inspections and tests to check the conformity with the requirements of this regulation. Check after the choice of the manufacturer: 126.1. examining and testing every product in accordance with the provisions of paragraph 128;
126.2. checking and testing the products by statistical methods in accordance with the provisions of article 129. 127. the manufacturer or his authorized representative shall keep a copy of the Declaration of conformity for at least 10 years after the last product has been manufactured. 128. the examination and testing of products: 128.1. the product individually examined and tests defined in example in rojamo standards, or equivalent tests, to ensure that the product is in conformity with the look game specified CE sample examination certificate and with the requirements of this regulation;

128.2. the notified body shall affix, or cause to be affixed, its identification manufacturer number to each approved product and draw up a written certificate of conformity concerning the tests carried out;
128.3. the manufacturer or his authorized representative shall ensure that the notified body's certificates of conformity issued available upon request. 129. statistical verification: 129.1. the manufacturer shall present his products as a uniform group and must do to make the manufacturing process ensure the uniformity of each group produced;
129.2. all products shall be available for inspection in a uniform group. Choose from each group. Samples of the product of the individual checks and tests set out in the applicable standards, or equivalent tests, to ensure that the product is in conformity with the requirements of this regulation and to determine whether the group is validated or rejected;
129.3. statistical inspection, the following elements: 129.3.1. statistical method;
129.3.2. sampling plan with a description of its implementation;
129.3.3. the exhaust and noise emission conformity assessment (annex 4);
129.3.4. gas emissions in conformity assessment (annex 4);
129.4. If product is approved, the notified body shall affix, or cause to be affixed, its identification manufacturer number to each product and draw up a written certificate of conformity relating to the tests carried out. All products in the group can offer the market, except those who were identified as non-compliant;
129.5. If product is rejected, the notified body or the consumer protection centre shall take appropriate measures to prevent the sale of this product on the market;
129.6. If the product group has been rejected several times, the notified body may cancel the results of statistical tests;
129.7. If a notified body's responsibility, the manufacturer may affix the notified body's identification number during the manufacturing process;
129.8. the manufacturer or his authorised representative shall, on request, be produced to the notified body's certificates of conformity issued. 7.8. the unit verification (module G) 130. This module describes the procedure whereby the manufacturer ensures and de klar, the product that is the subject of this provision, paragraph 132 a certificate meeting the requirements of this regulation. The manufacturer or his authorized representative in the European Union must affix the CE marking to the product and draw up a declaration of conformity. 131. the notified body shall examine and testing of every product as laid down in the applicable standards, or equivalent tests, to check the conformity of the products with the requirements of this regulation. 132. The notified body shall affix, or cause to be affixed, its identification manufacturer number to the approved product and shall draw up a certificate of conformity relating to the tests carried out. 133. The technical documentation shall enable the conformity of the product with the requirements of these provisions and provide an explanation of the product's design, manufacture and use. 7.9. Full quality assurance (module H) 134. This module describes the procedure whereby the manufacturer who fulfils the obligations listed in the rules, ensures and declares that the products concerned meet the requirements of these regulations applicable to them. The manufacturer or his authorized representative in the European Union must affix the CE marking to each product and draw up a written declaration of conformity. 135. The CE marking supplemented by the identification number of the notified body responsible for the provisions set out in paragraph 147. 136. the manufacturer shall ensure that rule 7.10. sub-chapter quality system with respect to the product's design, manufacture and final inspection and testing, as well as the supervision order is subject to the rules set out in paragraph 147. 7.10. the quality system 137. to evaluate the quality system, the manufacturer shall provide the notified body application, which shall include information on the expected products and quality system documentation, as well as, where appropriate, technical documentation and CE sample a copy of the inspection certificate. 138. the quality system shall ensure compliance of the products with the requirements of these provisions and the CE examination certificate of the sample. 139. the elements adopted by the manufacturer, the requirements and the conditions for systematic document, presenting them as written plans, procedures and instructions. 140. the quality system documentation shall ensure a quality policy, procedures, quality programmes, plans, manuals and protocols for common understanding. 141. the quality system documentation includes: 141.1. the quality system objectives and structure, responsibilities and powers of the management with regard to design and product quality;
141.2. technical specifications, including the standards which will be applied (if standards were not applied in full, the-features that will be used to ensure that requirements are met);
141.3. control and construction design examination technical take, process and across Member in activities relating to the product category;
141.4. the corresponding manufacturing, quality control and quality assurance techniques, related to the processes and systematic actions;
141.5. the examinations and tests that will be carried out before, during and after manufacture, and inspection and testing frequency;
141.6. quality records (such as inspection reports and test messages, kalib catches news, qualifications of the personnel concerned messages);

141.7. features the required design and product quality supervision, protection of and effective operation of the quality system. 142. The notified body shall assess the quality system to determine its compliance with this provision, 138, 139 and 140.141. point requirements and assumes that a quality system which implements the applicable standard, meets these requirements. 143. the conformity assessment expert team has at least one person with experience in the product technology concerned. The assessment procedure includes a visit to the manufacturer's premises. 144. the decision shall be notified to the manufacturer. Notification shall include testing and evaluation in conclusion you justification. 145. The manufacturer shall undertake to fulfil the obligations arising out of the approved quality system, and maintain the quality system adequate and efficacious. 146. the manufacturer or his authorized representative shall inform the notified body of any planned quality improvement of this system. The notified body shall evaluate the modifications proposed and decide whether the premium quality system complies with this rule 138., 139, 140 and 141.. point requirements or needs assessment. The notified body shall notify its decision to the manufacturer. The notification shall contain the conclusions of the examination and the grounds for the decision. 147. The notified body: 147.1. checks to make sure that the manufacturer duly fulfils the obligations arising out of the approved quality system;
147.2. periodically carry out audits to make sure that the manufacturer maintains and applies the quality system and provide the manufacturer with audit reports;
147.3. without warning can make the manufacturer's inspection. Such inspection the notified body may carry out tests or have them carried out, to check the quality of the system. The notified body must provide the manufacturer with an inspection report and, if a test has taken place, and the test results. 148. the notified body To perform the test, the manufacturer provides free access to it's design, manufacture, inspection, testing and storage locations and provide all required information including: 148.1. quality system documentation;
148.2. quality records, relating to the construction (the results of analyses, calculations, tests);
148.3. quality records that are related to the production (inspection reports, test and calibration results, qualifications of the personnel concerned ones). 149.10 years after the last product has been manufactured, keep at the manufacturer of such control bodies available documents: 149.1. the quality system documentation;
149.2. documentation on the quality system improvements;
149.3. notified body decisions and reports on quality system compliance with applicable standards, periodic audits and on the manufacturer additional tests. 150. Each notified body must, on request, give the other notified bodies information on issued and withdrawn the approval of the quality system. 8. The manufacturer's technical documentation submitted 151. Modules A, B, C, D, G and E referred to in the technical documentation includes information, and the way the manufacturer provides the constructive components of vessels and their compliance with the requirements. 152. technical documentation provides information about the product's design, manufacture, installation and operation and assess compliance with the requirements of this regulation. 153. in order to carry out the evaluation, the technical documentation includes: 153.1. General description of the sample;
153.2. conceptual and storyboard drawings of parts, assemblies, and other elements of the scheme, as well as the explanatory descriptions and instructions for use of the product;
153.3. list of applicable standards applied in full or in part, and descriptions of the solutions adopted to meet the requirements of this regulation if the applicable standards are not applied;
design and calculation of 153.4. results of checks;
153.5. test results or estimates regarding stability in accordance with the provisions of paragraph 17 of the conditions and buoyancy in accordance with the provisions of paragraph 18;
153.6 exhaust emission test protocol, showing compliance with this provision the requirements of Chapter 2;
153.7. noise emission test report or a reference to the ship's data, showing compliance with these rules in Chapter 2 requirements. 9. the CE marking 154. Recreational craft, water motorcycles, uzkaramo engines, engines with Z-shaped propeller drive with single exhaust system and the rules referred to in paragraph 7 of the design components which comply with this provision in paragraph 5 the requirements placed on the market, shall be marked with the CE marking. 155. the CE marking is located on the Recreation Board on water motorcycles and to this rule set out in section 7 of the design components and their packaging. The CE marking is clearly visible, legible and indelible. The CE marking is accompanied by the identification number of the notified body which has carried out of Aa, (D), (F), (G) and (H) the procedures in the module. 156. it is prohibited to place on the products listed in these rules marks or inscriptions which are likely to mislead third parties as to the meaning or form of the CE marking. Other signs can be placed on the products listed in these rules and their packaging provided that the visibility and legibility of the CE marking is not thereby reduced. 157. If a notified body establishes that the CE marking is positioned incorrectly, the manufacturer or his authorized representative in the European Union is obliged to end the infringement. 158. If further failure to comply with the requirements set out in these rules for the labelling of the product, the notified body shall take measures to limit or prohibit the placing on the market of such products, or to ensure that it is withdrawn from the market, subject to this provision in the chapter 4 requirements. 10. the written declaration of conformity for 159. The written declaration of conformity with the requirements of this regulation are located: 159.1. recreational craft and water motorcycle, and it's in the owner's manual;
159.2. This provision at paragraph 7 of the said ingredients;
159.3. at engine, and it is added to the owner's manual. 160. The written declaration of conformity shall include the following: 160.1. the manufacturer or his authorized representative in the European Union the name and address;
160.2. recreational craft, water motorcycle, or this rule 7, paragraph description of ingredients;
160.3. references to relevant applicable standards or references to instructions, in accordance with which conformity is declared;
160.4. If necessary, the reference to other legislation;

160.5. this information, if necessary for CE sample examination certificate issued by a notified body;
160.6. If necessary, the notified body name and address;
160.7. the data of the person, the signatory who has been empowered to represent producers in the European Union. 161. the written declaration of conformity is issued in one of the languages of the European Union or its Member States in a specific language, in which the engine is offered in the market. 162. with regard to the rules referred to in paragraph 64 of the engines in addition to the Declaration of conformity that rule 160. the information specified in point include a statement by the manufacturer that the engine exhaust emissions will correspond to the requirements of these regulations, if the engine is to be installed on recreational craft, in accordance with the manufacturer's instructions and added, if necessary, that this engine must not be put into service until the rest of the Board declared (in which it installed) compliance with the relevant provisions. 11.163. Market surveillance market surveillance authority under the national budget resources to fulfil consumer centres. Consumer rights protection Centre carries out the laws and measures to prevent the provision of inadequate recreational vessels and their equipment distribution market. 164. If the rest of the ship and its equipment, the manufacturer or his authorized representative in the European Union has not fulfilled the requirements laid down in these provisions, the trade of the product concerned is not permissible. 12. The final issue 165. Be declared unenforceable in the Cabinet's April 1, 2003, the provisions of no. 144 "rules on the rest of the shipbuilding, the assessment of conformity and placing on the market" (Latvian journal, 2003, nr. 53; 2004, nr. 68).
