Cabinet of Ministers Regulations No. 814, Riga 2005 October 25 (Mon. No 61 42) amendments to the Cabinet of Ministers on 9 June 1998 the Regulation No 217 "minimum safety requirements on the materials and articles in contact with food" Issued under the food surveillance article 10 of the law 1. make Cabinet June 9, 1998 regulations No. 217 "minimum safety requirements on the materials and articles in contact with food" (Latvian journal, 1998, nr. 174; 2003; 2004, nr. 14. No, 68; 2005, nr. 20) the following amendments: 1. to make paragraph 1 by the following: "1. this regulation lays down minimum safety requirements for materials and articles in contact with food (hereinafter referred to as materials and articles).";
1.2. the express 1.1 point as follows: "1.1 General requirements for materials and articles in contact with food, the European Parliament and of the Council of 27 October 2004, Regulation (EC) No 1935/2004 on materials and articles intended to come into contact with food and repealing directives 80/590/EEC and 89/109/EEC (hereinafter Regulation No 1935/2004).";
1.3. to supplement the provisions under point 1.2 in the following wording: "1.2 for use in the manufacture of materials and articles, substances other than those referred to in these regulations shall comply with Regulation No 1935/2004 the procedures laid down in article 9, in submitting the application the Latvian food centre. ';
1.4. the deletion of chapter II;
1.5. to supplement the provisions of the following paragraph 10.2: "10.2 using the manufacturing of materials and objects of additives permitted for use in Latvia as food additives or flavourings manufacturers ensure that their migration in food does not reach the quantities that have a technological function in the finished product, or exceed regulations on food additives and flavourings in defined quantities.";
1.6. the introductory part of paragraph 14 to express the following: "14. Plastic materials and articles in production allowed additives, including polymer additives (polymers and oligomers, prepolymers which can be added to plastics to achieve a technical effect but which alone without other polymers cannot be used on the finished material or article of the main ingredients), determine the provisions of annex 3. The additives used in the following: ";
1.7. the deletion of the words in paragraph 14.2. "(emulated the gator, surface active substances, buffer and other substances);
1.8. make 15.1. subparagraph by the following: "15.1. the substances which directly influence the formation of polymers, pigments and solvent process;";
1.9. the introductory part of paragraph 21, supplemented by the number "2." with a name and a number "and 3. ';
1.10. to make 30, 31 and 32 as follows: "30. Regenerated cellulose film is a thin layer of material obtained from refined cellulose derived from recycled wood or cotton. To get a specific film, technological characteristics, the production process and mass, both on the surface of various additives can be added, and regenerated cellulose film may refer to: 30.1. without coating;
30.2. the pulp;
30.3. with a plastic coating.
31. Regenerated cellulose film is a film, which is used as a material in contact with food or which form part of the material in contact with food. These provisions do not apply to synthetic regenerated cellulose protective cover.
32. Regenerated cellulose film with no coverage or coverage allowed the pulp produced only from the substances or groups of substances listed in annex 5 of these regulations, subject to the limits fixed in the annex, as well as substances used for painting (paints and pigments) or as adhesives, if validated chemical analysis show no migration of these substances in food or on its surface. ";
1.11. to supplement the provisions and paragraph 32.2 32.1 the following: 32.1 If "regenerated cellulose film for plastic coating, the coating to produce only from the substances or groups of substances referred to in this provision in chapter I of annex 5, subject to the limits fixed in the annex. Plastic coated regenerated cellulose film allowed to produce only from the substances or groups of substances in accordance with this provision, 2., 3., 2.1 and 3.1 of annex. On regenerated cellulose film with coating also apply this provision 9, 21, 22 and 23 above.

1.12. the deletion of paragraph 35, the words "possible quantity of cadmium and lead shall be determined in accordance with the national standard";
1.13. put 36 as follows: "36. Materials and articles for use in the food chain is controlled by the food and veterinary service.";
1.14. the deletion of paragraph 37, the words "as well as for this rule 25., 28, 34 and 35 above standards";
1.15. supplement with 45, 46, 47 and 48 of the following paragraph: "45. Plastic materials and articles which put up to 2 august 2005 and which contains AZODICARBONAMIDE as a blowing agent, can continue to propagate, if they are specified in the date of filling. The date of filling may be replaced by another indication, provided it allows you to define the date of filling. The news about the date of filling shall be provided, upon request, this provision 36. control authorities referred to in paragraph 1.
46. for materials and articles used in the manufacture of additives other than those referred to in annex 3 of these rules, but which is used in one of the European Union and European economic area Member States, the applicant shall submit the application to the Latvian food centre no later than December 1, 2006, pursuant to the provisions of Regulation No 1935/2004 the procedures laid down in article 9. Application in accordance with the 2001 December 19, "the European food safety authority for the submission of applications for the evaluation of the safety of the substances that are used before authorization of materials in contact with food" add data demonstrating the safety of the additive. The Latvian food Centre supports the presentation of the information received, the European food safety authority by 31 December 2006.
47. on 1 March 2006 banned manufacture and importation of plastic materials and articles intended to come into contact with foodstuffs and which does not meet the requirements of this regulation.
48. on 29 January, 2006. restricted to manufacture and import into the regenerated cellulose film materials and articles intended to come into contact with foodstuffs and which does not meet the requirements of this regulation. ";

1.16. Add to the informative reference to directives of the European Union with 13, 14 and 15 of the following paragraph: "13) Commission of 1 March 2004, Directive 2004/19/EC amending Directive 2002/72/EC relating to plastic materials and plastic articles intended to come into contact with foodstuffs;
14) Commission of 29 January 2004, Directive 2004/14/EC amending Directive 93/10/EEC relating to materials and articles made of regenerated cellulose film intended to come into contact with foodstuffs;
15) Commission on 6 January 2004, Directive 2004/1/EC amending Directive 2002/72/EC in respect of the use of azodicarbonamide as blowing agent. ";
