Cabinet of Ministers Regulations No. 836 in 2005 (November 1. No 63 47) rules on driving and rest time tracking digital equipment (tachograph) card issuance, cancellation and suspension of the time Issued in accordance with the law of road transport 5.1 of the first paragraph of article 6, paragraph i. General questions 1. determines the order in which the State limited liability company "road transport administration" (hereinafter referred to as the Directorate) issued, annulled or suspending the driving and rest time tracking digital recording equipment (digital tachograph) card according to the Council of 20 December 1985 to Regulation (EEC) No 3821/85 on recording equipment in in road transport, as amended (hereinafter Regulation No 3821/85). 2. the Directorate shall take a decision on the digital tachograph card (card): 2.1 first;
2.2. the renewal;
2.3.;
2.4. suspension or cancellation of the time;
2.5. denial of service. 3. the decision of the Executive may be challenged in the administrative process, the Ministry of transport regulatory laws. 4. the meaning of these provisions: 4.1 first card issuance is a card service: 4.1.1 first for a definite period of time under these rules referred to in paragraph 5;
4.1.2. If the previous card expires;
4.1.3. If the card previously issued in another country;
4.2. card renewal according to the type of card has its service: 4.2.1 if the card validity term is coming to an end. In this case, the application shall be submitted at least 15 working days before the expiry date of the card;
4.2.2. If you changed the card holder's personal or registration data;
4.3. card replacement service in until the card is the previous card expiration, if previously issued card is stolen or lost, or damaged, or doesn't function. 5. the Directorate shall issue such a card: 5.1. driver card (annex 1), identifying the drivers and is designed for the driving and rest periods for retention of data by running a vehicle equipped with a digital tachograph;
5.2. the company's card (annex 2) for the digital tachograph in the registered owner of the vehicle or of the holder's activity-related data to display, download, print, or lock to other transport means the owner or holder with them without consultation;
5.3. workshop card (annex 3) for verification of the digital tachograph, installation, repairs, calibration or to change the digital count down the Tagus, loading the data identifying the owner of a workshop card, for which the following authorized to perform;
5.4. Control card (annex 4) which is intended to control, read, print or download the digital count of the Tagus or driver card data collected. 6. the card is a credit card format (85 x 54 mm) with iestr in it and security elements and chip storing information according to the requirements of the Council of 24 September 1998 Regulation (EC) No 2135/98 amending Regulation (EEC) No 3821/85 on recording equipment in road transport and Directive 88/599/EEC concerning Regulation (EEC) No 3820/85 and (EEC) No 3821/85 (hereinafter Regulation No 2135/98) and the Commission of 13 June 2002 Regulation (EC) No 1360/2002 adapting for the seventh time to technical progress Council Regulation (EEC) No 3821/85 on recording equipment in road transport. 7. the driver card in accordance with the requirements laid down in Regulation No 2135/98 article 1, point 7 (b) of Regulation No 3821/85 shall be added to article 14 3 a) and 4 (a)), shall be issued only to persons who have a valid driver's licence, other than a driver's license, which allowed to drive only A 1 or category A vehicles. 8. the company's card is issued in Latvia registered the vehicle owner or holder, which has at least one vehicle equipped with a digital tachograph. For each vehicle owner or holder, making driving and rest time tracking with digital tachograph must have at least one valid company card. One owner may own a maximum of 62 valid business cards. Company card is issued for five years. 9. the workshop card shall be issued to a person working in the inspection body which is accredited by the national agency "Latvian National Accreditation Bureau" according to LVS EN ISO/IEC 17020:2005 standard "main criteria in different types of bodies performing inspection" requirements (workshop). The workshop card shall be issued for one year, and is responsible for its use of the workshop. 10. Control card issued by the control bodies in accordance with the laws on road transport control has the right to control drivers ' driving and rest periods and make it count. The control card shall be issued for a period of two years. II. procedure for requesting the card to get 11, restore or replace the driver, the driver shall provide the following document development and design regulations documents: 11.1. The application shall state: 11.1.1. name, surname, date and place of birth, social security number;

11.1.3. driver's license number and expiration date;
11.1.4. information about the driver previously issued and valid cards, if any, and the desired required driver card validity period start date;
11.2. a copy of the identity document, showing the original. If the person is not a permanent resident of the Republic of Latvia, shall submit a document proving the compliance with Regulation No 2135/98 article 1, point 7 (b) of Regulation No 3821/85 shall be added to article 14 (a)), paragraph 3 above;
11.3. valid driver's license, by presenting a copy of the original;
11.4. a photograph produced according to annex 5 of these regulations;
11.5. the replacement driver for the card, if the driver card is damaged or doesn't function;
11.6. law enforcement authorities issued a document that certifies that the driver card stolen, if the application is lodged a head of stolen card replacement;
7.3. a document showing the driver the exchange of personal data, if you filed an application for renewal of a driver card, since have changed;
11.8. the document certifying the payment of the first driver card issuance, renewal or replacement. 12. to receive, renew or replace the card company, transport means the owner or keeper shall submit the following documents and drafting relevant design regulations documents: 12.1. The application shall state: 12.1.1. applicant name and legal address;
12.1.2. the merchant's registration certificate number and date of registration, if the applicant is registered in a commercial register, or the taxpayer's registration number and the date of the licence, if the applicant is not registered in the commercial register;
12.1.3. officers who will be responsible for the compliance with the provisions on the use of the card (name and title);
12.1.4. for information on disposal of the applicant with the digital tachograph fitted a number of vehicles, as well as the previously issued to the applicant and the valid cards, if any, and the desired business card requested validity period start date;
12.2. the company card replaced if the company card damaged or not functioning;
12.3. law enforcement authorities issued a document that certifies that a company card stolen, if you filed an application for a replacement card stolen company;
12.4. a document certifying the applicant's data exchange fact, if you filed an application for the renewal of the card company, because the data of the applicant have changed;
12.5. a document certifying payment for the company's first card issuance, renewal or replacement. 13. to receive, renew or replace the card, garage, workshop Manager lodged the following document drafting and design regulations documents: 13.1. The application shall state: 13.1.1. the applicant's name and business address;
13.1.2. the merchant's registration certificate number and date of registration, if the applicant is registered in a commercial register, or the taxpayer's registration number and the date of the licence, if the applicant is not registered in the commercial register;
13.1.3. the employee's name and the position for which you are asked for the card;
13.1.4. information on the applicant or the employee has previously issued and valid cards, if any, and the desired workshop card requested validity period start date;
13.2. identity of the employee a copy of the document to which the card is being requested;
13.3. a copy of the document, in accordance with paragraph 9 of these regulations demonstrate that the workshop is accredited to perform actions with the digital tachograph (presentation of the original);
13.4. the copy of the document certifying the qualifications of the staff concerned to take action on the digital tachograph (presentation of the original);
13.5. the employee's photo, produced according to annex 5 of these regulations;
13.6. replaceable, if the workshop card workshop card damaged or not functioning;

8.5. the law enforcement authorities issued a document that certifies that the workshop card stolen, if you filed an application for the replacement of a workshop card been stolen;
8.6. a document certifying the applicant's or employee's data exchange fact, submission of an application for renewal of a workshop card, in a workshop or have changed employee data;
13.9. the document certifying the payment of the first workshop card issuance, renewal or replacement. 14. to prepare documents for decision about the company or workshop card first issuance, renewal or replacement of a Directorate administrative processes, regulatory laws duly obtained business register issued by the merchant copy of the registration certificate, if the applicant is registered in the commercial register, or the taxpayer a copy of the registration certificate, if the applicant is not registered in the commercial register. 15. a company or workshop card holder has the right to obtain and submit the same Directorate in this rule referred to in paragraph 14. 16. to receive, renew or replace the card, the control authorities shall submit to the Executive Head of the submission. The application shall indicate the number of cards needed and add: 16.1. Control card replaced if it is damaged or not functioning;
16.2. the law enforcement authorities issued a document showing that the control card stolen, if the application is submitted to the control card stolen replacement;
16.3. the document certifying the payment of the first control card issuance, renewal or replacement. 17. the application of the company or control card for renewal shall be submitted not earlier than six months and not later than 15 working days before the said card expiration date, but the driver card renewal — Regulation No 2135/98 article 1, point 8 b) in the first subparagraph within the time limit. 18. the application of restoration of a workshop card be submitted not earlier than two months and not later than 15 working days before the workshop card expiry date. 19. The application for the renewal of the card, if you have changed the person of the applicant or the registration data shall be submitted within 30 days after the exchange of the relevant data. 20. the application of lost, stolen, damaged or non-functioning company, workshop or control card replacement shall be made within seven days after the card is lost, stolen or in the days since the card does not function, but lost, stolen, damaged or not functioning driver card replacement — Regulation No 2135/98 article 1, point 8 b) in the second subparagraph within the time limit. III. Consideration of the application and issuance of the card 21. Submissions and documents accompanying the application shall be adopted by the Directorate, if contains all of the necessary information is submitted all the required documents and they are prepared according to the development and presentation of documents, regulatory requirements. 22. If, when examining the application, it is found that the information provided is different from the official registers or databases of information, including information that has been obtained from the European information system "TACHONE", which is a network for the exchange of information on driver cards issued (hereinafter referred to as the TACHONE network), the card shall not be issued and submitted documents are returned to the applicant explaining the reasons for the refusal. 23. to decide on the issue of the card, the Directorate shall have the right to request additional information on these rules 11, 12, 13 and 16 of the documents and information necessary for the issuing of the card. 24. the card must be issued by the Directorate: 24.1 15 working days after all necessary documents and information, if the received application for maps for the issue or renewal of the first;
24.2. within five working days after all necessary documents and information, if the application is lost, stolen, damaged or non-functioning company, workshop or control card replacement, but if the application is lost, stolen, damaged or not functioning driver card replacement — Regulation No 2135/98 article 1, point 7 (b) of Regulation No 3821/85 shall be added to article 14 (a), point 4) within the prescribed period. 25. If the day of receipt of the application for the replacement of the card until the card replaced expiration date left less than three months, the card is issued to a new term according to card type. 26. on receipt of the card, as well as the personal identification number (PIN) if the workshop card is issued, the holder shall present an identity document and signature confirming that they have received the card or the workshop card and envelope with the PIN code. 27. After the card holder's previous request, the card can be sent via registered mail. IV. Card terms of use 28. The card holder shall ensure that: 28.1. card is used only in Regulation No 3821/85 for the intended purposes;
28.2. card use is not supplied to any third party;
17.6. not use the card that has expired or has been damaged or not functioning;
28.4. the card is protected from high temperatures or strong electro magnetic field exposure, as well as from physical damage;
28.5. PIN code is not available to a third party. 29. If the owner of a workshop card forgot your PIN code or it became known to a third person, the Cardholder shall immediately submit an application for the workshop card replacement. 30. If the driver, company, workshop or control card stolen, the Cardholder shall immediately notify the Directorate for the protection of the rights and authority of the State where the card was stolen. Seven days after the theft detection card holder shall provide the Directorate said authorities statement and submission, if stolen, the workshop or control card, and Regulation No 2135/98 article 1, point 8 b) in the second subparagraph, the time limit laid down, the driver card if stolen. 31. If the driver, company, workshop or control card damaged or not functioning lost, the card holder shall immediately notify the Director and in accordance with the procedure laid down in these provisions within seven days of submitting the application, adding a written report on the possible cause of damage to the card or the circumstances of the loss, if damaged do not function, or lost business, workshop or control card, and Regulation No 2135/98 article 1, point 8 b) in the second subparagraph the period prescribed: If damaged, do not function or lost driver card. 32. If the workshop card stopped working relations with the relevant works or no longer meet the requirements to which the basis of the workshop card issued, the workshop immediately transmits the Directorate for this card. 33. After the termination of the workshop all received the workshop card shall immediately transmit to the Directorate. 34. The owner or keeper shall ensure that the information from digital tachographs, which are located in existing vehicles at its disposal, is downloaded at least once every three months, but their driver cards, which he employs, — at least every female. V. maps of the suspension or cancellation of the Directorate shall be entitled 35. to take a decision on the card at the time of the suspension or cancellation: 21.8. with regard to the driver's card — Regulation No 2135/98 article 1, point 7 (b) of Regulation No 3821/85 shall be added to article 14 (c)), 4 cases;
35.2. with regard to the company, workshop or control card if: 35.2.1. card holder provided false statements to get the company, workshops or control card;
35.2.2. map a fake or it used the person who is neither the owner nor the card user;
35.2.3. repeatedly infringed the company, workshops or control the use of the card. 36. The issue of the card at the time of the suspension or cancellation of the Directorate looks, inviting the card owner. The card owner seven days before the meeting informed of the nature of the infringement. In the absence of the card owner to sitting may not give rise to proceedings before a suspension. 37. The term of validity of the card may be suspended for a period of up to three months, if the card holder has violated the terms of use of the card. 38. The card holder shall map Directorate for 15dien after receipt of the decision of the Directorate of the card at the time of the suspension or cancellation. 39. If the card expiration date, including temporarily suspended from the days when card passed to the Directorate. Vi. Card accounts and storing information Directorate consists of 40 cards issued tracking database (hereinafter database), subject to the individual data protection law and other laws and regulations on the physical protection of personal data and process to ensure Latvian and foreign competent authorities with information about the cards issued. 41. the Directorate provides: 41.1. secure information submitted by the applicant, without the card and PIN code;
41.2. a continuous exchange of information TACHONE the network and the network of Regulation No 3821/85. 42. all non-valid card is destroyed, and the Directorate shall draw up a report on it. 43. The card is considered invalid if: 43.1. expired card expires;
