The eleventh article-disputes any dispute concerning the interpretation or application of this MOU, counselling towards as the lowest level members only and not directed at any third party. The twelfth article-entry into force, duration, amendment and termination 12.1 This MOU shall enter into force when it is signed by at least 3 members. The MOU shall enter into force with respect to each of the other participants in the day of the participant concerned have signed this MOU. 12.2. States which are not parties to this MOU, and expressed a desire to visit the training "Cold response 2006" after this MOU is entered into force, are invited to join SM, applying the statement of accession (PP) or the intention of the Protocol (WIP) procedure. 12.3. This MOU may be amended at any time by the mutual written consent of the participants. Amendments shall enter into force on the date of receipt of the last written approval. 12.4. To all participants of the mutual written agreement of this MOU may be terminated at any time. Any Member may withdraw from this MOU by written notice to the Norwegian Ministry of defence two months in advance. Termination of this MOU, or withdrawal from, does not release members of their commitment that developed or which undertook during the implementation of this MOU. 12.5. this MOU shall remain in force until such time as all the staff who participated in training "Cold response 2006" is removed from the territory of Norway and has settled all financial and legal obligations. 12.6. Any outstanding financial obligations and/or commitments relating to security measures, are required to pass regardless of the termination of this MOU. This MOU has been prepared for 1 (one) original copy, in the English language. Members distributed a certified copy of this MOU with all the signatures. The main principle is the scaleabl approach of a multinational expeditionary force in to meet assigned missions and other requirements. Since the scope of the exercise goes beyond the NATO response force (NRF) concept, some Of the ners have been invited to participat (menu Rngton Line4), establish the written principles for the execution of the exercise Cold response which will take place in Norway in 2006, Recognising that the Participants in the exercise Cold response 2006, hereafter referred to as the exercise, will consis of members of NATO and other States Participating in the Partnership for peace , Having regard to the provision of the agreement between the parties to the North Atlantic Treaty regarding the status of their forces (NATO sofa) dated 19th June 1951. Having regard to the provision of the agreement among the State parties to the North Atlantic Treaty and the Other States Participating in the Partnership for peace regarding the status of their forces dated 19 June 1995 (PfP sofa). Having also regard to the Additional Protocol to the agreement among the States parties to the North Atlantic Treaty and the Other States participating in the Programme regarding the status of their forces, done in Brussels on 19 June 1995, have reached the following understanding: SECTION one-DEFINITION As a general rule, the terms used in the document should refer to NATO, and be defined as in the , the NATO Glossary of terms and definition (AAP-6). For the purpose of this memorandum of Understanding (MOU) and its supporting documents, the following terms used in the host Nation support (HNS) planning process with a defined below: 1.1. Host Nation (HN): (A) nation, which receive the forces and/or supplies of allied forces and organisations, located on, operating in, or transiting through its territory. 1.2. the Sending Nation (SN): deploying A nation or other element forces, supplies, equipment and requesting host nation support for the exercise. 1.3. Host Nation support (HNS): the civil and military assistance rendered in peace, emergencies, crisis and conflict by (a) the host nation in their allied forces and organisations which are located on, operating in or transiting through the host nation's territory, territorial waters or airspac. 1.4. Logistics: the science of planning and carrying out the movement and maintenance of forces. In its most comprehensive sense, the aspects of military operations which deal with: (i) Design and development, acquisition, storage, transport, distribution, maintenance, evacuation and disposition of materiel; (ii) transport of personnel. (iii) Acquisition or construction, maintenance, operation and disposition of facilities. (iv) Acquisition of services or furnishings. (v) Medical and health service support. 1.5. Technical (TA): Through A written document for a specific operation or exercise. It provides the concept, responsibilities, procedures and the detailed financial and legal aspects for the provision of HNS by the HN to the SN/NATO Commander. The TA supplements the MO and supports the development of the concise Jia (s). 1.6. Joint Implementation (JI) Through: (A) the follow-on through the that establish the commitment between DSB's or NATO with the HN element concerning the provision and receipt of HNS. It includes detailed information on the required and offered support, site-specific procedures for implementation and reimbursemen or payment terms. 1.7. Nato Commander: (A) the military commander in the NATO chain of command. 1.8. Note of Accession (FROM): (A) A document indicating the intent of a SN subject for the participat in the HNS under the provision of the HNS MOU and/or a for a specified exercise or operations. Format to be used-see AJP 4.5 (A). 1.9. the statement of requirement (SOR): A document prepared by the DSB's and/or NATO commander, detailing forces and equipment to be deployed and related facilities, supplies and services required. 1.10. Statement of intent (SOI): (A) A document indicating the SN's intent to participat in arrangements for the HNS under the provision of the HNS MOU and/or a for a specified NATO operations but subject to certain specific reservations. The HN will confirm or not the whethers reservations with a acceptabl ... SECTION two-purpose AND scope 2.1. The purpose of this MOU is to establish written principles on command and control, force protection, logistics, financial and legal aspects concerning the execution of the exercise Cold response 2006 2.2. This MOU is not intended to conflict with national or international law or any existing agreements between any of the participants. Should any such conflict, national and international law will occure prevails. Conflicts with existing agreements will be solved between the participants concerned. The participants will notify each other in the event of any conflict. 2.3. the TA Subordinat (s) and JI (s) will be concluded between the HN and SN for further detailing of this MOU. SECTION three-the COMMAND AND CONTROL Chief of defence Nor is the Officer Scheduling the exercise (s). Commander National Joint Headquarters is the Officer Conducting the exercise (OCE). Participating units and individual will remain under the Full Command of their national authorities, retaining normal chain of command the national. Operational Control of the participating units will be assigned to the individual and their Commander National Joint Headquarters (COMNJHQ) for the duration of the exercise. Further instructions on the transfer of authority and delegation of command will be detailed in exercise Planning Instruction (EXP) and exercise the OPLAN. SECTION FOUR-force PROTECTION comprehensive and effective force Protection (FP) will be planned for the exercise, and will be detailed in the OPLAN, EXP or supplementary agreements, as appropriate. FP will be implemented in accordanc with NATO policy and procedures and in a manner consistent with the NATO or the PfP sofa. The under of the FP will circumstanc required-or to the contrary, be provided by NATO or the PfP sofa or HN law. As appropriate, the HN will inform the NATO Commander of DSB and its proposed measure FPS, limitations and restriction. As appropriate, each SN is responsible for identifying and providing it for FP requirements and limitations to the HN SECTION five-responsibilities of the VISHNU will: (i) direct the HNS effort under the MOU level. (ii) Chair for the joint host Nation support Steering Committee (JHNSSC). (iii) Develop detailed concepts supervis HNS and the development and execution of the subject. subordinat (iv) procedures to comply with the direct tax exemption policies. (v) Line support and participat in joint site survey. (vi) provides the support required, in accordanc with this MOU and subordinat is subject. The SN's will: (i) the HNS Participat in the process through the JHNSSC. (ii) Identify the HNS requirements to the HN through the SORT and site visit process. (iii) Comply with the provision of "axis by the HN prerequisite for receiving the HNS. (iv) to the authority the selected national representatives to the subject of the conclud subordinat this MO. (v) the Reimburs HN for the support received in accordanc with the provision of the subject. subordinat (vi) In the case of direct contracting, with the responsible of the DSB's for proper and timely contracting and co-ordination with the HN contracting POC. SECTION SIX – LOGISTICS support the framework and procedures for logistics support to put down in the reference documents, emphasising the multinational logistics arrangements in support of an expeditionary force. Each participant is in principle is responsible for its own logistics support. Participants being a member of NATO will be prepared to attend multinational logistics arrangements to make it possible to exercise the NRF logistics concept. However, the HNS will be provided by appointed host units (HU) as stated and the SN's detailed in TA (s) and JI (s) subordinat to this MOU. SECTION SEVEN – finance 7.1. Should a conflict involving the national law of a participant to occure in relations to any financial obligation, this participant will without delay notify the participant the benefiting from the obligation. The participants involved will resolve the matter through mutual consultation. 7.2. For any logistics support, supplies or services which are not provided free of charge in accordanc with relevant arrangements for including and the the STANAG 3113 subordinat TA, the HN and the DSB may not gotiat for payment either in cash in the currency specified by the HN (a "reimbursabl transactions"); replacement-in-kind (an "Exchange transaction"); or payment in the "equal value" to be defined in monetary terms only. Accordingly, the DSB will pay the HN in conformance with the relevant provision for each type of transaction detailed in sub paragraphs (a), (b) and (c) below as well as the more general provision is stated in the remainder of this Section. a. Reimbursabl transactions. The DSB will pay outstanding balance from the later than SIXTY (60) days after receipt of invoice. In pricing reimbursabl transactions, the participants will observe the following principles: (i) the responsible representative of the SN and authorities will not gotiat HN a price not including charges excluded below. (ii) When a definitive price is not negotiated in advance of the order, the order will set forth a maximum limitations of liability for the SN who will be ordering the logistics support, supplies or services, pending negotiation of a final price. The relevant authorities of the participants will promptly enter into negotiation to establish a final price, which may under certain of the 12 initial circumstanc maximum limitations of liability. The burden of justifying the increase will rest with the Participant to seeking it exceeds 100 the maximum. In the event that the relevant authorities of the participants have difficulty in a final price, gotiating they may consider replacement-in-kind. (iii) At the time the not settled accounts ither Participant will make or retain any profit resulting from the transactions being settled. (iv) In the case of specific acquisition by the HN from local contractors on behalf of the SNA, the cost will be less than a favourabl from the price charged to the HN forces for identical support, supplies and services in any non excluded below TEU. However, the price charged may take into account the differential due to delivery schedules, points of delivery and other similar considerations. (v) In the case of transfer from the HN's own resources, the amount paid by the DSB for logistics support, supplies and services provides will be the same charges its own HN forces as of the date the order is accepted. b. exchange transactions. The DSB will pay the HN military authorities in kind by transferring logistics support, supplies or services that are identical or substantially similar to those which are delivered or performed and satisfactory to the HN military authorities. If the DSB cannot pay in kind within the terms of a replacement schedule in effect at the time of the original transaction, the transaction may, by mutual consent, be deemed a reimbursabl transactions and governed by sub paragraph (a) above, except the that the price will be based upon the date on which the pay men in kind was scheduled to take place. c. Equal value. The term "equal value" means logistics support, supplies or services defined in monetary terms using actual or estimated prices in effect at the time a transaction is approved. The DSB will pay the HN military authorities by transferring logistics support, supplies or services that are equal in value to those which are delivered or performed and satisfactory to the HN military authorities. If the SNA does not pay in "equal value" within the terms of an Exchange schedule in effect at the time of the original transaction with time frames, which do not exceeds 100 three months from the date of the original transaction, the transaction will be deemed a reimbursabl transactions and governed by sub paragraph (a) above. 7.3. the Contractual guidelines. a. In fulfilling their co-ordination role with respect to facilitating supply from commercial sources, the HN military authorities will not obtain services or commit to any commercial contracts on behalf of the DSB unless the latter have specifically consented to accept the services, supplies etc, and also have consented to pay a specified cost for them. b. All services and supplies from commercial sources will be based upon a formal contractual arrangements. Such contracts may benefit from any existing contracts and/or agreements valid for the if deemed appropriate and acceptabl HN by the DSB. c. will not take any responsibility TAKEN for contracts or special arrangements between two or more SNA's. 7.4. Both the SNA and the HN military authorities will maintain records of all transactions. The Command HQ for the HN's units involved in the provision of support to the overall responsibility of the DSB will undertak for the relevant accounting procedures and the maintenance of ensur HN records of all transactions. 7.5. Invoices for the provision of logistics support, supplies or services will take the form of Annex B of STANAG 2034; will refer to this MOU as well as to any applicable order number. Invoices will be accompanied by evidence of receipt by the SNA and to be settled locally through the detailed arrangements either in the Jia or sent to the designated finance agency from DSB later than 30 days from the date that the logistics support, supplies or services were provided to those forces. The invoices will itemis the charges for the various logistics support, supplies or services being billed. 7.6. The SNA will normally pay for supplies, equipment or services from commercial sources such as food, vehicle hire, laundry, medical etc. prior to departure from the territory, unless the HNS's contractually determined otherwise or unless a dispute regarding cost or receipt of services exists. In the case of the latter situation arising, every effort will be made to resolve the dispute as soon as possible in order to the settlements of accounts expedit. Subject to availability, the CWD may offer the SN's personnels with messing and accommodation to the same standard and cost as would be provided to members of the HN. 7.7. The DSB will not retransfer logistics support, supplies or services, either OK or permanent it another nation or organisation without the written consent of the HN. 7.8. Insofar as existing laws, regulations and international agreements permit, the HN Government will ensur that taxes, customs duties and similar charges not be imposed. In accordanc with NATO/PfP sofa, taxes, customs or duties will not be imposed on petrol, oil and lubricant and exemption from road-toll will be provided. In addition, grant tax exemption for CWD food purchased from marine store dealers as well as beer, mineral-and soda water purchased directly from breweries. HNS will provide the DSB with applicable procedures and forms, and will provide information on available marine store dealer and breweries. Where taxes, customs duties and similar charges are payable, they will be administered by the HN in the manner most satisfactory favourabl to the execution of the subject is described in this MOU. 4.9. Further detailed financial arrangements, including those for settlement of accounts will be specified, as appropriate in the TA and Jia (s) supporting this MOU for the exercise or training activity in question. SECTION eight-status AND JURISDICTION the NATO sofa and the PfP sofa will govern the legal status of the sending nation and their personnel when present on Norwegian territory with the purpose of participating in exercise Cold response 2006, including activities directly related to the pre-exercise and post exercise deployment redeployment. SECTION nine-claims claims not covered by the NATO sofa and the PfP sofa will be deal by the participants involved, and will be settled on a case-by-case basis. SECTION TEN 10.1 All classifieds-SECURITY information exchanged or generated in connection with the exercise will be used, transmitted, stored, handled and safeguarded in accordanc with the participants national security laws and regulations, including relevant bilateral security agreements-between the various participants-CM (2002) 49 regarding the security relations between the NATO States. 10.2. Each Participant will take all lawful steps to ensur that information provided or generated in connection with the exercise is protected from further disclosure unless the originating Participant to consent to such disclosure. 10.3. The participants will take all lawful steps to investigat all cases in which it is known or here there are grounds for suspecting that classified information generated in connection with this exercise has been lost or disclosed to unauthorized persons or entities. The participants will inform the other participants of the details of such cases. SECTION ELEVEN-of Any DISPUTE regarding the interpretation dispute or implementation of this MOU will be resolved exclusively between the participants at the lowest possible level through consultation and will not be referred to any third party for settlement. SECTION twelve – ENTRY into effect, DURATION, AMENDMENTS AND TERMINATION 12.1 this MOU will enter into effect when signed by at least 3 of the participants. The MOU will be valid for each of the remaining participants on the data of their respectiv signatures. 12.2. the Nations not mentioned as participants to this MOU, that want to attend exercise Cold response 2006 after the MOU has entered into effect, is invited to accede to the MOU by a note of Accession (a) or (a) the statement of intent (SOI). 12.3. This MOU may be amended at any time by mutual written consent of the participants. Amendments will enter into effect on the date of the last written approval. 12.4. This MOU may be terminated at any time by mutual written consent of the participants. Any of the participants may withdraw from this MOU by giving two days written notice to the Ministry of defence of the Kingdom of Norway. (A) the termination of or withdrawals from the MOU does not clear from any liabilit participants to created or contracted during its application. 12.5. This MOU will remain in effect until all personnel participating in exercise Cold response 2006 have been redeployed from Norwegian territory and all financial and legal obligations will have been settled. 12.6. Any outstanding financial obligations and/or obligation regarding the subject of security will be fulfilled notwithstanding the termination of this MOU.
