The Ministry of Agriculture presented version of annex 1 of the Cabinet of Ministers of 2 May 2006, regulations no 350 preface open project submission contest guidelines (the guidelines) are designed to help you apply for the structural funds of the European Union-fisheries financial instrument for funding.
The Latvian Government has developed the single programming document (SPD-) which defines the strategy and priorities for social ālekonomisk the improvement of the situation in the country 2004-2006 programming period and the single programming document for the programme complement (hereinafter also-PP), which is the implementation of the structural funds of the European Union's basic documents in Latvia in 2004-2006. Before applying to the structural funds of the European Union and the State budget funding (structural funds), it is recommended to familiarize yourself with both the planning documents.
The guidelines are: 1) provides information to help you apply for funding by the structural funds of the European Union;
2) explain the single programming document priorities, measures and activities that are to be imported into Latvia;
3) explain the basic requirements that must be followed when applying for the funding of the structural funds.

The situation of the European Union structural funds, one of the main guiding principles of the Union's regional policy is a tool for the implementation of the structural funds. The whole territory of Latvia in the EU structural funds objectives are aligned with the Objectives of the Division 1 region, where per capita GDP is below 75% of the average level of the EU Member States.
Objective 1 areas such the structural funds of the European Union: 1. European Regional Development Fund (ERDF).
The ERDF aims to provide support to the regional gap, with the participation of the regions lagging behind in development and structural alignment, as well as the industrial transformation of the regions that the condition worsens;
2. the European Social Fund (hereafter ESF).
The ESF aims to eradicate discrimination and inequality in the labour market, to support the development of human resources, to promote the information society;
3. the European agricultural guidance and guarantee fund (EAGGF).
EAGGF objective is to support the restructuring of agriculture and contribute to rural development;
4. Financial instrument for fisheries guidance (FIFG).
The FIFG aims to ensure the structural measures in the fisheries and aquaculture sectors, as well as fishery products processing industry and trade.

Field support service (LADA) is a second-level intermediate, which is administered by the measures financed from the EAGGF and FIFG.
 
1.3. The FIFG measures co-financed by the and a description of the activities co-financed measures the FIFG and the objective of these activities is to support the development of the fisheries sector, including both the fishery and aquaculture and fish processing. Measures co-financed by the FIFG are focused mainly on the adaptation of the fishing fleet capacity to the available fish resources, as well as to the restructuring of the fleet according to the shipping and safety requirements. The FIFG supported measures are in accordance with the fisheries industry trends and directions.
Measures co-financed by the FIFG and the activities provided to balance the capacity of the fishing fleet to available fish resources, develop high-quality and high-value-added products, to develop the fish processing sector and bring its competitiveness in the European Union and the international market, improve port infrastructure, particularly by improving fish unloading and storage conditions, the development of the aquaculture sector and to improve the socio-economic conditions in the fisheries sector.
Measures co-financed by the FIFG: 1) weighting of fishing effort (this measure is 43.6% of the structural funds allocated for public funding);
2) fleet renewal and modernisation of fishing vessels (2.8%); 3) fisheries and aquaculture product processing and marketing improvement, fishing port facilities and aquaculture (43.1%); 4) coastal fisheries development, socio-economic measures, support for temporary cessation of fishing activities and other financial compensation, the acquisition of new markets and support for producer organisations (10.5%).
To ensure maximum complementarity effect, measures are planned in the process of coordination also with the measures to be financed by the ERDF (port facilities available to the public, marketing and export promotion activities, etc.) and the ESF (fishermen's retraining).
 
1.4. activities "in the Baltic Sea and the Gulf of Riga behind coastal fishing vessels, the transfer of the Division to the non-profit purposes or for use outside the fishery" justification and apraksts1 activity provides the total fishing fleet capacity reduction because there is a problem of fish stocks from year to year the quota reduction is manifested in the Baltic Sea, particularly cod, herring and sprat, which is one of the few fish species, fishing in Latvian fishermen. Developing the project submissions, the following should be taken into account in EU and national policy documents in the field: 1. the single programming document;

3. European Union legislation: · Council of 21 June 1999, Regulation (EC) No 1260/1999 laying down general provisions on the structural funds;

· The Commission of 8 November 2000, the Regulation (EC) No 1685/2000 laying down detailed rules for the implementation of Council Regulation (EC) No 1260/1999 as regards eligibility of expenditure of operations co-financed by the structural funds; Commission on 10 March 2004, Regulation (EC) no 448/2004 amending Regulation (EC) No 1685/2000 laying down detailed rules for the implementation of Council Regulation (EC) No 1260/1999 as regards eligibility of expenditure of operations co-financed by the structural funds, and repealing Regulation (EC) no 1145/2003; · Council of 21 June 1999, Regulation (EC) no 1263/1999 on the financial instrument for fisheries guidance; · 1999 of the Council of 17 December, Regulation (EC) No 2792/1999 laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector; Council of 20 December 2002, Regulation (EC) No 2369/2002 amending Regulation (EC) No 2792/1999 laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector; Council of 28 January 2002, Regulation (EC) No 179/2002 amending Regulation (EC) No 2792/1999 laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector; Council of 28 June 2001 of Regulation (EC) no 1451/2001 amending Regulation (EC) No 2792/1999 laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector; Council of 19 July 2004, Regulation (EC) no 1421/2004 amending Regulation (EC) No 2792/1999 laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector; Commission of 30 May 2000, the Regulation (EC) No 1159/2000 on information and publicity measures to be taken by the Member States concerning assistance from the structural funds;
4. the Republic of Latvia regulatory enactments.
 
1.5. Available funds available within the activity of public funding is allocated from the FIFG and the national budget resources under the single programming document, the amount of funding provided for under the FIFG Steering Committee approved the allocation of available financial resources.
The total amount of public funding available for the event "balancing" fishing effort "of the activity in the Baltic Sea and the Gulf of Riga behind coastal fishing vessels, the transfer of the Division to the non-profit purposes or for use outside the fishery" is posted on the website www.lad.gov.lv and the LADIES of the Ministry of Finance created the website www.esfondi.lv.
 
The maximum amount of the projects: measure the structural funds provided for funding for each fishing vessel owner in this programming period can be given only once per fishing vessel and does not exceed the maximum specified in the calculation table.

4. for all the above amount of funding received by the structural funds the allocated as aid for the fishing vessel owner in cases of temporary suspension of these priorities within the one year period prior to the application of the project.
 
Calculation example: to calculate the amount of funding, you first need to determine in which of the six categories the vessel. For example, the second category includes those vessels with a gross tonnage of 10 and 25 (not including) tonnes (table square brackets means that a number falls within a given category, but the round brackets means that the figure does not include the given category). So the amount of funding varies depending on the vessel's gross tonnage. This means that if the disposal of the ship's gross tonnage, for example, 15 tonnes, the amount of funding are: + 62 000 5 000 15 000 euro Calculated in 137 Financing = amount is the maximum to which the applicant may be eligible for the project. Analogy can also calculate the amount of funding received by other vessels of gross tonnage.
But the maximum amount shall be reduced by 1.5% for each 1 year over 15 years, if the vessel is from 20 to 29 years old. Structural Funds project applicant project applicants to this activity is a Latvian ship registry and registered in the Ministry of agriculture in national fisheries management (VZP) fishing vessels included in the list of owners of fishing vessels.
Fishing vessels may be written off if the fishery company or the individual merchant vessels in each of the previous two full calendar years prior to the application of the project have been involved in fishing activities for at least 75 days.
The project applicant is responsible for all the work on the project.
Not be eligible for funding for people who: • has been declared insolvent, is wound up, the economic activity is paused or stopped, or of legal proceedings for winding up, insolvency or bankruptcy;
• with the current decision, which is not possible on appeal, found guilty of fraud, bribery, a crime linked to corruption, as well as the involvement of criminal organisations, or other illegal activities, which affected the Republic of Latvia or the financial interests of the European Community and a criminal record is not deleted or removed;
• perfect professional misconduct, and there is a decision in force, which are found guilty of offences in connection with their professional activities;
• have not fulfilled obligations relating to the payment of taxes and the tax debts in Latvia or any other country where it is registered;
• has failed to fulfil its obligations in relation to the State social insurance contributions and is the country's social security payment shows in Latvia or any other country where it is registered;
• breached the conditions of the contract, the non-fulfilment of treaty obligations, which closed with the LADIES or other contracting authorities within the European Community;
• perfect misrepresentation in supplying the information relating to the information to be submitted, which is a precondition for participation in the project proposals;
• attempt to obtain confidential information in your possession or affect the Evaluation Commission or contracting institution project tender evaluation.
 
2.2. Project activities in This project can be implemented in the territory of the EU countries.
Activities funded under the Baltic Sea and the Gulf of Riga behind coastal fishing vessels, the transfer of the Division to the non-profit purposes or for use outside the fishery.
 
Financing conditions: • fishing vessel must be at least 20 years old (under construction);
• Fishing vessels must be registered to the same owner for at least 2 years prior to the submission of the project;
• The funding of the structural funds can qualify only the owner of the fishing vessel which has entered into a lease fishing rights;
• Fishing vessels can be divided (t.sk. cut scrapping) or released for use for other purposes outside the fishery only in EU Member States and must have a contract with a company to conduct a fishing vessel for the Division or company/institution that will be passed to the ship for use in non-profit purposes outside the fishery;
• Fishing vessels are scrapped with public funding, could not be replaced by another fishing vessel;
• Written off the fishing vessel owner whose property is only one fishing vessel can not replace it with another fishing vessel or continue to fish with leased vessel/s;
• Fishing vessel Scrapped the repeals fishing licence.
 
Project implementation period end date of project activities is no later than august 31, 2008, at the request of the structural funds, the final deadline for payment shall be no later than 15 September 2008.

2.3. the costs

Structural funding is awarded only for project submissions set out in these guidelines on eligible costs. Project submissions will be considered for funding by the structural funds, having regard to the draft submitted by the applicant, the application and supporting documents.
 
Eligible costs: in the Baltic Sea and the Gulf of Riga behind coastal fishing vessels, the transfer of the Division to the non-profit purposes or for use outside the fishery: 1. Compensation for the Baltic Sea and the Gulf of Riga fishing behind the coastal areas the transfer of fishing vessels, including the scrapping of the Division, cutting into pieces;

Other means (fax or email) or to another address sent to project submissions will be rejected.
 
3.2. the deadline for project submissions will be accepted 1 month after LADA official notification newspaper "journal".
The adoption of project submissions will be terminated after notification in the LADIES ' Journal of Latvia ".

4. Evaluation and selection 4.1 administrative compliance with the submission of the project received a LADA. The purpose of administrative compliance is to check that the project is complete and the application targeted for further evaluation.
If the application of the draft structural funds does not meet the project's administrative application evaluation criteria (table 2), Paris, France is entitled once in writing to request additional information to clarify the application of the project (in accordance with the management of the structural funds of the European Union Act 22. p.). Decision on the rejection of the project application can be accepted for the following reasons: • the project does not meet the program's criteria;

• If the total funding is spent;

The decision on the refusal of the application is final, but the project, the applicant is entitled to lodge a complaint.

4) undertakes to store and need to show all project and its implementation and monitoring of the related documentation and information (project application with supporting documents, the demand of the structural funds and related documentation, reports on the implementation of the project, a project of the financial activities of the applicant, documents, etc.), as well as agree to controls, which in relation to the project and its implementation and monitoring will be carried out by Latvia and the European Union institutions (European Commission, LADA, etc.) before approving a project, the representatives during the implementation of the project and 5 years from the last payment;
5) the implementation of the measures provided for in the draft will not be launched before the conclusion of the contract with the LADIES;
6) documents the information provided is true. The project, the applicant is informed that providing false information will be excluded from the circle of beneficiaries of the structural funds up to 2 years;
7) the project will be implemented within the time provided for in the project. The project, the applicant is informed that the project does not comply with the prescribed time, the contract will be terminated;
8) does not make any changes to the project without matching them with the LADIES;
9) undertakes to report on each project phase;
10) is declared bankrupt, is wound up, the economic activity is not paused or stopped or not started proceedings for winding up, insolvency or bankruptcy;
11) in the absence of any decision on the project, the applicant has been guilty of fraud, bribery, a crime linked to corruption, as well as the involvement of criminal organisations, or other illegal activities, which affected the Republic of Latvia or the financial interests of the European Community, and a criminal record is not deleted or removed;
12) no professional misconduct and does not exist in the current decision, with which the project applicant is found guilty of the offence in connection with their professional activities;
13) has fulfilled all obligations relating to the payment of taxes and no tax liability in Latvia or any other country in which the applicant is established in the project;
14) has complied with the obligations in relation to the State social insurance contributions and is not a State social security payment shows in Latvia or any other country in which the applicant is established in the project;
15) has broken the conditions of the contract, the non-fulfilment of treaty obligations, which closed with the LADIES or other contracting authorities within the European Community;
16) not provided deliberately false information (News), as well as not concealed information (messages) in relation to a project;
17) not tried to get its limited accessibility (confidential) information or act with criminal or administrative actions to influence the Evaluation Commission or the LADA project open tender evaluation;
18) fishing vessel which is removed from the fishing vessel register, using public funds, will not be replaced by another fishing vessel;

Implementation of the project start date is the date specified in the application for the project.

If the structural funds within the beneficiary has not submitted the relevant document referred to in paragraph 5.1, sends out a notification with the LADIES collection for document delivery within 10 working days from the date of receipt of the notification. The ERDF aims to provide support to the regional gap, with the participation of the regions lagging behind in development and structural alignment, as well as the industrial transformation of the regions that the condition worsens;

The ESF aims to eradicate discrimination and inequality in the labour market, to support the development of human resources, to promote the information society;
3. the European agricultural guidance and guarantee fund (EAGGF).
EAGGF objective is to support the restructuring of agriculture and contribute to rural development;
4. Financial instrument for fisheries guidance (FIFG).
The FIFG aims to ensure the structural measures in the fisheries and aquaculture sectors, as well as fishery products processing industry and trade.

2) fleet renewal and modernisation of fishing vessels (2.8%); 3) fisheries and aquaculture product processing and marketing improvement, fishing port facilities and aquaculture (43.1%); 4) coastal fisheries development, socio-economic measures, support for temporary cessation of fishing activities and other financial compensation, the acquisition of new markets and support for producer organisations (10.5%).
To ensure maximum complementarity effect, measures are planned in the process of coordination also with the measures to be financed by the ERDF (port facilities available to the public, marketing and export promotion activities, etc.) and the ESF (fishermen's retraining).

• Fishing vessels must be registered to the same owner for at least 2 years prior to the submission of the project;

• The funding of the structural funds may not qualify if the 10 years before the fishing vessel (boat) write-off, that is purchased for State subsidies.
• Fishing vessels can be divided (t.sk. cut scrapping) or released for use for other purposes outside the fishery only in EU Member States, and must have a contract with a company to conduct a fishing vessel for the Division or company/institution that will be passed to the ship for use in non-profit purposes outside the fishery;
• Fishing vessels are scrapped with public funding, could not be replaced by another fishing vessel;
• Written off the fishing vessel owner whose property is only one fishing vessel can not replace it with another fishing vessel or continue to fish with leased vessel/s;

7) the project will be implemented within the time provided for in the project. The project, the applicant is informed that the project does not comply with the prescribed time, the contract will be terminated;
8) does not make any changes to the project without matching them with the LADIES;
9) undertakes to report on each project phase;
10) is declared bankrupt, is wound up, the economic activity is not paused or stopped or not started proceedings for winding up, insolvency or bankruptcy;
11) in the absence of any decision on the project, the applicant has been guilty of fraud, bribery, a crime linked to corruption, as well as the involvement of criminal organisations, or other illegal activities, which affected the Republic of Latvia or the financial interests of the European Community, and a criminal record is not deleted or removed;
12) no professional misconduct and does not exist in the current decision, with which the project applicant is found guilty of the offence in connection with their professional activities;
13) has fulfilled all obligations relating to the payment of taxes and no tax liability in Latvia or any other country in which the applicant is established in the project;
14) has complied with the obligations in relation to the State social insurance contributions and is not a State social security payment shows in Latvia or any other country in which the applicant is established in the project;
15) has broken the conditions of the contract, the non-fulfilment of treaty obligations, which closed with the LADIES or other contracting authorities within the European Community;

4.7. This contract covers the Contracting Parties of the rights, duties and responsibilities, as well as the procedure and the conditions to be met in order to achieve the objectives laid down in the draft and receive FIFG funding, including: • the beneficiaries of structural funds, the responsibility for the implementation of the activities contained in the project agreement within the time limits and procedures;
• project implementation, the duration of the application;
• project funding terms-project total funding and sources of funding (State budget and FIFG funding);
• the procedure for the submission of information on the implementation of the project;
• arrangements for the remaining project implementation checks and controls;
• sanctions and actions, in cases where the violation is detected in connection with the implementation of the project or not.
Implementation of the project start date is the date specified in the application for the project.
 
5.1. documents to be submitted by the project during the implementation project is designed for only one final payment when the project's complete implementation. (f)) work for the transfer-acceptance Act and this Act, copies of one original.
If the structural funds within the beneficiary has not submitted the relevant document referred to in paragraph 5.1, sends out a notification with the LADIES collection for document delivery within 10 working days from the date of receipt of the notification. If the beneficiaries of the structural funds after the receipt of the notification within the time specified in the documents are not submitted, the LADIES look about the obligations of the beneficiary of the financing by the structural funds.
Based on the terms and the documents submitted, the LADIES will be carried out before payment of the documentary and physical checks and monitoring of the implementation of the project, for which the beneficiary of the structural funds is warned.
