Clarifies 11.10.2006, Latvian journal, no. 162 (3530) Cabinet of Ministers Regulations No. 545 Riga, 27 June 2006 (pr. No 34 56) arrangements for the management of the structural funds of the European Union institutions involved in the implementation of the structural funds and supports the amendment of the planning documents Issued in accordance with the management of the structural funds of the European Union article 9 of the law on the second and fifth, the third paragraph of article 10, article 11 of the fourth part of article 16, first paragraph 1, 8 and 11 i. General questions 1. determines the order in which the structural funds of the European Union (hereinafter referred to as the structural funds), the participating institutions provide the amendment of planning documents and the implementation of the structural funds 1.1. introduction of open project: application of the competition, including the open project submission prepared for the competition guidelines, submit and evaluate project submission open tendering project submissions, shall take a decision on the approval or rejection, as well as implementing and amending tender projects;
1.2. introduction grant scheme, including grant schemes shall be prepared, submitted and evaluated in a description of the grant scheme of the project submissions, shall take a decision on the approval or rejection, as well as implementation and for the amendment of the grant scheme for projects;
1.3. implementing national programmes, including the preparation and approval of national programmes, as well as implementation and for the amendment of the national programme projects.
2. the first level of intermediate functions: 2.1. Ministry of the economy;
2.2. The Ministry of education and science;
2.3. The Ministry of culture;
2.4. The Ministry of welfare;
2.5. Regional development and local government Ministry;
2.6. the Ministry of transport;
2.7. the special task Minister for electronic Government Affairs Secretariat;
2.8. The Ministry of health;
2.9. The Ministry of the environment;
2.10. the Ministry of agriculture.
3. the second level intermediate function: 3.1 Central Finance and contracting agency, the measures financed from the European regional development fund;
3.2. the rural support service – measures financed from the European agricultural guidance and guarantee fund and the financial instrument for fisheries guidance;
3.3. State employment agency, the measures financed from the European Social Fund;
3.4. the Agency for the development of vocational training — measures financed from the European Social Fund.
4. Grant Scheme operator functions: 4.1 the investment and development agency of Latvia;
4.2. the State regional development agency;
4.3. the society integration fund;
4.4. Management of a social service.
5. the first level, second level intermediate intermediate, grant schemes, the operator, the managing authority and the paying authority with the management of the structural funds implementation duties respecting sound financial management principle.
6. the intermediate level, the second level intermediate and grant schemes, the operator shall ensure that the functions of the Department and employee responsibilities separate so as to ensure the fair and proper functioning of the principles of working with the project submissions and prevent any possibility of a conflict of interest.
7. the second level intermediate and grant schemes, the operator shall ensure that the competence of the person at the same time would not have direct effect in more than one of the following: 7.1 request for examination and the structural funds payment order;
7.2. inspection project locations and in monitoring the implementation of the project.
8. the second level intermediate, grant schemes, the operator, the beneficiary of the structural funds and grant the beneficiary provides a separate accounting system or a separate account (accounts) in order to ensure the existing system accounts for the funding of the structural funds.
9. the first level, second level intermediate intermediate, grant schemes, the operator, the managing authority and the paying authority shall ensure that activities relating to the management of the structural funds, should be clearly defined internal procedures, as well as writing to ensure regular review, updating and submission to the leading authority on the basis of the cooperation agreement with the managing authority or to the authority or at the request of the managing authority.
10. the second level intermediate and grant schemes for internal procedures the operator: 10.1 determine the order in which shall carry out random checks on the structural funds for the project. 10.2. determine the order in which the decision on the recovery of expenses carried out appropriately, and ensure an adequate accounting of expenditures made and recovery.
11. the second level intermediate internal procedures determine the order: 11.1. what provides support for procurement matters to the recipient of the funding of the structural funds, which is not the budgetary authority;
11.2. the structural checks on the beneficiaries of payment documents and submitted requests for the structural funds, as well as prepare the payment flow forecast and expenditure declarations;
11.3. any financial and statistical information on the structural funds for projects financed by the structural funds is entered in management information system, thus ensuring the reporting in the management of the structural funds of the participating institutions.
12. beneficiaries of the structural funds by contract, concluded with the second level intermediate and grant the beneficiary under the contract concluded with the grant scheme operators: 12.1. implement projects and payments;
12.2. the structural funds submitted request second level intermediate or grant schemes for the operator;
12.3. a full accounting of the project, as well as stores;
12.4. ensure unjustified expenses made and records;
12.5. provide an overview of progress in implementation of the project the second level intermediate or grant schemes for the operator;
12.6. other activities carried out under the contract.
13. the structural funds the structural funds for the funding of projects financed by or grant beneficiary can be implemented in partnership with the institutions that meet the following conditions: 13.1. open fulfil the project submission guidelines, the grant of the tender description of the scheme or the national program partners;
13.2. involved in the project through its owned property, intellectual property, finance or human resources;
13.3. after the project got any material or non-material benefits.
 
II. Open project submission contest 14. Open project submission guidelines in the development of the competition the first intermediate level in cooperation with second-level intermediate under single programming document and the programme complement objective 1 programme 2004 to 2006 for the specified.
15. Open the project application to the contest guidelines: 15.1 application project open tender;
15.2. the intermediate level;
15.3. the second level intermediate;

16. the first level intermediate shall submit a draft application to open tendering guidelines for managing body, to move the structural alignment of the Management Committee.
17. After the submission of the draft open tendering guidelines matching the relevant structural funds Management Committee the first level intermediate shall submit a draft application to open tendering guidelines for the approval of the Cabinet of Ministers.
18. 19. 24. If open competition project amendments relate to the structural funds, the beneficiary's base data (contact information and bank details) or without prejudice to the objective of the project, beneficiaries of the structural funds, the period of implementation of the project, the expected results and an audited value change and changes in the total amount of eligible costs or the breakdown by year of design, amended by the beneficiaries of the structural funds and the second-level intermediate bodies mutual agreement within 15 working days of receipt of the request for amendment to the second level intermediate;
25.3. If open competition project amendments do not apply to the beneficiaries of the structural base data (contact information and bank details), and without prejudice to the objective of the project, the beneficiaries of the structural funds, the period of implementation of the project, the expected results and an audited value change and changes in the total amount of eligible costs or the breakdown by year of design, second level intermediate 15 working days evaluate the amendment request and assent, shall submit it to the first level intermediate to the making of the decision;
25.4. the intermediate level within 10 working days of the amendment and the second-level intermediate bodies received the opinion shall take a decision on the approval or rejection of amendments and inform the second level intermediate;
25.5. the second level intermediate 10 working days after this rule 25.2. referred to in the agreement or on the basis of the first-level intermediate bodies for approval of an amendment of a decision made pursuant to amendments to the agreement on the implementation of the project tender and shall inform the beneficiaries of the structural funds;
15.9. the second level intermediate based on the first-level decision on the amendment of its rejection, within two working days, inform the beneficiaries of the structural funds for the necessary clarifications and amendments again.
26. the second level intermediate to that rule 25.2. the decision referred to in paragraph shall have the right to agree with the first level intermediate.
27. the second level intermediate quarterly to inform the Steering Committee of the changes to the open tender for the project application to the amount of available funding, if the expected changes due to changes in the open competition project total eligible costs or the possible beneficiaries of the structural funds for the contract for tender early termination of the project.
28. 30.10. other grant schemes the project application preparation and implementation conditions.
31. the first level intermediate shall submit grant schemes describes the managing body for the coordination of the structural funds for the promotion of the Management Committee.
32. After the grant schemes describes the Reconciliation Committee of management of the structural funds first level intermediate shall submit it to the Cabinet for approval.
33. the first level in cooperation with the IB grant scheme, the operator shall develop procedures for the evaluation, the Commission shall establish and review the schemes of the project grant applications.
34. Grant Scheme introduced in the following order: 34.1. grant scheme, the operator shall issue a grant scheme for projects submission contest;
21.3. the grant scheme, the applicant shall provide the project grant scheme application grant scheme of the project manager of the project for the evaluation of the administrative application evaluation criteria. Application of the project in the case of administrative compliance grant scheme, the operator moves the project submissions for future evaluation of the submission of the project quality and the specific evaluation criteria;

34.5. evaluation the Commission shall assess the application of the scheme of grants for the project according to the project quality and the application of specific evaluation criteria;
21.5. the grant scheme, the operator shall, on the basis of the evaluation, the decision of the Commission, shall decide on the grant scheme project application approval or rejection, and not later than five working days, inform the applicant of the project. The decision on the grant scheme application rejection of the project grant scheme, the operator shall indicate the project's reasons for rejecting the application;
21.6. After this rule 21.5. decision referred to, grant schemes, the operator shall inform the Management Committee of approved and rejected the grant scheme for projects.
35. Grant Scheme of the project after this rule 21.5. decision referred to, but before this rule referred to in paragraph 37 of the conclusion of the contract or of these rules, 38.2. case in point may be specified by grant schemes and grant the operator the requested funding by mutual agreement.
36. Grant Scheme, the operator shall, in cooperation with the managing authority in developing model contracts project with grant, the beneficiary of the grant scheme for implementing the project and submit it for approval to the management of the structural funds Committee.
37. the Grant Scheme, the operator shall, within 30 working days after it has adopted the decision on the grant scheme project application approval or by these rules specified in paragraph 35 of the grant scheme, the project if financial resources are available for the enforcement of obligations under the Treaty, enter into an agreement with grant beneficiaries.

38.2. If the grant scheme of the draft amendments relate to the grant beneficiary's base data (contact information and bank details) or without prejudice to the objective of the project, the beneficiary of the grant, the deadline for implementation of the project, the expected results and an audited value change and changes in the total amount of eligible costs or the breakdown by year of design, amended after grant funding recipients and grant schemes for mutual agreement the operator within 15 working days of the submission of the request for grant, amendment of the scheme operator;
38.3. If the grant scheme amendment do not apply to the grant beneficiary's base data (contact information and bank details), and without prejudice to the objective of the project, the grant beneficiaries, the project implementation period, the expected results and audited value change and changes in the total amount of eligible costs or their breakdown by year of design, grant schemes, the operator shall submit the amendment request evaluated in cooperation with the first level intermediate and 20 working days, shall take a decision on the approval or rejection of the amendment What shall inform the beneficiary of the grant;
23.9. the grant scheme, the operator shall, within five working days after this rule 38.2. referred to in the agreement or on the basis of its decision on the approval of amendments to make the appropriate amendments to the agreement on the grant scheme, the implementation of the project and shall inform the beneficiary of the grant;
38.5. the grant scheme, the operator, on the basis of its decision on the rejection of the amendment, two working days, inform the beneficiaries of the grant, the necessary clarifications and amendments again.
39. the Grant Scheme, the operator shall inform the quarterly Steering Committee of changes to grant funding available for the scheme, if the expected changes due to changes in the grant scheme, the total eligible project costs or possible to grant the beneficiary of the financing contract for grant schemes for the early termination of the project.
 
IV. National program 40. national programme for the structural funds is the programme complement objective 1 programme 2004-2006 (hereinafter referred to as the programs you added) the specified activity implementation, defining the activities envisaged in the programme complement or apakšaktivitāš conditions and the implementation of the agenda.

46.2. may contract with the beneficiaries of the structural funds and the first level of the national structural fund IB program project implementation, if the first level intermediate is not relevant structural fund national programmes of the structural funds, the beneficiary of the project.
47. This rule 46.1.46.2 and referred to below to the draft Treaty on the second level of its development, in cooperation with the managing authority. Second level intermediate shall submit for the approval of the draft Structural Fund Management Committee.

If the amendment does not apply to the beneficiaries of the structural funds the base data, the second level intermediate within 15 working days of receipt of the request for amendment shall assess the amendment request and, if the opinion is positive, the first level of the intermediate body shall be submitted to the making of the decision;
49. the first level intermediate within 15 working days of receipt of the request for amendment shall take a decision on the approval or rejection of amendments and inform the second level intermediate;

30.8. the second level intermediate 15 working days following this rule 30.6. referred to in the agreement or on the basis of the first-level intermediate bodies for approval of an amendment of a decision made pursuant to these provisions, amendments to 46.1.46.2. or contract referred to in subparagraph and shall inform the beneficiaries of the structural funds;
30.8. the second level intermediate based on the first-level decision on the amendment of its rejection, within two working days, inform the beneficiaries of the structural funds for the necessary clarifications and amendments again.
50. the first level of intermediate quarterly to inform the Steering Committee of the structural funds the structural funds national projects program amendments.
 
V. amendments to programming documents 51. Amendment to the single programming document shall be made in the following order: 51.1. suggestions for amendments can be submitted to the managing authority or intermediate first level;
51.2. the managing authority shall prepare and submit a draft amendment to the Supervisory Committee for a decision on the approval or rejection of the amendment;
51.3. the decision of the Monitoring Committee for approval of amendments to the managing authority's draft amendment to the single programming document shall be submitted for approval to the European Commission;
51.4. after receipt of the decision of the European Commission, the managing authority shall inform within 10 working days of the first-level intermediate bodies, the second-level intermediate bodies and grant scheme for keepers of the decision adopted by the European Commission.
52. the amendments to the programme complement shall be made in the following order: 52.1. the Supervisory Committee shall prepare proposals for amendments to the programme complement and submitted them to the managing body;
52.2. the managing authority shall prepare and submit draft amendments to Appendix a Monitoring Committee, a decision on the approval or rejection of the amendment.
 
Vi. Closing questions 53. beneficiary of the structural funds and the grant beneficiary by 2016 December 31 stores all project-related original documents including any correspondence related to the project, the advertising regulations, work and supply dealers, service providers and the evaluation of the tender documentation, project documentation, contracts and any correspondence related to the contract, the work, supplies and services, as well as supporting documentation for payments.
54. This provision 1., 2., 3., 4., 6., 7., or the structural funds specified in annex 8 project form and its annexes shall not apply if this provision to the date of entry into force of the project application in the evaluation, the decision has been taken on the structural fund project approval or a contract concluded for its implementation.
