No 34 43) identification of fertilizers, quality, conformity assessment, and trade rules Issued in accordance with the law of the movement of fertilizer 4, the first paragraph of article i. General questions 1. determines: 1.1. fertilizers not marking "EC fertiliser": 1.1.1. identification, quality and marketing requirements;
1.1.2. registration conditions and procedures;
1.1.3. the permissible deviations from the fertilizer quality declared;
1.1.4. the unwanted impurities maximum permissible concentration;
1.1.5. monitoring and control arrangements;
1.1.6. the conformity assessment procedures of the quality monitoring and control purposes;
1.1.7. the requirements of the fertilizer label and packaging;
1.2. the fertiliser, which is labelled "EC fertiliser", frame-instructions on the label;
1.3. the granting of authorisation procedures for the marketing of fertilisers or under temporary importation arrangements, which are not included in the public registry of fertilisers (hereinafter register) or which do not correspond to the declared quality or quality requirements, or identification requirements.
2. the provisions do not apply to fertilizers, which are placed under a customs procedure — inward processing.
 
II. identification of the fertilizers, quality and trade requirements 3. identification of the fertilizer requirements specific to each type of fertilizer specific indicators (annex 1): 3.1 the official name of the fertilizer;
3.2. the method of production and essential constituents of the fertilizer;
3.3. quality requirements (plant nutrient minimum content (a percentage of the fertiliser by mass)), the form and the specific fertilizer requirements;
3.4. accompanying the fertilizer label or marking the quality indicators to be declared.
4. the fertiliser complies with declared quality in accordance with these rules, taking into account the allowable deviation (annex 2).

16. To register a fertilizer, the person shall provide the service: 16.1. submission (annex 5);
16.2 the company registry issued a copy of the certificate of registration;
16.3. the accredited laboratory test report issued by the original (Packer-copy), the Member States of the European Union and European economic area countries manufactured fertilizers-accredited laboratory of the manufacturer or a test report issued;
16.4. the label or labelling information with samples of Latvian language in accordance with the provisions of paragraph 40;
16.5. test review copy for detonation safety of ammonium nitrate fertilisers with a nitrogen content exceeding 28%;
16.6. the safety data sheet (if any);
10.4. list of point of sale;
16.8. the document on the fertilizer registration fees.
17. To register in Latvia, prepare fertilisers mixtures of motor service submitted by: 17.1. application (annex 6);
17.2. Register of companies issued a copy of the certificate of registration;
17.3. the mechanical mixture of a copy of the production technical description;
17.4. a copy of the test report for detonation safety of mixtures with nitrogen content exceeding 28% if one of their components are ammonium nitrate;
17.5. the Blender mixture statement (Packer-copy) that mechanical mixture made of fertilizers or registered is with the marking "EC fertiliser" and that not registered therein component (if any) does not exceed 0.5% of the total mass;
10.9. labels or markings with the sample text information for Latvian language in accordance with the provisions of paragraph 40;
17.7. the list of points of sale;

23. the service: 23.1. following the adoption of the decision shall inform the person in writing;
23.2. If the decision on the registration of fertilizer, 10 working days, issue the person a certificate of registration, certifying that the fertilizer included in the register and is made of it in the service of surveillance and control;
23.3. the entry in the registry, including all the data referred to in the application (or annex 6).
24. the marketing authorisation holder shall be responsible for compliance with the fertilizers regulations on fertilisers and chemicals and products.
25. The registration certificate (annex 7) specifies the following information:

25.1. the fertiliser name according to this provision, annex 1, core and trade name (if any);
25.2. the fertiliser chain (production, importation, packaging, preparation of compound for sale or trade);
25.3. This provision of the annex set out in box 5 of the declared data;
25.4. the holder of the registration certificate;
25.5. the number of the registration certificate, the issuing of a registration certificate, date of issue;
15.9. the manufacturer of the fertilizer or the Blender mixture.
26. the holder of the registration certificate within 10 days notify the Department in writing of the changes that result from the documents submitted for registration.
27. Amendments to the register made in accordance with the decision taken on the basis of the owner of the certificate of registration of the application and the attached documents. The holder of the registration certificate shall indicate in the application the reasons for the amendment.

36. If, in accordance with the test report of the fertilizer quality does not meet the requirements of this regulation, all the control sample testing costs shall be borne by the person that the fertiliser produced, packaged, marketed, imported for sale or prepared fertilizer mixtures.
37. the service within five working days, inform the person of the decision: 37.1. adopted under this provision paragraph 35;

38. a Person may, without the authorisation of importation of fertilizer not registered for personal use, if its value does not exceed the amount referred to in Council of 28 March 1983, Regulation (EEC) No 918/83 establishing a Community system of reliefs from customs duty, article 47.

41. The label may be replaced by a label that contains the information referred to on the label. A label or mark shall be affixed to the packaging as to be clearly visible and clearly separate from any other information. The packaging shall be concluded in such a way that after you open it, you might see damage to the packaging.
42. the information label or the label is in the Latvian language, clearly legible. The label or marking shall be resistant to external influence.
43. The fertiliser producer, Blender, Packager of mixtures and the importer guarantees: 43.1. fertilizer packaging strength and security, to maintain the quality of the fertilizer;
43.2. ammonium nitrate fertiliser of high nitrogen content (more than 28%), liquid and solid fertilizers fertilizers that contain one or more micronutrients, supply sales in packaged form.
 
Vi. Authorisation procedure fertilizers for sale or importation, not recorded in the register or which do not correspond to the declared quality or quality requirements, or requirements identification service issued the following 44. authorisation (annex 9) fertilizers for sale or importation: 44.1. permission registered fertilizer trade, if test results show a mismatch in the register of declared quality;
44.2. the authorisation for the marketing of fertilisers or for import, which is not mentioned in annex 1 of these rules;
27.5. permit for unregistered importation of fertilizer efficiency tests and studies;
27.6. the permit for the import of fertilizer testing and registration;
27.7. permission for testing and registration of fertilizers imported the relevant lots to trade;
27.7. the registered party certain of fertilizer import and marketing of fertilizer if the party does not comply with the rules referred to in annex 1 of the quality requirements.
45. in order to receive a permit, submit an application service (annex 10) and the relevant documents in accordance with these rules or, or 47.51, 49 or 53, 55 or 57 or paragraph.

48. Authorisation for the import of fertilisers or trade that is not mentioned in annex 1 of these regulations, shall be issued, if fertilizer does not meet the requirements of this regulation, but is not dangerous to human and animal health and the environment.
49. for these rules permit referred to in paragraph 48, the fertilizer manufacturer or importer shall submit to the Department: 30.5. test report issued by the manufacturer (if the fertilizer produced in the Member State of the European Union and European economic area country) or accredited laboratory test report contains the unwanted impurities in accordance with the provisions of annex 3;
30.6. test review copy for detonation safety of ammonium nitrate fertilisers with a nitrogen content exceeding 28%;
30.6. The business register issued a copy of the certificate of registration;
49. the label or labelling information with samples of Latvian language in accordance with the provisions of paragraph 40;
30.8. the marketing list.
50. the authorization shall be established for the importation of fertilizer efficiency trials and studies shall be issued, if fertilizer is not registered and not dangerous to human and animal health and the environment.
51. for the provisions referred to in paragraph 50, the fertilizer manufacturer or importer shall submit to the Department:

51.1. the test report issued by the manufacturer (if the fertilizer produced in the Member State of the European Union and European economic area country) or accredited laboratories of the issued test report contains the unwanted impurities in accordance with the provisions of annex 3;
51.2. testing report about the detonation safety of ammonium nitrate fertilisers with a nitrogen content exceeding 28% (copy);
51.3. the register of companies of issuing the registration certificate (copy);
51.4. information about the test and study of place, time, and by whom, the quantity of fertilizer trials and research objectives.
52. the permit for the import of fertilizer testing and registration shall be issued, if fertilizer is mentioned in annex 1 of these provisions, but not registered.
53. for the provisions referred to in paragraph 52, the fertilizer manufacturer or importer shall submit service: 53.1. Register of companies issuing the registration certificate (copy);
53.2. test report issued by the manufacturer;
53.3. test of resistance to detonation of ammonium nitrate fertilisers with a nitrogen content exceeding 28%.
54. the authorization for testing and registration of fertilizers imported the relevant lots to trade, provided the accredited laboratory test results show non-compliance with the fertilizers 1. Annex quality requirements, but dangerous impurities does not exceed the maximum of undesirable impurities levels.
55. for the provisions referred to in paragraph 54, the fertilizer manufacturer or importer shall submit to the Department: 55.1. Register of companies issuing the registration certificate (copy);
55.2. accredited laboratories of the issued test report contains the unwanted impurities in accordance with the provisions of annex 3;
55.3. imported fertilizers in the lot number and quantity;
the label or labelling. 55.4 sample text with the information in the Latvian language in accordance with the provisions of paragraph 40;
55.5. list of points of sale.
56. the authorisation shall be registered for a particular batch of fertilizer importation and marketing of fertilizer if the party does not comply with the rules referred to in annex 1 quality, shall be issued, if fertilizer is not dangerous to human and animal health and the environment.
57. for the provisions referred to in paragraph 56, the fertilizer manufacturer or importer shall submit to the Department: 57.1. Register of companies issuing the registration certificate (copy);
57.2. accredited laboratory test report contains the unwanted impurities in accordance with the provisions of annex 3;
57.3. test report about the detonation safety of ammonium nitrate fertilisers with a nitrogen content exceeding 28% (copy);
57.4. the lot number of the fertilizer and the quantity;
57.5. label or marking the sample text with the information in the Latvian language in accordance with the provisions of paragraph 40;
57.6. list of points of sale.
58. the service within 15 working days after all this rule 47 or 49 or 51.., or 53, 55 or 57 or paragraph of receipt of documents shall take a decision on the permit concerned. Import licences shall be valid for 18 months.
59. The permit holder is responsible for compliance with the permit of the fertilizer of the declared quality indicators.
 
VII. Closing questions 60. Be declared unenforceable in the Cabinet of Ministers of 25 June 2002, the provisions of no. 247 "identification of the fertilizers, conformity assessment, and trade rules" (Latvian journal, 2002, 97 no; 2003, 66, no. 172; 2004, nr. 69).
