Cabinet of Ministers Regulations No. 51 in 2007 (January 9. 26. § 3) the procedure for the grant, administered and monitored by the European Union's support for the restructuring of the sugar industry have been issued under the agricultural and rural development Act article 5, fourth and seventh part i. General questions 1. determines the order in which grant, administered and monitored by the European Union's support for the restructuring of the sugar industry (hereinafter referred to as the restructuring aid) according to the Council of 20 February 2006, Regulation (EC) No 320/2006 establishing a temporary scheme for the restructuring of the sugar industry in the community and amending Regulation (EC) No 1290/2005 on the financing of the common agricultural policy ( hereinafter referred to as the Council Regulation No 320/2006), and of the Commission of 27 July 2006, Regulation (EC) No 968/2006 laying down detailed rules for the implementation of Council Regulation (EC) No 320/2006 establishing a temporary scheme for the restructuring of the sugar industry in the Community (hereinafter referred to as Commission Regulation No 954/2006).
2. Restructuring aid is administered by the rural support service.
3. Sugar producers to the eligible for restructuring aid in accordance with the Council Regulation No 320/2006 paragraph 1 of article 3.
II. Restructuring aid to sugar beet growers 4. If sugar producers renounces sugar production quotas and fully dismantled production equipment, sugar beet growers will receive 20% of the restructuring aid of Council Regulation No 320/2006, article 3, paragraph 5 of the specific support.
5. Sugar beet growers received restructuring aid if: 5.1 country under Commission Regulation No 954/2006 article 10 restructuring aid is granted;
5.2. previous marketing years preceding the marketing year during which the sugar manufacturer is eligible for restructuring aid, sugar beet growers to the manufacturer has entered into a contract for the delivery of beet;
5.3. previous marketing years preceding the marketing year during which the sugar manufacturer is eligible for restructuring aid, sugar beet producer to sugar beet producers or sugar, if sugar beet is not delivered, according to sugar industry contract is drawn up on sugar beet volumes for damage;
5.4. previous marketing years preceding the marketing year during which the sugar manufacturer is eligible for restructuring aid, the beet producers up to 15 may, has provided support services in the Field of application of the restructuring aid to sugar beet growers (annex).
6. Restructuring aid to sugar beet growers will receive for this rule 5.2. beet referred to in subparagraph laid down in the contract for delivery of the quantity of beet sugar quota (tonnes). This quantity multiplied by the rate of the restructuring aid to sugar beet growers.
7. restructuring aid to sugar beet growers rate is calculated using the following formula: 20% × (B × C) = (A) – – – – – – – – – – – – – – A – D which restructuring aid rate in euro per tonne of sugar beet;
B – specific to the manufacturer of sugar sugar production quota (tonnes);
C – restructuring aid per tonne of renounced quota sugar production in accordance with the Council Regulation No 320/2006, article 3, paragraph 5 of the year;
D – total beet quantity (tonnes) sugar quotas, for which this provision during the period referred to in point 5.2 of the beet supply contract was concluded.
8. previous marketing years preceding the marketing year during which the sugar producers claim to be restructuring aid on this provision during the period referred to in point 5.2, the sugar producer to 15 June submitted support service in the field with the following information: the beet grower 8.1 natural persons name, surname, personal code or entity name, registration number, registered office;
8.2. the provisions referred to in point 8.1 of beet growers and sugar beet producers concluded a supply contract number and date;
8.3.8.2. these provisions referred to in subparagraph beet specified in the delivery contract beet quantity (tonnes) sugar quota;
8.4. the rules referred to in point 8.1 of beet growers of beet delivered real quantity (tonnes) for the production of sugar within the quota.
9. the rural support service shall decide on the rules for payment referred to in paragraph 5 and shall ensure their cost in accordance with Commission Regulation No 954/2006 article 19 paragraph 2.
III. restructuring aid to sugar producers in the adoption and application of the evaluation 10. for restructuring aid, sugar producers in the rural support service shall submit an application for restructuring aid (hereinafter referred to as the application) in accordance with Council Regulation No 320/2006, article 4.
11. the rural support service to register the application, specifying the date and time of submission.
12. Submissions that correspond to Commission Regulation No 954/2006 article 8, paragraph 2, of the Field support service within five working days after the receipt thereof shall be submitted in the Ministry of agriculture, the Ministry of Welfare and the Ministry of the environment.
13. Submissions in the areas concerned, evaluate the following institutions: the Ministry of agriculture 13.1 – operation of the restructuring plan and compliance measures;
13.2. The Ministry of the environment-environmental action plan and compliance measures;
13.3. The Ministry of welfare-social plan and measure compliance.
14. The rules referred to in paragraph 13 of the bodies shall be assessed according to the application of Commission Regulation No 954/2006 article 9 and paragraph 2 of the following criteria: 14.1 or the measures and actions described shall comply with the relevant laws and regulations;
14.2. or the measures and actions described meet the objectives of the restructuring of the sugar sector;
14.3. the envisaged activities are clearly defined and commensurate with cost of implementation;
14.4. the envisaged activities are proportionate with the planned implementation timetable;
14.5. or the measures and actions described contain objectively verifiable indicators;
14.6. financial expenses or description is accurate, sufficiently detailed, transparent and real expenditure;
9.1. is that preparing a social plan, consult with the manufacturer of sugar sugar factory trade union or the employees ' representatives.
15. If the application does not comply with the provisions referred to in paragraph 14, the requirements of the Ministry of agriculture, Ministry of welfare, the Ministry of the environment or make a request in writing to the manufacturer of sugar additional information to clarify the application. The manufacturer requested additional information, no later than the Council Regulation No 320/2006, article 4, paragraph 1 shall be submitted in writing within the time limit set by the Ministry of agriculture, the Ministry of Welfare or the Environment Ministry and the field support service.
16.25 working days after receipt of the application, but not later than 15 working days before the Council Regulation No 320/2006, article 5, paragraph 1, the time limit laid down in the Ministry of agriculture, the Ministry of welfare and the Ministry of the environment shall provide support services in the Field of writing an opinion on the conformity of the application of these rules in paragraph 14.
17. Within five working days after the rules referred to in point 16 of the receipt of the opinion of the rural support service, based on the Ministry of agriculture, the Ministry of welfare and the Ministry of the environment provided opinions and Council Regulation No 320/2006, article 5 (2) the requirements laid down in the decision on the conformity of the application and inform the sugar manufacturer.
18. Two working days after the decision on approval of the application to the rural support service to forward it to the European Commission.
19. the rural support service to ensure that the provisions referred to in paragraph 3 of the restructuring cost in the month following receipt of the funds from the European Commission in accordance with Council Regulation No 320/2006, point 4 of article 10.
IV. implementation of the measures provided for in the application, monitoring and reporting 20. following notification of the decision of the European Commission of the financial restructuring fund resource availability and before the application of the implementing measures provided for in the rural support service with sugar producers signed a contract for receiving restructuring aid.
21. the rural support service, in cooperation with the national environment service regional environmental governance and State labour inspection verifies the implementation of the measures provided for in the application, in accordance with Commission Regulation No 954/2006 article 25.
22. the application of the measures provided for in the period of the sugar manufacturer shall provide support services in the Field of Commission Regulation No 954/2006 laid down in article 23.
23. the rural support service to prepare and Commission Regulation No 954/2006 in article 24 and 25 in the order provided to the Ministry of Agriculture and the European Commission with information on the implementation of the measures provided for in the application.
V. closing question 24. the restructuring of the sugar industry measures implemented by 2010 and 30 September.
