No. 24) Detective licensing and certification provisions Issued in accordance with article 3 of the law of the Detective's third and article 13 i. General questions 1. determines the special permit (license) for the conduct of detective (hereinafter licence) and a certificate of the detective (there can-certificate), the duration of service (hereinafter-the validity period), license renewal and cancellation of the certificate and the suspension arrangements, as well as for the issue of licences and certificates and the validity of the extension of the stamp duty payable and payment arrangements. 2. The Ministry of Internal Affairs of the Ministry of the Interior established the Licensing Commission of not less than five persons. The Commission shall adopt the decisions on the issue of licences and certificates, the extension of their period of validity, licences and certificates as well as the withdrawal or suspension. II. issue of licences and certificates 3. Sole proprietor, partnership or corporation that wants to get a license (annex 1) (hereinafter referred to as the license applicant) shall submit the application to the Ministry of Interior licence. 4. licence applications shall be accompanied by the applicant: 4.1 commercial register issued a copy of the certificate of registration;
4.2. space rental contract, or a copy of the document certifying the property right to premises that are specified in the license applicant's registered address;
4.3. a psychiatrist and narkolog opinion on the State of health of the persons who occupy positions in the governing bodies of the applicant for the license, or the applicant's licence-individual merchant-State of health;
4.4. a copy of the contract of employment concluded by a natural person who has received a certificate (hereinafter referred to as the Detective). Physical person who wishes to obtain a certificate (annex 2) (hereinafter referred to as the certificate applicant) shall submit the application to the Ministry of the Interior certificate. 6. the applicant for the certificate application shall be accompanied by the following: 6.1. photo (3 x 4 cm);
6.2. a copy of the document or law enforcement authorities issued a document, certifying the legal practical work experience in the respective institution (if the certificate applicant is the following work experience) and reason (dismissal) release from work;
6.3. the psychiatrist and narkolog opinion on the State of health of the person. III. licence and extension of the period of validity of the certificate 7. to prolong the license validity period, sole proprietor, partnership or corporation that received a license (detective agencies), no later than 30 days before the licence expires, submit the application to the Ministry of the Interior of the extension of the validity of the licence. 8. the application shall be accompanied by: detective agencies 8.1. psychiatrist and narkolog's opinion about the State of health of the persons who occupy positions in the governing bodies of detective agencies;
8.2. other this provision in paragraph 4 of these documents if the information has changed or expired period of validity of the document;
8.3. Overview of the detective, stating: 8.3.1. number of contracts that have been concluded during the period of the provision of services to continue providing detective;
8.3.2. the detective's name, address and certificate number, the time limits laid down in the employment contract and the detective service type. 9. If the detective agencies that paragraph 7 has not delivered within the time limit referred to in the renewal of the licence application, as well as the rules referred to in point 8, the application documents shall be submitted to the general licence procedures. 10. To extend the period of validity of the certificate, the detective not later than 30 days before the expiry of the period of validity of the certificate shall submit an application in the Ministry of the Interior of the period of validity of the certificate extension. 11. to add the application to the Detective: 11.1. photo (3 x 4 cm);
11.2. a psychiatrist and narkolog opinion on the person's State of health;
11.3. Overview of the detective, stating: 11.3.1. number of contracts concluded in the detective service give away;
11.3.2. the period laid down in the Treaty and Detective Services. 12. 15.2. the request of the State revenue service of the applicant, certificate, or license to the applicant, and the detective, detective agencies if the detective is a self-employed person, not the tax debt;

15.3. the decision on the issuance of the licence or certificate, the extension of their period of validity, or for a refusal to issue a license or certificate. 16. If you need to request from foreign law enforcement authorities information about foreign citizen holding a licences applicant or post detective agencies governing body or the certificate applicant or detective, and the information is not received within the time limit set by the Ministry of the Interior, the Licensing Commission may defer the decision until receipt of the information requested from the relevant foreign law enforcement agencies, but not longer than the administrative procedure law. For the consideration of the application for the extension of the Licensing Commission of the Ministry of the Interior shall provide written information. 17. If the documents submitted information is incomplete or inaccurate or needing checking to objectively decide on the issuance of the licence or certificate, or license or extension of the period of validity of the certificate, the Licensing Commission of the Ministry of the Interior shall issue and require the license applicant, detective agencies, certificate applicant or detective 15 working days submit the required information or carry out the necessary checking and shall notify the applicant of the licence detective agencies or certificate, the applicant, or detective. 26.3. the detective in the licence exempt from work or other hired detective. 27. the certificate shall be issued if the detective repeatedly changed the detective's name or surname. 28. If the licence or certificate has been lost or corrupted, Detective detective agencies or five working days shall inform in writing the Licensing Commission of the Ministry of the Interior. The Commission shall, on the basis of an application, issue a duplicate of the licence or certificate. VII. withdrawal of licences and certificates, renewal and suspension of the license and certificate 29. revoke the license of the Ministry of the Interior of a statutory Commission Detective cases, for it by decision. 30. The license and certificate suspended if: 30.1. the head of detective agencies or detective called to criminal liability for intentional criminal offence,-for the time until the entry into force of the court order or the Prosecutor's statement as punishment or terminated the criminal proceedings against him;
30.2. the Licensing Commission of the Ministry of the Interior is the head of the company who received the application for suspension of the licence in respect of all licence detectives release from work-to time until Detective Services has recruited at least one detective. 31. in order to restore the operation of the licence or certificate after the Prosecutor's decision or entry into force of a court ruling that the head of the company reabilit detective or criminal investigator in which he was called a criminally liable for intentional criminal offence, although the head of the detektīvsabied, or the detective submit to the Ministry of the Interior in the Commission for licensing: 31.1. application license renewal;
31.2. the Prosecutor's decision or a copy of the ruling, adopted the relevant criminal proceedings. 32. in order to renew the license, which ended with the licence of all detectives release from work, the head of detective agencies submit to the Licensing Commission of the Ministry of the Interior: 32.1. renewal of licence application;
32. a copy of a document certifying that work has taken the detective. 33. the application for the activity licence or the renewal of the certificate of the Ministry of Interior to the Licensing Commission month after submission and the Prosecutor's decision or a copy of the court order. 34. If the operation of the licence or certificate has been restored by this provision, respectively, 7 and 10. the period referred to in paragraph or after the license or certificate expires, it is assumed the Prosecutor's decision or entry into force of a court ruling that the head of the reabilit detective agencies or criminal detective, apply for a licence or the renewal of the period of validity of the certificate. 35. If the decision on the refusal to issue a licence or certificate shall extend the validity period or revoke the licence or certificate, the merchant who created a new company, or an individual submission again new licences or certificates may be submitted not earlier than one year after the adoption of the relevant decision. 36. If the Interior Ministry Licensing Commission has decided not to issue a licence or certificate do not extend the validity period, suspend or revoke the activity licence or certificate, the three working days following the adoption of the decision in writing, inform the applicant of a licence or certificate, or detective and detective agencies noted that the decision may be challenged, and to appeal to the administrative procedure law. 37. 24.0. on issue of licences and certificates-three lats. 39. A State fee shall be paid before receipt of the licence and the certificate. 40. State fee including the State budget. 41.
