Cabinet of Ministers Regulations No. 506 in 2015 (September 1. No 44 24) fertiliser and substrate identification, quality, conformity assessment, and trade rules Issued in accordance with the law of the movement of fertilizer in the first part of article 4, paragraph 1 of the i. General questions 1. determines: 1.1. fertilizers not marking "EC fertiliser", as well as the substrate: 1.1.1. identification, quality, compliance and marketing requirements; 1.1.2. registration conditions and procedures; 1.1.3. the permissible deviations from fertiliser and substrate quality declared; 1.1.4. the unwanted impurities maximum permissible concentration; 1.1.5. monitoring and control arrangements; 1.1.6. the supervision and control of the necessary quality conformity assessment procedures; 1.1.7. the requirements for the label, marking and packaging; 1.2. requirements for the declared plant fertilizer nutrient form, which is labelled "EC fertilizer"; 1.3. in accordance with the European Parliament and of the Council of 9 July 2008. Regulation (EC) no 764/2008 laying down procedures relating to the application of certain national technical rules to products lawfully marketed in another Member State and repealing Decision No 3052/95/EC, Latvia imported fertiliser and substrate (hereinafter notified fertiliser and substrate) the notification and submission of documents, the unwanted impurities maximum concentration , monitoring and control procedures, as well as quality conformity assessment procedures for monitoring and control purposes; 1.4. the granting of authorisation procedures for fertilizers and substrates for marketing or importation, which are not included in the crop monitoring information system of national fertiliser and substrate in the national register (hereinafter register) or which do not correspond to the declared quality or quality and identification requirements.
2. Animal organic fertiliser and substrate movement shall take place in accordance with the legislation on veterinary requirements of animal by-products and processed products, not intended for use in food, as well as the European Parliament and of the Council of 21 October 2009. Regulation (EC) no 1069/2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002 (hereinafter Regulation No 1069/2009), and the European Commission on 25 February 2011 Regulation (EU) No 142/2011, implementing European Parliament and Council Regulation (EC) no 1069/2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and Council Directive 97/78/EC with regard to certain practices and goods which are not on the border veterinary checks carried out under that directive (hereinafter Regulation No 142/2011).
II. the fertiliser and substrate applicable identification, quality and trade requirements 3. Fertilizer and substrate identification and applicable quality requirements, as well as the declared quality indicators are defined in annex 1 of these rules. 4. The fertiliser and substrate declared quality meeting the requirements of this regulation, if a specific performance indicator in the negative deviation does not exceed the provisions mentioned in annex 2.

Laboratory accredited national accreditation body according to the laws and regulations on assessment of conformity assessment bodies, accreditation and supervision or in another Member State of the European Union or European economic area national accreditation body (hereinafter referred to as the accredited laboratory), issue a test report for fertiliser and substrate. III. The fertiliser and substrate registration 13. Fertilisers and substrates are recorded in the relevant registers and manages the service. 14. the application of fertilizer or substrate for registration shall submit the legal or physical person who manufactured, packaged or imported fertiliser and substrate or preparing a mixture of fertilizers (except mixtures in accordance with specific agreements made by individual order the end user) (hereinafter person). If fertilizer or substrate are recorded by the manufacturer, it may be freely imported.
15. To register a fertilizer or substrate, a person shall submit to the Department: 15.1. submission (annex 5); 15.2. the manufacturer or importer-accredited laboratory test reports issued (Member State of the European Union and European economic area country produced fertilizer and the substrate may submit a test report issued by the manufacturer), turn on biologically active compounds of the plant growth promoters and viable micro-organisms the microbiological preparations may submit a test report issued by the scientific institution, which according to the law of scientific activity is registered in the register of scientific institutions , or another Member State of the European Union officially registered scientific institutions. Opinion indicates crop used in the trial; 9.6. labels, label or accompanying document text with the information in the Latvian language in accordance with the provisions of paragraph 52 – fertilizer (other than microbiological preparations), in accordance with the provisions of paragraph 53-microbiological preparation and in accordance with paragraph 54 of these regulations – substrate; 15.6. a test report (a copy) of the detonation safety of ammonium nitrate fertilisers with a nitrogen content exceeding 28 percent; 15.7. the safety data sheet, if the European Parliament and of the Council of 18 December 2006, Regulation (EC) No 1907/2006 concerning the registration, evaluation, authorisation and restriction of chemicals (REACH), establishing a European Chemicals Agency, amending Directive 1999/45/EC and repealing Council Regulation (EEC) No 793/93 and Commission Regulation (EC) No 1488/94 as well as Council Directive 76/769/EEC and Commission directives 91/155/EEC , Directive 93/67/EEC, 93/105/EC and 2000/21/EC; 15.8. the planned list of point of sale; 15.9. information on the assigned registration or recognition of the official number, and a reference to the tīmekļvietn of the competent institution, which contains information that the fertilizer or the manufacturer of the substrate is recognized or registered pursuant to Regulation No 1069/2009, if fertilizer or substrate containing animal by-products or derived products not intended for human consumption (animal by-products); 15.10. the manufacturer's written permission of microbiological preparations repackaged, if it is intended to do. 16. to register in the preparation of mechanical mixtures of fertilisers, the person shall: 16.1 the Services application (annex 7); 16.2. the mechanical mixture of a production copy of the technical description (except packaging); 16.3. test review copy for detonation safety feature where the fertiliser ammonium nitrate nitrogen content exceeding 28 percent of the fertiliser by mass; 16.4. the Blender mixture for that motor blend made from the registered fertilisers or of fertilisers that are marked "EC fertiliser", and that not registered therein component (if any) does not exceed 0.5% of the total mass (the Packager shall submit a copy of the registration certificate of the mixture); 16.5. labels, label or accompanying document sample text with the information in the Latvian language in accordance with the provisions of paragraph 52; 16.6. the planned list of point of sale.
17. The Registrar is responsible for these rules 15 and 16 of the document referred to in paragraph 1. 18. Regulation (EC) No 1107/2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC , or in third countries similar latitudes and it has made a scientific institution, which according to the law of scientific activity is registered in the register of scientific institutions, or other government institution that is registered in the register of scientific institutions in accordance with national legislation; 21.5. atypical fertilizer, plant growth promoter or microbiological preparations for trial, where the only difference in compliance with principle and who performed with field crops in the last 10 years, at least two years in a row, but with cover crops of the area, at least two consecutive harvest cycles, the period under examination are given an average of at least 10 percent yields growth (except for decorative plants). The fertilizer label indicates their crop or crop group for which a positive result of the test of effectiveness; 21.6. State fee has been paid in accordance with the laws of the State fee for fertiliser and substrate registration or authorization of fertiliser and substrate for import or trade. 22. paragraph 21 of these rules If the conditions are not met, the Department shall take a decision on the refusal to register a fertilizer or substrate.
23. the service: 23.1. within three working days after the decision shall inform the person in writing; 23.2. 25. Fertilizers (except the microbiological preparations) shall indicate in the certificate of registration information in accordance with the provisions of Annex 8, the microbiological preparation in the registration certificate, in accordance with the provisions of Annex 9 and substrate in the registration certificate, in accordance with the provisions of annex 10.
26. the holder of the registration certificate within 10 days notify the Department in writing of the amendments resulting from the registration of the documents submitted.

31. 32. Control authority within five working days after the certificate is issued with a receipt, notify the Department.

IV. The fertiliser and substrate notification procedures 34. If the application is submitted in paper form, the applicant the label or labelling shall also be submitted in electronic form; 21.4. information about organic fertiliser and substrate materials; 34.5. information about organic fertiliser and substrate, if it contains animal by-products, showing the assigned registration or recognition of the official number, as well as the competent institution tīmekļvietn, which contains information that the organic fertilizer and substrate manufacturers have recognised or registered pursuant to Regulation (EC) no 1069/2009. 35. Expenses associated with the notification and fertilisers into the substrate, the importer or the manufacturer in the list shall cover, in accordance with the regulations on professional fees provided by the services price list. 36. the service 20 working days after the rules referred to in paragraph 34 of document receipt shall take a decision on the notified or substrate fertilizer records, including the fertiliser and substrate in the list. V. monitoring and control 40. 44. If the fertilizer or the substrate quality does not meet the requirements of this regulation, the Department within 10 working days, send to the laboratory accredited or the appropriate scientific institution in the other fertilizers or substrate control sample. 45. If the service finds the fertilizer or the substrate quality, it five working days, inform that person of the expenditure connected with the testing of the control sample, and their payment arrangements.
47. If the Department finds that the notified fertilizer or substrate may be harmful to human and animal health and the environment, that five working days shall inform in writing the Ministry of Agriculture.

VII. Authorization procedures for fertilizers and substrates for sale or importation, not recorded in the register or which do not correspond to the declared quality or quality requirements, or requirements identification service issued the following 62. permits (annex 15) fertiliser and substrate for sale or importation: 62.1. permissions and substrate fertilizer for import testing and registration; 62.2. authorisation for the fertiliser and substrate for import or trade that is not mentioned in annex 1 of these rules; 38.7. permission registered and substrate fertilizer trade, if test results show a mismatch in the register of declared quality; 38.8. permission for testing and registration of imported fertiliser and substrate of the batch concerned trade; 62.5. authorisations shall not be established for the importation of fertilizer efficiency tests and studies; 38.9. permission registered fertilizer specific for the import and marketing of the party if the fertiliser batch does not comply with the rules referred to in annex 1 of the quality requirements.

Authorisation for the fertiliser and substrate for import or trade that is not mentioned in annex 1 of these regulations, shall be issued, if the fertiliser and substrate does not meet the requirements of this regulation, but is not dangerous to human and animal health and the environment. 67. for these rules permit referred to in paragraph 66, the fertiliser and substrate, the manufacturer or importer shall submit to the Department: 67.1. a test report issued by the manufacturer (if the fertiliser and substrate manufactured in a Member State of the European Union and European economic area country) or accredited laboratory test report contains the unwanted impurities content according to annex 3 of these rules; 67.2. a copy of the test report on the detonation safety of ammonium nitrate fertilisers with a nitrogen content exceeding 28 percent; 67.3. labels or markings with the sample text information for Latvian language in accordance with the provisions of paragraph 52 or 54.; 41.9. list of points of sale.
