No 45 81) at national and European Union aid, administration and supervisory arrangements for milk product delivery for learners in general education institutions Issued under the agricultural and rural development Act article 5, fourth and seventh part i. General questions 1. determines the order in which grant, administered and monitored by national and European Union support for the supply of milk products to the learner's general education (hereinafter referred to as aid) pursuant to the European Parliament and of the Council of 17 December 2013 Regulation (EU) no 1308/2013 establishing agricultural products the common organisation of the markets, and repealing Council Regulation (EEC) no 922/72, (EEC) No 234/79, (EC) no 1037/2001 and (EC) No 1234/2007 article 26, European Commission, July 10, 2008, Regulation (EC) No 657/2008 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 as regards Community aid for supplying milk and certain milk products to pupils in educational establishments (hereinafter Regulation No 657/2008) and the Council of 16 December 2013 Regulation (EU) No 1370/2013 for specific support and determination of the compensation measures in relation to agricultural products the common organisation of the markets in the article 6. 2. The granting of aid, administration and supervision is a rural support service (hereinafter service). II. conditions for national and European Union aid and support the approval procedure for applicants 3. aid shall be granted for Regulation No 657/2008 referred to in annex I (I) and (II) the supply of products in categories of learners no 657/2008 of the regulation referred to in article 2 in the General educational institutions, providing for national co-financing in accordance with the provisions of point 7 and 8. 4. the applicant (hereinafter the applicant) is no 657/2008 of the regulation article 6, paragraph 2, the person who is registered in the single sector of agriculture information system in accordance with the laws and regulations on the single information system of agriculture sector and which has issued the approval of this provision of the services referred to in paragraph 3 for the supply of the products. 5. for this provision, the approval referred to in paragraph 4, the applicant shall submit the application service (annex 1). Service within five working days after receipt of the said application confirms applicant. 6. The applicant, which is derived from a public person, this provision in paragraph 3, the products in question period of support in general education institutions in accordance with the laws and regulations in the area of public procurement, unless these rules require a different procedure. 7. The provisions referred to in paragraph 3, national co-financing will be granted for heat-treated milk without additives and flavourings (milk) supply of pre-school educational institutions and 1-9. classes, if the learner: 7.1 produced according to the organic farming scheme requirements and certifies organic farming regulations governing the control of the institution in the form of a certificate or a certificate for a transition period to organic farming or also produced according to national food quality schemes and the food and veterinary service certificate issued in accordance with the requirements of the legislation on food quality schemes, the implementation, operation, monitoring and control procedures; 7.2. from the place of production to the education authority transported 250 kilometres within; 7.3. for education trainees are distributed free of charge. Service on a quarterly basis, taking into account the national average raw milk purchase prices in the current quarter and other costs, as well as to compensate for the premium for milk, produced according to the organic farming scheme, and requirements of value added tax, shall determine the amount of the public contribution per litre of milk (rate): 9.1 pack, not the majority of the 250 ml; 9.2. the package of more than 250 millilitres. 10. If a national co-financing rate exceeds the maximum amount of the aid, the national co-financing rate shall be reduced by the part. 11. the official Edition of the "journal" published: 11.1. national co-financing rates for the next quarter-to-quarter during the last month of the twenty-fifth day; 11.2. the rest of the cost, and the maximum amount of the aid – each year, up to 15 July.  12. the Commission once a year after the service or at least three of the candidates support the receipt of a written request shall be entitled to revise the current school year applicable to the rest of the cost, and the maximum amount of the aid. 13. the service within five working days of the Commission's decision shall be published in the Official Gazette of the "journal". The revised overall cost or the maximum amount of the aid shall apply from the next month after the date of publication. IV. National and European Union aid and monitoring arrangements 14. For support, an applicant shall submit an application in the service: 14.1. support to the previous calendar month (annex 2) (hereinafter referred to as the aid application); 14.2. copy of general education certificate (annex 3) that it will carry out these provisions in certain support program requirements and will indicate the number of trainees and the number of days of training educational institution where the applicant on the application to the education authority for the current academic year submitting for the first time. General education institution that prepares the receipt in duplicate. One copy of the certificate is stored in a general education institution, and the other shall be returned to the applicant; 14.3. the general education authority accompanying derivative products supplied or its summary, which according to the derivatives of the accompanying document shall include at least the following information: 14.3.1. delivery date and number of the document; 14.3.2. delivered product type, the amount and the unit of measurement; 14.3.3. the price per unit of measurement; 14.3.4. the manufacturer of the product delivered; 14.3.5. General educational institution name. 15. expenditure on the provision of the products referred to in paragraph 3 of the withdrawal of the learner's educational institution of the common application, the amount of the aid (without value added tax): 15.1. no more than three percent, the milk in the package, not the majority of the 250 ml; 15.2. no more than seven percent of the milk in the package of more than 250 millilitres. 16. If the Department determines that this provision has been exceeded 15. expenditure referred to in paragraph about it in calculating the amount of aid to be paid shall be applied pro rata reduction. 17. within three months of the properly completed and valid support of receipt of the application, shall take a decision on the payment of the aid and, in accordance with Regulation No 657/2008 of 12 paid support. 18. After receipt of payment by the applicant of these provisions 14.1, 14.3 and 22.1. documents referred to or their derivatives shall be kept for a period of five years and will produce it on demand. 19. If no 657/2008 of the regulation article 6 paragraph 2 c the applicant has referred to the food and veterinary service recognized dairy, national co-financing it every three months on the following: 19.1. After this provision referred to in paragraph 14 of document delivery service in writing, the applicant shall submit a request for payment of the public contribution for a period of three months; 19.2. the service within 15 working days, subject to the application of the aid delivered in quantity of products, calculate the national co-financing for the period that includes the month in which the aid application is submitted, and the two subsequent months; 19.3. If the tenderer that rule 19.2. the period referred to in the last two months supply more products than the first month of service is calculated and paid to the applicant the balance of national co-financing; 19.4. If the tenderer that rule 19.2. the period referred to in the last two months less than the product of the first month, the service the amount deducted from the calculated amount of the public contribution for the next delivery month. 20. If milk processing establishment shall inform the Department that the applicant has not supplied timely quitter on milk products, service requests to the applicant within five working days to submit proof of payment for the received milk products in the period, for which the applicant submitted an application for aid. 21. If the applicant proof of payment this provision in point 19 submitted within that period, the Department decides to submit the relevant documents in time to stop the granting of aid to the applicant. 22. the General Authority that the applicant supplied milk products in accordance with these terms: 22.1. every month, based on student attendance, prepare a report on the withdrawal of milk products supplied (annex 4), specifying information about the purchase and the quantity of milk products. The report shall be drawn up in duplicate. One copy of the report is stored in a general education institution, and the other shall be submitted to the applicant. If the applicant is a general education institution, the report shall be drawn up in a single original. The requirement to submit a certain number of copies of documents not apllicable if the documents submitted in accordance with the law on electronic document circulation; 22.2. stored in menu five years after the withdrawal of the products by the end of the period, which in accordance with the appropriate menu, and they produce a service on request; 22.3.
